Agenda 03/14/2023 Item #16A11 (Termination of Grant Contract No. F19AC00805 and approve the required Budget Amendment )03/14/2023 Recommendation to approve the termination of Grant Contract No. F19AC00805 between Collier County and the U.S. Department of the Interior and the Florida Department of Environmental Protection and approve the required Budget Amendment to reduce grant funds in the amount of $190,003.41 in the Growth Management Grant Fund (711). OBJECTIVE: To terminate an agreement with the US Department of the Interior, US Fish and Wildlife Services, and Florida Department of Environmental Protection (FDEP), Rookery Bay National Estuarine Research Reserve (RBNERR) Hazard Mitigation Grant Program (HMGP). CONSIDERATIONS: On September 10, 2017, Hurricane Irma made landfall in Collier County and severely impacted our region. As a result of the widespread devastation, significant marine debris was generated along the Marco River estuary and various tributaries in unincorporated Collier County. On July 14, 2020 (Agenda Item 16.A.40), the Board accepted a federal grant through the U.S. Department of the Interior, U.S. Fish and Wildlife Service (USFWS) for a total amount of $294,353.41, including funding from FDEP-RBNERR in the amount of $104,350.00, for the removal of eligible debris from mangroves, shorelines and open waters as a result of Hurricane Irma. On February 23, 2022, just prior to construction bid award, staff received notice via email from FDEP-RBNERR that they were cancelling their project grant funding of $104,350.00, and their agreement with the County as they decided to pursue projects within their own agency instead. This resulted in an administrative Budget Amendment that reduced the budgeted grant funds by $104,350.00 within the Stormwater Local Operating Fund (325), Project No. 33700, and transferred the funds to the Stormwater Reserves Fund (325). As the boundaries of the project had changed, the County was reverifying old mapping ("water truthing"), looking for additional debris within the boundaries, and trying to obtain the original GIS base map information to prepare new bid documents. An amendment extending the agreement was issued on August 8, 2022, approving the time extension of the project period to September 30, 2023. On September 28, 2022, Hurricane Ian made landfall in Lee County causing the debris that was generated by Hurricane Irma to be washed away. As the result of Hurricane Ian, there is an ongoing project that will address the debris caused by this most recent catastrophic weather event. Therefore, Collier County is seeking termination of the Contract no. F 19AC00805, which supported removal of marine debris due to Hurricane Irma. Upon the Board approval to terminate the Grant Contract No. F19AC00805, a termination letter will be signed by the administrator of the agreement and forwarded to FDEP to finalize the contract termination. FISCAL IMPACT: Collier County has not received any grant revenue to date for the project. A budget amendment is required to reduce budgeted grant funding, in the amount of $190,003.41 in the Growth Management Grant Fund 711, Project No. 33700. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item.
