MINUTES OF THE COLLIER COUNTY
WATER AND WASTEWATER AUTHORITY MEETING
Naples, Florida, July 11, 2022
LET IT BE REMEMBERED, the Collier County Water and Wastewater Authority in
and for the County of Collier, having conducted business herein, met on this date at
2:00 P.M. in REGULAR SESSION at the Collier County Growth Management
Department Building, Conference Room 609/610, 2800 Horseshoe Drive N., Naples,
Florida, with the following members present:

I. Call to Order (Determination of Quorum) and Roll Call
Chairman Ricardo called the meeting to order at 2 p.m. Roll call was taken and a quorum of five
was established.
II. Approval of Agenda – Meeting of July 11, 2022
No changes
Vice Chair Sherry moved to approve the agenda. Second by Dr. Ritter. The motion passed
unanimously, 5-0.
III. Approval of Minutes – Meeting of March 21, 2022
Vice Chair Sherry moved to approve the March 21, 2022, meeting minutes. Second by Dr. Ritter.
The motion passed unanimously, 5-0.
IV. Items Requiring Action by the Authority
A. Ave Maria Utility Company Notice of Intent to Adjust Rates Pursuant to 2022 Index
Mr. Kovensky stated that Ave Maria came in for a price index petition based on the 2022 Price
index that this Authority adopted in March, with a factor of 4.53%. That was adopted by Final
Order No. 2022-01. Their petition included both the adoption of the 4.53% as a factor, as well as a
reduction in rate-case expenses that they were required to come in for, which was based on the
Ave Maria petition, the five-year rate case that was done five years ago. That got factored in and
resulted in an increase to the water rates of 1.58% and to the wastewater rates of 1.76%. That’s
codified in the Final Order No. 2022-01.
There is a Scrivener’s error in the report under No. 1. “The application of the 2021 Price Index”
should say “2022.”
Unless there are any questions, you can vote to approve the Final Order 2022-01.
Dr. Ritter moved to approve Ave Maria Utility Company’s petition to adjust its rates pursuant to
the 2022 Price Index. Second by Vice Chair Sherry. The motion passed unanimously, 5-0.
V. Staff Discussion
Chairman Ricardo asked about the Ave Maria Utility Company developer agreements.
Mr. Kovensky stated that there were routine additions. Ave Maria Utility Co. is required to submit
to this authority all the developer agreements they’ve processed since the previous reporting
period, so they are all listed for your review. A cover page on p. 47 lists developments and the
development names, as well as the number of residences that were created. For water, they
increased the number of residences by 15,176 and for wastewater, 15,175. No action is required by
the Authority. This is just for informational purposes.
Mr. Wordehoff asked what the capacity utilization of the water and wastewater facilities and what
are the recommended best practices limits? You don’t want to hit 100%.

Mr. Kovensky said that in their cover letters, they list the total permitted maximum day operation
capacity of .999 million gallons per day, and .9 for the daily flow. And it says current max daily
flow, at least in this one, is .716 and .641, so they’re not near capacity yet.
Mr. Wordehoff noted that the permit would not be near 100% capacity. It’s a facilities thing, a
backup capability.
Mr. Kovensky said he’d defer to Mr. Ricardo as more of an expert for flows.
Chairman Ricardo said they’ve already been permitted for a certain amount. They take into
account that if anything exceeds that, they’ll come back and they’ll either …What you’re asking is
they may have to have a booster center or they create another avenue for it. That’s just for
pressure, but then if they need volume, it becomes a different thing. It’s all done in the early phases
of development.
Mr. Wordehoff asked, So they work up to their permit capacity?
Chairman Ricardo said yes.
Mr. Wordehoff said he understood.
Mr. Kovensky said that for the Authority’s awareness, the attorneys for Ave Maria put a request
in to expand their territory. It’s preliminary, but I’ve received a request from the Sundstrom &
Mindlin law firm to take a look at a parcel just east of their current territory. Per the rules, what
we’re required to do is draw a four-mile radius around that center and provide them with a map,
and any other jurisdiction or entity that might be affected for them to go out and try and serve this
area. We’ve been working on the map, but we haven’t submitted it to them.
They came in about five years ago to try and do the same thing for Hogan Island. There was a lot
of back and forth between the County and Ave Maria. The County objected to the expansion and it
eventually was dismissed, so we’ll see where this goes. This probably will have the same
jurisdictions that will be affected, the Collier County and Immokalee sewer and water districts.
There will be more to come on that. This is all preliminary now. He’ll send them the map and the
information shortly and they’ll go out and notify the jurisdictions of their intent and then that’ll
start the ball rolling.
Vice Chair Sherry asked if the property touches their property, or is it like the other one where it
was a little farther away?
Mr. Kovensky said it abuts their property.
