17.B 02/28/2023 EXECUTIVE SUMMARY Recommendation to approve a resolution designating the Close -Out of the adopted Walgreens Planned Unit Development (PUD) which has fully completed development pursuant to their development orders constructing up to the authorized density and/or intensity and have been found by county staff to be compliant with their specific developer commitments and to have only one remaining transportation commitment which will be tracked through the Commitment Tracking System. (PL20220002238) OBJECTIVE: To have the Board of County Commissioners (Board) approve by resolution the Close-out of the Walgreens Planned Unit Development such that the PUD will have all commitments, except one transportation commitment, deemed completed in accordance with Section 10.02.13.17 of the Land Development Code (LDC) and be relieved of its Annual Monitoring responsibilities as defined by Sections, 10.02.13.17 and 10.02.07.C.1.b of the LDC. CONSIDERATIONS: Staff seeks the approval of the Walgreens PUD Close -Out resolution so that the PUD is designated, without uncertainty, as "complete," "built -out" and/or "closed -out" and once approved will be certified as having met all its commitments. The one remaining transportation commitment will still be in effect and will be tracked through the Commitment Tracking System. The Closed -Out PUD shall remain in that status whereby no further development orders shall be issued relative to applications for the authorization of additional residential density and/or commercial intensity within the subject PUD. In order to grant future development rights for density and/or intensity within a Closed -Out PUD the Board of County Commissioners shall approve a PUD amendment which shall return the PUD to an active status and require the PUD to be compliant with the reporting responsibilities of the Land Development Code Section 10.02.13.F. There is one remaining transportation commitment. The commitment is for a fair share contribution towards a future traffic signal at the PUD's access point. This commitment states: The applicant or his successor in title shall be responsible for a fair share contribution toward any future traffic signal serving any access point for this project. After the final determination of Close -Out is rendered by the Board of County Commissioners this Closed -Out PUD will be eliminated from any further demands for commitment contributions or assessment of commitment compliance by staff and the PUD will remain Closed -Out until subsequent action is approved by the Board of County Commissioners as an amendment specific to the PUD. The PUD amendment will then return the PUD to an active status for monitoring. The Walgreens PUD summary of development and compliance with the developer commitments follows: Ordinances: 1998-84 (repealed), 1999-53, 2017-36 and HEX decision 2015-24. Ordinance Authorized: 156,800 gross square feet of commercial development or a single hotel site with a Walgreens drugstore as an outparcel or a combination of hotel, outparcel and shopping center Recorded Built Out: 141,967 gross square footage of commercial, no hotel constructed Relinquishing Units: 14,833 gross square footage of commercial FISCAL IMPACT: The Close -Out of the Walgreens PUD will have no fiscal impact on the County. The application fee submitted has been applied to the staff hours allocated to the preparation of the PUD documents for verification reviews and for the presentation to the Board, and for advertising costs. Due to the nature of the review process established for these Close -Out reviews there was a need to rely on paper documents to circulate among the reviewers. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. Agent Agent/Owner Name (please print) Created 9/28/2017 Page 3 of 3 Packet Pg. 1479 17.B.2 © HAGAN ENGINEERING WALGREENS PLANNED UNIT DEVELOPMENT CLOSEOUT NARRATIVE AND BASIS FOR APPROVAL Hagan Engineering, LLC is representing the property manager for the landowners in the Walgreens Planned Unit Development (PUD) to pursue a "PUD Closeout" with the Collier County Board of Commissioners and relieve the land owners from further monitoring of the zoning approval. CCPA Aerial The Walgreens PUD was originally adopted by the Collier County Board of Commissioners on October 13, 1998, via ordinance 98-84. The 15.68f acre property was approved for 156,800 square feet of commercial land uses found to be appropriate within Activity Center #11. The PUD has been amended two times through the adoption of Ordinances 99-53 and 17-36. Shortly after the original zoning approval the property was initially developed with a retail pharmacy (Walgreens Store #4958) in the southwest quadrant of the intersection of Airport Road and Vanderbilt Beach Road. The surrounding lands to the south and west of the new Walgreens were then subdivided into Olympic Park Condominium Plat recorded in Official Records Book 2763, Page 0131.Over a period of time the Olympic Park Condominium was fractionalized into seven (7) Units, and a portion of those condominium lands were further subdivided into Olympic Medical Park Condominium A, which is a singular medical building fractionalized into nine (9) Units. The County's Growth Management Division issued several development orders permitting the Packet Pg. 1480 17.B.2 Page 2 of 4 construction of 146,825 square feet of commercial uses and issued five (5) Certificates of Public Facility Adequacy (COA) after payment of impact fees and complying with the conditions associated with those development order approvals and the PUD. Please refer to the Walgreens PUD Closeout Commercial Areas spreadsheet included in the application materials. This spreadsheet identifies the taxable commercial square footage of the various land uses permitted and in existence on the PUD lands. The tax data was obtained through the Collier County Property Appraiser's website and is current as of the date of this closeout application submittal. This exhibit also identifies the COAs issued along with the development order approvals and lists the permitted commercial area associated with each individual COA. It is apparent that the total taxed commercial area is less than the total area approved through the development orders and issued COAs. This is due to normal transition of commercial leasable areas and tenant improvements over time. The landowners wish to perpetually preserve the total commercial area permitted through the development orders (146,825 square feet), and will forego the right to permit and construct the remaining 6,950 square feet approved in the PUD Zoning. This total commercial allocation of 146,825 square feet would be the maximum amount of allowed PUD land uses that could be permitted in the future for the PUD lands. The Walgreens PUD commitments are as follows: Transportation: A. Arterial level street lighting shall be provided at all project access points prior to the issuance of any Certificate of Occupancy. Status: Compliant B. Access points shall be coordinated with adjacent development to the west and to the north, such that future traffic signalization may be accommodated. Status: Compliant C. Turn lanes shall be provided consistent with Ordinance 93-64 along with compensating right-of-way prior to the issuance of any Certificate of Occupancy. Status: Compliant D. The County reserves the right to modify, including full closure, any median opening serving this project. Status: Acknowledged E. The applicant or his successor in title shall be responsible for a fair share contribution toward any future traffic signal serving any access point for this project. [PL202200022381 The PUD is located in Collier County, Florida at the Southwest corner of Airport - Pulling Road and Vanderbilt Beach Road, in Section 2, Township 49 South, Range 25 East, consisting of 15.68± acres. All interested parties are invited to appear and be heard. A copy of the proposed Resolution is on file with the Clerk to the Board and is available for inspection. NOTE: All persons wishing to speak on any agenda hem must register with the County Manager prior to presentation of the agenda item to be addressed. Individual speakers will be limited to 3'minutes on any item. The selection of any individual to speak on behalf of an organization or group is encouraged. if recognized by the Chairman, a spokesperson for a group or organization may be allotted 10 minutes to speak on an item.
