(Sponsored by Commissioner Saunders) 2/28/2023 11:53 AM 16.F.7 02/28/2023 EXECUTIVE SUMMARY Recommendation to approve Change Order No. 3 and Change Order No. 4 under Agreement No. 19-7650, Golden Gate Golf Course Redevelopment Project, providing for a time extension of 730 days and a realigning of task funding with a zero -dollar change and to approve payment of invoices for work associated with Change Orders No. 3 & No. 4, which was verbally staff directed prior to approval of those change orders. (Project No. 80412) OBJECTIVE: To approve Change Order Numbers 3 and 4 adding time and realigning existing task funding for zero dollars and approve the payment of invoices associated with same. CONSIDERATIONS: On June 25, 2019, (9275) the Board approved the acquisition of the Golden Gate Golf Course located at 4100 Golden Gate Blvd. (Agenda Item 1 LQ On December 10, 2019, (10932) the Board approved Agreement No. 19-7650 "Collier County Golden Gate Golf Course Redevelopment" with Davidson Engineering in a time and materials amount not to exceed $684,666.50, for all professional services (Agenda Item 16.17.11). The agreement included conceptual planning, community outreach, environmental consulting, golf course site rezoning, and transportation analysis. On September 24, 2020, Change Order No. 1 to Agreement No. 19-7650 was administratively approved. The change order utilized $38,826 of the 10% allowance to provide funding for Phase I, Task 7 surveying tasks necessary for completing lease agreements. This was a zero -dollar net contract change. On May 25, 2021, the Board approved a Long -Term Lease and Operating Agreement with CC BSG Naples, LLC ("BigShots") to operate and manage a twelve -hole public golf course on the former Golden Gate Golf Course property, to lease land for the construction and operation of a BigShots golf/entertainment facility to benefit the residents of Collier County and support the overall redevelopment plan for the property (Agenda Item I LK). On May 26, 2021, Amendment No. 1 to Agreement No. 19-7650 was administratively approved. The amendment replaced Schedule F, Key Personnel for zero dollars to reflect staffing changes at Davidson Engineering. On July 13, 2021, the Board approved Change Order No. 2 to Agreement No. 19-7650 in a time and material amount of $178,273.40 to include services for updating the rezone/GMP amendment, providing for partial ERP permitting, updating the boundary survey and groundwater/environmental tasks. (Agenda Item 16.C.21). On July 27, 2021, the Board approved the Second Amendment to Agreement No. 19-7650 (ratified on September 14, 2021) primarily in a time and material amount of $1,179,786.20. The amendment provided for Phase II (Site Design and Permitting) and Phase III (services during construction). The work provided for the development of the BigShots facility, golf course redevelopment, and further site development. (Agenda Item 16.C.5/16.F.3) On April 26, 2022, the Board approved the rezone of the Golden Gate Golf Course to the MPUD zoning district providing for Golf Course uses, a residential tract, a public use tract and a government facility tract. On November 23, 2022, the Procurement Services Division administratively approved Change Order No. 3 for zero net dollars. Change Order No. 3 realigns $86,682.50 from Site Design and Permitting Phase 2, Task 5, 1.5 Architectural Design Maintenance and Cart Storage to Phase 2, Task 3 Site Development Plan to support obtaining SFWMD ERP and FDEP 404 Permitting. The realignment is required to support work necessitated by unforeseen site conditions and regulatory requirements. This is a zero -dollar net contract change. Change Order No. 4: A time extension is needed to complete the project. Phase 2, Site Design & Permitting tasks have been complicated by the following factors: (1) the Conceptual Environmental Resource Permitting ("ERP") as originally included in the contract encompassed the entire County owned property. This approach was modified to Packet Pg. 1256 16.F.7 02/28/2023 separate the Golf Course from the Big Shots area to expedite the ERP, FDEP and Collier County Site Development Plan permitting; (2) during the permitting process, it was determined that an acoustic survey for Bonneted Bats was required; (3) soil contamination testing was significantly intensified because of more contamination than anticipated; and (4) the SFWMD determined that a FDEP 404 permit (pertaining to wetlands and surface waters) would be needed requiring additional testing and evaluation. The above factors have affected the length of contract time as well as increasing hours necessary to complete required contract tasks. Accordingly, staff recommends approval of the attached Change Order No. 4 providing for a time extension of seven hundred and thirty (730) days and realignment of contract task budgets to provide funding required to support additional permitting and environmental work. Increase Phase 1 Task 5 Concept ERP in the amount of $45,055.00, deduct ($7,425.00) from Phase 1 Task 1 Concept Plan and deduct ($37,630.00) from Phase 1 Task 4 Transportation Rezone GMPA. This is a zero -dollar net contract change. Change Orders No. 3 and No. 4 reflect direction provided verbally prior to the preparation and approval of change orders. This allowed time and material work to exceed task amounts without prior authorization. Staff requests approval for payment of invoices considered "after the fact" (i.e., after the Board's approval of those Change Orders) up to $131,737.50, the task funding realigned by Change Orders No. 3 and No. 4, for otherwise properly documented work under Agreement 19-7650. This issue arises because the consultant was directed to proceed with a revised project approach and proceed with additional work necessitated by unforeseen conditions but the project manager overseeing the project resigned from employment without initiating and finalizing the necessary change orders. FISCAL IMPACT: The current total contract amount under Agreement No. 17-7650 is $2,042,726.10. Task funding realigned by Change Order No. 4 is $45,055.00 for a zero -dollar net contract change. The additional time has no additional net contract fiscal Impact. Funding for Agreement No. 19-7650 is provided in Capital Project Fund (301) under Project No. 80142 (Golden Gate Golf Course Redevelopment). GROWTH MANAGEMENT IMPACT: There is no impact to the current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. This will extend the contract through February 22, 2025. A time extension is needed to complete the golf course portion of the project. The overall Collier County Golf Course project schedule was affected by three major scope changes listed below. I. The Conceptual Environmental Resource Permitting (ERP) as originally included in the contract encompassed the entire County owned property including the driving range area. It was determined by CC that the driving range should be treated separately to expedite the ERP, FDEP and CC Site Development Plan permitting for that portion of the property. 2. During the permitting process through the state agencies, it was determined that an acoustic survey for bonneted bats was required. This was not in the original scope. 3. The original soil contaminate testing scope was intensified because preliminary testing indicated that there is more soil contamination than originally anticipated due to past golf course use and maintenance area use. It was determined by SFWMD that a FDEP 404 would be needed therefore a higher level of new soil testing was required.
