Agenda 02/28/2023 Item #16E 1 (Contract #22-7994 for Full-Service Auctioneer, Royal Auction Group, Inc.)16.E.1 02/28/2023 EXECUTIVE SUMMARY Recommendation to award Request for Proposal ("RFP") #22-7994, "Full -Service Auctioneer," to Royal Auction Group, Inc., and authorize the Chairman to sign the attached agreement. OBJECTIVE: To provide the County with full service (traditional and internet-based sales) auction services. The Auctioneer will provide all the required services and tasks to market, advertise, transport, and sell the equipment and vehicles for the County. CONSIDERATIONS: On June 7, 2022, the Procurement Services Division issued RFP #22-7994, "Full -Service Auctioneer." The County received three proposals by the July 29, 2022 deadline. Staff determined that all three proposals are responsive and responsible. A selection committee met on August 30, 2022, and after review of the proposals and deliberation, the committee scored the proposals and ranked the firms as shown below. The selection committee did not require oral presentations by the proposers. Proposers Final Ranking Royal Auction Group, Inc. 1 IAS Family, Inc. DBA Insight Auctioneers and Sales 2 Jeff Martin Auctioneers, Inc. 3 Staff is recommending award to the top -ranked firm, Royal Auction Group, Inc. The attached agreement will replace existing Agreement #18-7262 with Royal Auction Group, Inc., which runs through March 12, 2023. Royal Auction Group, Inc. was established in 1970 and has done business with Collier County since 2018. FISCAL IMPACT: The Auctioneer is paid from a buyer's premium, at no cost to the County. Net sales revenues are returned to the general fund or the enterprise fund which paid for acquisition of asset or goods. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan resulting from action. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires a majority vote for Board approval.-SRT RECOMMENDATION: That the Board award RFP #22-7994, "Full -Service Auctioneer," to Royal Auction Group, Inc., and authorize the Chairman to sign the attached Agreement. Nothing herein contained shall create or be construed as creating a partnership between the County and the Contractor or to constitute the Contractor as an agent of the County. 9. PERMITS: LICENSES: TAXES. In compliance with Section 218.80, F.S., all permits necessary for the prosecution of the Work shall be obtained by the Contractor. The County will not be obligated to pay for any permits obtained by Subcontractors. Payment for all such permits issued by the County shall be processed internally by the County. All non -County permits necessary for the prosecution of the Work shall be procured and paid for by the Contractor. The Contractor shall also be solely responsible for payment of any and all taxes levied on the Contractor. In addition, the Contractor shall comply with all rules, regulations and laws of Collier County, the State of Florida, or the U. S. Government now in force or hereafter adopted. The Contractor agrees to comply with all laws governing the responsibility of an employer with respect to persons employed by the Contractor. 10. NO IMPROPER USE. The Contractor will not use, nor suffer or permit any person to use in any manner whatsoever, County facilities for any improper, immoral or offensive purpose, or for any purpose in violation of any federal, state, county or municipal ordinance, rule, order or regulation, or of any governmental rule or regulation now in effect or hereafter enacted or adopted. In the event of such violation by the Contractor or if the County or its authorized representative shall deem any conduct on the part of the Contractor to be objectionable or improper, the County shall have the right to suspend the Agreement of the Contractor. Should the Contractor fail to correct any such violation, conduct, or practice to the satisfaction of the County within twenty-four (24) hours after receiving notice of such violation, conduct, or practice, such suspension to continue until the violation is cured. The Contractor further agrees not to commence operation during the suspension period until the violation has been corrected to the satisfaction of the County. 11. TERMINATION. Should the Contractor be found to have failed to perform his services in a manner satisfactory Agreement for cause; thirty (30) day written D the County as per this Agreement, the County may terminate said further the County may terminate this Agreement for convenience with a iotice. NO DISCRIMINATION. The Contractor agrees that there shall be no discrimination as to race, sex, color, creed or national origin. 13. INSURANCE. This shall include: Owned Vehicles, Hired and Non -Owned Vehicles and Employee Non -Ownership. C. ® Workers' Compensation: Insurance covering all employees meeting Statutory Limits in compliance with the applicable state and federal laws. The coverage must include Employers' Liability with a minimum limit of $1,000,000 for each accident. D. ® Professional Liability: Shall be maintained by the Contractor to ensure its legal liability for claims arising out of the performance of professional services under this Agreement. Contractor waives its right of recovery against County as to any claims under this insurance. Such insurance shall have limits of not less than $1,000,000 each claim and aggregate. This insurance shall be primary and non-contributory with respect to any other insurance maintained by, or available for the benefit of, the Additional Insured and the Contractor's policy shall be endorsed accordingly. Current, valid insurance policies meeting the requirement herein identified shall be maintained by Contractor during the duration of this Agreement. The Contractor shall provide County with certificates of insurance meeting the required insurance provisions. Renewal certificates shall be sent to the County thirty (30) days prior to any expiration date. Coverage afforded under the policies will not be canceled or allowed to expire until the greater of thirty (30) days prior written notice, or in accordance with policy provisions. Contractor shall also notify County, in a like manner, within twenty-four (24) hours after receipt, of any notices of expiration, cancellation, non - renewal or material change in coverage or limits received by Contractor from its insurer, and nothing contained herein shall relieve Contractor of this requirement to provide notice. Contractor shall ensure that all subcontractors comply with the same insurance requirements that the Contractor is required to meet. 14. INDEMNIFICATION. To the maximum extent permitted by Florida law, the Contractor shall defend, indemnify and hold harmless Collier County, its officers and employees from any and all liabilities, damages, losses and costs, including, but not limited to, reasonable attorneys' fees and paralegals' fees, whether resulting from any claimed breach of this Agreement by Contractor, any statutory or regulatory violations, or from personal injury, property damage, direct or consequential damages, or economic loss, to the extent caused by the negligence, recklessness, or intentionally Page 4 of 12 Revenue Generating Agreement #2021 (Ver.1) Packet Pg. 1048 16.E.1.c wrongful conduct of the Contractor or anyone employed or utilized by the Contractor in the performance of this Agreement. This indemnification obligation shall not be construed to negate, abridge, or reduce any other rights or remedies which otherwise may be available to an indemnified party or person described in this paragraph. This section does not pertain to any incident arising from the sole negligence of Collier County. L d 16.1 The duty to defend under this Article 13 is independent and separate from the duty to 0 indemnify, and the duty to defend exists regardless of any ultimate liability of the Contractor, County, and any indemnified party. The duty to defend arises immediately upon presentation of a' a claim by any party and written notice of such claim being provided to Contractor. Contractor's obligation to indemnify and defend under this Article 13 will survive the expiration or earlier termination of this Agreement until it is determined by final judgment that an action against the County or an indemnified party for the matter indemnified hereunder is fully and finally barred by the applicable statute of limitations. M M LO 15. AGREEMENT ADMINISTRATION. This Agreement shall be administered on behalf of the N County by the Procurement Services Division. 0 16. CONFLICT OF INTEREST. Contractor represents that it presently has no interest and shall acquire no interest, either direct or indirect, which would conflict in any manner with the performance of services required hereunder. Contractor further represents that no persons having any such interest shall be employed to perform those services. 17. APPLICABILITY. Only the sections corresponding to any checked box (®) will apply to this Agreement. 18. COMPONENT PARTS OF THIS AGREEMENT. This Agreement consists of the following component parts, all of which are as fully a part of the Agreement as if herein set out verbatim: Contractor's Proposal, Insurance Certificate(s), ❑ Exhibit A Scope of Services, Exhibit B Fee Schedule, ® RFP/ ❑ 4T-W❑ C44ar #22-7W4, including Exhibits, Attachments and Addenda/Addendum and ® Other Exhibit/Attachment: Exhibit C-1 and C-2 -- Performance and Payment Bonds. 19. PROHIBITION OF GIFTS TO COUNTY EMPLOYEES. No organization or individual shall offer or give, either directly or indirectly, any favor, gift, loan, fee, service, or other item of value to any County employee, as set forth in Chapter 112, Part III, Florida Statutes, Collier County Ethics Ordinance No. 2004-05, as amended, and County Administrative Procedure 5311. Violation of this provision may result in one or more of the following consequences: a. Prohibition by the individual, firm, and/or any employee of the firm from contact with County staff for a specified period of time; b. Prohibition by the individual and/or firm from doing business with the County for a specified period of time, including but not limited to: submitting bids, RFP, and/or quotes; and, c. immediate termination of any Agreement held by the individual and/or firm for cause. 20. COMPLIANCE WITH LAWS. By executing and entering into this Agreement, the Contractor is formally acknowledging without exception or stipulation that it agrees to comply, at its own expense, with all federal, state and local laws, codes, statutes, ordinances, rules, regulations and requirements applicable to this Agreement, including but not limited to those dealing with the Immigration Reform and Control Act of 1986 as located at 8 U.S.C. 1324, et seq. and regulations relating thereto, as either may be amended; as well as the requirements set forth in Florida Page 5 of 12 Revenue Generating Agreement #2021 ( --li + Packet Pg. 1049 16.E.1.c Statute, § 448.095; taxation, workers' compensation, equal employment and safety including, but not limited to, the Trench Safety Act, Chapter 553, Florida Statutes, and the Florida Public Records Law Chapter 119, including specifically those contractual requirements at F.S. § 119.0701(2)(a)-(b) as stated as follows: IF THE CONTRACTOR HAS QUESTIONS REGARDING THE APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO THE CONTRACTOR'S DUTY TO PROVIDE PUBLIC RECORDS RELATING TO THIS CONTRACT, CONTACT THE CUSTODIAN OF PUBLIC RECORDS AT: a Division of Communications, Government and Public Affairs 3299 Tamiami Trail East, Suite 102 y Naples, FL 34112-5746 U- Telephone: (239) 252-8999 M Email: PublicRecordReg uest(a colliercountyfl.gov N The Contractor must specifically comply with the Florida Public Records Law to: 1. Keep and maintain public records required by the public agency to perform the service. 2. Upon request from the public agency's custodian of public records, provide the public agency with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided in this chapter or as otherwise provided by law. 3. Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the contract if the Contractor does not transfer the records to the public agency. 4. Upon completion of the contract, transfer, at no cost, to the public agency all public records in possession of the Contractor or keep and maintain public records required by the public agency to perform the service. If the Contractor transfers all public records to the public agency upon completion of the contract, the Contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the Contractor keeps and maintains public records upon completion of the contract, the Contractor shall meet all applicable requirements for retaining public records. All records stored electronically must be provided to the public agency, upon request from the public agency's custodian of public records, in a format that is compatible with the information technology systems of the public agency. If Contractor observes that the Contract Documents are at variance therewith, it shall promptly notify the County in writing. Failure by the Contractor to comply with the laws referenced herein shall constitute a breach of this Agreement and the County shall have the discretion to unilaterally terminate this Agreement immediately. 21. AGREEMENT TERMS. If any portion of this Agreement is held to be void, invalid, or otherwise unenforceable, in whole or in part, the remaining portion of this Agreement shall remain in effect. Agreement in compliance with the Procedures. 16.E.1.c Additional items and/or services may be added to this Procurement Ordinance, as amended, and Procurement 23. DISPUTE RESOLUTION. Prior to the initiation of any action or proceeding permitted by this Agreement to resolve disputes between the parties, the parties shall make a good faith effort to resolve any such disputes by negotiation. The negotiation shall be attended by representatives of Contractor with full decision -making authority and by County's staff person who would make the presentation of any settlement reached during negotiations to County for approval. Failing resolution, and prior to the commencement of depositions in any litigation between the parties arising out of this Agreement, the parties shall attempt to resolve the dispute through Mediation before an agreed -upon Circuit Court Mediator certified by the State of Florida. The mediation shall be attended by representatives of Contractor with full decision -making authority and by County's staff person who would make the presentation of any settlement reached at mediation to County's board for approval. Should either party fail to submit to mediation as required hereunder, the other party may obtain a court order requiring mediation under section 44.102, Fla. Stat. 24. VENUE. The Contractor's personnel and management to be utilized for this Agreement shall be knowledgeable in their areas of expertise. The County reserves the right to perform investigations as may be deemed necessary to ensure that competent persons will be utilized in the performance of the Agreement. The Contractor shall assign as many people as necessary to complete required services on a timely basis, and each person assigned shall be available for an amount of time adequate to meet required services. 26. ORDER OF PRECEDENCE. In the event of any conflict between or among the terms of any of the Contract Documents, the terms of solicitation the Contractor's Proposal, and/or the County's Board approved Executive Summary, the Contract Documents shall take precedence. 27. ASSIGNMENT. Contractor shall not assign this Agreement or any part thereof, without the prior consent in writing of the County. Any attempt to assign or otherwise transfer this Agreement, or any part herein, without the County's consent, shall be void. If Contractor does, with approval, assign this Agreement or any part thereof, it shall require that its assignee be bound to it and to Page 7 of 12 Revenue Generating Agreement #2021 (Ver.1) Packet Pg. 1051 16.E.1.c assume toward Contractor all of the obligations and responsibilities that Contractor has assumed toward the County. 28. SECURITY. The Contractor is required to comply with County Ordinance 2004-52, as amended. List of all lot numbers on which individual bidders were successful, to include total dollar amount spent by each registered bidder. b. Dollar amount of bid price for each lot sold. c. Reports available at the day of auction. 2.3 Trained staff able to provide the following services: a. Receive and tag lots as they are received from County to auction site. b. Perform data entry on above noted automated system. c. Receive and account for payments. d. Issue receipts and vehicle documents including bill of sale and title transfers 2.4 Advertising by Auctioneer: a. Notify all individuals and companies on the maintained bidders' lists for equipment, vehicles and other items offered for sale at auction. b. Advertise in auction trade journals, publications, website, etc. c. Edit, print, and distribute brochures based on equipment and other items to be sold at auction. d. Provide brochures to the County for distribution in quantities determined by the County. e. Submit and pay for all publicity, including, but not limited to advertisements, printing and mailing of brochures to perspective buyers identified by the County. At a minimum, one (1) display advertisement and one (1) classified advertisement must be published in the Naples Daily News not more than two (2) weeks and not less than one (1) week prior to the date of the auction. 2.5 Transport Items/Equipment Requirement: a. Transport all items/equipment from the County to the Auctioneer's warehouse and/or auction site(s) at no cost to the County with the proper transportation equipment. b. Transport all unsold items/equipment from the Auctioneer's auction site(s) to the County at no cost to the County with the proper transportation equipment upon request of the County. Auctioneer shall retain property at their location until auction is held, unless otherwise approved in writing by the County. 2.6 Reporting a. Sales report by category: Prepare and provide reports as designated by the County, a customer "sales" catalog, and a completed sales report. All sales reports must contain the property name, description, model/equipment numbers, any unique County asset/tracking number(s), approximate value of the property, and final sale price. Initially, upon notice of pending award by the Board of Collier County Commissioners, and then fourteen (14) days prior to each subsequent auction, the Auctioneer shall furnish to the County a Performance Bond. The Performance Bond shall be underwritten by a surety authorized to do business in the State of Florida and otherwise acceptable to the County. The surety shall be rated as "A-" or better as to general policy holders rating and Class V or higher rating as to financial size category and the amount required shall not exceed 5% of the reported policy holders' surplus, all as reported in the most current Best Key Rating Guide, published by A.M. Best Company, Inc. of Fulton Street, New York, NY 10038. Should the contract amount be less than $500,000, the requirements of Section 287.0935, Florida Statute shall govern the rating and classification of the surety. b. If the surety for any bond furnished by the Auctioneer is declared bankrupt, becomes insolvent, its right to do business is terminated in the State of Florida, or it ceases to meet the requirements imposed by the Contract Documents, the Auctioneer shall, within five (5) calendar days thereafter, substitute another bond and surety, both of which shall be subject to the County's approval. All performance security under the subsequent contract shall be continued for sixty (60) days after the event. 2.8 Auction Coordination: a. Auctioneer shall be responsible for coordination of all auction activities with the County or designees. b. The Auctioneer shall obtain all necessary permits/licenses, advertising and set up for each auction event (e.g., tent, signs, etc.). c. The Auctioneer shall provide all tables, racks, display cases, shelving, internet hosting, warehouse space, pictures, etc., suitable for displaying property to be sold. Merchandise must be on display at least one 24 hours prior to date of sale for viewing by the public for traditional sales; 72 hours prior to date of sale for viewing by the public for internet sales. d. Auctioneer shall offer suggestions, on a timely basis, for maximizing sale value of items. e. The County will provide Auctioneer an inventory list(s). f. The County reserves the right to add/delete items from the list up to the day of the auction. g. A master list shall be printed for distribution as close to the auction day as possible. h. Auctioneer shall tag all items for sale prior to the day of the auction. 2.9 Motor Vehicle Sales: a. The vehicles shall be transported by use of tow trucks, transport truck, roll -back truck or driven under its own power. The use of a tow bar with one vehicle towing another vehicle is not permitted. b. The County shall provide the Auctioneer with titles and other necessary documentation for vehicles no less than five (5) calendar days prior to sale day. Any fees or services will be the sole responsibility of the Auctioneer; the County will not accept any additional fees for this service from the Auctioneer. 2.10 Proceeds from Sales: a. Collier County allows for other consignors to participate during the same auction events held by the auctioneer. The Auctioneer must, however, provide a final accounting and itemized sales result to the County with only those items sold by the County withing two (2) weeks after the auction date that contains all the information identified above. b. For Traditional Sales the Auctioneer must collect the proceeds of the sale and remit the net proceeds to the County within two (2) weeks after the sale. c. For Internet Sales the Auctioneer must collect the proceeds of the sale, report gross and net sales by each piece of property sold and remit the net proceeds to the County within two (2) weeks after the date of the sale. d. The Auctioneer shall sell all items "as is" without warranty to the highest bidder, regardless of price. 2.11 Services to The Public: a. The County is not responsible for any Auctioneer services provided to the public before, during or after the auction. A standard rate sheet listing the services provided by the Auctioneer to the purchaser with the charge for each service must be supplied to the prospective purchasers at the time of buyer registration or before start of sale. The rate sheet must be prominently displayed at the sale site. 2.12 Reservations: a. The County reserves the right to sell on its own, dispose of, or transfer to other agencies any items it chooses not to be sold by the Auctioneer. Traditional Sales and Service: Defined as picking up and transporting property to auction site determined by the County; advertising per County requirements; set up, maintain and tear -down auction site and property prior to, during and after the event; registration of attendees; conduct auction; collect revenue from sales; handle license transfers, fees, and taxes; and complete record keeping and reports to the County per requirements. DETAILED SCOPE OF WORK The County is seeking a highly qualified and experienced Auctioneer capable of providing the highest net cash return to the County on all items sold through auctions. The Auctioneer must be in good standing, licensed, insured, and bonded in the State of Florida and shall conduct business in accordance with Florida Statutes Title VI, Chapter 468 and perform all the required services and tasks to market, advertise, de -badge, transport, sell furniture, equipment, vehicles, and miscellaneous items for the County. Furnish all methods of communication, including, but not limited to public address system(s), signs, etc., for the traditional sale sites. The Auctioneer will be responsible to provide material and labor for furnishing and erecting the auction sign at the sale site. Initially, upon notice of pending award by the Board of Collier County Commissioners, and then fourteen (14) days prior to each subsequent auction, the Auctioneer shall furnish to the County a Performance Bond. The Performance Bond shall be underwritten by a surety authorized to do business in the State of Florida and otherwise acceptable to the County. The surety shall be rated as "A-" or better as to general policy holders rating and Class V or higher rating as to financial size category and the amount required shall not exceed 5% of the reported policy holders' surplus, all as reported in the most current Best Key Rating Guide, published by A.M. Best Company, Inc. of Fulton Street, New York, NY 10038. Should the contract amount be less than $500,000, the requirements of Section 287.0935, Florida Statute shall govern the rating and classification of the surety. 4 Packet Pg. 1074 16.E.1.e b. If the surety for any bond furnished by the Auctioneer is declared bankrupt, becomes insolvent, its right to do business is terminated in the State of Florida, or it ceases to meet the requirements imposed by the Contract Documents, the Auctioneer shall, within five (5) calendar days thereafter, substitute another bond and surety, both of which shall be subject to the County's approval. All performance security under the subsequent contract shall be continued for sixty (60) days after the event. 2.8 Auction Coordination: a. Auctioneer shall be responsible for coordination of all auction activities with the County or designees. b. The Auctioneer shall obtain all necessary permits/licenses, advertising and set up for each auction event (e.g., tent, signs, etc.). c. The Auctioneer shall provide all tables, racks, display cases, shelving, internet hosting, warehouse space, pictures, etc., suitable for displaying property to be sold. Merchandise must be on display at least one 24 hours prior to date of sale for viewing by the public for traditional sales; 72 hours prior to date of sale for viewing by the public for internet sales. d. Auctioneer shall offer suggestions, on a timely basis, for maximizing sale value of items. e. The County will provide Auctioneer an inventory list(s). f. The County reserves the right to add/delete items from the list up to the day of the auction. g. A master list shall be printed for distribution as close to the auction day as possible. h. Auctioneer shall tag all items for sale prior to the day of the auction. 2.9 Motor Vehicle Sales: a. The vehicles shall be transported by use of tow trucks, transport truck, roll -back truck or driven under its own power. The use of a tow bar with one vehicle towing another vehicle is not permitted. b. The County shall provide the Auctioneer with titles and other necessary documentation for vehicles no less than five (5) calendar days prior to sale day. The Auctioneer shall be responsible for ensuring that proper sales information (including, but not limited to actual vehicle odometer readings) concerning each asset for sale is accurate and properly communicated to each bidder at time of sale. c. Vehicle titles must be transferred to buyers according to Florida Department of Motor Vehicles regulations. d. Any fees or services will be the sole responsibility of the Auctioneer; the County will not accept any additional fees for this service from the Auctioneer. 2.10 Proceeds from Sales: a. Collier County allows for other consignors to participate during the same auction events held by the auctioneer. The Auctioneer must, however, provide a final accounting and itemized sales result to the County with only those items sold by the County withing two (2) weeks after the auction date that contains all the information identified above. b. For Traditional Sales the Auctioneer must collect the proceeds of the sale and remit the net proceeds to the County within two (2) weeks after the sale. c. For Internet Sales the Auctioneer must collect the proceeds of the sale, report gross and net sales by each piece of property sold and remit the net proceeds to the County within two (2) weeks after the date of the sale. d. The Auctioneer shall sell all items "as is" without warranty to the highest bidder, regardless of price. 2.11 Services to The Public: a. The County is not responsible for any Auctioneer services provided to the public before, during or after the auction. A standard rate sheet listing the services provided by the Auctioneer to the purchaser with the charge for each service must be supplied to the prospective purchasers at the time of buyer registration or before start of sale. The rate sheet must be prominently displayed at the sale site. 2.12 Reservations: a. The County reserves the right to sell on its own, dispose of, or transfer to other agencies any items it chooses not to be sold by the Auctioneer. The items to be sold by the Auctioneer shall be selected at the sole discretion of the County. b. The County reserves the right to perform investigations as may be deemed necessary to ensure that competent persons will be utilized in the performance of the contract. c. The County reserves the right to check all references furnished and consider the responses received. REQUEST FOR PROPOSAL (RFP) PROCESS 1.1 The Proposers will submit a qualifications proposal which will be scored based on the criteria in Evaluation Criteria for Development of Shortlist, which will be the basis for short -listing firms. The Proposers will need to meet the minimum requirements outlined herein in order for their proposal to be evaluated and scored by the COUNTY. The COUNTY will then score and rank the firms and enter into negotiations with the top ranked firm to establish cost for the services needed. The COUNTY reserves the right to issue an invitation for oral presentations to obtain additional information after scoring and before the final ranking. If a contract cannot be successfully negotiated with the firm ranked second, negotiations with that firm will be formally terminated and negotiations shall begin with the third ranked firm, and so on. The COUNTY reserves the right to negotiate any element of the proposals in the best interest of the COUNTY. Our approach for this project is the same process we have always fulfilled for Collier County with our constant improvement philosophy. Below is our process in more detail. Royal's 2 Ring Monthly Public Auction — Royal Auction Group Inc. is a full -service auction company that provides both live onsite and live online auction services simultaneously. Royal Auction Group currently holds six one day auctions a year at our Ft. Myers location and six one day auctions at our Tampa location. Our Tampa location opened in March of 2020. We have one day auctions for now, but as we grow, our plans may expand the auction to a two-day, multiple rings, auction. Each auction location spaces the auctions 60 days apart. We conduct an auction every month, rotating the location of the auction each time, therefore our auctions are every other month in both locations. The two -ring auction is designed to allow bidders to be able to participate with their schedule. If they are bidding on work related items, ring one is more convenient to attend or bid online competitively. The ring two sale is designed for the homeowner, business owner and average worker alike to bid on items pertaining to the public in full. The ring one sale sells more construction and work -related items. Such items include, but are not limited to, buses, medium/heavy duty trucks, vocational trucks and dump trucks, service vehicles, small equipment, cranes, backhoes, excavators, loaders, skid steers, chippers and trailers. The ring two items are more geared to vehicles, recreational type assets as well as office and shop equipment. Ring two items include, but are not limited to, cars, light pick-up trucks, vans, boats, golf carts, ATV's and agricultural items such as lawn and garden equipment. All auctions are performed by a licensed auctioneer with four to six ring -men who help facilitate and capture the bids placed by the live bidders. All drivable assets can be sold on a ramp driven in front of the crowd to show condition and increase value. Additionally, a representative of Proxibid, (The largest On-line Auction Bidding Platform) as well as one or more other on-line bidding platforms are present to facilitate the live on-line public bidding. Both live and on-line auctions happen at the same time and therefore maximize the return for the seller, Royal also collects pre -bids and absentee bids from bidders not able to attend the sale both online and onsite. Royal Auction Group owns four tractor trailer combination vehicles that enables us to pick up large construction type assets, dump trucks, or several vehicles at one time. The trucks are equipped with winches making picking up assets that do not run a routine process. We also have a transport truck with a fifth wheel hook up used to tow a three -car hauler. Additionally, we have several other pickup trucks with trailers that can be used to pick up a non -running car or landscaping type assets. All county assets that can be driven will be tagged with dealer/ transport tags provided by Royal and driven by qualified drivers. Every customer who registers for the auction is provided with an individual paddle number specific to them only. The buyer will utilize the paddle number to bid on each item as the auction progresses. Paddle numbers are given to registers on-line as well. Online bidders are given numbers above below 4000 or above 10,000 so Royal Auction Group can easily identify on-line bidders from on -site bidders. During registration, Royal Auction Group gathers the buyer's information; name, address, phone number and email and stores the information on the Wave Bid software. Each buyer receives a copy of our terms and conditions, a map of our site layout for that auction and an inventory catalog with lot numbers and a detailed description of each item. First time buyers are required to place a $500.00 fully refundable deposit. Auction Day Process — Auction days are full of action and excitement at Royal Auction Group. In Ft. Myers, vve have a separate parking lot we use for customer parking. Arrow boards and directional signs are placed instructing auction goers where to park. Two - Three Sherriff deputies will also be present. One will help with traffic and the second will monitor the auction site with the third roaming the yard for safety. Royal Auction Group will have auction staff for the aid in parking in a safe and efficient manner. Tampa has parking at our site, so no bus ride is needed. Catalogs will be available for anyone who did not already receive one. All sale assets will be lined up with a lot number assigned to each which matches the catalog number for easy reference. The auction site often has a large tent where customers can sit in front of the super ramp where all drivable units will be driven across for bidding. TV's are provided with the live bidding on Proxibid pulled up for additional viewing of what is being auctioned off at that time. The TV's also provide a means for customers to see items that are not driven on the ramp while they are being auctioned off. Breakfast & Lunch will be available for purchase and tables will be available under the tent for eating and relaxing. Royal Auction Group also has haulers available that can help in the pickup of assets purchased. The auction itself is conducted by an accredited auctioneer along with four to six ring men. Each asset is assigned a lot number and the auction starts at lot #1 and continues until all assets for that day are sold. All assets are auctioned off one at a time at a pace that allows all bidders to consider the going price and bid accordingly while keeping the pace moving for those interested in upcoming items. All assets are described by the auctioneer, as noted in the catalog, and the bidding starts at the current online bid, if any, or the value the auctioneer feels the asset can sell for. All bidding continues until the interest and bidding on that asset slows followed by a final chance to bid before the hammer falls and the item is closed to further bids. Buyer Processing — Once a buyer is awarded the winning bid, they are able to pay for the asset immediately and pick up on the Monday after the auction. Royal Auction Group accepts cash, credit cards, wire transfers, cashier's checks or approved business & personal checks. The winning bid and the corresponding paddle number is announced by the auctioneer, clerked into our accounting software, recorded on paper by a second clerk and recorded by audio and video to ensure accuracy and to prevent fraud. Upon payment, the buyer is given a receipt and a gate pass that is used to pick up their purchase from the yard. The title clerks are responsible for ensuring all titles are in hand prior to the auction and to ensure all required signatures and documentation are in order prior to the sale. After payment is complete, all title transfers are processed by Royal Auction Group and are completed by fast title ensuring each buyer receiving the title as quickly as possible. We do not allow consignors to bid on their own items to protect their reserves or inflate their returns. Our first auction site is located at 7061 Alico Rd. Ft. Myers, FL 33912 & our second auction site is located at 2738 Gall Blvd. Zephyrhills, FL 33514. We have been at this location for over four years. Alico Rd. is a major commercial and business thoroughfare in Fort Myers. Alico Road is exit 128 off 175, one exit south of Southwest Florida International Airport. Our site is less than three miles from the exit. We have two entrances to our facility and a parking area on our property. The site is secured by gates, and we have security guards patrolling the site. The Ft. Myers location has six forty -foot, dry storage, sea containers for keeping weather sensitive items safe and dry prior to auction day. Additionally, we have two additional 40ft dry storage box trailers, that can be utilized for storage as well. Our current office space is just under 1000 sq. ft. but are in the process of putting in a 3500 sq. ft building This building should be ready for use in the 41" qtr. of 2022. The new building will have move check in stations, a bigger lobby for our customers, and a small area to sit and enjoy the AC while the auction is shown live on the TV. Royal has plenty of bathrooms to accommodate over 400 customers and more if needed, during live auctions and the week following. Our new office has ADA ramp access and room for up to 10 check -in check-out stations.
