Agenda 02/28/2023 Item #16A 1 (Final acceptance of the potable water and sewer facilities for Esplanade at Hacienda Lakes, Phase 4C1 & 4C2)16.A.1 02/28/2023 EXECUTIVE SUMMARY Recommendation to approve final acceptance of the potable water and sewer facilities and accept the conveyance of the potable water and sewer facilities for Esplanade at Hacienda Lakes Phase 4C1 and 4C2, PL20220004770. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water -Sewer District, approve final acceptance of these potable water and sewer facilities, in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of Esplanade at Hacienda Lakes Phase 4C1 and 4C2, has constructed the potable water and sewer facilities within dedicated easements to serve this private development (see attached location map). The value of these water and sewer facilities (Assets) was $37,480.62 and $30,716.26, respectively. 2) Staff recorded all final acceptance documents associated with the facilities being conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney's office as to form and legality. The County acquired its interest in the potable water and sewer facilities by Warranty Deed and Bill of Sale recorded at Official Records Book 6205, Pages 3342, and are located within County utility easements dedicated by the plat of Esplanade at Hacienda Lakes Phase 4, recorded in Plat Book 64, Pages 81- 86, of the Public Records of Collier County, Florida. 3) A final inspection to discover defects in materials and workmanship was conducted by the Development Review staff on November 21, 2022, in coordination with Public Utilities, and these facilities have been found to be satisfactory and acceptable. 4) Staff recommends final acceptance of the subject potable water and sewer utilities facilities as follows: the amount of $37,480.62 for potable water, and $30,716.26 for sewer. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described therein. 5) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended. 6) Staff is unaware of any issues that would serve to negate the recommendation to approve this final acceptance. FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water -Sewer District receiving title to the potable water and sewer utility facilities, which have a gross value of $68,196.88 (no depreciation applied) and an asset will be recorded in the financial records of the county. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. -DDP RECOMMENDATION: To approve final acceptance and accept the conveyance of the potable water and sewer utility facilities for Esplanade at Hacienda Lakes Phase 4C 1 and 4C2, PL20220004770, and accept the conveyance of the Utilities Facilities Deed, and the facilities described therein.
