02/28/2023 EXECUTIVE SUMMARY Recommendation to accept an update on the status of acquisitions in the already Board approved Conservation Collier Land Acquisition Cycles and Multi -Parcel Projects, review Cycle 11B proposed Conservation Collier Active Acquisition List (AAL) and direct staff to complete Cycle 10 and 11A acquisitions and return to the Board in the last quarter of 2023 to consider Cycle 11B and potentially Cycle 12. OBJECTIVE: To inform the Collier County Board of County Commissioners' (Board) of the status of acquisitions in the already approved cycles and to obtain direction on Cycle 1113 and future Cycles. CONSIDERATION: On November 3, 2020, the Collier County electors approved the Conservation Collier Reestablishment referendum with a 76.5% majority vote. Pursuant to Section 11 of Conservation Collier Ordinance No. 2002-63, as amended the Conservation Collier Land Acquisition Advisory Committee (CCLAAC) recommends qualified acquisition proposals for the proposed Active Acquisition List (AAL) to the Board for approval. On December 7, 2022, the CCLAAC selected qualified acquisition proposals for inclusion in the AAL. Since the approval of the referendum, several cycles of AAL's have been approved by the Board. The properties in Cycles 10 and 11A are presently in various stages of acquisition. There are also four Board approved multi - parcel projects within these cycles (Gore, Panther Walk, Red Maple Swamp, and Winchester Head) that have properties approved by the Board for acquisition. On December 13, 2023, the Board approved an updated Conservation Collier Purchasing Policy, Resolution No. 2023-10. The new policy states the offer amount shall be determined by staff but shall be no more than the appraised value. Since then, staff has been in contact with many of the property owners who have accepted offers in Cycle 10 but whose purchase sale agreements have not been presented to the Board. During these communications the property owners were presented with updated offers reflective of present market conditions. At the upcoming Board meeting, a report on the status of these communications will be presented. The AAL for Cycle I I includes the staff and CCLAAC recommendations (Attachment 1). The map provided as backup shows the location of all proposed Cycle I I properties along with currently owned Conservation Collier properties (Attachment 2). In accordance with the Conservation Collier Ordinance (No. 2002-63, as amended), the proposed AAL has been separated into three (3) categories, A, B, and C as required by Section 11 which states: The Active Acquisition List shall separate proposals into three (3) categories, A (pursue acquisition), B (hold for re -ranking in the next cycle), and C (no interest in acquiring). The A -category parcels/projects shall be further categorized as 1 (high priority), 2 (medium priority), and 3 (low priority), in order to give County staff direction as to the priority for acquisition tasks. Staff prepared and presented property reports, called Initial Criteria Screening Reports (ICSR), to aid the CCLAAC in their evaluation of each property. Included in each ICSR is a scoring matrix based on researched and observed data. The ICSRs have been posted on the Conservation Collier website here: <hgps://www.colliercog tfl.gov//govemmept/public-services/divisions/conservation-collier/public- documents/eleventh-c, cj le> At the December 7, 2022, CCLAAC meeting, property ranking occurred after staff presented summaries of all properties and public comments. In total, there are twelve (12) project areas recommended for the A -category of which ten (10) are an expansion of an existing Conservation Collier Preserve as noted on the Cycle 11B proposed AAL. The Brewer parcel is not a preserve expansion, though is nearby to the Red Maple Swamp Preserve and is seasonally occupied by a swallow- tailed kite roost. The other property that is not a preserve expansion is the Owl Hammock property owned by Packet Pg. 232 02/28/2023 Collier Land Holdings and CDC Land Investments, Inc. discussed below. There are two (2) B-category properties and one (1) C-category property. Where there is potential for roadway expansion within areas surrounding proposed acquisitions, staff will consider this information when planning amenities and public access on the site. Additionally, when applicable, language will be memorialized in the Purchase Agreements and related closing documents to ensure Collier County Transportation will be able to purchase a portion of the properties from Conservation Collier for future right-of- way, if and when needed, at the original per -acre acquisition cost. Following the Board's approval of the AAL, staff will obtain an appraisal for each property. Pursuant to direction by the Board at the January 10, 2023, Board meeting regarding the Conservation Collier Purchasing Policy, staff will then negotiate the purchase price of each property with the property owners. Based on Board direction this item includes the property owner's residence location, whether the owner lives near the property, and management costs (Attachment 7). No owners within application live adjacent to the property being offered. Owl Hammock 7,378-acre property The Owl Hammock 7,378-acre property is recommended for the A -category by CCLAAC and staff. The estimated value of this property is $29,512,000. If the property is recommended for the A -category two (2) appraisals would be obtained to assist staff in determining the offer amount. The property is located along the east side of State Road 29 within the Rural Lands Stewardship Area (RLSA) and contains Flowway Stewardship Area (FSA), Habitat Stewardship Area (HSA), Water Retention Area (WRA), and 500-foot buffer); and the entire property is within the Area of Critical State Concern (ACSC). A majority of the property is within RLSA Flowway Stewardship and Habitat Stewardship Areas, which are target protection areas under the Conservation Collier Ordinance. The acreage breakdown of the property is: 5,586 acres FSA; 910 acres HSA; 408 acres WRA; 385 acres Open; and 89 acres 500 ft Buffer. Collier Land Holdings does not have any Stewardship Agreements recorded on the property and therefore has not "opted in" to the RLSA Program. The property is also within the state -recognized Okaloacoochee (OK) Slough flow -way. Multiple listed species use this property including the Florida panther, sandhill crane, crested caracara, and listed wading birds including wood stork. The Owl Hammock property provides an important link between the protected lands of OK Slough State Forest to the north and Big Cypress National Preserve to the south. Multi -parcel projects Staff and the CCLAAC recommend the Red Maple Swamp (North Golden Gate Estates Unit 53) and Winchester Head projects remain as A -List acquisition areas. The Program continues to acquire parcels in these areas. Additionally, these areas are identified in LDC section 3.05.07.H.1. to satisfy on -site preservation requirements off - site. Within Red Maple Swamp 236.26 acres have been acquired and 63 acres remain to be acquired. Within Winchester Head, 95.84 acres have been acquired and 50 acres remain to be acquired. As part of Cycle 11B, staff and the CCLAAC recommend converting the existing Panther Walk Preserve (North Golden Gate Estates Unit 42) and Dr. Robert H. Gore III Preserve (North Golden Gate Estates Units 91 and 92) "Preserve expansion areas" to multi -parcel projects as shown on the Cycle I I B AAL. The current acreage of Panther Walk Preserve is 11.83 acres, and the acreage of the parcels surrounding the preserve recommended for the A -list is 364.5 acres. The current acreage of the Dr. Robert H. Gore III Preserve is 172.8 acres, and the acreage of the parcels surrounding the preserve recommended for the A -list is 367.4 acres. ADVISORY COMMITTEE RECOMMENDATIONS: On December 7, 2022, the CCLAAC met in a public meeting and selected qualified acquisition proposals for Board consideration. CCLAAC recommends twelve (12) projects (16 properties) comprised of 7,660.8 acres for the "A" list category in Cycle I IB AAL. The estimated Packet Pg. 233 02/28/2023 acquisition cost for the properties is $35,965,896. On January 4, 2023, the CCLAAC was presented with an updated version of the Cycle 11B AAL that they had previously ranked at their December 7, 2022, meeting. The updated AAL provided multi -parcel project area allocations in Cycle 11B for budgeting purposes. The CCLAAC voted unanimously to confirm the updated AAL, which is provided. FISCAL IMPACT: The total estimated cost of A -category properties under consideration in Cycle 11B is $35,965,896. The table below outlines the status of previously approved Cycle 10 and Cycle 11A along with the proposed Cycle 1113. The table below depicts the acquisition of the pending Cycle 10 properties and remaining Cycle 11A and proposed Cycle 11B properties through FY24. A portion of the funding for land acquisition is budgeted within Conservation Collier Land Acquisition Fund (172). Assuming available cash is expended for the acquisition of properties in FY23, it is estimated, based on a slight increase in taxable value and a millage rate of .25, that approximately $21.2 million would be available for land acquisition in FY24. Additionally, CREW Land & Water Trust has committed to contributing a total of $12,500 for the Brewer and English Trust parcels within the CREW project boundary, should they be acquired (Attachments 6 & 7). The table below depicts the acquisition of the pending Cycle 10 properties and remaining Cycle 11A and proposed Cycle 11B properties through FY24. Funding for the management of any lands acquired by the program is budgeted in a separate fund, Conservation Collier Land Management Fund (174), which is funded via a transfer of 25% of the net Conservation Collier ad valorem tax levy. GROWTH MANAGEMENT IMPACT: Fee -simple acquisition of conservation lands is consistent with and supports Policy 1.3.1(e) in the Conservation and Coastal Management Element of the Collier County Growth Packet Pg. 234 02/28/2023 Management Plan. LEGAL CONSIDERATIONS: The Conservation Collier Ordinance (No. 2002-63, as amended), in Section 11, provides a legal framework for the development of the Active Acquisition List. The recommendation to acquire A - List properties on the Active Acquisition List falls within this legal framework. A portion of the Owl Hammock property along the east side of the State Road 29 curve is an "Open" area, which means it is not protected under the RLSA program. This section of Owl Hammock would be appropriate for purchase by Conservation Collier, if the owner is willing to sell just that area. I would have like to have provided you with these comments in person at the December 7, 2022 CCLAAC meeting, but unfortunately, I am unable to attend due to a prior commitment. The Conservancy recognizes Conservation Collier as a vital tool for protecting our water, land, and wildlife for the benefit of many future generations, so we thank you for your service on this extremely important committee. We know that this committee understands better than anyone that Conservation Collier's funds are very limited, and that tax dollars must be spent prudently, so that only the most vulnerable environmentally important lands are purchased. Packet Pg. 277 11.C.4 The Conservancy asks you to recommend that Owl Hammock does not move forward for purchase by Conservation Collier. You may be wondering: "Why would a conservation organization with a 58-year history dedicated to saving Collier County's environment be against a taxpayer funded acquisition of such a large wetland parcel?" There are two primary reasons why the Conservancy is against acquisition of Owl Hammock: Reason One: Layers and layers of environmental protection already exist over the Owl Hammock site. By virtue of the site's location within the Rural Lands Stewardship Area (RLSA) and the Area of Critical State Concern, development and mining are prohibited over the vast majority of the site. Therefore, a purchase of Owl Hammock would be an imprudent use of precious limited taxpayer funds, as Conservation Collier money should be used to purchase lands truly vulnerable to development. Layers of protection: • The entire Owl Hammock site is located within the Area of Critical State Concern (ACSC). ACSC regulations limit site alteration to only 10% of the total site. (Florida Administrative Code 28- 25.006) • In addition, approximately 91% of the Owl Hammock site is within a Flowway Stewardship Area (FSA) or Habitat Stewardship Area (HSA). (77% FSA and 14% HSA). RLSA Policy 5.1 prohibits residential uses and mining within a FSA and RLSA Policy 5.3 restricts site clearing and alteration to 20% of parcels within FSA and HSA designations. However, the ACSC further restricts site alteration to only 10% of the site, a stricter standard than Policy 5.3, and this stricter standard would apply to the Owl Hammock lands. (https://www.colliercountyfl.gov/home/showpublisheddocument/98908/637746656495370000 Ordinance 2021-28). • The RLSA has additional policies that restrict or limit development on lands with a high Natural Resource Index Value (NRI) having a score of 1.3 or more. Reason Two: RLSA landowners must be held accountable to their promises. For nearly two decades, RLSA landowners, including Collier Landholdings, promised Collier County that they would preserve over 100,000 acres, including the Owl Hammock site, "AT NO COST TO THE TAXPAYERS." Additional Background information: • The owner of Owl Hammock property is part of Eastern Collier Property Owners (ECPO). ECPO has promised at numerous RLSA workshops, Board of County Commission hearings, on their website, and in newspaper articles that they would preserve and maintain over 100,000 acres of the RLSA "at no cost to the taxpayer." The 100,000 acres includes the Owl Hammock site (see attached map). Why would ECPO make this promise? In 2002, when the RLSA program was adopted, ECPO agreed to preserve and maintain over 100,000 acres of environmentally important lands in exchange for the option to develop other lands as towns and villages.
