Agenda 02/28/2023 Item #11A (Partial Releases of Code Enforcement Liens with the accrued value of $860,230.36)02/28/2023 EXECUTIVE SUMMARY Recommendation to consider the partial releases of a code enforcement liens with an accrued value of $860,230.36 for payment of $16,623.98 in the code enforcement actions titled Board of County Commissioners v. Tarpon IV LLC. Special Magistrate Case Nos. CEPM201000018647 and CEPM20170007818 relating to property, Folio No. 40687400009, Collier County, Florida and obtain direction for staff and the County Attorney to review current Code Enforcement lien procedure OBJECTIVE: For the Board of County Commissioners to consider an offer to partially release two code enforcement liens encumbering the subject property (Folio Number 40687400009) for payment of $16,623.98 in relation to Code Enforcement Board Case Nos. CEPM20100018647 and CEPM20170007818 and obtain direction to update the current Code Enforcement Lien procedure. CONSIDERATIONS: As a result of code violations at a different property owned by Tarpon IV, LLC, 616 Palmetto Avenue (Folio No. 65070800000) code liens were placed on all the properties owned by Tarpon IV, LLC, at the time, which included the subject property (Folio No. 40687400009). The liens were recorded in the Official Records on September 26, 2011, at O.R. Book 4721, Page 2836 and on November 22, 2017, at O.R. Book 5451, Page 659. In accordance with Collier County Code of Laws and Ordinances Sec. 2-2030, a certified copy of an Enforcement Board or Special Magistrate's Order imposing a fine may be recorded in the public records and thereafter shall constitute a lien against the land on which the violation occurred or exists, and upon any other real or personal property owned by the Violator. The subject property (Folio No. 40687400009) was purchased by Mr. Rzewnicki (The Rzewnicki Land Company, LLC) from Tarpon IV, LLC, on February 10, 2022. The subject property was encumbered by the above referenced code liens. Mr. Rzewnicki indicates that he failed to discover the lien prior to finalizing the sale. He is seeking a partial release of the code liens as to the subject property only (Folio No. 40687400009). Mr. Rzewnicki has paid $16,623.98 in proposed settlement for the partial releases of the code liens and there are no code violations on the subject property (Folio No. 40687400009). Staff has reviewed the lien against this parcel and found this request to be consistent with previous Board actions. Although the lien was in place prior to Mr. Rzewnicki purchasing the property, all property currently owned by Tarpon IV, LLC, continues to be encumbered by the subject code liens. The accrual of large Code Enforcement liens often results in the Board being in a position of approving settlement recommendations for amounts substantially less than the lien. Liens currently accumulate without a procedure to report on the status as the lien accumulates or a predetermined trigger point that would necessitate taking steps to resolve the lien. Staff is recommending that the board provide direction to review the current Code Enforcement lien process and return to the board with recommendations for improvement. FISCAL IMPACT: Payment of $16,623.98 has been made, representing $9,998.62 in abatement costs, $1,495 in fines, and $5,130.36 in operational costs. If approved by the Board, accrued fines in the amount of $843,606.38 would continue to encumber all real property owned by Tarpon IV LLC. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board's policy contained in Resolution 2012-46. -CAK RECOMMENDATION: To consider accepting payment amount of $16,623.98, and direct staff and the County Attorney to review current Code Enforcement lien procedure and to authorize the Chairman to sign the attached partial releases of liens for recording in the Official Public Records. (1) Upon a finding of violation, the Enforcement Board or Special Magistrate may order the Violator to pay a fine which shall not exceed $1,000.00 per day per violation for each day the first violation continues past the date set for compliance by the Enforcement Board or Special Magistrate; or in the case of a repeat violation, may order the repeat Violator to pay a fine which shall not exceed $5,000.00 per day per violation for each day the repeat violation continues past the date set for compliance by the Code Enforcement Board, or from the time the violation has been repeated, and a hearing shall not be necessary for the issuance of the Order. If the Enforcement Board or Special Magistrate finds a violation to be irreparable or irreversible in nature, it may impose a fine not to exceed $15,000.00 per violation. (2) In determining the amount of the fine, if any, the Enforcement Board or Special Magistrate, as the case may be, shall consider the following factors: (a) The gravity of the violation; (b) Any actions taken by the Violator to correct the violation; and (c) Any previous violations committed by the Violator. (3) The Nuisance Abatement Board may order the Violator to pay a fine which shall not exceed $250.00 per day for each day the first violation continues past the date set for compliance; or in the case of a repeat Violator, may order the repeat Violator to pay a fine which shall not exceed $500.00 per day. (4) Where the Nuisance Abatement Board hears an administrative action, based on a stolen property nuisance, against a property owner operating an establishment where multiple tenants, on one site, conduct their own retail business, the property owner shall not be subject to a lien against his or her property or the prohibition of operation provision if the property owner evicts the business declared to be a nuisance within 90 days after notification by registered mail to the property owner of a second stolen property conviction of the tenant. The total fines imposed pursuant to the authority of F.S. § 893.138, shall not exceed $15,000.00. (5) A certified copy of an Enforcement Board or Special Magistrate's Order imposing a fine may be recorded in the public records and thereafter shall constitute a lien against the land on which the violation occurred or exists, and upon any other real or personal property owned by the Violator; and except as otherwise provided by law, including mortgages recorded prior in time and the lien of county taxes, shall be superior to the interest on such parcel or property of any owner, lessee, tenant, after -recorded mortgagee, or other person and shall be coequal with county taxes enforced in the same manner as a court judgment by the sheriffs of this state, including levy against personal property, but shall not be deemed to be a court judgment except for enforcement purposes. After three months from the filing of any such lien which remains unpaid, the enforcement board may authorize the county attorney to foreclose on the lien or forward the lien to a collection agency. No lien created pursuant to this Section may be foreclosed on real property that is a homestead under Article X, Section 4 of the Florida Constitution. (6) No lien provided under this division shall continue for a period longer than 20 years after the certified copy of an Order imposing a fine has been recorded, unless within that time an action to foreclose on the lien is commenced in a court of competent jurisdiction. The continuation of the lien effected by the commencement of the action shall not be good against creditors or subsequent purchasers for valuable consideration without notice, unless a notice of lis pendens is recorded.
