OBJECTIVE: To hear suggestions from Quiet Florida to reduce the noise pollution from illegal vehicle modifications. CONSIDERATIONS: On January 23, 2023, in anticipation of the upcoming budget cycle, Commissioners Saunders directed County staff to work with the Sheriff's office to address the noise pollution caused by vehicle modifications. The increase in noise pollution is a source of profound concern due to the social, health, and environmental impacts. According to law enforcement, the modifications to vehicles causing the increased noise and air pollution include illegal muffler modifications, altered or removed catalytic converters, and the removal of anti -pollution measures on heavy duty trucks. These modifications constitute a serious hazard to the public and environment in general. Many of the possible solutions to the noise pollution issue would need to be handled by the State legislature, such as the possibility of requiring annual vehicle inspections or utilizing noise cameras. In 2022, the City of Miami Beach instituted a pilot program to monitor noise pollution; however, the City is limited to providing warnings to drivers based upon current state law and is unable to issue citations using the noise cameras. In support of state action on this issue, the City of Miami Beach enacted Resolution 2022-32441 urging the Florida Legislature to enact legislation expressly authorizing counties and municipalities to utilize noise cameras in order to issue traffic citations for excessive vehicular noise; however, such enforcement mechanisms have not been addressed by the state legislature at this time. The Office of Program Policy Analysis and Government Accountability (OPPAGA) is expected to release a report in May 2023 regarding the noise pollution. The Sheriff's Office is already issuing citations for mufflers and other exhaust system noise violations. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues at this moment, and requires majority vote for Board action or direction. -JAK RECOMMENDATION: That the Board hear the request of Quiet Florida on possible steps the County Commission may consider to address the concerns of Quiet Florida. This noise pollution is a source of profound concern due to its deleterious social, health, and environmental impacts. A set of strong, comprehensive responses - both systematic and individual - are urgently needed to eliminate this scourge and protect the health, well-being, and quality of life of all Floridians. These responses include, but are not limited to: 1) substantial increases in enforcement of existing laws, e.g., FL 316.293; 2) notification to shops performing illegal after -market installations; and 3) new appropriate regulatory measures. Because of law enforcement manpower limitations, these responses must be supplemented at the earliest possible date with technology -driven "force multiplier" systems and innovative, public and privatized vehicle inspection measures that constitute "best practices" to achieve an overall solution and enforce existing law. In addition, heavy vehicular truck inspection and regulatory measures must be increased and enhanced ASAP. Law enforcement at the highest levels also indicate a very disturbing pattern regarding illegal muffler modification. Apparently in addition to altering the muffler to cause horrible noise, they strongly suspect the catalytic converters on a vast number of these vehicles are also being altered, or REMOVED. These are both currently illegal acts. Moreover, BOTH possess a serious NOISE POLLUTION, and AIR POLLUTION hazard to the public and the environment in general. Many heavy dump trucks in use are often guilty of the SAME illegal activity of illegally altering BOTH the muffler baffle, and anti -pollution measures of their vehicles. This is a major problem. Furthermore, one does not have to be on Florida roads long to see innumerable older vehicles and pickup trucks spewing unimaginable levels of black smoke and pollution out of their tailpipes!
