EXECUTIVE SUMMARY
Recommendation to appoint two members to the Educational Facilities Authority.
OBJECTIVE: To reappoint one current member and appoint one new member to five-year terms expiring on
March 23, 2028.
CONSIDERATIONS: The purpose of this five -member authority is to assist private non-profit institutions for
higher education in the construction, financing, and refinancing of projects. One member shall be a trustee, director,
officer, or employee of an institution for higher education located in Collier County. Terms are 5 years. A list of the
current membership is included in the backup.
Alice Carlson resigned from the Authority on January 4, 2023, and two additional seats will expire on March 23,
2023. The vacancies were advertised and applications were received from the following:

ATTENDANCE: During the past two years Ms. Rosenberg has had perfect attendance at meetings of the
Authority.
STAFF RECOMMENDATION: That Ms. Rosenberg be reappointed to her seat on this Authority, and that Mr.
Klass be appointed as a director of an institution of higher learning (Board of Governors of Ave Maria School of
Law), each to five-year terms expiring on March 23, 2028. A recommendation memo is included in the backup.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for

RECOMMENDATION: That the Board of County Commissioners adopts the Staff Recommendation, and
authorizes the Chair to execute the attached resolution confirming the appointments.

Rosenberg
The Collier County Educational Facilities Authority ("EFA") has a vacancy due to the
resignation of Alice Carlson. After advertising, the only application received was that of Richard
L. Klaas, and the Authority recommends that Mr. Klaas be appointed to fill the remainder of Ms.
Carlson's term, which expires on March 23, 2023, and then for a full four-year term. Mr. Klass'
history of public service to Collier County over the past 40 years speaks for itself, and included
in that service is service on similar boards to the Authority, so he is familiar with its processes
and duties. Further, the statute under which the Authority gets its power requires that at least one
member of the Authority be an officer of director of an institution of higher education, and Mr.
Klass is a director of Ave Maria Law School. We highly recommend his appointment.
The term of Barbara Rosenberg will expire on March 23, 2023, and she has applied for re-
appointment. No other applications were received. Ms. Rosenberg is a former chair of the
Authority, and currently serves as our vice -chair. She has a perfect attendance record at
meetings of the Authority, and her re -appointment is highly recommended.

243.18 - 243.40 - (Higher Educational Facilities Authorities Law) to transact any and all business
and to exercise any and all powers authorized by the Act for an educational facilities authority.
International College requested an EFA to assist with tax-exempt financing of its now
administrative/classroom facilities planned for the Northbrook Village PUD. EFA is limited only to
financing projects on behalf of private, nonprofit, post secondary educational facilities.

RESOLUTION NO.2023 -
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, REAPPOINTING BARBARA
ROSENBERG AND APPOINTING RICHARD KLAAS TO THE
COLLIER COUNTY EDUCATIONAL FACILITIES AUTHORITY.
WHEREAS, Collier County Resolution No. 99-177, established the Educational Facilities
Authority for Collier County pursuant to Sections 243.18 through 243.40, inclusive, Florida
Statutes (Higher Educational Facilities Authorities Law); and
WHEREAS, Resolution No. 99-177 provides that the Authority shall be composed of five
members; and
WHEREAS, there is one vacancy on the Authority, and two seats expiring on March 23,
2023; and
WHEREAS, the Board of County Commissioners previously provided public notice
soliciting applications from interested parties; and
WHEREAS, the Collier County Educational Facilities Authority has provided the Board
of County Commissioners with its recommendation for appointment and reappointment.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that BARBARA ROSENBERG is
hereby reappointed to her seat on the Collier County Educational Facilities Authority, and that
RICHARD KLAAS is hereby appointed to the Authority in the category of Institution of Higher
Education, each to serve a five-year term expiring on March 23, 2028.
