EXECUTIVE SUMMARY
Recommendation to accept an Access Easement necessary for the installation of a park bench and pavers by
the Vanderbilt Beach MSTU (hereinafter "MSTU") honoring Charles Arthur for his service to the MSTU.
The estimated cost not to exceed $4,050. (Fiscal Impact: $4,050, Vanderbilt Beach MSTU Fund 143)
OBJECTIVE: To acquire a perpetual, non-exclusive five-foot (5') Access Easement for the installation and
maintenance of a park bench and pavers to be supplied by the Municipal Service Taxing Unit (MSTU).
CONSIDERATIONS: The park bench and pavers are to be installed in front of The Dunes of Naples Property
Owners Association, Inc. on the west right of way line of Vanderbilt Drive. The bench is six feet long with a
4"x10.5" plaque mounted in the top rail and will be set on pavers.
During a regular meeting of the MSTU Advisory Committee on September 1, 2022, the committee voted by
unanimous consent to support acquiring an access easement from The Dunes of Naples Property Owners
Association, Inc. for the installation and maintenance of one park bench and pavers honoring Charles Arthur, who
lives in The Dunes, for his service to the MSTU.
Charles Arthur was one of the first members of the MSTU Advisory Committee which was established in 2001. He
was a long-time chairman of the committee and was instrumental in getting the support and approval to bury
approximately ten miles of overhead utilities within the MSTU which is just now nearing completion. Charles
served on the committee until December 2016.
FISCAL IMPACT: The source of funding is Vanderbilt Beach MSTU Fund 143. The total cost for the bench,
pavers and recording fees should not exceed $4,050.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for
approval. - RTT
RECOMMENDATION: That the Board of County Commissioners accept the attached Access Easement for the
installation and maintenance of said bench and pavers.

THIS EASEMENT, made and entered into this day of Dga-vy-- , 2022,
by THE DUNES OF NAPLES PROPERTY OWNERS ASSOCIATION, INC.. a Florida Not -For -
Profit Corporation, whose mailing address is 310 Dunes Boulevard, Naples, Florida 34110,
(hereinafter referred to as "Grantor"), to COLLIER COUNTY, a political subdivision of the State
of Florida, whose mailing address is 3299 Tamiami Trail East, c/o the Office of the County
Attorney, Suite 800, Naples, Florida 34112 (hereinafter referred to as "Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective heirs, legal representatives, successors, and assigns. Grantor
and Grantee are used for singular or plural. as the context requires.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grants and gives to
Collier County a perpetual, non-exclusive access easement for the installation and
maintenance of one park bench and pavers with the right of public access upon and across the
following described lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee, together with the right to enter
upon said land and to place and/or excavate materials for the purpose of providing and
maintaining access thereon. The easement granted herein shall constitute an easement
running with the land and shall burden the lands described above.
Grantee shall maintain the easement described herein in a good state of repair at the
sole cost and expense of Grantee, its successors, and assigns.
