EXECUTIVE SUMMARY
Recommendation that the Board designate the Clerk's website as the county's official publicly
accessible website for purposes of the notices and advertisements required under Florida Statute
50.011.
OBJECTIVE: For the Board to designate the Clerk's website the county's official website for purposes
of notices and advertisements required under Florida Statute 50.011.
CONSIDERATIONS: Pursuant to changes in Florida Statutes for 2022, a government agency may now
designate a publicly accessible website of the county in which it lies to publish legally required
advertisements and public notices. A government agency may publish its notices on the website if the cost
of publishing advertisements and public notices on such website is less than the cost of publishing
advertisements and public notices in a newspaper. A government agency that uses a publicly accessible
website to publish legally required advertisements and public notices shall provide notice at least once per
year in a newspaper of general circulation indicating that property owners and residents may receive
legally required advertisements and public notices from the governmental agency by first-class mail or e-
mail.
On January 9, 1996, the Board adopted Resolution No. 96-14 resolving that the Collier County Clerk of
Court's Office be designated to process and handle all advertising as required by statutes, county
ordinances, resolutions and other applicable rules and regulations. The changes to Florida Statutes
referenced herein are effective January 1, 2023. If approved, the implementation of appropriate software,
training of personnel and establishment of written procedures will begin immediately.
GROWTH MANAGEMENT IMPACT: None.
FISCAL IMPACT: Over the last five fiscal years the average annual amount spent for the notices and
advertisements referenced herein was approximately $281,000, not including staff time spent placing ads
and processing invoices. Currently, a portion of this cost is passed on to the developmental community
and the savings achieved by this action will benefit businesses operating in Collier County. If approved,
the fiscal impact would be contained within the Clerk's annual budget request from the Board. In
addition, these services may be offered to other entities, including Constitutional Officers. We expect the
initial cost of website development to be $20,000, with ongoing annual costs of $75,000 for staff time,
mailing and system maintenance. This represents a significant reduction in cost to taxpayers, and
businesses, and may be offset by fees received from additional customers.
LEGAL CONSIDERATIONS: Having spoken with the Clerk, my understanding is that the costs to
run the advertising will both approximate the costs incurred by the Clerk in providing this service and will
be less than the cost of legal advertisement that would otherwise be incurred if we continued our current
practice with the Naples Daily News. With that understanding, this item is approved as to form and
legality and requires majority vote for approval. -JAK

A RESOLUTION DESIGNATING THE CLERK OF COURTS'
OFFICE AS THE APPROPRIATE AGENCY TO PROCESS
AND HANDLE ALL LEGAL ADVERTISING AS RJ3QUIRED BY
COUNTY ORDINANCES, COUNTY RESOLUTIONS, FLORIDA
STATUTES AND OTHER APPROPRIATE RULES AND REGULATIONS
FOR ALL REQUIRED ITEMS DIRECTED AND/031 SCHEDULED
TO BE HEARD BY AND SCHEDULED ON THE BOARD OF COUNTY
COMMISSIONERS AGENDAS.
WHEREAS, Collier County Ordinances, Collier County
Resolutions, Florida Statutes and other rulem and regulations
require certain legal advertising prior to action by the Board of
County Commissioners; and
WHEREAS, the Clerk of Courts has requested that the Boaind of
County Commissioners review the legal advertising requirements and
adopt a Resolution designating the appropriate agency to be
responsible for processing and handle all lecfal advertising for
all items to be heard and scheduled on the Board of County
Commissioners agendas.
NOW, THEREFORE, BE IT RESOLVED BY THE B01M OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Clark of
Courts' Office is hereby designated to proce.:a and handle all
legal advertising as required by County ordinances County
resolutions, Florida Statutes, and other applicable rulas and
regulations for all items required to be advnrtised that are
either directed or scheduled to be heard by the Board of County
Commissioners.
