EXECUTIVE SUMMARY
Recommendation to approve administrative Change Order No. 1 for time extension and utilization of
$125,659.20 of the Design Contingency under the Professional Services Agreement 21-7884 with Matern
Professional Engineering, Inc., for the New Chiller Plant Building K. (Project No. 50214.1)
OBJECTIVE: To obtain an amended design for the New Chiller Plant Building K, by utilizing the design
contingency, and adding additional time to the agreement.
CONSIDERATIONS: The Board awarded Professional Services Agreement No. 21-7884 (the "Agreement") to
Matern Professional Engineering, Inc. ("Matern") to provide design services for the new Chiller Plant Building K,
Jail Generator and Platform at its January 25, 2022, Board meeting (Agenda Item 16.C.5.). Upon obtaining
construction cost estimates at the 60% design phase of the new Chiller Plant in conjunction with the fmal design of
the Underground Chilled Water mains project, it was determined that the original direction of design would result
in a construction project that exceeded the available budget by $8-$9 Million. Staff discussed an amended design
of the New Chiller Plant and reduction of scope to the Underground Chilled Water Mains whereby Matern and its
subconsultants will produce a 90% set of documents for the New Chiller Plant utilizing the amended design
direction. The amended design of the New Chiller Plant and reduction of scope of the Underground Chilled Water
Mains project is expected to bring the project more in line with available funding.
This Change Order No. 1 proposes to add 120 days to the design completion date and will also utilize existing
funds available in the purchase order for the additional design work necessary to complete the amended direction of
design. This change does not increase the value of the existing Agreement.
If not approved the contract will not have the necessary time and funding to complete the amended design.
The County's Procurement Services Division administratively previously approved Change Order No. 1 as
authorized by the Board in accordance with its Procurement Ordinance, Section Nineteen, Contract Administration,
subsection 3.b.
FISCAL IMPACT: The combined Infrastructure Surtax funded Government Campus Chiller and Chilled Water
lines project budget is $15,500,000. This change order utilizes $125,659.20 of contract contingency but does not
increase the contract total.
GROWTH MANAGEMENT IMPACT: There is no impact to the current Growth Management Plan standards
to ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for
Board approval.-SRT
RECOMMENDATION: That the Board approves administrative Change Order No. 1 for time extension and
utilization of $125,659.20 of the Design Contingency under Professional Services Agreement 21-7884 with Matern
Professional Engineering, Inc., for the New Chiller Plant Building K (Project No. 50214.1)

Scope of Additional Services Requested:
1. TASK 9 - Construction Documents Redesign Directive
1.1. Based on the mutually agreed upon redesign directive consultant shall prepare,
for approval by the Owner, design documents consisting of drawings and other
documents illustrating the scale and relationship of Project components.
1.2. The redesign directive involves utilizing the existing structure of building K for
support of the four air cooled chillers, the addition of a new pump room to be
located east of the existing building K where the existing ice tanks are currently
located, and utilization of the existing ice tank farm located north of building K for
a new backup generator.

1. This change order will utilize $125,659.20 of the approved Owner's Design Contingency, leaving a balance of $1203.60 to amend
the design direction, and add 120 days to the contract time. Upon obtaining construction cost estimates at the 60% design phase, it
was determined that the original direction of design given to Matern would result in a construction project that would substantially
exceed the available budget for this project. An amended design was discussed and agreed upon. Matern and their subconsultants
will produce a 90% set of documents utilizing the amended design direction in order to reduce estimated construction costs. An
additional 120 days has been added to the contract time to account for the additional work necessary.
2. The potential for this change was included in the original contract and accounted for with the design contingency as part of our cost
estimating and value engineering process.
3. If this change order is not processed, the design for this project will not be completed. It is estimated that the use of the design
contingency will result in a $1.5 million reduction of the 60% construction cost estimate.
