Agenda 01/10/2023 Item #11A (Award Construction Invitation to Bid No.22-7992R "Palm River Public Utilities Renewal Project Areas 1 & 2")01 / 10/2023 EXECUTIVE SUMMARY Recommendation to award Construction Invitation to Bid ("ITB") No. 22-7992R, "Palm River Public Utilities Renewal Project Areas 1 and 2," to Haskins, Inc., in the amount of $15,579,339.85, authorize the Chairman to sign the attached Agreement, and approve the necessary budget amendments. OBJECTIVE: To provide reliable, sustainable, and regulatory compliant services to Palm River neighborhood customers by replacing the water, wastewater, stormwater, and sidewalk infrastructure. CONSIDERATIONS: The proposed scope of work under Project Number 60234, "Palm River Stormwater Improvements," is consistent with the Stormwater Five-year Work Program of the 2022 Stormwater Management Annual Update Inventory Review / CIE approved by the Board on November 9, 2021, and with the goals, objectives and policies of the Conservation and Coastal Management Element and the Stormwater Management Sub -Element of the Growth Management Plan. The proposed scope of work under Project Number 70257, "Palm River Public Utilities Renewal," is consistent with the FY2023 Budget approved by the Board on September 22, 2022. The Palm River Neighborhood is located north of Immokalee Road between Goodlette-Frank Road and Airport Pulling Road. The existing potable water, wastewater, stormwater, and irrigation quality water infrastructures were installed in the 1970's. Those utilities have reached the end of their useful lives. The neighborhood does not have continuous sidewalks and the community would like to complete a continuous looped sidewalk within the neighborhood as part of the utility improvement project. The community petitioned the Board of County Commissioners to fund the sidewalk construction through the Municipal Service Taxing Unit ("MSTU") process. The Board approved the creation of the Palm River Sidewalk MSTU on February 23, 2021. The neighborhood was divided in 10 areas to design and construct the infrastructure. Areas 1 and 2 of the attached map were designed and include replacing and rehabilitating water, wastewater, stormwater, and sidewalk assets as follows: 1) Improvements to the water infrastructure include removing and disposing of the existing asbestos - cement ("AC") water main and installing approximately 10,600 linear feet of new polyvinyl chloride ("PVC") water main, along with fire hydrants, gate valves, water services, water meters, and back flow preventers. 2) Improvements to the wastewater infrastructure include removing the existing vitrified clay gravity sewer pipe, and the aging force main and installing approximately 9,600 linear feet of new PVC gravity main and 3,700 linear feet of PVC force main along with manholes, wastewater services, and clean - outs. The complete rehabilitation of two pump stations is also included in this project. 3) Improvements to the stormwater infrastructure include removing and disposing of various sized corrugated metal culvert pipes, drainage structures, and mitered end sections and installing approximately 9,000 linear feet of high -density polyethylene storm water pipe systems, along with new reinforced concrete culvert pipes, mitered end sections, inlets and catch basins with sumps to ensure proper drainage throughout the area and improve water quality. The project also includes televising stormwater outfalls to assess the condition and replace them as applicable. 4) Improvements to the sidewalk infrastructure include the replacement of the existing sidewalks damaged as a result of the Utilities project, and the construction of new sidewalks along Cypress Way East, the first segment of the Palm River Sidewalk MSTU project. Construction on the Project will be performed consecutively in Areas 1 and 2. Water mains within the areas will be replaced at the beginning of the project to avoid damaging fragile asbestos cement water mains throughout the Packet Pg. 250 O1/10/2023 course of the project. Wastewater and stormwater construction will follow, occurring in small sections within each area to minimize neighborhood disruption and to accelerate the restoration. This process proved effective during the construction of the avenues in Naples Park. The attached proposed Agreement also includes additional conditions and restrictions pertaining to the utilization of staging/storage lots based on recent experiences and citizen input on other neighborhood projects. The project will benefit approximately 164 residences within Areas 1 and 2. The condition of the stormwater, water and wastewater assets are defined as "Red" as reported to the Board at the October 1, 2013, Asset Assessment and Management Workshop. On August 23, 2022, the Procurement Services Division issued ITB Solicitation No. 22-7992R, "Palm River Public Utilities Renewal Project Areas 1 and 2." On September 26th, 2022, the County received three bids as summarized below. Respondents: Company Name City County ST Bid with Allowances plus Alternative 1 Responsive/ Responsible Haskins, Inc. Bonita Springs Lee FL $15,579,339.85 Yes/Yes Denco Construction Inc, Fort Myers Lee FL $17,536,058.00 Yes/Yes Douglas N. Higgins, Inc. Naples Collier FL $18,497,387.70 Yes/Yes County staff and engineering consultant, Q. Grady Minor & Associates, P.A. ("Q. Grady"), determined the low bid fair and reasonable and recommends awarding the contract to Haskins, Inc. Q. Grady evaluated Haskins, Inc.'s references and found them sufficient to determine Haskins' experience on work of a similar magnitude within the last five years, including assessing its experience, skill, business standing and ability to complete the work as required under the terms of the attached proposed Agreement. Haskins' bid is less than 1% below Q. Grady's $15,736,782.50 estimate of probable cost. The Procurement Services Division concluded the bidding was competitive and representative of market conditions. The bid tabulation, NORA, engineer's letter of recommendation, and proposed Agreement are all attached. Haskins, Inc. was incorporated in the State of Florida in 1978. Haskins has been working with Collier County for around 20 years, performing emergency work and capital improvement projects for Public Utilities and Stormwater as part of the Underground Contractors agreement. Therefore, staff recommends Haskins, Inc., the lowest responsive and responsible bidder, be awarded the attached Agreement in the amount of $15,579,339.85. FISCAL IMPACT: This item covers two project areas out of a planned ten project areas. The two project areas discussed herein have a construction contract bid of $15,579,400. Budget Amendments are required as follows: • Stormwater Bond Fund 327: A budget amendment in the amount of $4,172,679.61 from reserves to project 60234 to cover the construction cost share of $3,591,482.85, Construction Engineering and Inspection Services (CEI) and Public Information Services (PIO) cost share of $581,196.76. • Growth Management Fund 310: A budget amendment in the amount of $135,559.00 from project 60118 to project 60234 to cover the construction cost share of $116,677.50, Construction Engineering and Inspection Services (CEI) and Public Information Services (PIO) cost share of $18,881.50. These fees will be paid back by the Palm River Sidewalk MSTU upon funding being established in FY 24. • Water User Fee Capital Fund 412: A budget amendment in the amount of $3,500,000.00 from Project 70120 to Project 70257 to cover the cost for construction for this fund. • Wastewater User Fee Capital Fund 414: A budget amendment in the amount of $7,380,000.00 from Packet Pg. 251 01 / 10/2023 Projects 70120 and 70240 to Project 70257 to cover the cost for construction for this fund. Staff has analyzed current and future needs to be funded from the cited project numbers to assure that these budget amendments will not affect current and future financial commitments. The sources of funding are Growth Management Fund (310), the Stormwater Bond Fund (327), Water Capital Fund (412) and Wastewater Capital Fund (414), allocated as shown below. There will be no new maintenance costs associated with the stormwater improvements. While there will be additional closed drainage, the offset cost to clean and maintain should be no more than for the maintenance of the existing mixed open and closed system. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.-SRT GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. (Haskins) with a low bid of $15,579,339.85, which includes the Owner's Allowances but excludes the Bid Alternatives. Haskins bid is just under (less than 1%) the Project's Opinion of Probable Construction Cost (OPCC) in the amount of $15,676,782.50 (which includes the Owner's Allowances and excludes Bid Alternatives). GradyMinor reviewed the bid tabulation to confirm accuracy and a copy of the bid tabulation is included with this letter.
