disclosure be provided by Commission members. Recommendation to deny an
Ordinance amending Ordinance Number 2004-41, as amended, the Collier County
Land Development Code, by changing the zoning classification of the herein
described real property from a Commercial Intermediate District (C-3) Zoning
District to a Mixed Use Planned Unit Development (MPUD) Zoning District for the
project to be known as Isles Of Capri MPUD, to allow construction of mixed -use
development up to 168 feet in actual height including a maximum of 108 multi-
family dwelling units, up to 10,000 square feet and 200 seats of restaurant and
membership clubs, a marina including up to 64 wet slips, a 258-unit dry boat
storage facility, and a ships store and dockmaster's office limited to 1,000 square
feet, and 6,000 square feet of general offices, plus accessory indoor and outdoor
recreation uses and parking structures without limitation. The subject property
is located on the Isles of Capri on both north and south of Capri Boulevard,
consisting of 5.32f acres; providing for repeal of Resolution No. 92-588 relating
to setback variances and Resolution No. 93-370 relating to a parking variance for
boat slips; and by providing an effective date. [PL20210002314] (This is a

For the past few years, our little island has been under un-ending attack. Irma
devastated our paradise in September 2017. It took years to rebuild, but we
came together in crisis.
Capri was tested again when the Fiddler's Creek developer, who purchased C-3
zoned property in our business district over a decade ago leaving it in disrepair
changed gears and instead of building a club house /restaurant for their FC
residents, pursued a change in zoning which if approved would open the flood
gates to development & destroy the Capri "life style". Capri residents unified &
rallied to protect our community's identity. Our stamina & determination in
this David/Goliath battle has been difficult to sustain, BUT we have not letup.
Once again, Mother Nature has ravaged Capri which looks &feels like a war
zone post -Ian.
We are in a fight for survival. Now we need your help. Please DENY FCC's
request for a zoning change. They bought the property C-3, now build it C-3.
The Collier County Planning Board after thorough research voted 6-1 against the
FCC plan. They, as we, believe that the plan is completely inconsistent with this
community. Three 1684eet tall towers would destroy Capri forever for
generations of its residents . Our grandchildren love the Capri tiki-hut feel.
None of us want towers .
Please vote against greed!!!! PLEASE PROTECT US. Help us in this tragic time.

park it is not crowededa When I kayak, I Iove to see dolphins and go over to
the beach. We cannot do that in Troy, Ohio.
Rhett- I like the park because it has fun stuff. Bocce is super fun to play
with my Mimi and brother and sister. I also like kayaking to see dolphins
and fish. I also like to see my grandparents dog Delanie. I king of just like
going to see my grandparents.
Reagan- I like the island because we can walk to dinner or lunch. I love
that it is not crowded so when we go to the park it is not busy. 1 also
like seeing dolphins and feeding the fish. Everyone there is friendly.

Hi.
I am writing in regards to this coming Tuesday's Board of Commissioner's meeting and your vote on the rezoning on Isles
of Capri. The planning commission found this project to be not compatible with the surrounding area and I ask you to
please take their advice.
Buildings of the size that is being requested is completely out of sync with the rest of Capri. They in no way, shape or
form will fit in with the feel of the rest of the island. The residents on Capri are asking you to please vote NO to
rezoning on our business island. We would like to keep the business island business. We don't want a private
community that Capriers can not use, we don't want giant buildings destroying the views of the island, we don't want
something that will make our island feel like Marco or Naples. We moved to Capri because of the smallness, because of
the nature, because it's out of the way of the giant structures. We are a down to earth neighborhood. Yes, there are
some big beautiful homes and likely more to come. But it's still very limited in size. These proposed huge structures and
gated area will take away from the community's beauty and peace. We would like to be able to enjoy the businesses on
our business island. If this rezoning is approved, other businesses on that island will do the same. And then what do we
have?... a bunch of huge residential towers and no restaurants or shops to serve the Isles of Capri residents... and no
restaurants or shops to bring visitors from Marco or Naples. What a huge disappointment Capri could become... How
very sad! Please help save our island life. Vote NO to rezoning.

As concerned citizens of the Isles of Capri, we are requesting your support on the case referenced above which will
come before you very soon.
The citizens of the Isles of Capri wish to thank the Planning Commissioners for their wisdom and understanding of the
many aspects as to why the rezoning application should be denied. Paraphrasing some of the Commissioners'
comments, they stated the proposal was "inconsistent, incompatible and not complimentary with the Isles of Capri." We
couldn't agree more! Just look at our lovely community and how everyone pulled together to help one another and
bring our tiny island back after Hurricane Ian. Commissioner LoCastro, you were a big player in the restoration Isles of
Capri, and your help and direction was invaluable. Those who live on Capri and those who enjoy visiting feel that it is a
unique and special place, and any attempt to rezone should be closely scrutinized in efforts to keep it that way. The
developers knew the way the land was zoned when it was purchased, so why would the County Board of
Commissioners even consider the change? The community has worked tirelessly, and so far successfully, to ensure we

This is an email I sent to Mr LaRow-Director — Economic Development and Housing Division
I have several questions regarding affordability density bonuses.
I live on the Isles of Capri. At the CCPC it was stated a developer could pay a fee to the county to get
around providing affordable housing units in their proposed luxury project on the Isles of Capri and
get additional density bonus.
Can you explain how that works? I would like to know how the fee is determined, to whom it is
paid?
Please advise where in the code this is stated.

Answer I received from Mr LaRow Director — Economic Development and Housing Division
To answer your question, there's nothing in the Land Development Code that speaks to or provides
for a payment calculation where an applicant can contribute a Local Housing Trust Fund to support
the development of housing that is affordable.
The comment was intended to convey Board of County Commissioner direction to staff that projects
requesting density above what is currently allowed in the Comprehensive Plan to provide some public
benefit in exchange for the additional density. That public benefit has been manifested in
approximately 20% of the units developed to be set aside and made affordable for 30 years. For this
particular project, the number of units would have stood at 21 to be reserved as affordable.
Since the applicant appeared to be resistant to that exchange the comment was made for the
purposes of discussion for the applicant to consider as a potential to consider if they were interested.
To be clear, the Board hasn't broached the subject of a payment in lieu of providing units. It was more
of a reminder to the applicant that with the density requested staff would recommend some public
benefit as a result
This is my response to Mr LaRow
It sounds to me like an auction. If they agree to provide dollars to Affordable housing for
public benefit. Then the Isles of Capri has to live with something that is incompatible and doesn't
compliment the existing homes in the area. What about their public benefit? If the area is in High
coastal hazard area and Urban Coastal Fringe Subdistrict how does giving dollars to the Affordable
housing protect the safety of the residents in the community from these designated areas? It seems
to me it is just putting more people in harm's way. It gives the applicant a way to go around rules
that are set aside to protect people.
It also sounds to me like discrimination not wanting to have service people in their luxury buildings.
I know I am ranting to you when I am just upset about how the government always allows money to
buy whatever they want at the cost of the safety of the residents.
I am going to forward this note to the board of county commissioners also.

I just wanted to comment on the proposed benefits made by the devloper to the residents of IOC and send you a
condensed version of the staff's density rating system for the proposed developement.
False benefit claims to the community.
Sewer: The developer is MANDATED TO improve the sewer system in order for them to hook up to it. "No connections
are allowed to Marco's force main until a gravity sanitary sewer collection system is constructed". (As stated to the
developer in a letter from Marco Island Utilities)
Culverts: IOC already has a committee working on the culvert project. Grants are available and the process takes time.
House Prices: Not sure how house prices will increase. Would you buy a house 100ft across the bay from this
development?
Summary of Staff's Density Rating System.
(Please note the developer has confirmed that the marina to the south of the vacant lots will stay as a marina so the red indicates the
actual land available for development. Staff uses the total acreage of 5.32.)
Urban Coastal Fringe Subdistrict (UCFS) = 4 DU's/A
258 dry slip facility consumes approx. 1.2 acres
Applicant proposing 20.3 DU's/A.
108 / 5.32 = 20.3
Coastal High Hazard Area (CHHA) = 3 DU's/A
Actual land available = 4.12 acres.
Should be 26 DU's/A based on 4.12 acres.
108/4.12=26
Ways to increase density through the Future Land Use Element (FLUE).
Density Rating System (Density Bonus)
1) Conversion of Commercial Zoning Bonus
Allows 1 DU/A for every acre converted from commercial to residential use.
But there's a cap of 4DU's/A because the site lies within the UCFS.
Max. allowed is 4 x 5.32 = 21.28 or 21 DU's but should be 4 x 4.12 = 16.48 or 16 DU's
2) Transfer of Development Rights (TDR's)
No bonus allowed.
In no case shall density be transferred into the CHHA from outside the CHHA. The transfer of TDR's is not
permitted into the UCFS. These provisions address hurricane evacuation and protect the adjacent
environmentally sensitive conservation area. i.e. Rookery Bay Aquatic Preserve.
3) Affordable Housing Density Bonus (AHDB)
No bonus allowed.
Max. of 12 DU's/A may be added to the base density if the project meets the requirements of the AHDB
Program by providing AH within the development. This increase is not an entitlement and the bonus must be
requested through the formal process. The applicant has not submitted a request for AHDB for this
development so no bonus is allowed.
Max. allowable DU's/A for this site = 4 DU'/A under the provisions allowed in the FLUE.
Clearly nowhere near the proposed 20.3 DU's/A
Therefore, this small-scale amendment is NOT CONSISTENT with the FLUE of the Growth
Management Plan (GMP) and should be denied for approval.

Hi.
I am writing in regards to this coming Tuesday's Board of Commissioner's meeting and your vote on the rezoning on Isles
of Capri. The planning commission found this project to be not compatible with the surrounding area and I ask you to
please take their advice.
Buildings of the size that is being requested is completely out of sync with the rest of Capri. They in no way, shape or
form will fit in with the feel of the rest of the island. The residents on Capri are asking you to please vote NO to
rezoning on our business island. We would like to keep the business island business. We don't want a private
community that Capriers can not use, we don't want giant buildings destroying the views of the island, we don't want
something that will make our island feel like Marco or Naples. We moved to Capri because of the smallness, because of
the nature, because it's out of the way of the giant structures. We are a down to earth neighborhood. Yes, there are
some big beautiful homes and likely more to come. But it's still very limited in size. These proposed huge structures and
gated area will take away from the community's beauty and peace. We would like to be able to enjoy the businesses on
our business island. If this rezoning is approved, other businesses on that island will do the same. And then what do we
have?... a bunch of huge residential towers and no restaurants or shops to serve the Isles of Capri residents... and no
restaurants or shops to bring visitors from Marco or Naples. What a huge disappointment Capri could become... How
very sad! Please help save our island life. Vote NO to rezoning.

Honorable Commissioner,
I respectfully ask you to vote no on the FCC application for zoning change on Isles of Capri. As a resident of Capri I look
forward to the restoration of the marina property owned by FCC. I know they will build a beautiful clubhouse, and I hope
they will build a place for businesses that will attract boaters and visitors to Capri, to enjoy the waterfront, shop and
dine. However, I believe our isles will forever be changed if they are allowed to build high-rise, high density
condominiums on this property. We are a community of people who enjoy a lifestyle of mostly single family and low
profile homes and great neighbors. We are people who come together to work, play, and care for one another,
especially after a tragedy like Hurricanes Irma and Ian. The proposed condominium complex will be isolated from us by
design, and I believe the residents will be a community all their own.
If this project is approved I believe every existing waterfront business will follow suit and apply for the same zoning
change, to tear down the small business buildings to make room for new mixed use development, and the community
we have now will go into the scrapbooks of history.

I am writing to plea to you and urge you to vote against the rezoning of the Isles of Capri, for the
betterment of the island, surrounding water quality, wildlife and preservation of our beautiful County.
We are not opposed to any development allowable under the C-3 zoning. We are only opposed to the
owner's unreasonable attempt to change the zoning, without any regard for the surrounding homes,
people, and nature. It is extremely unethical for the owners to build 3 high-rise towers, in the middle of a
very small residential island, surrounded by our ocean water, adjacent to Rookery Bay. If this is allowed,
this rezoning will surely bring additional high-rise towers, which will definitely destroy one of the last
few remaining wildlife sanctuary areas in Collier County, which can not be undone. It is SO OBVIOUS that
this rezoning request is WRONG FOR THE AREA and it would be a BAD INVESTIMENT FOR THE
FUTURE for the county's land use. The county's planning staff and the planning commission already
concluded that these high-rise towers would not be compatible with the surrounding areas and rejected
this outrageous building proposal.
Our country was built on a foundation of brave people like yourself, who evaluated the issues fairly and
stood up for what is RIGHT and WRONG, for the BETTERMENT OF THE PEOPLE. Please, do not be
persuaded by political influence, big money, corporate greed, or highly skilled attorneys' attempts to
cloud your impartial, honest judgment in this matter. We know that you personally hold tremendous
power to change people's lives forever in a positive way and preserve our unique natural resources in
Collier County.
I am one of those conservative people who fled to our beautiful State of Florida from one of the decaying,

Collier County Board of Commissioners:
I am a property owner in Tarpon Village, Isles of Capri (IOC) and seasonal resident of same.
Attached is a letter to Commissioner LoCastro on 8/21/22 regarding this matter and in response to his concern of what
the IOC residents would like to see on the property in question zoned as C-3. Please note that the statements in that
letter are my opinion and I do not speak for the IOC. Since the County Board of Commissioners were originally copied I
have attached it primarily as a reminder of my objection to the proposed rezoning request and for the new
Commissioners' review.
I object and oppose development of three (3) high-rise buildings —168 feet - consisting of 108 muti-family dwelling
units. That kind of development is not compatible nor consistent with other development on IOC. There is no public
benefit associated with the requested growth management plan amendment.
County Planning Commission staff recommended denial of the rezoning applications for two main reasons: density in
the Urban Coastal Fringe High Hazard Area; and height — C-3 is zoned for 50- foot height. The Planning Commission
ultimately denied the application.
Former Commissioner Taylor once said "Developers have an eye to profit, instead of an eye to what our community
values ..." "Collier County is not here to support a developer making a profit from his assets. That is not our job. Our
job is to preserve the quality of life and our community and ensure that people who have invested their life savings in
their home have a continuing strong investment."
I ask you to consider the residents of IOC and their investments. I ask you to consider the location of IOC in a nature
preserve.
I ask you to deny this application to rezone — it is inconsistent, incompatible with past and present development.

I am at Twin Dolphins. Last week we experienced the fire which destroyed our generator and in tern
or electrical system. Residents were required to evacuate the premises. Well, the fire department
determined the damage to the building
My question is simple. It is Simple. Is the fire department on the Isle of Capri large enough to handle
a fire in a large building as proposed . Help from a neighboring station will not be sufficient to assist
the tenants of the proposed building in time to save lives

Not counting the existing boat storage large building , only 3+acres remain to build 108 condos , yacht club , private
restaurant, parking garage, swim/recreation facility, yacht dockage, dockmasters building, etc.
No foretold benefit to the nearby residents
Please read the agenda particulars on this issue before making your decision on my future . I implore you to vote
'NO' . THANK YOU and I look forward to you carrying out your term as the commissioner who promotes the will of the
residents . yes, many members of collier government desire growth , growth , and more growth ! growth can be

My name is Joan Coyne. I am a member of SaveCapri.org. We are a group of citizens representing approx.
900 residents( signatures on a petition) on the Isles of Capri. We are asking you as a member of the Collier
County Board of Commissioners to help us defeat the rezoning request by the FCC Beach and Yacht, LLC to
build 3 High Rise Condo buildings in the middle of our Island. The proposed project does not add anything
beneficial and is not complementary to our community. Most of the homes and businesses in the area are
two or three story buildings.
This property is located within the Urban Coastal Fringe Subdistrict and Urban Coastal High
Hazard Subdistrict. We all know how that has affected all of us during Hurricane Ian. We have residents not
living in their homes because of the destruction of the high water. It will probably take until next spring or
summer before they can return.
I understand there are a "FEW" residents on the island who would like to see this project go forward. Those
residents are in the minority. They are willing to sacrifice having high rise condos for the opportunity to join
the proposed private "Restaurant Club". Most residents here are not of that "ILK".
Please come to the Isles of Capri. Check out the area of the proposed project See how this project of 3 High
Rise Condos (108 residential dwelling units, 148 feet zoned and 168 feet actual), on 5.32-acre does not fit our
lifestyle. I understand it will be a beautiful project however, it will be a disservice to those of us who presently
live here. Everyday having to look at something that is not COMPATIBLE with the rest of the Island. Sticks out,
like not like a sore thumb, but a glitzy reminder of what money can buy.
We understand they want to bribe us by "building" two culvert projects and helping us by including us with
the sewer project. The City of Marco Island may not allow FFC Inc. to connect to their system unless they

make provision for the whole island to eventually connect. So ....... And we have a committee working on the
culvert project so we don't need their help with either.
The Zoning Department staff did not recommend this project. The Planning Commission voted against it also,
with only one member voting for it.(He lives in the Fiddlers Creek community) so I think he should have
recused himself.
Please Do not allow this rezoning project to go forward. If rezoning is allowed it will change the landscape of
this island forever. We are not against FCC Inc. building within the C-3 zone.
I appreciate your time and ask you to support the Isles of Capri residents opposed to this project.

Planned Unit Development allowing for residential and commercial uses. The 5.32-acre

This is an email I sent to Mr LaRow-Director — Economic Development and Housing Division
I have several questions regarding affordability density bonuses.
I live on the Isles of Capri. At the CCPC it was stated a developer could pay a fee to the county to get
around providing affordable housing units in their proposed luxury project on the Isles of Capri and
get additional density bonus.
Can you explain how that works? I would like to know how the fee is determined, to whom it is
paid?
Please advise where in the code this is stated.

Answer I received from Mr LaRow Director — Economic Development and Housing Division
To answer your question, there's nothing in the Land Development Code that speaks to or provides
for a payment calculation where an applicant can contribute a Local Housing Trust Fund to support
the development of housing that is affordable.
The comment was intended to convey Board of County Commissioner direction to staff that projects
requesting density above what is currently allowed in the Comprehensive Plan to provide some public
benefit in exchange for the additional density. That public benefit has been manifested in
approximately 20% of the units developed to be set aside and made affordable for 30 years. For this
particular project, the number of units would have stood at 21 to be reserved as affordable.

Since the applicant appeared to be resistant to that exchange the comment was made for the
purposes of discussion for the applicant to consider as a potential to consider if they were interested.
To be clear, the Board hasn't broached the subject of a payment in lieu of providing units. It was more
of a reminder to the applicant that with the density requested staff would recommend some public
benefit as a result
This is my response to Mr LaRow
It sounds to me like an auction. If they agree to provide dollars to Affordable housing for
public benefit. Then the Isles of Capri has to live with something that is incompatible and doesn't
compliment the existing homes in the area. What about their public benefit? If the area is in High
coastal hazard area and Urban Coastal Fringe Subdistrict how does giving dollars to the Affordable
housing protect the safety of the residents in the community from these designated areas? It seems
to me it is just putting more people in harm's way. It gives the applicant a way to go around rules
that are set aside to protect people.
It also sounds to me like discrimination not wanting to have service people in their luxury buildings.
I know I am ranting to you when I am just upset about how the government always allows money to
buy whatever they want at the cost of the safety of the residents.
I am going to forward this note to the board of county commissioners also.
