Agenda 12/13/2022 Item #16A12 (To obtain Board approval for the Public Transportation Agency Safety Plan Update)12/13/2022 EXECUTIVE SUMMARY Recommendation to approve Collier Area Transit (CAT) Public Transportation Agency Safety Plan (PTASP) Update in accordance with Final Rule 49 C.F.R. Part 673 requirements. OBJECTIVE: To obtain Board approval for the Public Transportation Agency Safety Plan (PTASP) Update. CONSIDERATIONS: On July 19, 2018, Federal Transit Administration (FTA) published the Public Transportation Agency Safety Plan Final Rule, which requires certain operators of public transportation systems that receive federal funds under FTA's Urbanized Area Formula Grants to develop safety plans that include the processes and procedures to implement Safety Management Systems (SMS). The PTASP regulation implements a proactive, risk-based approach to managing transit safety and requires recipients and subrecipients of financial assistance under the Urbanized Area Formula Program (49 U.S.C. Section 5307) and rail transit agencies that are subject to the FTA State Safety Oversight Program to have an Agency Safety Plan. Each safety plan is required to include several components including: • The documented processes of the agency’s SMS, including the agency’s Safety Management Policy and processes for Safety Risk Management, Safety Assurance, and Safety Promotion; • An employee reporting program; • Performance targets based on the safety performance measures established in FTA’s National Public Transportation Safety Plan (NSP); • Criteria to address all applicable requirements and standards set forth in FTA’s Public Transportation Safety Program and the NSP; and • A process and timeline for conducting an annual review and update of the safety plan. The plan for Collier Area Transit (CAT) was originally adopted by the Board on May 12, 2020, agenda Item 16D5. Since its adoption the Bipartisan Infrastructure Law was enacted and included new requirements for Public Transportation Agency Safety Plans. Staff have made the required modifications to the CAT Plan, including the establishment of an Agency Safety Committee and documenting the committee’s review and approval of the plan. An Agency Safety Committee was established on July 21, 2022, and recently met on October 25, 2022, to review and approve the plan. FISCAL IMPACT: Approval of the PTASP ensures compliance with federal requirements to receive annual appropriations awarded by FTA. FTA grant programs are typically funded within CAT Grant Fund (424). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality and requires majority vote for approval. -JAK RECOMMENDATION: That the Board approve the Collier Area Transit (CAT) Public Transportation Agency Safety Plan (PTASP) Update in accordance with Final Rule 49 C.F.R.
