WHEREAS, on October 28, 1986, the Board of County Commissioners approved Ordinance No. 86-72, establishing the Sabal Palm Road Extension Municipal Service Taxing and Benefit Unit (the "MSTU-BU"): and WHEREAS, the Board of County Commissioners approved Ordinance No. 2001-51, amending the District purpose to provide for on-going maintenance activities of Sabal Palm Road Extension; and WHEREAS, the development along Sabal Palm Road Extension has changed over time whereby some property access is no longer required via Sabal Palm Road Extension warranting a modification of the geographical boundaries of the MSTU-BU to remove those property owners that no longer have access to nor otherwise derive any benefit from the MSTU-BU's stated purpose. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION 1: AMENDMENT TO SECTION ONE ON ORDINANCE NO 86-72. Section 1: Creation, Boundaries, Purposes. The sections of the Ordinances may be renumbered or re- lettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION TREE: CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: EFFECTIVE DATE This Ordinance shall become effective upon filing with the Florida Department of State.
