Agenda 12/13/2022 Item #17G (Ordinance - Sabal Palm Road)12/13/2022 EXECUTIVE SUMMARY Recommendation that the Board approve a proposed amendment to Collier County Ordinance No. 86-72, the Sabal Palm Road Extension Municipal Service Taxing and Benefit Unit (MSTU), to amend the geographical boundaries of the MSTU to remove three hundred thirty-two properties that no longer derive benefit from the MSTU’s stated purpose. ____________________________________________________________________________________________________________________________________________________________ OBJECTIVE: To ensure only those property owners benefiting from the Unit are being assessed. CONSIDERATIONS: On October 28, 1986, the Board of County Commissioners (Board) adopted Ordinance 86-72 establishing the Sabal Palm Road Extension Municipal Service Taxing and Benefit Unit, providing for the purpose of providing a preliminary engineering study for the design, construction, and financing of roadway improvements within the unit and to do all things reasonably necessary in connection therewith. On September 25, 2001, the Board adopted Ordinance 2001-51, amending Ordinance 86-72, to provide for the maintenance of Sabal Palm Road Extension. On October 9, 2009, the Board entered into a Memorandum of Agreement (MOA) with the Florida Department of Agriculture and Consumer Services Division of Forestry (DOF) in which the County agreed to supply construction materials for the maintenance of Sabal Palm Road Extension and the DOF would provide labor and equipment for said maintenance. The County also agreed to be the project coordinator for all activities related to the maintenance of Sabal Palm Road Extension and serve as the sole contact for the residents within the Unit and/or DOF. A portion of the properties within the MSTU have been newly plated into three hundred and thirty-two (332) parcels with access via the Hacienda Lakes Planned Unit Development (PUD) approved in Section 24, Township 50 South and Range 26 East on the western side of the MSTU with no access via Sabal Palm Road. All access to their properties is now via Hacienda Lakes Parkway. Because those parcel owners no longer benefit from the ability to access and travel upon Sabal Palm Road, staff is requesting that the Board revise the geographical boundaries of the MSTU and to remove those applicable properties from the MSTU. FISCAL IMPACT: Tax year 2022 taxable value for the Sabal Palm Road MSTU was approximately $113 million, the amended geographical boundaries will result in a taxable value reduction of approximately $106 million or 94% of the current taxable value. The current millage is set at 0.0 as it has been since FY17. The current funding balance of Sabal Palm Ext. MSTU Fund (151) is approximately $60,000 which should be sufficient to maintain the road for another 2-3 years. The operational budget of the MSTU will continue to be evaluated annually as part of the County's budget cycle. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary.
