Agenda 12/13/2022 Item #16F 2 (Agreement for Advanced Life Support)12/13/2022 EXECUTIVE SUMMARY Recommendation to approve a Certificate of Public Convenience and Necessity for Advanced Life Support (ALS) non-transport services for one year to the City of Naples Fire-Rescue concurrent with the approval of an accompanying Interlocal Agreement (ILA) and authorize the Chairman to execute the ILA, Permit, and Certificate. OBJECTIVE: To execute an Interlocal Agreement for Advanced Life Support traditionally used with participating fire service organizations and authorize the issuance of a Certificate of Public Convenience and Necessity (COPCN) to City of Naples Fire -Rescue for Class 3 Advanced Life Support (“ALS”) non-transport services in Collier County for a period of one year. CONSIDERATIONS: City of Naples Fire -Rescue has filed an application for a Certificate of Public Convenience and Necessity to operate ALS services within its district. Critical to the consistent delivery of pre -hospital care, Collier County Emergency Medical Services (EMS) further request an Interlocal Agreement for ALS be signed by both parties to ensure the highest level of quality assurance with its approved protocol and medical direction approved by the County’s Medical Director, Dr. Robert Tober. The Director of the Bureau of Emergency Services and the Chief of Collier EMS support awarding the COPCN for ALS non -transport services. The Emergency Medical Authority has reviewed the application and at its September 14, 2022, meeting unanimously approved the application. In accordance with Section 10 of Ordinance No. 04-12, as amended, the Director of the Bureau of Emergency Services recommends approval based on his finding that there is a public necessity for City of Naples Fire- Rescue to provide the service and that all other requirements under Ordinance No. 04-12 have been met. If this item which includes the Advanced Life Support Interlocal Agreement and the Certificate of Public Necessity and permit is approved by the Board, the COPCN will commence on January 6th, 2023 and expire on January 5th, 2024. FISCAL IMPACT: There is no fiscal impact to the Board for the granting of this certificate. The Board is requested to accept and recognize as revenue in General Fund (001) the $250.00 application fee with the corresponding application. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact. LEGAL CONSIDERATIONS: Ordinance 04-12 provides in relevant part as follows: 7. The Board of County Commissioners shall not grant a certificate unless it shall find, after public hearing and based on competent evidence that each of the following standards has been satisfied: A. That there is a public necessity for the service. In making such determination, the Board of County Commissioners shall consider, as a minimum, the following factors: 1. The extent to which the proposed service is needed to improve the overall emergency medical 16.F.2 Packet Pg. 2202 12/13/2022 services (EMS) capabilities of the County. 2. The effect of the proposed service on existing services with respect to quality of service and cost of service. 3. The effect of the proposed service on the overall cost of EMS service in the County. 4. The effect of the proposed service on existing hospitals and other health care facilities. 5. The effect of the proposed service on personnel of existing services and the availability of sufficient qualified personnel in the local area to adequately staff all existing services. (2) That the applicant has sufficient knowledge and experience to properly operate the proposed service. (3) That, if applicable, there is an adequate revenue base for the proposed service. (4) That the proposed service will have sufficient personnel and equipment to adequately cover the proposed service area.” In making the determinations provided for in Section 7 above, the Board may, in its sole discretion, appoint a Hearing Officer to hold a public hearing and to make factual findings and conclusions because of the hearing. Should a Hearing Officer be appointed, said Hearing Officer shall render a written report to the Board within 30 days of the hearing, which report shall contain the officer's findings and conclusions of fact, and a recommended order. The findings and conclusions of fact shall be binding upon the Board, but the recommended order shall be advisory only. This item is approved as to form and legality and requires a majority vote for approval. -JAK RECOMMENDATION: That the Board of County Commissioners: 1. OBJECTIVE: That the Board of County Commissioners adopts the attached resolution and the related amendments that amend the Fiscal Year 2022-23 adopted budget in accordance with Section 129.06, Florida Statutes. CONSIDERATIONS: Section 129.06, Florida Statutes defines how an annual budget, as adopted by the Board, can be amended. Budget amendments recognizing grants, donations, contributions, insurance proceeds, or receipts from enterprise or proprietary funds that increase the total appropriations of a fund over the adopted annual budget must be approved by resolution of the Board of County Commissioners. Also, budget amendments appropriating moneys from reserve for future construction and improvements must be approved by resolution of the Board of County Commissioners. The budget amendments in the attached resolution cover Board approved items for the period through December 13, 2022. The budget amendments in the attached Resolution have been reviewed and approved by the Board of County Commissioners via separate Executive Summaries. FISCAL IMPACT: The amendments and executive summaries, which were previously considered and approved by the Board, contained their respective fiscal impact statements. Page 38 Appendix item 6: City of Naples Financial Data...............................Page 39 The following information is for consideration of a Class 3: Advanced Life Support Non -Transport Certificate of Public Convenience and Necessity (COPCN) for the City of Naples Fire -Rescue Department. The goals and objective of this request is to document that the City of Naples Fire - Rescue Department meets the requirements specified in the Collier County, Florida Code of Ordinances, Chapter 50 — Emergency Services. The quintessential objective of pre -hospital care is to quickly respond to an emergency, provide enough resources to effectively stabilize a patient and continue that care while enroute to a medical facility. The City of Naples Fire -Rescue Department currently benefits the community by augmenting the EMS system with both ALS and BLS resources to enhance public safety to those citizens that are ill or injured. An Engine, Squad, or Ladder often has a quicker turn around and could be the first unit on scene to begin the patient assessment and provide early interventions. These same units can be utilized by the EMS transport units to provide additional personnel to assist with care of unstable patients while enroute to the hospital. Granting of the COPCN allows the City of Naples Fire -Rescue Department to continually improve its ability to maintain the highest level of service and plan for what the future may hold for pre - hospital care. As the COVID-19 pandemic proved, the strain on our medical services can come from a variety of emergencies. As an example, the City ran a COVID vaccine clinic out of Fire Station 1. EMS personnel were required to stand by on scene as they were the ones that received the actual vaccine from the Department of Health. This tied up two county paramedics in positions that could have been staffed by Fire -Rescue personnel and further strained the entire County effort to provide care to the residents. The ability of the Fire -Rescue Department to provide additional personnel and resources for public education, public screening, vaccinations, etc. could prove to be vital in the future. These improvements bolster and enhance the overall level of service to the City and the County, via All -Hazards support to our jurisdictional partners and Collier County EMS. The addition of a COPCN and an Associate Medical Director specifically working with the Naples Fire -Rescue Department offers many other avenues for improvement of services for the public. The Medical Director could assist with training of other City Departments including the Police Department and the lifeguards at the River Park Aquatic Center. Having intra-city training opportunities promotes better communication and better outcomes when emergencies occur. Other areas of improvement include public outreach programs such a Citizen Emergency Response Teams (CERT), Stop the Bleed, Run -Hide -Fight, community CPR training and other community heath related programs. As thoroughly discussed in a variety of position statements from the National Association of EMS Physicians (NAEMSP) and National Association of State EMS Officials (NASEMSO), direct interaction and education with EMS Physicians and medical direction is a vital component of education and quality assurance/quality improvement initiatives. In conclusion, the aim of the COPCN request is to improve our overall service to the residents of the city, visitors to our area, and to the County as a whole. Each of the aforementioned reason indicate areas that can be improved and lead to overall community risk reduction. Conversely, there is no negative impact on the quality or cost of the current EMS system, existing hospitals, or other health care facilities. The first Emergency Medical Technicians were introduced into the system in 1975. We have worked in coordination with Collier County Emergency Medical Services since that time to provide both Basic Life Support and Advanced Life Support medical care. The management staff for Naples Fire -Rescue has over 183 years of medical experience as either an Emergency Medical Technician or Paramedic. The Executive Staff alone has 116 years combined medical experience. Credentials for the Staff include AHA CPR Instructor/Provider, AHA Advanced Cardiac Life Support Instructor/Provider, AHA Pediatric Advanced Life Support Instructor/Provider, Trauma Emergency Casualty Care, and Tox-Medic. For the past 7 years medical training for the City of Naples Fire Rescue Department has been conducted and coordinated through Collier County Emergency Medical Services by Chief Phillip Pennington. During the past 7 years, Chief Pennington has produced numerous training programs that have been vetted and approved by the Collier County Medical Director Dr. Tober or the Deputy Medical Director Dr. Lee. Chief Pennington has attended numerous Collier County In -Service trainings as both a participant and as an instructor. The Training, knowledge, and background for Chief Pennington are listed below: WORK EXPERIENCE: November 2021- Present Member of the City of Naples Fire Rescue Department • Interim Fire Chief o Assumed all duties as the Fire Chief for the City. o Responsible for all oversite in daily operations for the Fire Rescue Department. o Oversee all budget and capital improvement plans. o Attend Department Director meetings. o Speak at City Council meetings to explain Fire Department issues. The Department currently does not charge for these services and has no plans on changing this policy. (8) Other pertinent information The City of Naples Fire -Rescue Department currently works under the Collier County EMS & Fire Department Common Medical Protocols. Our department will continue to follow Medical Direction as provided through the Office of Collier County Medical Director Dr. Robert B. Tober and Dr. Douglas S. Lee. In addition to and in alignment of Sec. 50-62, the City of Naples has contracted the services of Dr. Benjamin N. Abo to serve as the Class 3 Operator Medical Director. Dr. Abo will work in cooperatively with the Collier County's Medical Directors to ensure continuity of care and provide guidance to the City of Naples Fire -Rescue Department personnel with training, continued CQI/CQA, certification/re-certification of personnel, performance standards, and planning of employee health and safety. (See appendix item 2; Dr. Abo Contract / CV) The City of Naples Fire -Rescue Department currently provides EMS recertification training through a combination of State approved online medical courses via Vector Solutions (Target Solutions) and other in -person training classes. The in -person trainings are pre -approved by the Office of the Collier County Medical Director with a written class syllabus. The in -person training has been a combination of courses designed by the Naples Fire -Rescue Training Chief or programs put together by Collier County EMS Training Bureau. If it is classes put on during the EMS in-service; Naples Fire -Rescue Training Chief attends and instructs at the in-service prior to reproducing the material for Naples Fire -Rescue personnel. Crews on duty, attend the in -person trainings and these training sessions occur over three consecutive days, once monthly. The Department has also used company officer lead scenario -based training for review of protocols. With Vector Solutions (Target Solutions) we also have the capability to produce training videos that can be issued as mandatory training for all members. This was one option used, in conjunction with the Collier County Medical Directors and Collier County EMS, during the COVID pandemic. The attached training outline shows that there is one monthly EMS based training assigned to all personnel each month. The total hours can vary from cycle to cycle. However, this training alone always exceeds the minimum hours of continuing contact hours for recertification of both EMT's and paramedics. This does not include additional hours via other training courses and in- service trainings. CPR and ACLS are provided in-house and follow AHA guidelines. All Fire -Rescue personnel are required to complete CPR training and all paramedic certified personnel are required to complete ACLS training. The City of Naples Fire -Rescue Department currently attends County meetings and provides information regarding Quality Assurance and Quality Improvement to Collier County EMS and the Office of the Collier County Medical Director. The addition of an Associate Medical Director allows continued improvement in these areas by the Department. The Naples Fire -Rescue Department and Collier County EMS both use Image Trend for ePCR's and data collection. The City of Naples Fire -Rescue Department currently attends Collier County EMS protocol meetings. We will continue to attend these meetings and look forward to continued collaboration to improve pre -hospital care within Collier County. The City of Naples Fire -Rescue Department currently conducts in-house EMS orientation training for all new employees. Stat., requires that certain public agency contracts must include certain statutorily required provisions concerning the contractor's compliance for Florida's Public Records Act; and WHEREAS, Section 768.28, Fla. Amendment. This Addendum hereby amends and supplements the terms of the Agreement. In the event of a conflict between the terms of the Agreement and terms of this Addendum, the terms of this Addendum shall prevail. 2. Public Records Compliance. Contractor agrees that, to the extent that it may "act on behalf" of the City within the meaning of Section 119.0701(1)(a), Florida Statutes in providing its services under this Agreement, it shall: (a) Keep and maintain public records required by the public agency to perform the service. (b) Upon request from the public agency's custodian of public records, provide the public agency with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided in this chapter or as otherwise provided by law. [Rev.1-21] 13 (c) Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the contract if the contractor does not transfer the records to the public agency. (d) Upon completion of the contract, transfer, at no cost, to the public agency all public records in possession of the contractor or keep and maintain public records required by the public agency to perform the service. If the contractor transfers all public records to the public agency upon completion of the contract, the contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the contractor keeps and maintains public records upon completion of the contract, the contractor shall meet all applicable requirements for retaining public records. All records stored electronically must be provided to the public agency, upon request from the City's custodian of public records, in a format that is compatible with the information technology systems of the City. Public Records Compliance Indemnification. Contractor agrees to indemnify and hold the City harmless against any and all claims, damage awards, and causes of action arising from the contractor's failure to comply with the public records disclosure requirements of Section 119.07(1), Florida Statutes, or by contractor's failure to maintain public records that are exempt or confidential and exempt from the public records disclosure requirements, including, but not limited to, any third party claims or awards for attorneys' fees and costs arising therefrom. Contractor authorizes the public agency to seek declaratory, injunctive, or other appropriate relief against Contractor in Collier County Circuit Court on an expedited basis to enforce the requirements of this section. 4. Compliance/Consistency with Section 768.28, Fla. Stat. Any indemnification or agreement to defend or hold harmless by City specified in the Agreement shall not be construed as a waiver of City's sovereign immunity, and shall be limited to such indemnification and liability limits consistent with the requirements of Section 768.28, Fla. Stat. and subject to the procedural requirements set forth therein. Any other purported indemnification by City in the Agreement in derogation hereof shall be void and of no force or effect. 5. Non -appropriation. The City's performance and obligation to pay under this Agreement is contingent upon an appropriation during the City's annual budget approval process. If funds are not appropriated for a fiscal year, then the Contractor shall be notified as soon as is practical by memorandum from the City Manager or designee that funds have not been appropriated for continuation of the Agreement, and the Agreement shall expire at the end of the [Rev. 1-21] 14 fiscal year for which funding has been appropriated notwithstanding any automatic renewal as may be provided in the Agreement. The termination of the Agreement at fiscal year-end shall be without penalty or expense to the City, subject to the City paying all invoices for services rendered during the period the Agreement was funded by an appropriation. 6. E-Verify Compliance. Contractor affirmatively states, under penalty of perjury, that in accordance with Section 448.095, Fla. Stat., Contractor is registered with and uses the E- Verify system to verify the work authorization status of all newly hired employees, that in accordance with such statute, Contractor requires from each of its subcontractors an affidavit stating that the subcontractor does not employ, contract with, or subcontract with an unauthorized alien, and that Contractor is otherwise in compliance with Sections 448.09 and 448.095, Fla. Stat. 7. Compliance/Consistency with Scrutinized Companies Provisions of Florida Statutes. Section 287.135(2)(a), Florida Statutes, prohibits a company from bidding on, submitting a proposal for, or entering into or renewing a contract for goods or services of any amount if, at the time of contracting or renewal, the company is on the Scrutinized Companies that Boycott Israel List, created pursuant to section 215.4725, Florida Statutes, or is engaged in a boycott of Israel. Create disciplinary reports, pursuant to Florida Statute Section 401.265 (2), to be filed with the Fire Chief or his/her designee for action which documents possible violation of adopted City of Naples Fire -Rescue policies and rules. Respond or consult on medically related injuries arising from on-the-job activities of paramedics and emergency medicine technicians and advise the City of Naples on questions arising from Occupational Health and Infection Control issues. 19 Respond to emergency medical calls, with crews, subject to the availability of the MEDICAL DIRECTOR's time. Participate in county -wide joint MEDICAL DIRECTOR meeting(s) on behalf of City of Naples Fire -Rescue to assist in the development of new guidelines and to update current guidelines.
