Agenda 12/13/2022 Item #16A30 (Final Engineering, Design and Permitting for the Comprehensive Watershed Improvements Project)12/13/2022 EXECUTIVE SUMMARY Recommendation to approve the selection committee’s ranking of Request for Professional Services (“RPS”) No. 22-8001, “Comprehensive Watershed Improvement Project,” and authorize staff to begin contract negotiations with the top-ranked firm, Atkins North America, Inc., so that staff can bring a proposed agreement back for the Board’s consideration at a future meeting. OBJECTIVE: To obtain professional engineering services for the Final Engineering, Design, and Permitting for the Comprehensive Watershed Improvements Project. CONSIDERATIONS: Collier County’s Comprehensive Watershed Improvement Plan utilized ten major studies and reports developed by various local, state and regulatory agencies over the past 15 years to reduce freshwater flows into Naples Bay, restore fresh water flows into Rookery Bay, improve water quality and re -hydrate approximately 10,000 acres of the Picayune Strand State Forest/South Belle Meade area by linking hydrologic and ecological restoration projects that will function on a regional basis. This project will allow the County to manage its natural resources in a more holistic and comprehensive manner. On June 13, 2022, the Procurement Services Division posted RPS No. 22 -8001, the Comprehensive Watershed Improvement Project. The County received three proposals by the July 13, 2022, submission deadline. Staff found all three firms to be responsive and responsible. A selection committee met and scored each of the proposals on August 18, 2022. Due to a committee m ember’s inconsistent evaluation, the County dismissed the original committee and assembled a new committee to evaluate the proposals. The new selection committee met on October 25, 2022, scored the proposals, and shortlisted all three firms to provide presentations. On November 17, 2022, the selection committee convened for presentations and to reach a recommended final ranking. Taylor Engineering, Inc. stated it would not conduct a presentation and withdrew its proposal from consideration. The selection committee ranked the firms as follows: Firm Ranking Atkins North America, Inc. 1 South Florida Engineering and Consulting, LLC 2 Taylor Engineering, Inc. Not Ranked Staff is recommending that the Board approve the selection committee’s ranking and authorize staff to begin contract negotiations with the top-ranked firm, Atkins North America, Inc. (“Atkins”). Atkins is a qualified design consultant that has worked with Collier County on numerous environmental projects over the last 15 years, most recently leading the design for the Upper Gordon River Weir Replacement project. In the event an agreement cannot be reached with Atkins, staff will continue negotiating with the second ranked firm, until a proposed agreement can be brought back for the Board’s consideration at a future meeting. If an agreement cannot be reached with the second ranked firm, staff will need to resolicit these services in an effort to obtain other interested consultants. FISCAL IMPACT: There is no fiscal impact at this time. Once negotiations are completed and approved, funding will be available through RESTORE a US Department of Treasury Direct Component (Pot 3) Grant. GROWTH MANAGEMENT IMPACT: There are no growth management impacts as a result of this project. The Consultant, at a minimum, must achieve the requirements of the Specifications or Scope of Work stated. BACKGROUND The Collier County/ Rookery Bay Comprehensive Watershed Improvement Plan Final Design and Permitting Phase integrates a series of linked surface water management projects on approximately 10,000 acres of eastern Collier County. The objective of the project is restoring the hydrology and ecology of both Naples Bay and Rookery Bay, as well as the hydrologic restoration of the southern Belle Meade area of the Picayune Strand State Forest (PSSF). This project will divert water from entering Naples Bay, which is overly impacted by a freshwater surplus during wet season, by creating a flow-way from the Golden Gate Canal structure through the PSSF to Rookery Bay, which has a freshwater deficit. Approximately 70% of Collier County’s 2,300 sq. miles has been altered since the 1950’s in order to accommodate coastal development. In addition to shoreline modifications, extensive canal construction for urban and agricultural drainage has changed the timing and quantity of freshwater inflows to coastal waters. These changes have dramatically affected water quality and quantity of many County estuaries. Prior to intense development, rainfall either infiltrated into the surficial aquifer or flowed through extensive wetlands into the coastal waters of the County. The final design and permitting of this project are the first step in rehydrating and restoring at least a portion of the historical flows within the region helping to reestablish historical wetlands and hydroperiods to some degree. TERM OF CONTRACT County reserves the right to modify this scope during negotiations for budgetary reasons. The contract term, if an award is made , will commence on the date of the Notice to Proceed, and end upon acceptance and approval of final payment. Prices shall remain firm for the term of the awarded contract. Surcharges will not be accepted in conjunction with this award, and such charges should be incorporated into the pricing structure. 16.A.30.a Packet Pg. 1132 Attachment: 22-8001 Solicitation (24075 : RPS No. 22-8001, “Comprehensive Watershed Improvement Project) DETAILED SCOPE OF WORK The purpose and intent of this solicitation is to develop the final design and obtain construction permitting from required regulatory agencies. A. This portion of the project will focus on and address the following tasks: 1. Update the local scale MIKE SHE/MIKE11 models utilizing newly available data surveys and topographic LiDAR data to support the permit applications. 2. Prepare construction designs utilizing conceptual designs (if appropriate) with reviews at the 30%, 60%, 90% and 100% designs, Develop an Opinion of Costs at each level of design. 3. Perform stakeholder coordination/communication during the design phases along with executing flowway easements, private property owner coordination and execution of the TDR program. 4. Conduct development and public meetings as appropriate. 5. Resubmit existing Conceptual ERP permits applications after answering RAI questions, Address additional SFWMD questions and secure conceptual ERP permit. 6. Complete project development including detailed designs, develop a Construction ERP permit application and submit, address RAI questions, and obtain a SFWMD construction permit for this project. 7. Submit and obtain a State of Florida 404 construction permit including permit application, RAI questions, FWS, FWC and other required regulatory agency approvals required to obtain a construction 404 permit. 8. Obtain FDOT drainage connection and ROW permits. 9. Develop and coordinate the operations and maintenance plans for this program. 10. Develop a construction sequencing and master project schedule. 11. Prepare construction designs utilizing conceptual designs (if appropriate) with reviews at the 30%, 60%, 90% and 100% designs, Develop an Opinion of Costs at each level of design. 12. Assist through the construction period with shop drawing review and approval, submittal review, plan clarification or inconsequential field changes to plans, application for payment review and approval, and other tasks that will need input from the Engineer-of-Record. Record drawings will be required as well. 13. Engineering and Design for the entire project will be included for both phases in the Phase I scope to satisfy FWC requirement that only 100% designs will be reviewed in the conceptual permit application. 14. Value engineering for cost reduction opportunities during the design should be incorporated during the design process. B. Revised Conceptual Scope It is the County’s intent to phase the project into two separate phases and execute one negotiated agreement. The design may be based on the previous conceptual design developed by Taylor Engineering (Attachment_1) with the following changes and modifications: 1. Preliminary Design and Permitting a. Phase 1 will allow water to be pumped from the Golden Gate Canal via a new pump station (#1) through a new north flowway south to the I-75 Canal. A portion of the new north flowway (approximately 60%) has been designed and permitted by Davidson Engineering and will be constructed/funded as part of the Sports Park Program. The balance of this flowway will be constructed as part of this project. Analysis of the installed sports park northern flowway is required to determine the potential for use and modifications required for use on this project. b. A new floodgate will be installed to control flow direction to either Henderson Creek or the Restore Rehydration area. Rehydration water will flow under I-75 via existing culverts to the south I-75 canal to the second pump station. Pump Station #2 will then pump water to and through a distribution header for hydration of the state forest. c. The flow rate and maximum design rate of the system will not exceed 100cfs. d. Pumping volume for Phase 1 initially will not exceed 50cfs with the rate managed to complete hydration before entering the private property at the bottom of the Primary flowway. This will allow for a period of calibration and control of the Variable Frequency pumps (VFP). A second 50cfs VFP will be added in the future when calibration is completed making the capacity of Phase 1, 100cfs. e. The intake system from Collier Creek will be manual without any automatic grate cleaning system. The bar grates will be raked clean by hand. f. Both pump stations will be, as much as possible designed exactly the same with the lower design rates of 50cfs for phase 1 and 100cfs for phase 2. Both Pump stations will be located outside without a building. Approximately 60% of the northern flowway will have been constructed by the sports park contractor prior to the start of this project. Our flowway design will match the existing design that has been engineered and permitted by Davison Engineering. Our scope will include a northern tie-in to the first pump station and a tie-in in the south to the north I-75 canal. h. Several locations in the north and south I-75 Canals need cleaning as marked on the existing drawings. The existing box culverts under I-75 are sufficient for our flowway design needs. Road access and power will be required for pump station 2 as per the existing design. i. Earthwork activities will be reduced based on the lower design rate of the system (from 200cfs to 100cfs). Fill for the f lowway will be utilized as fill for the access roads throughout the project. Clearing and grubbing in the construction footprint will also be used for forestry requirement of exotic removal in work areas. j. Pump Station 2 will then pump water to and through a distribution header for hydration of the state forest. This portion of the project will be reduced in scope to 100cfs flow rate or less. This applies to the earthwork as well as the distribution headers. k. SCADA communications will be included at 2 monitoring stations to both VFP only. l. Phase I will also include working with the landowner in the Primary and Secondary flowway to secure ea sements to flow water across their property as well as working with Forestry to resolve exotic removals and maintenance needs. An allowance will be provided to assist in working with property owners to execute a flowway easement in exchange for TDR credits. An allowance will be provided to assist with Forestry’s exotic removal requirements is also required. m. A maximum design and flow rate of 100cfs. An allowance for 15 property owners that will not allow Collier County to flow water across their property as per the diking method detailed in the Taylor “Sanders Property Plan View 10”. C. Post Design Contractor Bidding Phase: a. Assist in preparing addenda, as required, to interpret, clarify, or expand Bidding Documents. b. Construction cost estimate and schedule to account for current and future market conditions. c. Consult with and advise the County as to the acceptability of the contractor and subcontractors, suppliers and other organizations proposed by the Prime Contractor for those portions of the work as to which such acceptability is required by the Bidding Documents. d. Consult with the County concerning, and determine the acceptability of, substitute material and equipment proposed by the Contractor when substitution prior to the award of contracts is allowed by the Bidding Documents. e. Attend a pre-bid/quote conference. f. Attend the bid opening, review bids, qualifications. g. Provide a recommendation letter of award with a “Reference Log” showing date, time, and comments of all contacted references provided by the prospective contractor. D. Public Involvement The Consultant and their subconsultant(s), if any, shall complete all required public involvement services throughout the design and construction phases. Work under this item is to include, but not be limited to, the following: a. Prepare a comprehensive mailing list for all property and business owners who will be affected by the construction with limits as shown on the most current set of construction documents. Mail notices through the project duration, as directed by the Project Manager. b. Prepare informational newsletter(s) which describes the project and addresses frequently asked questions. This task may require coordination with the County public relations officers. All notifications and materials for distribution must be approved by the project manager. c. Press releases as necessary for notification to the public. d. Contact businesses individually, including other contractors in the project area, either personally or by phone, as necessary to inform those businesses closely affected by the construction activities. e. Respond to public concerns in coordination with the project manager. This includes, phone calls, e-mails, site visits, meetings, and special reports. All messages left by residents should be answer within the next 24 hours. f. Attend construction progress meetings, as needed, for the duration of the design and construction. g. Secure site and develop meeting materials for Neighborhood Information Meetings. Create web page for project and update it weekly. The updates should include details of the construction and any notification that has been distributed door-to-door or mailed out. i. The PIO is expected to monitor the e-mail and phone Monday through Friday from 7:00 am through 7:00 pm and Saturdays from 8:00 am through 12:00 pm . E. Warranty Services The EOR and his team will provide warranty services for one (1) year after the final completion of the project construction. Work under this item is to include, but not be limited to, the following: a. Post Construction walk thru: Generate a list of warranty issues and coordinate with the contractor. b. Review the post construction video and pictures provided by the contractor. c. Keep a log of all warranty issues. d. One (1) Year Warranty walk thru with the Contractor and County Staff. CEI services will occur under a separate contract. Following the Selection Committee meeting, a decision was made to dismiss the Committee and assemble a new Committee to reevaluate the proposals due to a Committee Members inconsistent evaluation.
