Agenda 12/13/2022 Item #16A (Easement Use Agreement, Petition EUA OL20220000363 for Lot 341- Azure at Hacienda Lakes)12/13/2022 EXECUTIVE SUMMARY Recommendation to approve an Easement Use Agreement (Agreement), Petition EUA-PL20220000363 for Lot 341, Azure at Hacienda Lakes - Phase 2, according to the plat thereof as recorded at Plat Book 65, Page 72 of the public records of Collier County. _____________________________________________________________________________________ OBJECTIVE: To approve an Easement Use Agreement between the County, the Hacienda Lakes Community Development District, and the current property owners of Lot 341, Azure at Hacienda Lakes - Phase 2, in order to allow a screened pool, spa, and deck to encroach approximately 0.60 feet into a 5 -foot-wide drainage easement, more specifically shown on Exhibit “A”. CONSIDERATIONS: The property is located at 9007 Redonda Drive. There is an existing screened pool, spa, and deck on the subject property that encroaches 0.60 feet into a 5-foot-wide drainage easement located along the rear boundary of the property. The 5-foot-wide drainage easement use is for the sole purpose of construction, installation, maintenance, and operation of stormwater facilities. The current owners claim that they purchased the property in 2021 with this encroachment already in place. According to the plat of Azure at Hacienda Lakes - Phase 2 (Plat Book 65, Pages 72-76), the subject easement is dedicated to the Hacienda Lakes Community Development District, with responsibility for maintenance, and to Collier County with no responsibility for maintenance. Moreover, the Hacienda Lakes Community Development District has agreed to the encroachment into the 5’-foot-wide drainage easement which is recorded in Official Record Book 5937, page 120 of the public records of Collier County, Florida on April 22, 2021. Development Review and the Collier County Stormwater Program have reviewed the Agreement and Exhibits and recommend approval of the Easement Use Agreement. FISCAL IMPACT: Expenditures used for recording fees are reimbursed by the customer and deposited in Planning Fund (131). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP RECOMMENDATIONS: To approve the Easement Use Agreement between the County, the Hacienda Lakes Community Development District, and current property owners of Lot 341, Azure at Hacienda Lakes Phase - 2, and authorize the Chairman to execute the Agreement and direct the Clerk to record the Easement Us e Agreement into the public records of Collier County, Florida.
