Notice is hereby given that the Collier County Emergency Medical Authority will meet on Wednesday,
September 14t", 2022, at 9:30 a.m. in the IT Training Room, fifth floor, Collier County Government Center,
3299 Tamiami Trail E., Naples, Florida.
About the public meeting:
Two or more members of the Board of County Commissioners may be present and participate at the
meeting. The subject matter of this meeting may be an item for discussion and action at a future Board of
County Commissioners meeting.
All interested parties are invited to attend, and to register to speak. All registered public speakers will be limited
to three minutes unless changed by the chairman.
Collier County Ordinance No. 2004-05 requires that all lobbyists shall, before engaging in any lobbying
activities (including, but not limited to, addressing the Board of County Commissioners, an advisory board or
quasi-judicial board), register with the Clerk to the Board at the Board Minutes and Records Department.
Anyone who requires an auxiliary aid or service for effective communication, or other reasonable
accommodations to participate in this proceeding, should contact the Collier County Facilities Management
Division, located at 3335 Tamiami Trail E., Suite 101, Naples, Florida 34112, or (239) 252-8380, as soon as

Meeting called to order at 9:30 am by Mrs. Yarnell. A quorum was established.
2. AGENDA AND MINUTES
a. Approval of Today's Agenda
Motion to approve agenda by Mr. Johnson. Seconded by Mr. Chalhoub. Passed
unanimously.
b. Approval of the June 8th, 2022, Meeting Minutes
Revise to add Mr. Summers to the attendance of the June meeting. Motion to
approve June minutes with corrections by Mr. Johnson. Seconded by Mr. Chalhoub.
Passed unanimously.
3. OLD BUSINESS
a. Performance Measures Update
Chief Butcher discussed performance measures. Overall, there has been an
increase in calls from last year. We are still meeting response times and are
looking to add more units. Overdose on fentanyl is still going up nationwide.
Offload times are still going well.
b. Greater Naples Fire Non -Transport Update
Greater Naples provided additional documents requested by the board members
during June meeting. Board has approved and signed interlocal agreement. Chief
DiSarro discussed call volume, consistent. Motion to recommend Greater Naples
COPCN to the Board of County Commissioners by Mr. Chalhoub. Seconded by
Mr. Johnson. Passed unanimously.
4. NEW BUSINESS
No new business.
5. FIRE SERVICE DISCUSSION
No Discussion.

Chief Butcher discussed staff reports. Discussion of planning for new station off old 41.
Meetings for design has started. Actively working on station 74, bidding has begun. After
contract is established, it will need to go to the Board of County Commissioners for
approval.

Sec. 50-55 Procedure for obtaining certificate.
An applicant for a certificate shall obtain forms from the department to be completed and
returned to the division administrator. Each application shall contain:

(5) The training and experience of the applicant.
Ambitrans Medical Transport, Inc. was incorporated in 1983 to provide Paratransit
services to the residents of Charlotte County. In 1988, ownership of the company
transferred to its current principals. In 1995, Ambitrans commenced its ambulance
operations. Today, Ambitrans operates in Charlotte, Collier, Lee, Sarasota and Manatee
counties.
Ambitrans is committed to maintaining compliance with all federal, state and local laws
and regulations. We are compliant with Florida Statute 401 and Florida Administrative
Code 64J in accordance with standards set forth by the Bureau of EMS and Department of
Health. Our state license is valid through June 19, 2023. A copy of our state license is
attached hereto as Exhibit "B."
Ambitrans is a licensed Medicare and Medicaid provider and we have contracts in place
with many national third -party payors, which enable us to serve all citizens of Collier
County. Further, we employ a national law firm specializing in Medicare issues related to
the ambulance industry to ensure we remain compliant with all federal laws, rules and
regulations relating to Medicare, as well as our CEO, who is also a Florida Bar Board
Certified Health Law attorney, to ensure our facility contracts and daily operations
conform with all federal, state and local regulations.
The management team at Ambitrans collectively has over 200 years of experience in the
EMS industry. Our Training and Quality Assurance Department reviews patient care
reports for quality assurance and adherence to our medical protocols and standards of
care. Our education team is also responsible for our in-house training, which includes
CPR, Advanced Cardiac Life Support, Pediatric Advanced Life Support, Emergency
Vehicles Operators Course and on -going continuing education units needed for bi-annual
certification renewal.
Our local, in-house billing department is knowledgeable and responsive and available
Monday through Friday to answer any questions our customers may have.

Our personnel and managers have diverse experiences that take them well outside of
Southwest Florida. Michael Grant, our co-owner, is the Representative for District 75 in
the Florida House, where he serves as Majority Leader.
Vanessa Oliver, our Chief Executive Officer, is also an attorney and is Florida Bar Board
Certified in Health Law. Ms. Oliver was elected county -wide to the Charlotte County
Airport Authority, where she oversees the Punta Gorda Airport, one of the fastest growing
airports in the nation. She is also a past gubernatorial appointee to the State Board of
Funeral, Cemetery and Consumer Services.
Our Chief Operating Officer, Alan Skavroneck, served as President for the Florida
Ambulance Association and recently completed his term as State Surgeon General
appointee to the Emergency Medical Services Advisory Council.
Dr. Daniel V. O'Leary serves as our medical director of record as mandated under Florida
Statute 401.265. This is in addition to his normal day-to-day duties as an emergency
room physician at Bayfront Health Port Charlotte as well as serving as the Medical
Director for Charlotte County Fire and EMS. He is a member of the United States Army
National Guard and has deployed numerous times.

The following information is for consideration of a Class 3: Advanced Life Support Non -Transport
Certificate of Public Convenience and Necessity (COPCN) for the City of Naples Fire -Rescue
Department. The goals and objective of this request is to document that the City of Naples Fire -
Rescue Department meets the requirements specified in the Collier County, Florida Code of
Ordinances, Chapter 50 — Emergency Services.
The quintessential objective of pre -hospital care is to quickly respond to an emergency, provide
enough resources to effectively stabilize a patient and continue that care while enroute to a
medical facility. The City of Naples Fire -Rescue Department currently benefits the community by
augmenting the EMS system with both ALS and BLS resources to enhance public safety to those
citizens that are ill or injured. An Engine, Squad, or Ladder often has a quicker turn around and
could be the first unit on scene to begin the patient assessment and provide early interventions.
These same units can be utilized by the EMS transport units to provide additional personnel to
assist with care of unstable patients while enroute to the hospital.
Granting of the COPCN allows the City of Naples Fire -Rescue Department to continually improve
its ability to maintain the highest level of service and plan for what the future may hold for pre -
hospital care. As the COVID-19 pandemic proved, the strain on our medical services can come
from a variety of emergencies. As an example, the City ran a COVID vaccine clinic out of Fire
Station 1. EMS personnel were required to stand by on scene as they were the ones that received
the actual vaccine from the Department of Health. This tied up two county paramedics in
positions that could have been staffed by Fire -Rescue personnel and further strained the entire
County effort to provide care to the residents. The ability of the Fire -Rescue Department to
provide additional personnel and resources for public education, public screening, vaccinations,
etc. could prove to be vital in the future. These improvements bolster and enhance the overall
level of service to the City and the County, via All -Hazards support to our jurisdictional partners
and Collier County EMS.
The addition of a COPCN and an Associate Medical Director specifically working with the Naples
Fire -Rescue Department offers many other avenues for improvement of services for the public.
The Medical Director could assist with training of other City Departments including the Police
Department and the lifeguards at the River Park Aquatic Center. Having intra-city training
opportunities promotes better communication and better outcomes when emergencies occur.
Other areas of improvement include public outreach programs such a Citizen Emergency
Response Teams (CERT), Stop the Bleed, Run -Hide -Fight, community CPR training and other
community heath related programs. As thoroughly discussed in a variety of position statements
from the National Association of EMS Physicians (NAEMSP) and National Association of State EMS
Officials (NASEMSO), direct interaction and education with EMS Physicians and medical direction
is a vital component of education and quality assurance/quality improvement initiatives.
In conclusion, the aim of the COPCN request is to improve our overall service to the residents of
the city, visitors to our area, and to the County as a whole. Each of the aforementioned reason
indicate areas that can be improved and lead to overall community risk reduction. Conversely,

there is no negative impact on the quality or cost of the current EMS system, existing hospitals,
or other health care facilities.

boundaries described previously. The City of Naples Fire -Rescue will provide both Basic
Life Support and Advanced Life Support to all patients encountered through State

of care occurs with Collier County Emergency Medical Services personnel. Fire -Rescue

(5) The training and experience of the applicant
The City of Naples Fire -Rescue Department was founded in 1935. The first Emergency
Medical Technicians were introduced into the system in 1975. We have worked in
coordination with Collier County Emergency Medical Services since that time to provide
both Basic Life Support and Advanced Life Support medical care.
The management staff for Naples Fire -Rescue has over 183 years of medical experience
as either an Emergency Medical Technician or Paramedic. The Executive Staff alone has
116 years combined medical experience. Credentials for the Staff include AHA CPR
Instructor/Provider, AHA Advanced Cardiac Life Support Instructor/Provider, AHA
Pediatric Advanced Life Support Instructor/Provider, Trauma Emergency Casualty Care,
and Tox-Medic.
For the past 7 years medical training for the City of Naples Fire Rescue Department has
been conducted and coordinated through Collier County Emergency Medical Services
by Chief Phillip Pennington. During the past 7 years, Chief Pennington has produced
numerous training programs that have been vetted and approved by the Collier County
Medical Director Dr. Tober or the Deputy Medical Director Dr. Lee. Chief Pennington
has attended numerous Collier County In -Service trainings as both a participant and as

(7) Schedule of rates for services
The City of Naples Fire -Rescue Department is requesting a COPCN for ALS
non -Transport. The Department currently does not charge for these services and has no
plans on changing this policy.
(8) Other pertinent information
The City of Naples Fire -Rescue Department currently works under the Collier County
EMS & Fire Department Common Medical Protocols. Our department will continue to
follow Medical Direction as provided through the Office of Collier County Medical
Director Dr. Robert B. Tober and Dr. Douglas S. Lee. In addition to and in alignment of
Sec. 50-62, the City of Naples has contracted the services of Dr. Benjamin N. Abo to
serve as the Class 3 Operator Medical Director. Dr. Abo will work in cooperatively with
the Collier County's Medical Directors to ensure continuity of care and provide guidance
to the City of Naples Fire -Rescue Department personnel with training, continued
CQI/CQA, certification/re-certification of personnel, performance standards, and
planning of employee health and safety.

The City of Naples Fire -Rescue Department currently provides EMS recertification
training through a combination of State approved online medical courses via Vector
Solutions (Target Solutions) and other in -person training classes. The in -person trainings
are pre -approved by the Office of the Collier County Medical Director with a written
class syllabus. The in -person training has been a combination of courses designed by
the Naples Fire -Rescue Training Chief or programs put together by Collier County EMS
Training Bureau. If it is classes put on during the EMS in-service; Naples Fire -Rescue
Training Chief attends and instructs at the in-service prior to reproducing the material
for Naples Fire -Rescue personnel. Crews on duty, attend the in -person trainings and
these training sessions occur over three consecutive days, once monthly. The
Department has also used company officer lead scenario -based training for review of
protocols. With Vector Solutions (Target Solutions) we also have the capability to
produce training videos that can be issued as mandatory training for all members. This
was one option used, in conjunction with the Collier County Medical Directors and
Collier County EMS, during the COVID pandemic. The attached training outline shows
that there is one monthly EMS based training assigned to all personnel each month. The
total hours can vary from cycle to cycle. However, this training alone always exceeds
the minimum hours of continuing contact hours for recertification of both EMT's and
paramedics. This does not include additional hours via other training courses and in-
service trainings. CPR and ACLS are provided in-house and follow AHA guidelines. All
Fire -Rescue personnel are required to complete CPR training and all paramedic certified
personnel are required to complete ACLS training.

The City of Naples Fire -Rescue currently has forty (40) State certified Paramedics and
Twenty-two (22) State certified Emergency Medical Technicians Department wide.
The City of Naples Fire -Rescue Department currently attends County meetings and
provides information regarding Quality Assurance and Quality Improvement to Collier
County EMS and the Office of the Collier County Medical Director. The addition of an
Associate Medical Director allows continued improvement in these areas by the
Department. The Naples Fire -Rescue Department and Collier County EMS both use
Image Trend for ePCR's and data collection.
The City of Naples Fire -Rescue Department currently attends Collier County EMS
protocol meetings. We will continue to attend these meetings and look forward to
continued collaboration to improve pre -hospital care within Collier County.
The City of Naples Fire -Rescue Department currently conducts in-house EMS orientation
training for all new employees. Employees receive hands on training covering
introduction to the Common Medical Protocols, equipment utilized by the Department,
familiarization with Collier County transport units, operation of the stretcher, HIPPA,
and ePCR writing.

THIS ADDENDUM is made and entered into this 1 day of rC�'l rib a a, ,
2022, by and between the CITY OF NAPLES, a Florida municipality, hereinafter referred to as
the "City", and Dr. Benjamin Abo, hereinafter referred to as "Contractor", concerning that certain
agreement entitled Engagement Letter dated the 101h day of March, 2022 ("Agreement").
WITNESSETH:
WHEREAS, Section 119.0701, Fla. Stat., requires that certain public agency contracts
must include certain statutorily required provisions concerning the contractor's compliance for
Florida's Public Records Act; and
WHEREAS, Section 768.28, Fla. Stat., sets forth certain mandatory limitations on
indemnification and liability for Florida public agencies; and
WHEREAS, Florida law requires that public agency contracts be subject to non -
appropriation and thereby contingent upon appropriation during the public agency's statutorily
mandated annual budget approval process; and
WHEREAS, Section 448.095, Fla. Stat., imposes certain obligations on public agencies
with regard to the use of the E-Verify system by their contractors and subcontractors; and
WHEREAS, Section 287.135, Fla. Stat., provides restrictions on local governments
contracting with companies that are on certain Scrutinized Companies lists 00

NOW, THEREFORE, in consideration of the covenants set forth herein, the parties agree a)
to this addendum as follows: 21
1. Amendment. This Addendum hereby amends and supplements the terms of the
Agreement. In the event of a conflict between the terms of the Agreement and terms of this
Addendum, the terms of this Addendum shall prevail.
2. Public Records Compliance. Contractor agrees that, to the extent that it may "act
on behalf' of the City within the meaning of Section 119,0701(1)(a), Florida Statutes in providing
its services under this Agreement, it shall:
(a) Keep and maintain public records required by the public agency to perform the
service.
(b) Upon request from the public agency's custodian of public records, provide the
public agency with a copy of the requested records or allow the records to be
inspected or copied within a reasonable time at a cost that does not exceed the cost
provided in this chapter or as otherwise provided by law.

(c) Ensure that public records that are exempt or confidential and exempt from public
records disclosure requirements are not disclosed except as authorized by law for
the duration of the contract term and following completion of the contract if the
contractor does not transfer the records to the public agency.
(d) Upon completion of the contract, transfer, at no cost, to the public agency all public
records in possession of the contractor or keep and maintain public records required
by the public agency to perform the service. If the contractor transfers all public
records to the public agency upon completion of the contract, the contractor shall
destroy any duplicate public records that are exempt or confidential and exempt
from public records disclosure requirements. If the contractor keeps and maintains
public records upon completion of the contract, the contractor shall meet all
applicable requirements for retaining public records. All records stored
electronically must be provided to the public agency, upon request from the City's
custodian of public records, in a format that is compatible with the information
technology systems of the City.
(e) Pursuant to Section 119.0701(2)(a), Fla. Stat., IF THE CONTRACTOR
HAS QUESTIONS REGARDING THE APPLICATION OF
CHAPTER 119, FLORIDA STATUTES, TO THE
CONTRACTOR'S DUTY TO PROVIDE PUBLIC RECORDS
RELATING TO THIS CONTRACT, CONTACT THE

3. Public Records Compliance Indemnification.' Contractor agrees to indemnify E
and hold the City harmless against any and all claims, damage awards, and causes of action arising L.0
from the contractor's failure to comply with the public records disclosure requirements of Section

119.07(1), Florida Statutes, or by contractor's failure to maintain public records that are exempt
or confidential and exempt from the public records disclosure requirements, including, but not
limited to, any third party claims or awards for attorneys' fees and costs arising therefrom. a,
Contractor authorizes the public agency to seek declaratory, injunctive, or other appropriate relief
against Contractor in Collier County Circuit Court on an expedited basis to enforce the a
requirements of this section.
4. Compliance/Consistency with Section 768.28, Fla. Stat. Any indemnification or
agreement to defend or hold harmless by City specified in the Agreement shall not be construed
as a waiver of City's sovereign immunity, and shall be limited to such indemnification and liability
limits consistent with the requirements of Section 768,28, Fla. Stat. and subject to the procedural
requirements set forth therein. Any other purported indemnification by City in the Agreement in
derogation hereof shall be void and of no force or effect.
5. Non -appropriation. The City's performance and obligation to pay under this
Agreement is contingent upon an appropriation during the City's annual budget approval process.
If funds are not appropriated for a fiscal year, then the Contractor shall be notified as soon as is
practical by memorandum from the City Manager or designee that funds have not been
appropriated for continuation of the Agreement, and the Agreement shall expire at the end of the

fiscal year for which funding has been appropriated notwithstanding any automatic renewal as may
be provided in the Agreement. The termination of the Agreement at fiscal year-end shall be without
penalty or expense to the City, subject to the City paying all invoices for services rendered during
the period the Agreement was funded by an appropriation.
6. E-Verify Compliance. Contractor affirmatively states, under penalty of perjury,
that in accordance with Section 448.095, Fla. Stat., Contractor is registered with and uses the E-
Verify system to verify the work authorization status of all newly hired employees, that in
accordance with such statute, Contractor requires from each of its subcontractors an affidavit
stating that the subcontractor does not employ, contract with, or subcontract with an unauthorized
alien, and that Contractor is otherwise in compliance with Sections 448.09 and 448.095, Fla. Stat.
7. Compliance/Consistency with Scrutinized Companies Provisions of Florida
Statutes. Section 287.135(2)(a), Florida Statutes, prohibits a company from bidding on,
submitting a proposal for, or entering into or renewing a contract for goods or services of any
amount if, at the time of contracting or renewal, the company is on the Scrutinized Companies that
Boycott Israel List, created pursuant to section 215.4725, Florida Statutes, or is engaged in a
boycott of Israel. Section 287.135(2)(b), Florida Statutes, further prohibits a company from
bidding on, submitting a proposal for, or entering into or renewing a contract for goods or services
over one mullion dollars ($1,000,000) if, at the time of contracting or renewal, the company is on
either the Scrutinized Companies with Activities in Sudan List or the Scrutinized Companies with
Activities in the Iran Petroleum Energy Sector List, both created pursuant to section 215.473,
Florida Statutes, or the company is engaged in business operations in Cuba or Syria.
Accordingly, Contractor hereby certifies that Contractor is not listed on any of the w
following: (i) the Scrutinized Companies that Boycott Israel List, (ii) Scrutinized Companies with
Activities in Sudan List, or (iii) the Scrutinized Companies with Activities in the Iran Petroleum 00
Energy Sector List. Contractor further hereby certifies that Contractor is not engaged in a boycott N
of Israel or engaged in business operations in Cuba or Syria. Contractor understands that pursuant
to section 287.135, Florida Statutes, the submission of a false certification may subject Contractor
to civil penalties, attorney's fees, and/or costs. Contractor further understands that any contract

condition of this Agreement, each Party hereby irrevocably and unconditionally: i) consents to
submit and does submit to the jurisdiction of the Circuit Court in and for Collier County, Florida
for any actions, suits or proceedings arising out of or relating to this Agreement.

Please accept this proposal for emergency services medical director consulting from
Dr. Benjamin N. Abo for the City of Naples.
The City of Naples Fire -Rescue Department when granted a Certificate of Public
Convenience and Necessity by Collier County, to provide advanced life support
services on behalf of the CITY, a medical director will be required. Dr. Abo is qualified
to provide the medical direction necessary to coordinate the advanced life support
services that the City of Naples provides with Collier County's ongoing provision of
emergency medical services as required by Florida Statues Section 401.265.
Dr. Abo will provide these services at a flat rate of $45,000 per contracted year. The
City of Naples will be invoiced $11,250.00 per quarter on or about the last working
day of each quarterly period for services provided during the just -concluded quarter,,
and payments shall be made within thirty (30) calendar days of the date of the
invoice.
Please find attached to this letter, the full scope of services and responsibilities of the
medical director.

It is anticipated that this engagement will be contracted for one year, Any
modification to the terms of this agreement shall be in writing and agreed upon by
the parties.
In the event the City of Naples is no longer licensed by the State of Florida as a
provider of advanced life support services, this engagement shall terminate
immediately.
The affixing signature to this engagement letter and/or provision of a City -issued
Purchase Order will prove as your acceptance of this proposal. Upon return of the
executed engagement letter and receipt of a city issued purchase order, Dr. Abo will
be immediately ready to begin with these services.

Medical Director Proposal
Scope of Services:
The MEDICAL DIRECTOR shall devote at minimum twelve (12) hours per month to
provide medical supervision of City of Naples paramedics and emergency medical
technicians to ensure paramedics and emergency medical technicians become
familiar with and maintain compliance with applicable statutes, rules, standing
operating procedures, standing medical orders, and the application of emergency
medical procedures. The medical director shall maintain accreditation as a licensed
physician in the State of Florida, preferably with privileges at a hospital within the City
of Naples, and shall meet requirements provided by Chapter 401, Florida Statutes
and Chapter 64J-1, Florida Administrative Code.
Duties and responsibilities may include:
Permit or prohibit paramedics and emergency medical technicians from performing
basic and/or advanced life support techniques and make recommendations
regarding the competency of all paramedics and emergency medical technicians that
perform under the medical director's License.
Advise, consult with, train, counsel, oversee, supervise, and assume direct
responsibility for the medical performance of the Emergency Medical Technicians
and Paramedics assigned by Naples Fire -Rescue in providing basic and advanced life
support services to include monthly training sessions in accordance with Florida
Statutes Section 401.265, and the Rules of Florida Department of Health.
Establish a patient care quality assurance committee as required by Section 401.265
(2), Florida Statues to function for the purposes and according to the procedures
stated the rein and by applicable Rules of the Florida Department of Health,
Create disciplinary reports, pursuant to Florida Statute Section 401.265 (2), to be filed
with the Fire Chief or his/her designee for action which documents possible violation
of adopted City of Naples Fire -Rescue policies and rules.
Respond or consult on medically related injuries arising from on-the-job activities of
paramedics and emergency medicine technicians and advise the City of Naples on
questions arising from Occupational Health and Infection Control issues.

Respond to emergency medical calls, with crews, subject to the availability of the
MEDICAL DIRECTOR's time.
Participate in county -wide joint MEDICAL DIRECTOR meeting(s) on behalf of City of
Naples Fire -Rescue to assist in the development of new guidelines and to update
current guidelines. This in no way limits and is furthermore the expectation that the
MEDICAL DIRECTOR develop aggressive, progressive, and innovative City of Naples
Fire -Rescue specific protocols or guidelines.
Serve as City of Naples liaison to the Collier County Medical Society for the purpose
of advising and keeping the Society informed as to current standing medical orders
and patient transport protocols of the City of Naples.
Attend at minimum two State of Florida Emergency Medical Services MEDICAL
DIRECTORs quarterly meetings at the MEDICAL DIRECTOR`s own expense.
Meet regularly with the Fire Chief, Deputy Chiefs, Training Chiefs, EMS Program
Manager(s), and other EMS Training appointees.
On an as -needed basis, and upon request by Collier County, serve as the Assistant
System MEDICAL DIRECTOR of the Collier County Fire Department Services, and if
the Collier County System MEDICAL DIRECTOR is unavailable, to assume the role of
Acting System MEDICAL DIRECTOR of the Collier County Fire Department Services,
with the duties and responsibilities of that role. The responsibilities set forth in this
paragraph are opportunities for City of Naples and County MEDICAL DIRECTORs to
work together on an as -needed basis to support the provision of EMS to the Naples/
Collier County area. These responsibilities do not connote any reporting or
hierarchical relationship between the City of Naples and Collier County or between
their MEDICAL DIRECTORs.

TOPIC: EMS and Fire Department responsibilities on suspected crime scenes.
INTENT: Review of calls that can be potential crime scenes and how Fire Department personnel can
preserve evidence while performing their duties.
EQUIPMENT/MATERIALS REQUIRED: Class will be presented be a PowerPoint presentation. If possible,
Naples PD detective will be on hand to present and answer questions.
LECTURE EMPHASIS: The emphasis is to make Fire Department personnel more aware of their
responsibilities when arriving on potential crime scenes. Patient care is a priority, but with as little damage to
evidence as possible.
SKILLS COMPETENCY: The main competency is overall scene and personal awareness, Discussion on
how to recognize potential crime scenes and how scenes could change to a worse case scenario.
CASE STUDIES REVIEWED: No true case studies are addressed in this lecture. However, many crime
scene photos will be reviewed. This will open discussion to attendees to think how they would respond to the
given situation.

The largest portion of the City's net position (76.5%) reflects its investment in capital assets (land, buildings,
plants, and equipment) less outstanding debt used to acquire those assets. The City uses these assets to provide
services to citizens; consequently, these assets are not available for future spending. It is also important to recognize
that other resources will be required to repay the outstanding debt on capital assets. Restricted net position
representing 7.8% of the total net position) is subject to external restrictions on how it may be used. The remaining
21.2% of unrestrited net position, $66.3 million, may be used to meet the City's ongoing obligations to the citizens
and creditors.
The City's combined revenues, including contributions, grants, charges for services and taxes were $125.1 million.
Total expenses, City-wide were $101.3 million. For the total primary government, including both governmental
and business -type activities, net position increased $23.8 million. Net position for Governmental activities
increased by $14.8 million and net position for business -type activities increased by $9.0 million in 2020.

INTERLOCAL AGREEMENT
BETWEEN COLLIER COUNTY AND THE CITY OF NAPLES
CONCERNING A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY
FOR
NON -TRANSPORT ADVANCED LIFE SUPPORT SERVICES
THIS INTERLOCAL AGREEMENT dated this day of , 2022, is entered
into as authorized by Ch. 163, Florida Statutes ("Fla. Stat."), Intergovernmental Programs, by and
between the City of Naples (hereinafter "City") and the Collier County Board of County
Commissioners (hereinafter "County")
RECITALS:
WHEREAS, Section 163.01, Fla. Stat., authorizes the joint exercise of any power,
privilege, or authority which the public agencies involved herein share in common and which each
might exercise separately; and
WHEREAS, the City wishes to obtain a Certificate of Public Convenience and Necessity
("COPCN") for Non -Transport Advanced Life Support ("ALS") Services and the County desires
to execute this Interlocal Agreement outlining the terms and conditions for the issuance of the
COPCN
NOW, THEREFORE, in consideration of the foregoing RECITALS, and the mutual
covenants, promises and other good and valuable consideration set forth in this Interlocal
Agreement, the receipt and sufficiency of which is hereby mutually acknowledged, and with the intent
to be legally bound, City and the County agree as follows:
1. City and the County agree the foregoing recitals, sometimes referred to as "Whereas
Clauses", are true and correct and adopt and incorporate the recitals by reference into this Interlocal
Agreement.

2. The County shall issue the City a COPCN to provide ALS non -transport services
throughout the boundaries of the City on the Effective Date of this Agreement subject to the
following terms and conditions:
a. The City shall retain the services of an Associate Medical Director to serve as the
City's Medical Director working under the County Medical Director and by this
Agreement with the County shall utilize the protocols and standards issued by the
County Medical Director to govern the provisions of advanced life support services
authorized by the COPCN and licensed by the State. There shall be no charge to the
City for these services from Collier County. The City's Associate Medical Director
will assist the City with the implementation of the protocols, standards, training,
and certification/recertification standards established by the County Medical
Director relating to ALS services provided by the City. The Associate Medical
Director or any other medical professional employee and/or volunteer of the City
shall work under the supervision of the County Medical Director. It is
acknowledged by both Parties that the City does not, by this Agreement or any other
agreement or requirement, report to the Collier County Emergency Medical
Services ("EMS") Division or the County, and that all statutory and rule
requirements related to medical direction shall be made directly to the City
Associate Medical Director by the County Medical Director. The County Medical
Director will direct a Collier County EMS liaison to work with the City regarding
training and quality assurance. The County Medical Director, the City Associate
Medical Director, and, if applicable, the Collier County Deputy Medical Director,
shall comply with the provisions of Ch. 119, Fla. Stat., the Health Insurance
Portability and Accountability Act ("HIPAA"), Health Information Technology for
Economic and Clinical Health requirements, and any other federal or state

applicable laws relating to records and/or confidentiality of records. To that end,
the County Medical Director, the Associate Medical Director, and, if applicable,
the Collier County Deputy Medical Director, shall execute a HIPAA Business
Associate Agreement with the City. The County Medical Director may delegate any
or all his responsibilities under this Agreement to the Collier County Deputy
Medical Director.
b. The City shall operate under the Emergency Medical Technicians ("EMTs") and
paramedic credentialing and recredentialing standards issued by the County
Medical Director. The County Medical Director shall develop, with input from the
City's Associate Medical Director, the recredentialing standards for ALS non -
transport paramedics and EMTs on or before October 1, 2022. Notwithstanding,
City paramedics and EMTs credentialed by the County Medical Director prior to
July 1, 2021, shall not be required to be recredential by the County Medical Director
until July 1, 2023. The City's Associate Medical Director will oversee and assure
City Paramedic and EMT recredentialing and credentialing of new employees using
the County Medical Director's standards.
c. The City agrees that any time the circumstances of an incident dictate, or a Collier
County EMS paramedic requests a City paramedic to accompany a patient on the
Collier County EMS ALS transport from scene to hospital regardless of the level
of service, the City paramedic shall accompany the patient to the hospital.
d. The City shall have its own continuous quality assurance and continued quality
improvement program for City paramedics and EMTs as established by the City's
Associate Medical Director in conjunction with the County Medical Director or the
Deputy County Medical Director. The County Medical Director and/or the Deputy

County Medical Director may participate in the City's continuous quality assurance
and continued quality improvement program. The City shall also participate in a
countywide Quality Assurance Committee as established by the County Medical
Director, contingent upon all interested parties entering into a written mutually
agreeable business associate agreement to ensure compliance with the HIPAA
requirements and any other federal or state applicable laws.
e. The City and Collier County shall adhere to the patient care reporting system
requirements that allows for view only access to patient care reports. The City and
Collier County will provide to each other a one -user login account to a view only
patient care report dashboard of the City's/County's Patient Care Reporting System
to be used for continuum of care for a patient, quality assurance and performance
benchmarking. The Parties agree that it shall control the access to, and use of such
patient care reports. The City and Collier County will provide login access to the
City's and County's Patient Care Reporting Systems to the County Medical
Director and Associate Medical Director, with such access protected from
disclosure by the County Medical Director. Both Parties will work cooperatively to
ensure that any necessary third -party providers, such as hospitals and emergency
departments, have view only access to the patient care reports. The Parties shall use
their best efforts to negotiate and enter into any agreements that may be necessary
to meet all lawful requirements, including those related to HIPAA.
3. This Interlocal Agreement shall take effect upon execution by the Parties
('Effective Date"). The Interlocal Agreement will automatically renew for an additional year each
and every March 31, thereafter, unless a Party provides to the other Party written notice to the
contrary no later than January 3 1 " of such year. Notwithstanding, if a COPCN is not issued to the
City, then this Interlocal Agreement shall automatically terminate without further action of the

Parties. The City shall follow all COPCN annual renewal procedures as set forth in Collier County
Ordinance No. 04-12, as it may be amended or otherwise modified. The City shall begin providing
services within thirty days of issuance of a Chapter 401 Fla. Stat. license to provide ALS non -
transport services.
4. Should the City be found to have breached the terms of this Interlocal Agreement
or the COPCN in any way, all written complaints shall be investigated by both the County staff
and the City staff, and a response thereon made to both the Board of County Commissioners and
the Naples City Council, together with findings and recommendations, within 30 days of such
complaint. If termination of the Interlocal Agreement or revocation, suspension, or alteration of
the COPCN appears warranted, the Board of County Commissioners shall give notice to the City
that the same will be considered at the next available county commission meeting. The Board of
County Commissioners shall thereupon consider the complaint and either revoke or suspend the
COPCN, terminate the Interlocal Agreement, suggest alternatives to the COPCN, or dismiss the
complaint. Notwithstanding, this procedure shall be held in compliance with the County's COPCN
Ordinance No. 04-12, § 14, as amended.
5. Should the County or the County Medical Director be found to have breached the
terms of this Interlocal Agreement or the COPCN in any way, all written complaints shall be
investigated by both the County staff and the City staff, and a report thereon made to both the
Board of County Commissioners and the Naples City Council, together with findings and
recommendations, within thirty days (30) of such complaint. If termination of the Interlocal
Agreement or alteration of the COPCN or the Interlocal Agreement appears warranted, the City
shall give notice to the County that the same will be considered at the next available city council
meeting, provided the date of such meeting shall not be less than five (5) days from the date of

notice. The City of Naples Council shall thereupon consider the complaint and either terminate the
Interlocal Agreement or suggest alternatives to the COPCN or the Interlocal Agreement.
6. Notwithstanding anything that may be to the contrary in this Interlocal Agreement,
City and the County agree that either of them (as well as any other persons or entities intended to
be bound) shall, in the event of any breach, retain the right to enforce the terms and conditions of
this Interlocal Agreement.
7. The City and County, shall indemnify and save harmless each other, including all
employees from any loss or damages either may suffer as a result of claims, suits, demands,
damages, losses, fines, penalties, interest, expenses, costs, or judgments, including attorneys' fees
and costs of litigation, arising out of the City's or County's acts or activities taken for the purposes
set forth in this Interlocal Agreement. Neither party shall undertake to settle any lawsuit or
threatened lawsuit that could give rise to an obligation on the other without the prior consent of the
other, such consent to not be unreasonably withheld. The indemnities provided for by this
Interlocal Agreement will extend from the date of this Interlocal Agreement is executed by the last
party for the duration of this Agreement.
8. The parties agree to give each other written notice of any claims filed in connection
with this Interlocal Agreement, within (30) thirty days of the date that either party is aware of such
claim.
9. City and the County acknowledge and agree that this Interlocal Agreement is
intended to and shall be binding upon their respective owners, principals, officials, officers,
employees, former employees, agents, attorneys, representatives, insurers, successors, assigns, and
affiliates.
10. City and the County acknowledge and agree that this Interlocal Agreement is the
product of mutual negotiation and no doubtful or ambiguous language or provision in this
Agreement to be construed against any Party based upon a claim that the Party drafted the

ambiguous provision or language or that the Party was intended to be benefited by the ambiguous
provision or language.
11. This Interlocal Agreement may be amended only by a written instrument
specifically referring to this Agreement and executed with the same formalities as this Agreement.
12. In the event of an alleged breach of this Interlocal Agreement, City and the County
agree that the sole remedy for breach of this Agreement shall be for specific performance of its
terms and conditions or any damages arising from the breach. City and the County further agree
that the sole venue for any such action shall be in the Twentieth Judicial District in and for Collier
County, Florida in Naples, Florida.
13. This Interlocal Agreement shall be governed by the laws of the State of Florida.
The Parties shall attempt in good faith to resolve any dispute concerning this Agreement through
negotiation between authorized representatives. If these efforts are not successful, the Parties shall
utilize the process set forth within the Florida Governmental Conflict Resolution Act, Florida
Statutes, Chapter 164. In the event either party hereto shall institute legal proceedings in connection
with, or for the enforcement of, this Interlocal Agreement, each party shall be responsible for its
costs of suit, including reasonable attorney's fees, at both trial and appellate levels.
14. Should any part of this Interlocal Agreement be found to be invalid, then such
invalid part shall be severed from the Interlocal Agreement, and the remaining provisions of this
Interlocal Agreement shall remain in full force and effect and not be affected by such invalidity
15. Either the County or City may terminate this Interlocal Agreement after providing
written notice of its intent to terminate at least thirty (30) days in advance of the date of termination.
The City's COPCN is revoked on the termination date of this Interlocal Agreement without further
action by the County. This Interlocal Agreement shall automatically terminate if the City is notified

by the Florida Department of Health that its license to provide ALS service has been revoked with
just cause under Ch. 401. Fla. Stat. and associated rules. Upon receipt of such notification, the City
shall inform the County in writing.
16. This Interlocal Agreement is the entire agreement between the parties, and
supersedes all previous oral and written representations, agreements and understandings between
the parties. This Interlocal Agreement supersedes the agreements titled "Interlocal Agreement
Advanced Life Support Partnership Between Collier County and City of Naples" dated September
24, 2013.
17. Prior to its effectiveness, this Interlocal Agreement shall be filed with the Clerk of
Courts for the Circuit Court for Collier County pursuant to Sec. 163.01(2), Fla. Stat. The County
shall file said agreement as soon as practicable after approval and execution by both parties.
