MINUTES OF THE HEARING OF THE
COLLIER COUNTY SPECIAL MAGISTRATE
Naples, Florida, November 4, 2022
LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted
business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative
Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the
following persons present:

The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those
testifying at the proceeding did so under oath.

The Pledge of Allegiance was recited.
Prior to conducting the Hearing, Respondents were given an opportunity to speak with their

Officer Asaro represented the County and testified during an site investigation on April 20, 2022,
and review of historic aeiral photos of the property, he determined a dock had been extended on
the property. On 6/22/22, County Building Official Jonathan Walsh opined the improvement
required a County permit.
Peter Flood, Attorney, and Joshua Erickson were present.
Mr. Flood testified the Respondent acknowledges the violation exists howvever he did not enter
into a stipulation as he is obtaining a building permit on the property and the 30 day timeframe
discussed with the County to abate the violation is not feasible given permits need to be issued
and the construction on the lot completed.
Special Magistrate Neale recommended the parties meet to determine if a Stipulation may be
executed.

Officer Marinos testified he inspected the property on 3/8/22 as the result of a neighbor
complaint. Following a review, on 3/28/22 exotic growth was identified and a violation was
issued. The violation remains as of today.
Michelle Messina testified the area on the property has been the subject of neighbor complaints
