EXECUTIVE SUMMARY
Recommendation to approve a budget amendment to fund the FY2023 Pay and Classification Plan
for the Clerk of the Circuit Court and Comptroller Office in concert with the County's prior Plan
approvals effective October 1, 2022, in the amount of $1,339,300.
OBJECTIVE: For the Board to provide sufficient funds to comply with the Board's pay plan effective
October 1, 2022. To support the Board approved system of compensation, based on principles of public
accountability, external competitiveness, internal equity, relative complexity and responsibility between
classifications, market economic conditions, Clerk's Office financial policies, and appropriate federal,
state, and local laws.
CONSIDERATIONS: While the Clerk's Office was not included in the County's Evergreen Solutions,
LLC study approved by the Board, the study was utilized to create the proposed Clerk's Office Plan and
original FY23 Budget Request. The Clerk's Office Plan has been modified to mirror the salary ranges
recommended by Evergreen that were adopted by the County after the Clerk's Budget was submitted to
the Board. Clerk Office positions were reviewed within the proposed salary structure. A budget
amendment is necessary to fund pay adjustments to the minimums and the varying cost -of -living
increases approved by the Board to address market conditions.
The Clerk is committed to a Plan that makes the Clerk's Office competitive in the market and is in concert
with the County's Plan to attract new employees, retain high -performing employees, and increase
employee performance to ensure continued superior services to the public. The Clerk's Office utilized the
Evergreen Study and other data to slot Clerk titles in the new salary ranges. The Clerk's Office also
followed the County's approved pay plan increases for pay ranges and cost of living adjustments
(COLA).
The Clerk's Office is funded by three different funding sources:
1) County funds, which fund all non -court cost centers and an allocated portion of certain titles in
court cost centers that require statutory funding by the Board.
2) State funds through the Clerk of Courts Corporation (CCOC), which fund all court cost centers
and an allocated portion of certain titles that support the Courts Division in certain non -court cost
center.
3) Recording funds, which self -fund the Recording cost centers and is used to assist in the funding of
other non -court cost centers and Clerk services projects.
Over the past few budget cycles, the CCOC has not increased court budgets to keep pace with increases in
salary and fringe benefits and in fact has significantly reduced the Collier Clerk's budget. For FY2023,
the Clerk requested a court budget of $7.3 million (which was not inclusive of the requested funding
above as it was not known until September 2022). The CCOC reduced the Collier request to $6.5 million
based upon an allocated statewide projection of available revenues. This amount will not cover salary and
fringe benefit costs for local court operations and does not appear to comport to statutory guidelines for
funding.
The Collier Clerk to Court's budget issue has been presented to the CCOC for several years. The Court
budget request has been routinely cut due to other statewide Clerk's Office deficit operations. In FY2022,
that amounted to approximately $1.2 million of mandatory turnback and reduction of Collier Clerk's
Budget to fund other county's court operations. Other Clerk's Offices that are not meeting their required

revenue and/or the state mandated performance standards have received funding from Collier revenues.
The CCOC mandated turnback reduces our available funding and inhibits recruitment and retention
efforts which impacts the services available to the public in Collier County. The state's calculation does
not consider that Collier County has one of the highest cost -of -living and one of the highest population
growths in the state of Florida. The Collier County courts budget per capita is around $14.00, which is
among the lowest for comparable counties.
We are continuing to protest the reallocation of Collier earned funds to other counties. We plan to request
that the Board of County Commissioners join us in supporting changes to legislation or policy that
continues to distribute Collier Revenues to other counties.
GROWTH MANAGEMENT IMPACT: None.
FISCAL IMPACT: The estimated cost of the associated pay plan and cost of living adjustments to base
pay is $1,339,300 for FY2023 starting with the first full pay period in the fiscal year effective October 1,
2022. The breakdown for funding is:
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
