EXECUTIVE SUMMARY
Recommendation to approve and execute documents necessary for the conveyance of a Utility Easement for
potable water and wastewater infrastructure on County owned property to service the future Collier County
Resource Recovery Business and Government Operation Business Park (GOBP), to the Collier County
Water -Sewer District, at a cost not to exceed $200.
OBJECTIVE: To convey a Utility Easement and Utility Facilities Warranty Deed and Bill of Sale to the Collier
County Water -Sewer District (District) for potable water and wastewater infrastructure installed on County owned
property.
CONSIDERATION: On December 8, 2020 (Agenda Item 11.13), the County entered into the Sixth Amendment to
the Agreement with Manhattan Construction (Florida), Inc. for work for Phase 2.1 and 2.2A at the new Collier
County Sports Complex and Event Center (Project 50156). The construction of the facilities is now nearly complete
and in preparation for the final completion, we must meet the requirements of the District.
The District is the water and wastewater utility service provider in the City Gate area and will be providing water
and wastewater utility service to the future Collier County Resource Recovery Business and GOBP. Recording of
appropriate documents will be done by the Growth Management Department (GMD) once all District requirements
have been met for Preliminary Approval.
A location map is attached for reference.
FISCAL IMPACT: Funds in the amount of $200 for recording of the Utility Easement and Utility Facilities
Warranty Deed and Bill of Sale are available in the project budgets within Sports Complex Capital Fund (370).
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this
action.
LEGAL CONSIDERATIONS: The conveyance documents have been reviewed and approved for form and
legality and requires a majority vote for Board action. - RTT
RECOMMENDATION: That the Board:
Approve and authorize the Chairman to execute the documents necessary for the conveyance of the
utility facilities, including the attached Utility Easement, Utility Facility Warranty Deed and Bill of
Sale, and Owner's Affidavit.
2. Acting as Ex-Officio the Governing Board of the District to accept the attached Utility Easement; and
3. Direct the County Manager or his designee to proceed to follow all appropriate closing procedures and
to record the aforementioned documents in the Public Records of Collier County, Florida.

THIS UTILITY EASEMENT, made and entered into this day of

BEFORE ME, the undersigned authority, personally appeared WILLIAM L. MC
DANIEL, JR_ who to me is well known, and having been duly sworn and under oath,
deposes and states�
1. My name �s WILLIAM L. MCDANIEL, JR., I am over the age of twenty-one (21)
years, am suijuris, and have personal knowledge of the facts asserted herein.
2. COLLIER COUNTY is the owner of said real property located at 3952 City Gate
Blvd N and known as the Sports Complex and Events Center, and described on
Exhibit A, which shows the location of the subject utility facilities being conveyed.
3. All persons, firms, and corporations, including the general contractor, all laborers,
subcontractors and sub -subcontractors, materialmen and suppliers who have
furnished services, labor or materials according to plans and specifications, or extra
items, used in the construction, installation and/or repair of potable water and
wastewater utility system(s) or portion(s) thereof on the real estate hereinafter
described, have been paid in full and that such work has been fully completed and
unconditionally accepted by the current owner of such facilities.
4. No claims have been made to the owner, nor is any suit now pending on behalf of
any contractor, subcontractor, sub -subcontractor. supplier. laborer or material -men,
and no chattel mortgages or conditional bills of sale have been given or are now
outstanding as to the subject utility system(s) or portion(s) thereof placed upon or
installed in or on the aforesaid premises.
5. Title to the subject utility system(s) or po�tion(s) thereof and/or easement(s), if any.
being conveyed to the County is not encumbered by any recorded mortgage,
recorded assignment of rents or profits, by any recorded Uniform Commercial Code
Financing Statement, or by any other recorded document that imposes a security
interest that could negatively affect conveyance of marketable title to the utility
system(s) or portion(s) thereof and/or any easement being conveyed to the County.
6. As and on behalf of the owner of the subject utility system(s) or portion(s) thereof,
does for valuable consideration hereby agree and guarantee, to hold the Board of
County Commissioners of Collier County, Florida. as the governing body of Collier
County and as the Ex-Officio Governing Board of the Collier County Water -Sewer
District harmless against any lien, cla�m or suit by any general contractor,
subcontractor, sub -subcontractor, supplier, mechanic, material -man, or laborer, and
against chattel mortgages, security interests or repair of the subject utility system(s) or
portion(s) thereof by or on behalf of Owner. Affiant is used as singular or plural, as
the context requires.
