OBJECTIVE: To award a construction contract for the safety, capacity, and operational improvement project "Corkscrew Road at Wildcat Drive," to OHLA USA, Inc. CONSIDERATION: This project reconstructs the 90-degree curve on Corkscrew Road in the northwestern part of the County. County staff and consultants worked together to re -design the curve to improve safety. The County is also receiving funding from the Florida Department of Transportation ("FDOT") to construct these improvements. On June 7, 2022, the Procurement Services Division posted ITB No. 21-7932, Corkscrew Road at Wildcat Drive, and County received the following four bids summarized below on July 12, 2022. Staff determined that OHLA USA, Inc. ("OHLA"), a Miami - Dade County company, is the lowest responsive and responsible bidder. The Engineer of Record, Agnoli, Barber and Brundage, Inc., evaluated OHLA's references and found them acceptable to determine OHLA's experience on work of a similar magnitude judged within the last two years, to evaluate their skill, business standing, and ability to conduct the work as completely and timely as required under the Agreement. OHLA has performed work in Lee and Hendry counties primarily performing demo, earthwork, paving, and concrete construction and the firm appears reputable with a good work history and construction results. OHLA has been doing business in the Florida since 2005. OHLA's bid is 74% above the County's original $1,211,784 engineer's opinion of probable cost ("OPC") developed in March of 2021. Due to the recent economic downturn, which resulted in a sharp rise in inflation and a general shortage of material, the County requested a revised OPC. The revised OPC was based on more recent bid history and came in at $2,045,820, which was more in line with bids for this project. The Procurement Services Division concluded bidding was competitive and representative of market conditions. The bid tabulation, Engineer's Letter of Recommended Award, the Notice of Recommended Award, and proposed agreement are all attached. FISCAL IMPACT: The total funding required for this contract is $2,103,968,10. Funding in the amount of $2,048,180.75 is currently available within the Growth Management Grant Fund (711), Growth Management Match Fund (712), and Road Construction Gas Tax Fund (313). A budget amendment in the amount of $55,787.35 is needed to reallocate funds within Gas Tax Fund (313) to award the construction contract. The funding sources for this project are grant funds from Federal Highway Authority (FHWA); whereby, these grant dollars are passed through the FDOT via the LAP agreement and gas tax revenue. ("Engineer of Record" or "EOR") has completed our review of Collier County's analysis of the quotes received for this project, and we are pleased to provide the following award recommendation. The scope of the Corkscrew Road at Wildcat Drive project is the construction of improvements at Corkscrew Road and Wildcat Drive. The following four contractors submitted bids for consideration: • Ajax Paving Industries of Florida, LLC • OHLA USA, Inc. • Quality Enterprises USA, Inc. • Wright Construction Group, Inc. Upon review of the bids, it was determined by Collier County that the bid for Ajax Paving Industries of Florida, LLC was considered non -responsive because of missing required documents. However, since Ajax Paving Industries of Florida, LLC, had the highest bid, this did not affect the determination of the low bidder. Based on the bid tabulation provided by Collier County Procurement Services, the apparent low bidder was OHLA USA, Inc., with a bid of $2,103,968.10, which is approximately 74% higher than the original Engineer's Opinion of Probable Coast (OPC) of $1,211,784 which was prepared more than a year earlier in March 2021. There were a couple of items that were bid very low versus the other bidders and the OPC. A phone conference was held on 8-10-2022 to make sure OHLA USA, Inc. was aware of the work involved with these items and that they would be able to provide the items at their bid price. OHLA USA, Inc. indicated that they would be able to provide these items and provided the following written response via e-mail "As requested at our conference call of this morning, OHLA-USA confirms the bid unit price for the items listed below and compliance with the contractual requirements of the subject project." References were provided by OHLA USA, Inc. for five projects, and the Vendor Reference Check Logs which were completed by each reference are attached hereto. Note that the names provided for the two Lee County projects were procurement personnel, who were not able to complete the reference forms. FOR reached out to Lee County DOT for the appropriate person to complete these forms. All Vendor Reference Check Logs The project references provided by OHLA USA, Inc., contain sufficient relevant experience with similar projects to demonstrate the required successful experience to complete the project. OHLA USA, Inc., a Delaware corporation, registered as a Foreign Corporation in Florida in 2005 under the name of OHL USA, Inc. In 2021, the corporate name was changed to OHLA USA, Inc. Its principal place of business is listed in Flushing, New York, with a mailing address in Miami, Florida. OHLA USA, Inc. appears to be in good standing with the State of Florida. OHLA USA, Inc. is registered with the Florida Department of Business and Professional Regulation as a Construction Business with Manuel Aguiar and Bernardo Perez as the Primary Qualifying Agents for Business. In addition, both Qualifying Agents are Certified General Contractors, both of which registrations are current and active. We, the Engineer of Record, do not have previous project experience with OHLA USA, Inc. However, based on the types of projects and favorable performance reviews provided on the Vendor Reference Logs and its licensing, it appears that it is a qualified firm to conduct the requested work.
