I. CALL TO ORDER
The Meeting was called to order by the Honorable Special Magistrate Brenda Garretson
at 9:00 AM. All those testifying at the proceeding did so nnder oath.
A. Hearing Rnles and Regulations were given by Special Magistrate Garretson. Special
Magistrate Garretson noted that, prior to conducting the Hearing, the Respondents were
given an opportunity to speak with their Investigating Officer for a Resolution by
Stipnlation; looking for compliance without being pnnitive.

II. APPROVAL OF AGENDA
Arlene Harper, Code Enforcement Administrative Secretary, proposed the following changes:
(a) Under Item IV (A), "Motion for Continuance," the violation address of 182 Sunset Cay

all required permits to make repairs to the structure, to obtain all required inspections

$250.00 per day will be imposedfor each day the violation remains thereafter unless
altered by a subsequent Stipulation or Order of the Special Magistrate.

The Investigator stated the rental registration had not been renewed.
The Special Magistrate noted the Respondent had submitted a letter containing defenses
to the Notice of Violation. The Special Magistrate read the following into the record:
"I first want to apologize for not being able to attend this morning's
hearing. We reside in Boston, Massachusetts. I have left several
messages for Investigator H. Box and have never heard back from him.
I finally reached Susana Capasso and she suggested that] write this
letter. ] purchased this condo back in 1998, and had with the rental
department over at Naples Bath and Tennis until new owners took over
the clubhouse and went through the roof with their rental fees and

cleaning fees to a point where it makes no sense for us to keep it with
them and our membership to the Club. This year we have decided not
to join the Club and have taken our condo out of their rental pool.
My father has retired from the Weymouth Massachusetts Fire Department
and will spend the winters in Naples at the condo. Our immediate family
will be using the condo and we no longer will be renting it out. What we
need to do to stay in compliance with Collier County is what we will do.
Please let me know what I need to do next."
The Special Magistrate inquired as to the date the letter was received.
Investigative Supervisor Susana Capasso stated the letter had been emailed to her by
the Respondent on September 6,2007. She stated she spoke with the Respondent within
the two days prior to the Hearing.
When the Special Magistrate inquired as to when the Respondent ceased renting out the
unit, Investigative Supervisor Capasso stated the Respondent had not mentioned a specific
date.
The Special Magistrate determined that the violation had been abated.
Finding the Notice of Hearing had been properly served, and finding the violation
did exist but was CORRECTED prior to the Hearing, the Respondent was found
GUILTY of the alleged violation(s) and was ordered to pay to pay Operational Costs
incurred during the prosecution of this case in the amount of $251.60 on or before
October 7, 2007.
Investigator Box asked if the Respondent would still need to register the condo as a
rental unit because it was going to be occupied by individuals other than the owners.
The Special Magistrate read the following portions from Section 7, Subsection I of the
Rental Registration Ordinance into the record:
"When any dwelling unit is occupied by someone other than the
owner for any portion of a calendar year, a rebuttable presumption
arises that the dwelling unit is a rental unit. The presumption may
be rebutted by evidence that the occupancy of the dwelling unit is
due to housekeeping, babysitting, pet-sitting, or the like."
The Special Magistrate determined since the condo was presently vacant, the terms of
the Ordinance did nol apply in this situation.

GUILTY of the alleged violation(s) and was ordered to pay a civil fine in the amount
of $500.00 on or before October 7,2007, unless altered by a subsequent Stipulation
or Order of the Special Magistrate.
The Respondent was also ordered to mow the property on or before September 14,
2007, or afine of $50. 00 per day will be imposed for each day the violation remains
thereafter unless altered by a subsequent Stipulation or Order of the Special Magistrate.

The Investigator stated the property has been abandoned and is in foreclosure.
The Investigator introduced six photographs which were marked as County Composite
Exhibit "A" and admitted into evidence.
The Investigator stated the property and the Courthouse had been posted.
The Special Magistrate stated the pool is considered an "attractive nuisance" and concurred
the issue was health, safety and welfare.
Finding the Notice of Hearing had been properly served, the Respondent was found
GUILTY of the alleged violation(s) and was ordered to install a temporary safety
barrier by the end of business on September 7, 2007. If the Respondent is unable
to comply, the County will abate the violation by contractor bid-out and will assess
the cost to the Respondent.
The Respondent was also ordered to obtain a Collier County building permit, all
required inspections, and a Certificate of Occupancy for a permanent barrier on or
before October 7, 2007, or afine of$IOO.OO per day will be imposed for each day the

unable to contact the owners of the property even though he left several notices at their
residence.

The Investigator stated he was told by the tenants that the property owners had instructed
them to deny access to the property to any Code Enforcement representative. He further
stated he left several notices at their owner's residence but they did not respond.
At the request of the Special Magistrate, Assistant County Attorney Jeff Wright examined
the statutory definition of "repeat violation" and stated was provision-specific, not address
specific.
He introduced a fax from the City of Naples Utilities stating the water meter at the residence
had been locked since March, 2007 with attached Work Order which was marked as County
Composite Exhibit "A" and admitted into evidence.
Finding the Notice of Hearing had been properly served, the Respondents were
Found GUILTY of the alleged violation(s} and were ordered to pay a civil fine in
the amount of $5,000 on or before October 7, 2007, unless altered by a subsequent
Stipulation or Order of the Special Magistrate.
The Respondents were further ordered to restore water service to the property on or
