These additional services are based on a scope of work addition requested by the Collier County Growth Management Department, Transportation Engineering Division, required to complete the Collier III — Phase II Project Design and Permitting, and Bid the Project as a Design -Bid -Build Project. This Scope of Services addresses the following: Preparation of 60%, 90%, 100% and Bid Phase Plans to allow the 4 to 6-Lane Widening Project to be Bid as a Design -Bid -Build Project. Task 4 — Preparation of Bid Plans, Quantities and Estimates Consultant will prepare a Bid Set of Plans, Quantities, Estimates and Specifications - Modify/update the 100% plans to reflect County comments on 100% Submittal. • Bid Tabs will be Prepared • "Exhibit I" will be Prepared to reflect project requirements/opportunities/constraints Task 5 - Bridize Plans (1) - Main Golden Gate Canal Consultant will prepare necessary Plans, Details, Calculation Quantities and Cost Estimates for the proposed bridge replacement of the Collier Boulevard Bridge over the Main Golden Gate Canal Coordination with SFWMD — BCB will be required to obtain concurrence/approval of Bridge Length, Width, Profile, Clearance, Abutment Treatments and Canal modifications. It is assumed a separate Meeting(s), up to 2, will be required. Bridge Typical Section will consist of 3 Lanes in each direction plus dual left turn lanes in Southbound direction of City Gate North Intersection. Bike Lanes will be continuous across the bridge (As a 5 ft - 6-inch Shoulder) A Pathway will continue across the Bridge on the west side to connect to existing pathway on south side and planned pathway on north side. Bridge Development Report will be prepared for Main Golden Gate Canal Bridge Bridge Hydraulic Report will be prepared for Main Golden Gate Canal Bridge A Bridge No. (New) will be required from FDOT Bridge Plans will be submitted as part of the 60%, 90%, 100% and Bid Plan Milestones Note: There will be NO Sidewalk/Pathway on the east side of the Bridge per Collier County direction. Note: Due to existing geometric constraints — a Continuous 4.0 ft Vertical Clearance will not be possible. Consultant will meet with SFWMD-BCB to obtain a variance to this requirement. Note: Construction Phasing • A 2 Phased Construction of the Bridge will be required due to requirement to keep Collier Boulevard operational at all times and limited available ROW for temporary bridge. • Maintenance of Traffic During Construction will restrict Collier Boulevard to 1 Lane in Each Direction during Certain Phases. PAGE 7 OF 15 ��0 LID Task 6 - Bridge Plans (2) — CR 951 Canal at 27t' St SW Consultant will prepare necessary Plans, Details, Calculation Quantities and Cost Estimates for the proposed bridge replacement of the 27th Street Bridge over the CR 951 Canal. It is assumed the "structure" will be a 3-Sided Box Culvert with a bottom slab (Similar in dimensions to the Green Boulevard Structure built during Phase I). Retaining Walls will be required due to proximity to Collier Boulevard, 39th Street existing utilities and required geometry. Coordination with SFWMD — BCB will be required to obtain concurrence/approval of Bridge Length, Width, Profile, Clearance, Abutment Treatments and Canal modifications. It is assumed a separate Meeting(s), up to 2, will be required. Bridge Typical Section will consist of 1 EB receiving lane, 1 WB left lane, 1 WB combination Thru/Left Lane, I Right Lane. A WB bike lane (4 ft) will also be provided. Sidewalks will be provided on north and south side of bridge/culvert. Bridge shall align with entrance to Golf/Entertainment Facility on west side of Collier Blvd. Bridge Development Report will be prepared for 27th Street Bridge over the CR 951 Canal Bridge Hydraulic Report will be prepared for 27th Street Bridge over the CR 951 Canal A Bridge No. will be required from FDOT Bridge Plans will be submitted as part of the 60%, 90%, 100% and Bid Plan Milestones Task 7 - Bridge Plans (3) - Pedestrian Bridge (Truss) at Golden Gate Pkwy Consultant will prepare necessary Plans, Details, Calculation Quantities and Cost Estimates for the proposed Pedestrian Bridge over the CR 951 Canal at Golden Gate Parkway. It is assumed the "structure" will be a Truss Structure similar to the existing Pedestrian Bridge Constructed on Collier Boulevard (As part of Collier II) just south of Forest Glen. Structure will be located on the north side of Golden Gate Pkwy Intersection. Retaining Walls will be required due to proximity to Collier Boulevard, 39th Street existing utilities and required geometry. Coordination with SFWMD — BCB will be required to obtain concurrence/approval of Bridge Length, Width, Profile, Clearance, Abutment Treatments and Canal modifications. It is assumed a separate Meeting(s), up to 2, will be required. Bridge Typical Section will consist of 1 8-foot Clear Width Structure. Bridge will provide access from proposed pathway on east side of CR 951 Canal, across the canal to align with cross walk along the north side of the Golden Gate Pkwy Intersection. Bridge will be constructed on a Skew due to vertical clearance and geometry requirements/limitations Bridge Plans will be submitted as part of the 60%, 90%, 100% and Bid Plan Milestones Task 8 - Utility Design - 30 Inch/36 Inch Non -Potable Water (PCCP) - City of Naples Consultant will prepare necessary Plans, Details, Calculation Quantities and Cost Estimates for the proposed redesign of the existing 30 Inch/36 Inch Non -Potable Water Main over the CR 951 Canal PAGE 8 OF 15 Go0 110 at Golden Gate Parkway. A limited relocation along 39t" St SW will also be required. Proximity of existing County 36 Water Main shall be considered during relocation design. Task 10 - Permitting - SFWMD (ERP) - FDEP (State 404) Construction of the Collier Boulevard III — Phase II Project requires approval from Permitting Agencies. PAGE 9 OF 15 110 Previously a South Florida Water Management District (SFWMD) Permit and a U.S. Army Corps of Engineers (ACOE) Permit were obtained The SFWMD Permit (Permit 11-105951-P) will need to me modified to address Project changes being proposed as part of the Final Alignment of Collier Boulevard 6-Lane Widening Project. Note: The current SFWMD ERP Permit 11-105951-P expiration date was extended (on October 15, 2021) and now expires October 9, 2023. The original Army Corp. of Engineers Permit (ACOE — SAJ-2007-04904), was obtained but has an expiration date of 8/19/2020. A request for Permit Extension was prepared prior to expiration and submitted State Assumption became effective as of December 22, 2020. Therefore, the U.S. Army Corps of Engineers (Corps) transferred the pending Collier Boulevard III — Phase II Permit Extension Request to the Florida Department of Environmental Protection (FDEP) for processing. However, attempts to extend the Permit duration were not successful. A new FDEP State 404 Permit will need to be obtained due to the impacts to Other Surface Waters (No Wetland Impacts) It is anticipated that a Public Notice will be required for this Project due to the project changes and construction commencement changes Consultant will be responsible for preparing an ERP Permit Modification. At that time, a FDEP State 404 Permit application (Parts) will also be prepared. The CONSULTANT will prepare and submit a Permit Modification Application to the South Florida Water Management District (SFWMD) staff requesting a five-year time extension to the expiration date. This task includes preparing and submitting responses to two SFWMD requests for additional information, if required. Additional Services will include the following: Consultant will perform environmental surveys, coordinate with County, SFWMD, FDEP and USFWS staff, and prepare necessary modifications to Permit, Submit Permit, Respond to RAI's. Note: Services do not include Permit Fees. Permit Fees will be the responsibility of Collier County. Task 11 - Bus Stop 276 - Site/Civil, Signal (Relocate to across from 20th) Consultant will prepare necessary Plans, Details, Calculation Quantities and Cost Estimates for the proposed redesign of Bus Stop 276 (Northbound) from proximity of 17th Ave SW to across from 20t" PL SW. A Signalized Intersection will be designed as part of the Bus Stop Improvements Improvements to 201h PL SW will be prepared to accommodate the proposed roadway typical section to include a eastbound right turn lane and separate left turn lane. Roadway design along Collier Boulevard and 20th PL SW including Drainage, Lighting and Signing and Marking will be prepared to accommodate improvements A Bus Pullout along Collier Boulevard as well as associated Bus Stop amenities such as Bus Pads (2), Shelters (2), Bike Racks (2) and Trash Bins (2) will be designed. A Retaining wall system will be required along the east side of the Bus Stop facilities due to their proximity in relation to the existing CR 951 Canal. Quantities and Opinion of Probable Cost Estimates will be prepared Coordination with PUED staff will be required. Coordination with SFWMD — BCB will be required to obtain concurrence/approval of Bus Stops within the ROW/Easement. It is assumed a separate Meeting(s), up to 2, will be required. Respond to Bidders Written Questions - Addenda Respond to bidders written questions regarding interpretation and clarification of Contract Documents. The ENGINEER will prepare appropriate addenda in accordance with COUNTY policy and procedures, to be approved by the County Project Manager, and reviewed and issued by the County Purchasing Management Division. Review Bids The ENGINEER shall review submitted bid documents to ensure all quantities and costs are consistent with the Engineers Opinion of Probable Cost. Any significant deviation shall be documented and justified. Construction Phase Services It shall be the responsibility of the Engineer to provide services as requested by the County to help the County administer the construction contract in the manner so as to assure that the project is constructed in reasonable conformity with the plans, specifications, and contract provisions. PAGE 12 OF 15 011 110 Periodic On -site Inspection The Engineer shall provide services to periodically (at the request of the County) monitor the contractor's on -site construction operations and to randomly inspect materials entering into the work as required to assure that the quality of workmanship and materials is such that the project will be completed in reasonable conformity with the plans, specifications, and other contract provisions. The Engineer will not perform daily inspections nor monitor off -site activities and fabrication. The Engineer shall, in general, perform the periodic inspection services in accordance with the County's standard procedures and practices. It is assumed that the County (or County's representative) will perform daily inspections of the Contractor's work. Management Engineering Services The Engineer shall perform the management engineering services (as requested by the County) to help facilitate the activities of the parties involved in accomplishing completion of the project. The Engineer shall provide interpretations of the plans, specifications and contract provisions; to make recommendations to the County to resolve disputes which arise in relation to the construction contract; and to perform periodic surveillance of the contractor's activities. Services include the following: 1. Attend the pre -construction conference with the low bidder. 2. Assist the County with interpretation of the plans, specifications, and contract provisions, the Engineer shall consult with the County when an interpretation involves complex issues or may impact the cost and duration of performing the work. 3. Assist the County with analyzing changes to the plans, specification, or contract provisions and extra work which appear to be necessary to carry out the intent of the contract when it is determined that a change or extra work is necessary and such work is within the scope and intent of the original contract. Recommend such changes to the County for approval. 4. Assist the County with monitoring the project to the extent necessary to determine whether construction activities violate the requirements of the permits. Notify the contractor of any violations or potential violations and require his immediate resolution of the problem. 5. The Engineer shall request, receive, review, reject and/or approve shop drawings, product data and test results to be submitted by the contractor for all pertinent items needed in construction. The Engineer shall review the submittals to determine satisfactory compliance with the project plans and specifications, noting his approval or stipulations. Determine the acceptability, subject to County approval, of substitute materials and equipment proposed by the contractor and receive and PAGE 13 OF 15 ILV 110 review (for general content as required by the specifications) maintenance operating instructions, schedules, guarantees and certificates of inspection which are to be assembled by the contractor in accordance with the contract documents. 6. The Engineer shall attend with the County monthly construction conferences with the contractor, County, and Utility Companies to discuss in detail the requirements and responsibilities for such items as contractor's responsibilities for shop drawings submittal, maintenance of traffic, safety, etc. 7. Upon completion of construction and upon preparing the record drawings from as - built drawings provided by the contractor, the Engineer shall prepare the required certification of completion letters to SFWMD, Florida Department of Environmental Protection (FDEP), and other permitting agencies as required. The Engineer shall conduct the necessary site visits to assess the general progress of the work, to address any design related questions that may arise during construction and to verify the project is being constructed in accordance with the plans and specifications. SUBCONSULTANTS EA — Survey: Additional Survey Services to obtain missing topography and update outdated topography obtained during original design E.2 - Subsurface Utility Engineering (SUE): Consultant will obtain SUE information for Utility Tie-in locations and at certain boring locations to assist with identifying and avoiding existing underground utilities E.3 — Environmental Surveys: Consultant will perform necessary data collection and field surveys for Permitting process. It is assumed a field and acoustical Survey will be required for Florida Bonneted Bat. EA — Geotechnical Survey: Consultant will perform necessary geotechnical surveys required for Pedestrian Bridge Crossing, Signal Poles, Aerial Utility Crossing. There shall be no overtime pay without the COUNTY's prior written approval. B.2.3.1 CONSULTANT shall submit, with each of the monthly status reports provided for under Section B.1.1 of this Schedule B, an invoice for fees earned in the performance of Basic Services and Additional Services during the subject billing month. B.2.4. For Additional Services provided pursuant to Article 2 of the Agreement, if any, the COUNTY agrees to pay CONSULTANT a negotiated total fee and Reimbursable Expenses based on the services to be provided and as set forth in the Amendment authorizing such Additional Services. The negotiated fee shall be based upon the rates specified in Attachment 1 to this Schedule B and all Reimbursable Expenses shall comply with the provision of Section 3.4.1 below. There shall be no overtime pay on Additional Services without the COUNTY's prior written approval. B.2.5. The compensation provided for under Section B.2.1 of this Schedule B, shall be the total and complete amount payable to CONSULTANT for the Basic Services to be performed under the provisions of this Agreement, and shall include the cost of all materials, equipment, supplies and out-of-pocket expenses incurred in the performance of all such services. B.2.6. Notwithstanding anything in the Agreement to the contrary, CONSULTANT acknowledges and agrees that in the event of a dispute concerning payments for Services performed under this Agreement, CONSULTANT shall continue to perform the Services required of it under this Agreement, as directed by the COUNTY, pending resolution of the dispute provided that the COUNTY continues to pay to CONSULTANT all amounts that the COUNTY does not dispute are due and payable. 3. SCHEDULE OF PAYMENTS B.3.1. Notwithstanding anything herein to the contrary, the CONSULTANT shall submit no more than one invoice per month for all fees earned that month for both Basic Services and Additional Services. Invoices shall be reasonably substantiated, identify the services rendered and must be submitted in triplicate in a form and manner required by the COUNTY. B.3.1.1 Payments will be made for services furnished, delivered, and accepted, upon receipt and approval of invoices submitted on the date of services or within six (6) months after completion of contract. Any untimely submission of invoices beyond the specified deadline period is subject to non-payment under the legal doctrine of 1aches" as untimely submitted. Time shall be deemed of the essence with respect to the timely submission of invoices under this Agreement. B.3.2. Invoices not properly prepared (mathematical errors, billing not reflecting actual work done, no signature, etc.) shall be returned to CONSULTANT for correction. Invoices shall be submitted on CONSULTANT's letterhead and must include the Purchase Order Number and Project name and shall not be submitted more than one time monthly. B.3.3. Payments for Additional Services of CONSULTANT as defined in Article 2 hereinabove and for reimbursable expenses will be made monthly upon presentation of a detailed invoice with supporting documentation. B.3.4. Unless specific rates have been established in Attachment 1, attached to this Schedule B, CONSULTANT agrees that, with respect to any subconsultant or subcontractor to be utilized by CONSULTANT for this Agreement or Additional Services, CONSULTANT shall be limited to a maximum markup of five percent (5%) on the fees and expenses associated with such subconsultants and subcontractors. B.3.4.1 Reimbursable Expenses must comply with §112.061, Fla. Stat., or as set forth in the Agreement, be charged without mark-up by the CONSULTANT, and shall consist only of the following items: 110 B.3.4.1.1. Cost for reproducing documents that exceed the number of documents described in this Agreement and postage and handling of Drawings and Specifications. B.3.4.1.2. Travel expenses reasonably and necessarily incurred with respect to Project related trips, to the extent such trips are approved by the COUNTY. Such expenses, if approved by the COUNTY, may include coach airfare, standard accommodations and meals, all in accordance with §112.061, Fla. Stat. Further, such expenses, if approved by the COUNTY, may include mileage for trips that are from/to destinations outside of Collier or Lee Counties. Such trips within Collier and Lee Counties are expressly excluded. B.3.4.1.3. Permit Fees required by the Project. B.3.4.1.4. Expense of overtime work requiring higher than regular rates approved in advance and in writing by the COUNTY. B.3.4.1.5. Expense of models for the County's use. B.3.4.1.6. The CONSULTANT shall obtain the prior written approval of the COUNTY before incurring any reimbursable expenses, and absent such prior approval, no expenses incurred by CONSULTANT will be deemed to be a reimbursable expense.
