Agenda 10/25/2022 Item #11E (An update on the rock crushing activities on the property located at the southeast corner of Santa Barbara Blvd and Davis Blvd)10/25/2022 EXECUTIVE SUMMARY Recommendation to accept an update on the rock crushing activities on the property located at the southeast corner of Santa Barbara Blvd and Davis Blvd (Taormina Reserve MPUD). OBJECTIVE: To provide an update on the rock crushing activities on the property located at the southeast corner of Santa Barbara Blvd and Davis Blvd (Taormina Reserve MPUD). CONSIDERATIONS: On November 8, 2021, the Engineering Inspections team within Growth Management’s Development Review Division placed a Suspension of Work Order on the Taormina Reserve MPUD rock crushing activities due to the denial of the extension of the South Florida Water Management District (SFWMD) Environmental Resource Permit (ERP). Per LDC 10.02.03.D, an approved ERP is required to be submitted to the County prior to development activities. On August 5, 2022, Special Magistrate Patrick Neale heard Code Enforcement Case CENA20220005657 regarding the piles of concrete and debris on the property and ordered the property owner to “abate all violations by removing all unauthorized accumulation of litter to a site designed for final disposal or obtain all required Collier County approvals and permits to allow for the onsite use of these materials within thirty (30) calendar days of the hearing (September 4, 2022).” On September 22, 2022, the property owner received an approved ERP from SFWMD to allow grading and fill on the site. Development Review staff and the County Attorney’s Office met with the property owner, along with his consultants and contractor, for an additional pre-construction meeting on October 17, 2022, to discuss resuming the rock crushing operation with the following stipulations: • The renewal of the Site Development Plan (SDP) is solely for rock crushing, removal of construction debris and site filling activities on the property. • All rock crushing activities must be completed by May 1, 2023. • No additional material shall be imported to the site. • Hours of Crushing: Monday through Friday 8:00 a.m. through 5:00 p.m. No work is authorized on Saturdays, Sundays or holidays. • Water must be maintained on the crusher at all times when the crusher is operating to control dust to the maximum extent. • Maintenance of the silt fence around the construction areas must be in accordance with Collier County LDC requirements. • The visual screening fence shall be maintained and erect around the property at all times. • Grasses and weeds onsite and within the Right-of-Way must be maintained below 18 inches in accordance with the Collier County Code of Ordinances. • Construction debris that cannot be crushed (i.e., rebar, metal pipes, etc.) must be removed from the site periodically and completely removed from the site by the rock crushing deadline of May 1, 2023. Stockpiles of construction debris shall not exceed 8 feet in height from current grade elevation. 11.E Packet Pg. 263 10/25/2022 • Any stockpiling of fill must be done in accordance with the requirements of the Collier County LDC, including screening, slopes and stabilization. • Periodic inspections by County staff will be performed without notice to the property owner or contractor until the rock crushing and debris removal activities are complete. • A weekly monitoring report must be provided to the Director of Development Review. • All activity is subject to any additional stipulations or restrictions directed by the Board of County Commissioners. FISCAL IMPACT: None. GROWTH MANAGEMENT PLAN (GMP) IMPACT: None. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires a majority vote for approval. -JAK RECOMMENDATION: That to accept the update on the rock crushing activities and propose any additional stipulations or restrictions deemed necessary.
