FIRST AMENDMENT TO
AGREEMENT BETWEEN COLLIER COUNTY
AND
HABITAT FOR HUMANITY OF COLLIER COUNTY, INC.
THIS AMENDMENT is made and entered into this day of
2022, by and between Collier County, a political subdivision of the State of Florida
("COUNTY"), and Habitat for Humanity of Collier County, Inc. ("SPONSOR"), a private for -
profit corporation existing under the laws of the State of Florida.
WITNESSETH
WHEREAS, the Fiscal Year 2019-2022 Local Housing Assistance Plan, as amended, was
adopted by the Board of County Commissioners on April 23, 2019, Resolution No. 2019-109 and
further amended; and
WHEREAS, on October 26, 2021, Agenda Item 16.D.6, the County entered into an
Agreement with Habitat for Humanity of Collier County, Inc. to administer the State Housing
Initiatives Partnership (SHIP) New Construction Assistance program; and
WHEREAS, the parties wish to further amend the Agreement to add clarifying language
to allowing pre -award development/construction costs paid if prior to the commencement of the
Period of Performance.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties hereto agree to amend the Agreement as set forth below.

1.5 PERIOD OF PERFORMANCE
SPONSOR services shall begin on October 26, 2021, and end on June 30, 2024. This
project allows for pre -award development/construction costs if incurred prior to the
commencement of the Period of Performance. This Agreement must remain in effect
throughout the development process of the Project and is terminated upon completion of
construction and sale to a CHS referred applicant. SPONSOR is responsible for ongoing
reporting, subject to onsite monitoring, and tenant income qualification activities. In any
event, all services required hereunder shall be completed by SPONSOR prior to June 30,
2024. Any funds not obligated by the expiration date of this Agreement shall automatically
revert to the COUNTY.
The County Manager or designee may extend the term of this Agreement for a period of
up to 180 days after the end of the Agreement. Extensions must be authorized, in writing,
by formal letter to the SPONSOR.

The SPONSOR shall develop and submit to CHS, within 60 days of Agreement execution, a
construction schedule including the following:

completion of sale to referred households.
