FIRST AMENDMENT TO AGREEMENT BETWEEN COLLIER COUNTY
AND
COLLIER COUNTY HOUSING AUTHORITY
THIS AMENDMENT is made and entered into this 27th day of September , 2022, by
and between Collier County, a political subdivision of the State of Florida, ("COUNTY" or
"Grantee") having its principal address as 3339 E. Tamiami Trail, Naples FL 34112, and
"COLLIER COUNTY HOUSING AUTHORITY"a quasi-governmental agency established by
Florida Statutes chapter 421, existing under the laws of the State of Florida, (SUBRECIPIENT)
having its principal office at 1800 Farm Worker Way, Immokalee, FL 34142.
RECITALS
WHEREAS, on January 11, 2022 the COUNTY entered into an Agreement with the
United States Department of Housing and Urban Development (HUD) for a grant to execute and
implement using HOME Investment Partnerships (HOME) Program funds for the Tenant Based
Rental Assistance Program to provide very-low and low income households with rent, electric

utility deposits and/or security deposits for a period up to 24 months.
WHEREAS,the Board of County Commissioners of Collier County(Board)approved the
Collier County Consolidated Plan One-Year Action Plans for Federal Fiscal Years 2019-2020 and
2021-2022 for the HOME Program on June 25, 2019 and June 22, 2021, Agenda Items, 16.D.2.
and 16.D.7.,respectively and the Substantial Amendment dated December 14, 2021,Agenda Item
16.D.8.
WHEREAS, the Parties desire to amend the Agreement to increase funding, update the
UEI number, update component and supporting documentation language, and revise the period of
performance.
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and
valuable consideration,the receipt and sufficiency of which is hereby mutually acknowledged,the
Parties agree to amend the Agreement as follows:

1.3 PERIOD OF PERFORMANCE
SUBRECIPIENT services shall begin on JANUARY 1,2022 and end on JUNE 30, 2025
SEPTEMBER 30, 2023. The term of this Agreement and the provisions herein may be
extended by amendment to cover any additional time period during which the
SUBRECIPIENT remains in control of HOME funds or other HOME assets, including
program income.
No program costs can be incurred until an environmental review of the proposed project is
completed and approved by HUD. Further, the SUBRECIPIENT will not undertake any
activity or commit any funds prior to the HUD environmental clearance of funds and a
CHS Notice to Proceed(NTP) letter.Violation of this provision will result in the denial of
any reimbursement of funds under this Agreement.
The County Manager or designee may extend the term of this Agreement for a period of
up to 180 days after the end of the Agreement. Extensions must be authorized, in writing,
by formal letter to the SUBRECIPIENT.
The duration of the SUBRECIPIENT Agreement is as follows:

1.4 AGREEMENT AMOUNT
The COUNTY agrees to make available F^TT TWENTY �n �
($424,993.00) FOUR HUNDRED THIRTY-ONE THOUSAND FIVE HUNDRED
THIRTY-SEVEN DOLLARS AND SEVENTY-EIGHT CENTS ($431,537.78)for use
by the SUBRECIPIENT, during the term of the Agreement(hereinafter, referred to as the
"Funds"). This Agreement shall remain in effect until all HOME funds and program
income are no longer under the control of the SUBRECIPIENT.
Modifications to the "Budget and Scope" may only be made, if approved in advance, by
the COUNTY. Budgeted fund shifts between line items shall not be more than 10 percent
of the total funding amount and shall not signify a change in scope.Fund shifts that exceed
10 percent of the Agreement amount shall only be made with Board approval.
