EXECUTIVE SUMMARY
Recommendation to direct staff to amend the LDC and Administrative Code to require mailed
notice to abutting residential property owners when a petition for Site Development Plan or Site
Development Plan amendment is filed for commercial property.
OBJECTIVE: To provide notice to abutting residential property owners of development or
redevelopment of commercial property.
CONSIDERATIONS: Commercial property is being developed and redeveloped throughout Collier
County where abutting residential property owners are not aware of the requested action because Site
Development Plan approval is done administratively.
By providing notice of the existence of a petition for Site Development Plan or Site Development Plan
amendment, property owners would be more aware of the impacts to their property and owners would
have an opportunity to discuss the project with the developer before it is final.
Mailed notice could be provided to residential property owners that abut property proposed for
commercial development before or during staff review of a petition for Site Development Plan or Site
Development Plan amendment. It could be limited to commercial property that has not been subject to a
public hearing for commercial development for over one year at time of application for a Site
Development Plan or Site Development Plan amendment or will not be subject to a public hearing prior to
approval of the Site Development Plan or Site Development Plan amendment.
FISCAL IMPACT: The cost of mailing would be borne by the petitioner.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues at this time and requires majority vote for Board approval. -JAK
