Agenda 09/13/2022 Item #16F 6 (Agreement #19-7624 Change Order 3)09/13/2022 EXECUTIVE SUMMARY Recommendation to approve Change Order No. 3 to Agreement No. 19-7624 (Purchase Order 4500212457), Clam Pass Maintenance Dredging, to TSI Disaster Recovery, LLC, in the amount of $41,730.00. OBJECTIVE: To restore tidal exchange to Clam Pass, which is essential to the health of the Clam Bay Natural Resource Protection Area by performing mechanical bypassing and regrading of accumulated sand and restoration of the Clam Pass inlet channel and banks. CONSIDERATIONS: Collier County Ordinance No. 2002-27, as amended, established the Pelican Bay Municipal Service Taxing and Benefit Unit for the purpose of providing street lighting, water management, beach renourishment, ambient noise management, extraordinary law enforcement service and beautification, including but not limited to beautification of recreation facilities, sidewalk, street and median areas, identification markers, and maintenance of conservation or preserve areas. The Pelican Bay Services Division is solely responsible for advising the County on dredging and maintaining Clam Pass and manages such activities for the County. Clam Pass is a small inlet in Collier County that supports tidal flow to the wetland preserve of Clam Bay Natural Resource Protection Area. Maintenance dredging is essential to the health of the system because of the relatively small tidal prism for Clam Bay which is typically at a critical balance between tidal energy and littoral process at the inlet channel. The Florida Department of Environmental Protection Clam Pass maintenance dredging Permit No 0296087-001-JC was modified in 2019 (Permit No. 0296087-007-JN) to incorporate minor updates to the disposal fill template and conditions for work during turtle nesting season. Monitoring of the hydraulic and physical conditions of the Clam Bay system includes continuous water level and tidal data collection at four locations within the bay system. The monitoring of inlet conditions indicated continued high rates of sand accumulation at the south bank of the inlet and progressive channel migration northward. There has been persistent flow of sand from south side of the inlet since sand placement at Clam Pass Park in January 2020. A limited maintenance excavation and grading project was completed in April 2020 to mechanically bypass the sand accumulation at the south side of the inlet and restore the inlet channel to its design template. Additional limited maintenance work was completed in December 2020, which included removal of the sand spit and re-grading the inlet entrance using mechanical equipment. The volume of sand that was relocated within the template was approximately 10,000 cubic yards. Those maintenance events helped restore tidal flow, but the sand continued to encroach upon the inlet channel from the south pushing the channel to the north. On May 28, 2021, staff requested quotes from all current contractors under Agreement No. 19-7624, “Marine Contractor Services,” for proposed maintenance work at Clam Pass that included two options. Option 1 consisted of partial excavation, and Option 2 consisted of a full dredge of the template. Two contractors submitted quotes, which were received and opened by staff on June 11, 2021. Following a unanimous vote on June 28, 2021, the Tourist Development Council authorized an expenditure of Tourist Development Tax funds for Clam Pass maintenance in an amount not to exceed $357,739.80 and made a finding that the item promotes tourism. On July 13, 2021, the Board approved the TDC’s recommendation, and as the lowest responsive and responsible quoter, TSI Disaster Recovery, LLC was issued Purchase Order No. 4500212457 in the amount of $264,000 to perform Option 2, a full 16.F.6 Packet Pg. 2984 09/13/2022 dredge of Clam Pass. At the time of the quote and based on surveys performed in May 2021, the estimated total volume of sand was approximately 11,000 cubic yards for a full dredge. Pre-construction surveys indicated that site conditions had changed by the start of construction on February 22, 2022. Final Completion occurred on April 29, 2022. Post-construction surveys confirmed that the total volume of sand dredged from the Pass and placed and graded on the beach was more than was estimated in the quoting documents by approximately 62% - from 11,000 cubic yards to 17,442 cubic yards. As a result, the total cost of the full dredge increased by 15.81% or from $264,000.00 to $305,730.00. That dollar amount is based upon the unit cost prices established in TSI’s proposal (based upon the estimated quantities), plus the actual cost for the additional task involving a beach tilling Work Directive. Effective July 21, 2022, staff issued Stop Work Order to pause the contract time (to avoid the expiration of the Purchase Order), until the Board could consider staff’s recommendation to approve the attached Change Order No. 3 to TSI Disaster Recovery, LLC to increase Purchase Order No. 4500212457 by $41,7303 or 15.81%. When the Stop Work Order is lifted there will be eight days remaining on the project/contract duration. Staff is requesting that the Board approve Change Order #3 to TSI Disaster Recovery in the amount of $41,730.00 using non-Tourist Tax monies available in MSTU General Fund 111, Clam Bay Ecosystem Cost Center 183801. For informational purposes only, the Pelican Bay Foundation contributed $66,060.00 for 4,404 cubic yards of sand place on the “private” beach and $66,060.00 was deposited into Project 88032.1, Fund 195, Cost Center 183901 for future use. FISCAL IMPACT:. The total cost for Clam Pass maintenance dredging due to TSI Disaster Recovery, LLC, is $305,730.00. $41,730.00 is available in MSTU General Fund 111, Clam Bay Ecosystem Cost Center 183801.
