EXECUTIVE SUMMARY
Recommendation to approve the release of code enforcement liens with an accrued value of
$79,633.22 for payment of $2,793.32 in the code enforcement action titled Board of County
Commissioners v. Dalila Grimaldo in Case No. 2006-37 relating to property located at 324 W Main
St., Immokalee, Florida.
OBJECTIVE: To have the Board of County Commissioners (Board) accept an offer to release code
enforcement liens with an accrued value of $79,633.22 for payment of $2,793.32 in relation to Code
Enforcement Board Case No. 2006-37.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against Dalila
Grimaldo in Case No. 2006-37 for a code violation at 324 W Main St, consisting of improvement of a
property prior to obtaining required permits. The lien was first recorded in the Official Records on
February 5, 2007, at O.R. Book 4178, Page 1507 and then amended and recorded on May 4, 2007, at O.R.
Book 4224, Page 0274. The lien amount of $79,633.22 is based on 395 days of accrued fines ($200 per
day from September 26, 2006, through October 25, 2007) totaling $79,000, plus $633.22 in operational
costs. The property was brought into compliance on October 25, 2007.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment
of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by
an existing owner would be considered for a waiver as long as the existing owner has diligently pursued
abatement and compliance has been achieved. In 2005, Mr. and Mrs. Grimaldo’s only source of income,
the property located at 324 W Main Street, sustained heavy damage from Hurricane Wilma. It took a
substantial amount of time, follow up, and money to obtain permits, demolish and clear the property, to
achieve compliance on October 27, 2007. Over the next few years Mr. Grimaldo’s health began to
decline and in September 2017, Hurricane Irma destroyed their homestead. Mr. Grimaldo passed away a
short time later, leaving his wife as sole provider. Mrs. Grimaldo believed that demolishing the building
and coming into compliance at the offending property had relieved her of the fines. She only became
aware of the lien while applying for assistance through Habitat for Humanity to rebuild her homestead.
The property is being actively maintained and $2,793.32 has been paid in settlement of fines. The owner
is requesting a waiver of $76,839.90 in accrued fines, see attached hardship letter as required. There are
no known violations at this time.
FISCAL IMPACT: Payment of $2,793.32 in settlement of fines and costs has been made. If approved
by the Board, accrued fines in the amount of $76,839.90 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. -CAK
RECOMMENDATION: To waive the fines in the amount of $76,839.90, accept payment amount of
$2,793.32, release the liens, and authorize the Chairman to sign the attached release and satisfaction of
lien for recording in the Official Public Records.

Please consider this email as my letter of hardship in the reduction of fees for my property at the address of 324 W Main
street.
ln 2005 Hurricane Wilma destroyed my only source of income. We tried to save it and rebuild it. Then my husband acquired
an infection in the heart from a previous kidney transplant. He was in and out of the hospital for 3 months or more at a time.
It was hard to make ends meet and still keep up with the property and the mess Hurricane Wilma had created.
During this time we received these letters and we tried to comply with all the requirements that had been set forth by the
code enforcement officer that was assigned to my case and not assess fines. During this time my husband's lungs collapsed
and was placed on life support and on the day we were scheduled to appear in court we were told he was near death and
would probably not make it through the day. Even with this news we, my oldest son and l, appeared in court as this property
was the only livelihood either of us knew.
When we, my oldest son and l, went to court we were told that our property was free and clear of any fines and that since
we had complied with code enforcement requirements that we were free to go. So I left to be with my husband at the
hospital. My husband survived that day but not without being permanently ill. His illness at that time became more severe
and was put permanently on dialysis and had to carry an oxygen tank from then on, During these years I believed the fines
were free and clear, we never received notifications that something was due.
|n2017 hurricane lrma destroyed my house. We continued to live there due to my husband's continued illnesses and to
prevent him from having anxiety episodes. He passed away in August of 2018 of a massive heart attack after a dialysis
treatment. With FEMA applications pending and other programs such as the Salvation Army and Habitat for Humanity began
the process to build me a new house. Because of their requirements they needed to research the liens that were in my
name. I went to the office located at 310 Alachua street lmmokalee, spoke to someone and was told these liens had no fees
due, and had been dismissed and cleared. I was again told that I had no fees due in my name on either property. So again I
wanted these documents to be satisfied and was unable to get clear and proper information. This property has been vacant
for many years. I have kept up with mowing grass and keeping homeless people from making a mess, paying taxes diligently
on time with the assistance of my family. I have no other income other than a Social Security check of SZ8O a month. I have
no way of paying these fines . I am a 67 year old widow and have no choice at this time to plead with you and ask that these
fines be completely waived or reduced. I have S1200 saved and am willing to pay the operational cost of 5633.22 and use
the remaining amount towards my fees but that is all I have and beg of you and your department to accept my payment .
