EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve for
recording the amended final plat of Kaicasa Phase One (Application Number PL20220000198),
approval of the standard form Construction and Maintenance Agreement, and approval of the
performance security in the amount of $4,193,303.40.
OBJECTIVE: To have the Board of County Commissioners (Board) approve for recording the final plat
of the amended final plat of Kaicasa Phase One, a subdivision of lands located in Sections 12 and 13,
Township 47 South, Range 29 East, Collier County, Florida, in accordance with LDC Section
10.02.04.B.4. This procedure allows for the Board to approve the plat and associated construction
documents for construction purposes and recording purposes concurrently.
CONSIDERATIONS: On February 22, 2022, the Board approved the final subdivision plat for Kaicasa,
AR-12767. The developer now wishes to phase the construction over a longer period than the time frames
currently allowed by the LDC and proposes to amend the approved PPL to permit construction of 123
single family homes and supporting infrastructure. The remaining area will be platted as future
development tracts and subsequent PPLA applications will be submitted in the future to plat and develop
additional home sites. These changes necessitate this additional approval by the Board. According to
Section 10.02.04 B.5.b of the Land Development Code, following approval by the Board of the final
subdivision plat, but prior to recordation, the Board may approve amendments to the final subdivision
plat.
The Development Review Division of the Growth Management Department has completed the review of
the construction drawings, specifications, and amended final plat of Kaicasa Phase One. These
documents are in compliance with the County Land Development Code and Chapter 177, Florida
Statutes. This project is within the Kaicasa RPUD, Ordinance 07-34, as amended. All fees have been
paid.
Security in the amount of 10% of the total cost of the required improvements, and 100% of the cost of any
remaining improvements, together with a Construction and Maintenance Agreement for Subdivision
Improvements, shall be provided and accepted by the County Manager or designee and the County
Attorney’s office prior to the recording of the final plat. This procedure is in conformance with Section
10.02.04 F.2 of the Land Development Code.
The Development Review Division recommends that the amended final plat of Kaicasa Phase One be
approved for recording.
FISCAL IMPACT: The project cost is $3,812,094 (estimated) to be borne by the developer.
The cost breakdown is as follows:
a) Water & Sewer $1,253,364
b) Drainage, Paving, Grading $2,558,730
The Security amount, equal to 110% of the
project cost, is $4,193,303.40
The County will realize revenues as follows:
Fund: Growth Management Fund 131
Agency: County Manager
Cost Center: 138327 -- Land Development Services
Revenue generated by this project: Total: $78,261.91

The Review Fees are based on a construction estimate of $2,558,730 (does not include Immokalee Water
and Sewer District) and were paid in March, 2022.
The breakdown is as follows:

GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public
Facilities (COA) prior to the issuance of the construction plan final approval letter and plat rec ordation,
except when the applicant elects to delay obtaining a COA for non-residential developments that are
required to obtain approval of a site development plan prior to the issuance of a building permit.
LEGAL CONSIDERATIONS: The applicant is requesting approval of the final subdivision plat and
construction and maintenance agreement. The Board shall consider the County Manager or designee’s
recommendation and shall take evidence and testimony in regard to the final subdivision plat
requirements identified in LDC sections 10.02.04 B, 10.02.04 C, and other provisions of the LDC, as well
as Chapter 177, Florida Statutes. If the Board denies or places conditions on the final subdivision plat, it
shall state reasons for such denial or conditions.
The original final subdivision plat was approved by the Board on February 22, 2022. In accordance with
the LDC, the applicant is required to submit the final subdivision plat to the County Manager or designee
for recording within 18 months of the date of approval of the final subdivision plat by the Board.
However, following approval by the Board, but prior to recordation, the County Manager or designee may
approve minor insubstantial changes to the subdivision plat, and the Board may approve any changes that
are not minor and insubstantial. The applicant’s proposed changes to the originally approved final
subdivision plat are not considered minor and insubstantial, and therefore this amended final subdivision
plat requires Board approval.
This item has been approved as to form and legality, and requires a majority vote for Board approval. --

RECOMMENDATION: To endorse staff’s recommendation to approve the amended final plat of
Kaicasa Phase One (Application Number PL20220000198), for recording with the following stipulations:
1. Approve the amount of $4,193,303.40 as performance security for the required improvements; or
such lesser amount based on work completed, and as is approved by the Growth Management
Department.
2. Approve the standard form Construction and Maintenance Agreement and direct the County Manager
or designee:
a. To withhold Certificates of Occupancy until the required improvements have received preliminary
acceptance.
b. To delay recording of the plat until suitable security and an appropriate Construction and
Maintenance Agreement is approved and accepted by the County Attorney’s office and the Board

of County Commissioners or the County Manager or designee on behalf of the Board pursuant to
Section 10.02.04 F.2 of the Land Development Code.
