EXECUTIVE SUMMARY
Recommendation for the Board to approve and execute an Agreement with the Florida
Department of Economic Opportunity (FDEO), pursuant to Chapter 380.032(3), Florida
Statutes, pertaining to application of the Big Cypress Area of Critical State Concern
regulations to a parcel owned by an entity wholly-owned by the Seminole Tribe of Florida
and located on U.S. Highway 41 near the Miami-Dade County line.
OBJECTIVE: For the Board to consider approving and executing an Agreement with the
Florida Department of Economic Opportunity.
CONSIDERATIONS: The Big Cypress Area of Critical State Concern (ACSC) regulations
were established in the early 1970s in [what is now] Chapter 28-25, Florida Administrative Code
(F.A.C.), as provided for in Chapter 380.05, Florida Statutes (F.S.). The ACSC regulations were
subsequently adopted into the Future Land Use Element of the Collier County Comprehensive
Plan (a/k/a GMP, Growth Management Plan) as well as the County’s zoning regulations (LDC,
Land Development Code). The ACSC regulations - in F.S., GMP, and LDC - limit the area of a
site that can be impacted (cleared/disturbed) and limit the area of impervious surface (and
include other limitations not germane to this agenda item). Chapter 28-25, F.A.C., provides for a
variance to the ACSC regulations using the local government variance process, so long as the
intent of the regulations is met. The ACSC Overlay in the Future Land Use Element authorizes
an Agreement pursuant to Chapter 380.032(3), F.S., to address the application of the ACSC
regulations. This Agreement effectuates a variance for the subject site.
STOF Holdings LLC f/k/a S.T.O.F Holdings, Ltd., wholly-owned by the Seminole Tribe of
Florida, purchased a 1.84-acre parcel in 2012 within the ACSC located on the north side of US
41 (Tamiami Trail East), approximately 0.6 miles west of the Miami-Dade County line and 0.6
miles north of the Monroe County line, approximately 31 miles east of the intersection of State
Road 29 and US 41 (see Future Land Use Map with subject site denoted). The parcel, which is
not a reservation property, lies within the boundaries of the Big Cypress National Preserve and is
one of just a handful of holdings in this area. The Seminole Tribe intends to develop the site
with a government services building to serve the Tribal population in the surrounding area within
both Collier and Miami-Dade Counties.
The subject property was partially cleared decades ago and developed with one or more
structures. A review of an aerial map from January 1974, the oldest readily available in the
Zoning Division, reveals a structure is present at the same location, and of the same shape and
size, as is present on the site; and, it appears that roughly 50% of the site (southerly one-half) has
been cleared. More recent aerial maps (Collier County Property Appraiser GIS, 2014-2022) show
the structure still in place and the same amount of clearing, though the northwesterly quadrant
contains what appear to be swamp buggy trails.
The proposed Agreement increases the amount of the site that can be impacted by development
as well as contain impervious area beyond that otherwise allowed by the ACSC regulations; it
does not approve the land use itself - that requires conditional use approval (reference companion
item PL20190000360, Conditional Use to allow the development of an Essential Governmental
Services Building (15,000 square feet of floor area under air), including safety services, as

provided by Land Development Code Section 2.01.03.G.2.b.). Please see the below table
identifying the relevant ACSC regulations and the “variances” proposed in the Agreement.

Based upon the totality of the circumstances (historical site alteration, relatively small parcel
size, scarcity of privately owned lands in the area, need for the proposed go vernment services), it
is staff’s opinion that the amount and type of proposed development are reasonable and does not
contravene the intent of the ACSC regulations.
The Agreement, drafted with the assistance of Florida Department of Economic Opportunity
(DEO) staff and legal counsel, is attached to this Executive Summary. DEO staff has indicated
its support of the Agreement and its intent to execute the Agreement, once approved by Collier
County.
FISCAL IMPACT: There are no fiscal impacts to Collier County as a result of approving this
Agreement, other than administrative costs.
GROWTH MANAGEMENT IMPACT: Approval of this Agreement is authorized by State
Statute as well as the Area of Critical State Concern Overlay contained in the Future Land Use
Element of the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality. It requires a
majority vote for approval. [HFAC]
RECOMMENDATION: To approve and execute this Agreement with the Florida Department
of Economic Opportunity.
