I am requesting to speak because I love our community and feel substantive
actions must be taken to ensure its survival! According to a recent article titled,
America's Affordable Housing Problem, the writer concluded that pricing
essential workers out of the community is not only unconducive but will lead to
the eventual failure of the community. Likewise, the writer ascertains that the
problem is worse than we think.
This is my greatest concern for Collier County. While we all agree our community
is special and a great place to live, we can also agree that it is unsustainable
without its workforce. Therefore, to keep our community viable, it is incumbent
upon the County Commissioners to do what is best to sustain our economy by
retaining our workforce. lt is not feasible to continue to provide a high quality of
life for tourists and residents with a deficit in our workforce.
A deficit in one system will lead to deficits in other systems, which will
eventually Iead to a catastrophic collapse of our economy and community. We
must act immediately to address such deficits at the county level and treat
"essential" workers like they are wanted and needed to sustain our community.
The first step is to pass the 6o-Day Ordjnance. Doing so is the most cost-
effective means to help our workforce by guaranteeing they have a little extra
time to find a rental or home that is affordable.
Please explain in detail the action you are asking the Commission to take (attach
additiona I page if necessary):
Again, we are asking the Commission to follow the City of Naples' lead by also
passing the 60-Day ordinance at the county ievel by November. We are all aware
of this complex issue and there is no need to continue it. Doing so wil! result in
more essential workers leaving and more struggling businesses will lose needed
revenue, or possibly close. Acting expeditiously will ensure all "essential"
workers across our community will be afforded the same standardized
protection. Keep in mind that no one is asking the Commission to reinvent the
wheel. The City of Naples' lawyer has already done the legal work to ensure
compliance with state statutes in the drafting of their 60-Day Ordinance
documentation.
The only action the county staff would have to do is change the language to
reflect the county level and take out any housing studies that were not

conducted at the county level. Amending the document would require minimum
time, effort, and cost as the most complex aspects of preparing such a legal
document to fit the needs of our community are already done. As a bonus, the
county staff can contact the city staff if there are further questions or concerns
with the process. ln essence, the county could draft its version of the 60-Day
Ord ina nce in a day!
Again, the request'ls to add this issue to the agenda immediately, so the current
Commissioners can finish this process they started months ago. The best legacy
the current Commissioners can provide to the new Commissioners is to give
them one less unfinished problem to resolve. Again, please expedite this issue
and its advertisement, as time is not on the side of our workforce who must
leave and work elsewhere because they cannot afford inflated rents in Collier
County-

ORDINANCE 2022-14898
AN ORDINANCE AMENDING CHAPTER 56 ENTITLED "SUPPLEMENTAL
STANDARDS" IN ARTICLE III ENTITLED "STANDARDS APPLICABLE TO ALL
DISTRICTS" TO CREATE A NEW SECTION 56-55 FOR THE PURPOSE OF
REQUIRING LANDLORDS TO GIVE TENANTS 60 DAYS WRITTEN NOTICE OF A
RENTAL INCREASE IN EXCESS OF 5%; PROVIDING FOR REPEALER,
SEVERABILITV, CODIFICATION, AND AN EFFECTIVE DATE.
WHEREAS, many tenants residing in the City of Naples are unable to afford the
purchase price, and the corresponding cost(s) of ownership, of residential
property in the City due to numerous factors, including but not limited to the
ongoing Covid-19 pandemic, the demand upon the existing supply of
housing, cost of living, etc.; and
WHEREAS, it has become increasingly difficult for potential renters to find suitable
housing, at an affordable price; and
WHEREAS, many tenants, who were previously able to find and secure a residential
property, in which to reside within the City, have been surprised by landlords
suddenly seeking to increase, and sometimes very substantially, the
tenant's periodic rental payment, or seeking to amend other material terms
of the lease agreement; and
WHEREAS, unexpected rental increases due to the real estate market have made the
location of affordable housing a challenge for the City's workforce
population; and
WHEREAS, a 2017 study by the Urban Land Institute examined households throughout
Collier County, including the City of Naples, which were considered "cost
burdened," according to the United States Department of Housing and
Urban Development's standards, i.e. households who pay more than 30
percent of their income for housing and may have difficulty affording
necessities such as food, clothing, transportation and medical care; and
WHEREAS, Bright Community Trust, a nonprofit that works on housing and community
development strategies for cities and counties throughout Florida in
partnership with municipalities, nonprofits, the business community and
residents, recently completed a hlousing Affordability Study ("Study") for the
City of Naples Community Redevelopment Agency, which included
background data related to available affordable housing in the City as well
as in the City's community redevelopment area; and
WHEREAS, as background for the Study, Bright Community Trust relied on data finding
that "15% of Naples residents are 'severely cost-burdened,' spending more
than half of their income on housing costs. Another 8%" are 'cost-
burdened,' spending between 30-50% of their income on housing costs.";
and

WHEREAS, the Study also stated as background that:

. Families that spend too much on housing will predictably
have worse outcomes on average because they cannot
afford reliable transportation, nutritious food, optimal health
care, educational opportunities for improvement, childcare
to balance work and family opportunities.
. Healthcare, public safety, education, and other civic
infrastructure often wind up shouldering these unfunded
but substantial costs.
. Business and economic growth are limited by reducing
the pool of available and qualified employees because of
transportation and childcare costs immediately and lower
educational attainment in both the short- and long-term.
. Business recruitment and retention are constrained
when housing is too expensive for potential employees,
limiting our regional economy's growth.; and
WHEREAS, the Study noted that "[t]he CRA and the City are also experiencing a
shortage of homes for sale at prices accessible to first-time
homebuyers, growing families, and seniors with modest incomes looking
to downsize and stay in the area."; and
WHEREAS, Part II of Chapter 83, Florida Statutes, commonly known as the "Florida
Residential Landlord and tenant Act" ("the Act") applies to the rental of
residential dwelling units and sets forth the rights and duties of landlords
and tenants; and
WHEREAS, the Act does not provide specific notification requirements for landlords
seeking to increase rental rates; and
WHEREAS, it is the intent of the City Council to assist renters by adoption of an
ordinance that requires 60 days written notification to be given by landlords
in the City to their residential tenants prior to increasing a tenant's monthly
rent more than 5 percent in any zoning district that allows residential use;
and
WHEREAS, there are programs that are available to assist tenants in paying their rents,
which application process takes a minimum of thirty (30 days); and
WHEREAS, additionally, other states, including Alabama, Alaska, Arizona, California,
Indiana, Iowa, Kansas, Massachusetts, Missouri, New Hampshire, New
Jersey, New Mexico, North Dakota, Ohio, Pennsylvania, Rhode Island,
South Dakota, and Texas, have laws that require landlords to provide notice
to their tenants prior to increasing their rents; and
WHEREAS, adoption of this Ordinance is in the best interest of the residents of the City of
Naples and promotes the health, safety and welfare of the City; and

WHEREAS, for purposes of this Ordinance, underlined type shall constitute additions to
the original text, *** shall constitute ellipses to the original text, and
strikethrough shall constitute deletions to the original text;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITf OF
NAPLES, FLORIDA:
Section 1. The above "Whereas" clauses are ratified, confirmed, and incorporated by
reference as if set forth herein as the City Council's legislative findings.
Section 2. That section 56-55 of Chapter 56 of the Code of the City of Naples is
hereby created to read as follows:
CHAPTER 56. - SUPPLEMENTAL STANDARDS
ARTICLE II. - STANDARD APPLICABLE TO ALL DISTRiCTS
Sec. 58-55. Fair Rental Notification
a This Ordinance shall be known and cited as "The Crt of Na les Fair Notice to
Tenant Ordinance."
b A residential landlord that ro oses to increase rent b mbreth f?ve ercent

1. rovide 60 da s' notice to a tenant s if there is a written lease for a term
of 60 da s or more- or
2. rovide 15 da s' notice to a tenants s sub'ect to another leasin

ro osed rent increase or an acce table corn romise the landlord ma re uire the
tenant s to vacate the residence as rovided b Florida law or the terms of the lease.

su lemental to and are not to be construed to be in conflict with other revisions set
forth in F.S. Ch. 83 t. II overnin residential tenancies or in individual leases.
Enforcement. All violations of this Ordinance ma be rocessed accordin to
Article VI I of the Cit ofNa les Code of Ordinances or as emitted b Cha ter162 arts

violation.
Section 3. That if any word, phrase, clause, subsection or section of this Ordinance
is for any reason held unconstitutional, invalid, or ineffective, the same
shall not affect the validity of any remaining portions of this Ordinance. In

such event, the pre-existing word, phrase, clause, subsection or section,
will be revived.
Section 4. That all sections or parts of sections of the Code of Ordinances, City of
Naples, and all resolutions or parts of resolutions in conflict herewith, be and
the same are hereby repealed to the extent of such conflict.
Section 5. That this Ordinance will take effect immediately upon adoption at second
reading.
