during presentation at the hearing will become a permanent part of the record.
Any person who decides to appeal a decision of the Hearing Examiner will need a record of the
proceedings pertaining thereto, and therefore may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which the appeal is to
be based. Decisions of the Hearing Examiner arc final unless appealed to the Board of County
Commissioners.
Hearing Procedures will provide for presentation by the Applicant, presentation by staff, public
comment and applicant rebuttal. The Hearing Examiner will render a decision within 30 days.
Persons wishing to receive a copy of the decision by mail may supply County staff with their name,
address, and a stamped, self-addressed envelope for that purpose. Persons wishing to receive an
electronic copy of the decision may supply their email address.

I am Karen Correa and I live on Tahiti Circle in Naples Florida. I oppose the dock extension for 178 Tahiti
Circle BDE-PL20220002144. I oppose the excessive 34 foot dock extension over the permittable 20
feet. The lot is not wide enough to permit this sizeable dock extension. It appears as though they will
have a 54 foot dock / lift and another 24 foot dock / lift. The length of the two dock/lifts far exceeds the
lot size and exceeds the 50 percent of linear waterfront footage. The length of the dock, if the extension is
granted, will almost be the length of 3 regular docks.
A 50 foot vessel will not be appropriate for this location and neighboring properties. It should be moored
at a nearby marina which can accommodate this sizeable vessel.
Currently the water depths shift and the navigable waters between 178 Tahiti Circle and 195 W Pago
Pago Drive will be narrowed by allowing this extension and negatively impact the navigable channel to
and from Marlin Bay.
I searched the County Website to find Section 2-88 to properly file my opposition. If you could direct me
as to where I can find this I will submit another appeal.

I would like to oppose the dock permit at 178 Tahiti Circle to increase the dock to 54 feet. The staff report
on page 80 # 4 states there will be no effect of the view from # 186 and 182 Tahiti circle. I strongly
disagree. The view from #182 will be reduced by 50% and # 186 by 25%.
The second issue is the entrance to the Marlin Bay. The sandbar at the entrance shifts every year. A dock
of this size at the entrance will have a huge impact on people getting in and out of the bay.
The third issue is the fact we have not built a dock at 182 yet. We are enjoying the open space and do not
want to have people going across our area to get in and out of a jet ski dock and a dock too big for the
allotted area.
We have owned the property @186 since it was built back in 1970. We purchased 182 about 5 years ago.
When it was built, we were forced to have a 23-foot dock. This was due to the sea grass environmental
act, I guess this is no longer a worry. We just purchased a new boat and had to buy one to fit our dock. If
you own a boat that is bigger than the dock permitted, you should keep it in a marina built to house it. I
would love for you to come and stand on the dock @ 186 and see what I am talking about. It is one thing
to look through a stem of a boat about 16 Feet or so opposed to looking at a sold hull 45 feet long. No
more sunsets and not more bay view. I think every dock behind us will have to same issue. I do hope that
you represent all of us and will do the correct thing, there just has to be a better compromise.

Dear Sir,
We are OPPOSED to granting the boat dock extension #p120220002144 at the
resident address listed at 178 Tahiti Circle, Isle of Capri, Naples, Fl.
The petition diagram states that the waterway edge is 224 ft. across Marlin Bay,
but when it is measured from the end of the boat dock,
It is less than 140 ft. across. Why is this proposal not measured from the
Riparian line on the east boundary? This means that the waterway width
between dock facilities across Marlin Bay is limited. It is clear that a boat dock
of this size was never intended for the small bays we have in our natural
waterways of the Isle of Capri.
There is also a Sandbar that runs the length of the opening to Marlin Bay. We
are concerned over the effect that this large dock extension
would have over the present sandbar, due to the effect that water currents
have around a new structure, such as a large dock that extends into the bay.
This sandbar does affect our passage into the main waterways during low
tide.
The proposal also lists that there are no seagrass beds in the area. When our
dock was built 45 years ago, the structures were very limited in size to protect
the natural waterways and ecosystems. We wonder why all the seagrass beds
have disappeared in our bay. The Isle of Capri is beautiful residential area that
appears to be damaged by all the variances and extensions on boat docks that
have been allowed over the years.
And lastly, no mention is made to the obstructing view to the properties on
the east side of the proposal. We have adjacent properties that will be most
definitely affected by this large extension. Our view from both of our
properties extends across Marlin Bay and to Johnson Island.
We don't believe that the definition of view can be construed as directly or
straight out our back door. God created us with peripheral vision and it was
not by accident but with purpose. When we look at nature through a tube or
blinders we see an object, but when the blinders are removed our peripheral
vision comes into play and we can see the greatness of God's creation come to
life. The developers of the Isle of Capri incorporated this vision with the
creation of our beautiful Isle. They set aside residential areas with
waterfronts that have minimal dockage and a commercial area marina with
larger dockage for larger vessels and fishing businesses to exist. Thereby
creating and keeping our pristine natural bays in view for All to enjoy.
We sincerely hope that you consider all views on objecting this proposal to
extend a boat dock 54 ft. into Marlin bay.

Over the weekend we became aware of the varaince request
I wish to go on record opposing the request for a variance for a dock extension for 178 Tahiti Circle as it
is now submitted. My name is Michael Clark and own both 186 and 182 Tahiti Circle. Our properties are
the most negatively impacted by this proposal. Our family has owned 186 for over 40 years. Over the
years we have seen many changes affecting our island, some good others not so good. The idea of
SUPERSIZING our docks not good.
In reference to the Staff Reports for 178 Tahiti Circle I wish to make the following comments:
Primary criteria 3- a sandbar exists in the center of the entrance channel to Marlin Bay and from mid to
low tide must be passed close to the seawall, the dock variance will hinder navigation.
Primary criteria 4- because of the shape of the far seawall the true channel width is much less than what
is shown on the navigation documents if you go from the dock to the closest point on the far seawall.
Primary criteria 5- the 15ft between the dock and property line is insufficient to allow for easy launch and
recovery of the jet ski and will result in crossing the property line on a regular basis.
Secondary criteria 1- there is no riprap along the seawall to hinder docking as asserted. Photo views of
the seawall verify this
Secondary criteria- 182 Tahiti Circle will lose approximately 50% of its current view of Johnson Bay and
186 will lose approximately 25% of its current view. The majority of homes on Marlin Bay will also be
negatively impacted if the variance is granted. With a decreased view we will also experience a reduction
in property value
HOW WOULD YOU LIKE LOOKING AT AN 8FT by 50FT OBSTRUCTION OFF YOUR PORCH OR
DOCK BLOCKING YOUR VIEW???
I feel there are other options that should be explored before making a final decision on a dock that will
dwarf other docks in the area.

As Property owners of both 182 and 186 Tahiti Circle, we object to the the variant request for the dock
at 178 Tahiti Circle. We have no objection for the construction of a dock that meets the current
requirements without a variance.

Perproposal
4. Whether the proposed facility would have a major impact on the waterfront view of neighboring
property owners. (The facility should not have a major impact on the view of a neighboring property
owner.)
Criterion met. As proposed, the dock facility has been designed to be constructed fully within the
required 15-foot side/riparian setbacks. The applicant advises the neighboring dock facility to the west
provides no such setback and actually encroaches upon the subject property.
Objection
This makes no reference to the property to the east. Using the dimensions in attachment A, a polygon
was produced to model the represented volume of the dock and boat. The estimated height of the top
of the vessel taken from there drawings is approximately 15' above sea level. A model of a legal dock
per the current regulations was also used and it height was left at 15' for a fair comparison. Images
derived from google earth are presented along side actual photos validating the model. The views of
the neighbors to the east are significantly infringed upon.
From the prospective of 186 Tahiti Circle, this variance would cost us a reduction of 25% of our
unrestricted waterfront view. We currently have 58deg and this would reduce it to 44 degrees. A legal
dock without the variance would not reduce the view.
From the prospective of 186 Tahiti Circle, this variance would cost us a reduction of 27% of our
unrestricted waterfront view. We currently have 57deg and this would reduce it to 48 degrees with a
legal doc and further to 35deg with the variance

The proposed variance is not in the keeping of the current look and feel of Isle of Capri. The proposed
dock would be significantly bigger than any other docks nearby disturbing the current state and feel of
the area. The area has under gone a revitalization which is evident in the new homes but over -sized
docks are not part of the building plan an the current regulations are intended to keep large boats at
marinas and not in residential areas. Current homeowners right and values cannot be simply removed
by an individuals desire to own a large boat and for there convenience keep it at there residence by
filing for a variance.

Per proposal
4. Whether the proposed dock facility protrudes no more than 25 percent of the width of the waterway,
and whether a minimum of 50 percent of the waterway width between dock facilities on either side is
maintained for navigability. (The facility should maintain the required percentages.)
Criterion met. The subject waterway is 224t feet wide at this point. The proposed dock facility will
protrude 54 feet into the subject waterway which is 24.1 % of said waterway. The distance between the
subject dock facility and that on the opposite shore is 137 feet, given that the total width of the
waterway is 224f feet, over 50% (or 112 feet) is open and available for navigation
Objection
We are in disagreement with this. The property opposite of this parcel has a uniquely circular coast line
which allows them to measure the width of the channel at its widest point as 224'. However when one
assumes that a vessel would be traveling parallel to the channel, this is clearly not the case as it would
run directly into the sea wall at the location they measured. By using a simple 200' look ahead in the
channel, we can clearly see the channel width is approximately 175'. Using the 25% rule this dock
would be not approved if a more realistic channel was assumed.
Also please note if the dock was placed on the opposite bank it would not be allowed and we are
clearly talking about the same body of water

Per proposal
3. For single-family dock facilities, whether the length of the vessel, or vessels in combination,
described by the petitioner, exceeds 50 percent of the subject property's linear waterfront footage. (The
applicable maximum percentage should be maintained.)
Criterion not met. The proposed dock facility was designed to accommodate a 50-foot vessel and two
personal watercra fts (PWCs) each approximately 12- feet in length. The subject shoreline is 70± feet in
length; therefore, the vessel size will exceed the 50% threshold.
Objection
This dock is not in agreement with the current regulation. This regulation was designed to prevent an
excessive large vessel relative to the parcel from being moored at said location. The regulation was
known to the owner previous to purchase of the property and further made evident by his previous
experience building a dock on the same street and requiring a waiver at that time. The boards failure
to uphold a current regulation is unacceptable.
Objection 5
Per Proposal
5. Whether the proposed location and design of the dock facility is such that the facility would not
interfere with the use of neighboring docks. (The facility should not interfere with the use of legally
permitted neighboring docks.)
Criterion met. The proposed dock facility will exceed the required 15-foot side/riparian setback and
allows for the intended vessel to make a direct approach without crossing the riparian area of others.
The subject dock facility will not inhibit the access of neighboring dock facilities.
Objection
Per the drawings attached, the jetskis will be docked parallel to the sea wall with a drive on platform,
The jet skis are indicated to be approximately 12ft and given the turn radius and tidal flows plus wind
effects predominantly parallel to the sea wall, it is highly unlikely that they will be able to enter their
mooring without being more than 13.5 ft off the side of the dock assuming they are approximately 3ft
wide would require their center -line to be 13.5 ft to remain in there riparian area and execute a 90
degree turn inside of said area as the approximate mid stage tidal flow will be in the .5-.8 ft/sec
perpendicular to their direction of travel

Per proposal
3. Whether the proposed dock facility may have an adverse impact on navigation within an adjacent
marked or charted navigable channel. (The facility should not intrude into any marked or charted
navigable channel thus impeding vessel traffic in the channel.)
Criterion met. The applicant states that there are no marked channels within this section of Johnson
Bay, therefore the entire waterway provides safe navigation. As proposed, the dock facility will also
maintain the ingress/egress to both neighboring docks. Staff concurs.
Objection
The lack of a marked channel does not guarantee safe navigation. The waterway directly behind the
dock is mainly too shallow to allow for boat traffic during low tide with the exception of directly
adjacent to the the existing dock behind to the north and directly north to the dock to the west. The
shifting sandy bottom has filled in most of the are an is evident by the photo below. The new dock will
interfere with 1 of the 2 entry ways into the canal.
