Demolition Permit, inspections, and Certificate of Completion/Occupancy for conversion of the lanai into
living space on or before July 23, 2022, or a fine of$250.00 per day will be imposed for each day the
violations remain thereafter.
C. If Respondents fail to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriff's Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.28 on
or before July 23,2022.
E. Respondents shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came before the Code Enforcement Board(the"Board")for public hearing on April 28,2022,
and the Board,having heard testimony under oath,received evidence and heard argument respective to all appropriate
matters,hereupon issues its Findings of Fact,Conclusions of Law,and Order of the Board as follows:
FINDINGS OF FACT
1. Respondents,Jose Garcia and Limbania Verdecia,are the owners of the subject property(the"Property").
2. Respondents, having been notified of the date of hearing by certified mail and posting, had Limbania
Verdecia's daughter, Iriana (Iris) Pupo, and their agent, Joel Trujillo, appear at the public hearing, who
testified as to efforts to abate the violations.
3. The Property located at 1781 45th St. SW,Naples, FL 34116,Folio No. 35762600001 (Legal Description:
GOLDEN GATE UNIT 2 BLK 41 LOT 20 OR 2046 PG 1740) is in violation of Collier County Land
Development Code,Ord.No.04-41,as amended,Sections 10.02.06(B)(1)(a)and 10.02.06(B)(1)(e)(i),in the
following particulars:
Unpermitted modifications to a permitted screened lanai including,but not limited to: Enclosure of a
portion of the lanai to create a living space,replacement of screened areas with solid walls and addition
of water and electric utilities.Unpermitted conversion of the garage to a living space including,but not
limited to installation of an air conditioning system, plumbing for a full bathroom and electrical
modifications.
4. The violations have not been abated as of the date of this hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
2. The preponderance of the evidence shows that violations of Collier County Land Development Code, Ord.
No. 04-41,as amended,Sections 10.02.06(B)(1)(a)and 10.02.06(B)(1)(e)(i),do exist,and that Respondents
committed,and were responsible for maintaining or allowing the violations to continue as of the date of this
hearing.

Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida, it
is hereby ORDERED that:
A. Respondents are found guilty of violating Collier County Land Development Code, Ord. No. 04-41, as
amended, Sections 10.02.06(B)(1)(a)and 10.02.06(B)(1)(e)(i).
B. Respondents must abate all violations by:
1. ceasing and desisting occupancy of the unpermitted alterations to the lanai and garage on or before
May 28, 2022, or a fine of$200.00 per day will be imposed for each day the violations remain
thereafter; and
2. obtaining all required Collier County Building Permit(s) or Demolition Permit, inspections, and
Certificate of Completion/Occupancy to either keep the unpermitted alterations to the lanai and garage
or return them to a permitted state on or before July 27,2022,or a fine of$200.00 per day will be
imposed for each day the violations remain thereafter.
C. If Respondents fail to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriff's Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.28 on
or before May 28,2022.
E. Respondents shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

imposed for each day the violations remain thereafter.
C. If Respondent fails to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriff's Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondent.

before August 27,2022.

Before me, the undersigned, Christine Sullivan, on behalf of Christine Sullivan Rev/Trust, enters into this
Stipulation and Agreement with Collier County as to the resolution of Notices of Violation in reference (case)
number CESD201800155567 dated the 19th day of December, 2018.
This agreement is subject to the approval of the Code Enforcement Board. If it is not approved, the case may be
heard on the scheduled Hearing date, therefore it is strongly recommended that the respondent or representative
attend the Hearing.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which a
hearing is currently scheduled for July 28ih, 2022; to promote efficiency in the administration of the code

Obtaining all required Collier County Building Permit(s) or Demolition Permit, inspections, and Certificate
of Completion/Occupancy for the unpermitted alterations to the dock within 180 days of this hearing or a
fine of$100 per day will be imposed until the violation is abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the
Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,
then the notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to

THIS CAUSE came before the Code Enforcement Board(the"Board")for public hearing on July 28,2022,
and the Board,having heard testimony under oath,received evidence and heard argument respective to all appropriate
matters,hereupon issues its Findings of Fact,Conclusions of Law,and Order of the Board as follows:
FINDINGS OF FACT
1. Respondent,Rodolfo Trevino Jr.,is the owner of the subject property(the"Property").
2. Respondent,having been notified of the date of hearing by certified mail and posting,did appear at the public
hearing.
3. Prior to the hearing, Respondent entered into a Stipulation, which is attached hereto as Exhibit "A." The
Stipulation is adopted and incorporated into this Order,and Respondent is ordered to comply.
4. The Property at 1100 Auto Ranch Rd.,Naples, FL 34114, Folio No. 766920000 (Legal Description: 20 51
27 COMM SW CNR SEC 20, E 697.99FT TO POB, CONT E 638FT, N 330FT, W 637.65FT, S 330FT,
A/K/A LOT 16 OR 688 PG 921)is in violation of Collier County Land Development Code,Ord.No.04-41,
as amended, Sections 10.02.06(B)(1)(a)and 3.05.01(B),in the following particulars:
Remove protected vegetation without a permit and mechanic removed vegetation without first
obtaining approval from Florida DEP on this unimproved lot.
5. The violation has not been abated as of the date of this hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
2. The preponderance of the evidence shows that violations of Collier County Land Development Code, Ord.
No.04-41,as amended,Sections 10.02.06(B)(1)(a)and 3.05.01(B)do exist,and that Respondent committed,
and was responsible for maintaining or allowing the violation to continue as of the date of this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:

A. Respondent is found guilty of violating Collier County Land Development Code, Ord. No. 04-41, as
amended,Sections 10.02.06(B)(1)(a)and 3.05.01(B).
B. Respondent must abate all violations by obtaining all required Collier County approved mitigation plans,
Building Permit(s), Inspections, and Certificate of Completion/Occupancy to either keep the unpermitted
improvement of the property as is,or to restore the property to its originally permitted condition on or before
November 25, 2022, or a fine of $100.00 per day will be imposed for each day the violations remain
thereafter.
C. If Respondent fails to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriffs Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondent.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$59.28 on or
before August 27,2022.
E. Respondent shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspectionti to confirm compliance.

FINDINGS OF FACT
1. On March 24, 2022, Respondent, NELSON MARTINEZ LAND HOLDING, LLC, was found guilty of
violating Collier County Land Development Code, Ord. No. 04-41, as amended, Sections 1.04.01(A),
2.02.03, 10.02.06(B)(1)(a),10.02.06(B)(1)(e),and 10.02.06(B)(1)(e)(i)on the subject property located at 891
5th St. SW,Naples,FL 34117,Folio No.37162681000(Legal Description:GOLDEN GATE EST UNIT 12
S 1/2 OF TR 35N 2.50 AC OR 1625 PG 1371),hereinafter referred to as the "Property"), in the following
particulars:
Unpermitted alterations made to the principle dwelling and guest house,converting each structure
into multi-family dwellings.
2. On the same date as above, the Board issued an Order ordering Respondent to abate the violations on or
before June 22, 2022, or a fine of$350.00 per day would be assessed for each day the violations remained
thereafter(A copy of the Order is recorded at OR BK 6110,PG 3947).
3. Respondent, having been notified of the date of hearing by certified mail, posting and/or personal service,
did not appear at the public hearing.
4. Prior operational costs of$59.28 incurred by Petitioner in the prosecution of this case have not been paid.
5. Operational costs in the amount of$59.28 have been incurred by Petitioner for this hearing.
6. The violations have not been abated as of July 28,2022.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
2. Pursuant to Section 162.09, Florida Statutes, Petitioner has demonstrated by the preponderance of the
evidence that the fines and cost shall be imposed against Respondent.

A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.

THIS CAUSE came before the Code Enforcement Board(the"Board")for public hearing on July 28,2022,
upon the Petitioner's Motion for Imposition of Fines/Liens, and the Board, having heard testimony under oath,
received evidence and heard argument respective to all appropriate matters, hereupon issues its Findings of Fact,
Conclusions of Law, and Order of the Board as follows:
FINDINGS OF FACT
1. On March 24, 2022, Respondent, NELSON MARTINEZ LAND HOLDING, LLC, was found guilty of
violating Collier County Land Development Code, Ord. No. 04-41, as amended, Section 5.03.03(B) on the
subject property located at 891 5th St. SW,Naples, FL 34117, Folio No. 37162681000 (Legal Description:
GOLDEN GATE EST UNIT 12 S 1/2 OF TR 35N 2.50 AC OR 1625 PG 1371), hereinafter referred to as
the"Property"), in the following particulars:
Illegally renting a guest house.
2. On the same date as above, the Board issued an Order ordering Respondent to abate the violations on or
before May 23, 2022, or a fine of$500.00 per day would be assessed for each day the violations remained
thereafter(A copy of the Order is recorded at OR BK 6148,PG 3501).
3. Respondent, having been notified of the date of hearing by certified mail, posting and/or personal service,
did not appear at the public hearing.
4. Prior operational costs of$59.28 incurred by Petitioner in the prosecution of this case have not been paid.
5. Operational costs in the amount of$59.28 have been incurred by Petitioner for this hearing.
6. The violations have not been abated as of July 28,2022.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX, Code of Laws and Ordinances of Collier County,Florida.
2. Pursuant to Section 162.09, Florida Statutes, Petitioner has demonstrated by the preponderance of the
evidence that the fines and cost shall be imposed against Respondent.

Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Daily fines of$500.00 per day are assessed and imposed against Respondent for 66 days for the period from
May 24,2022,to July 28,2022,for a total fine amount of$33,00.00.
C. Respondent shall pay operational costs in the total amount of$118.56
D. Respondent shall pay fines and costs in the total amount of$33,118.56 or be subject to Notice of Assessment
of Lien against all properties owned by Respondent in Collier County,Florida.
E. The daily fines of$500.00 shall continue to accrue until abatement has been confirmed by a Collier County
Code Enforcement Investigator.

into multi-family dwellings.
2. On the same date as above, the Board issued an Order ordering Respondents to abate the violations on or
before June 22, 2022, or a fine of$350.00 per day would be assessed for each day the violations remained
thereafter(A copy of the Order is recorded at OR BK 6112,PG 2350).
3. Respondents, having been notified of the date of hearing by certified mail,posting and/or personal service,
did not appear at the public hearing.
4. Prior operational costs of$59.28 incurred by Petitioner in the prosecution of this case have not been paid.
5. Operational costs in the amount of$59.28 have been incurred by Petitioner for this hearing.
6. The violations have not been abated as of July 28,2022.

Observed alterations/conversions made to main residence of garage for additional living space on
improved Estates zoned parcel.
2. The violations have been abated as of April 27,2022.
3. Respondent, having been notified of the date of hearing by certified mail,posting and/or personal service,
had Respondent appear along with Sandra Bosa as interpreter, and testimony was received of the
Respondent's continuing diligent efforts to pursue abatement of the violations,the financial harm imposing
fines would cause,and the request that fines and costs be waived.
4. All operational costs previously incurred by Petitioner in the prosecution of this case have been paid.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida

2. Respondent has demonstrated by the preponderance of the evidence that mitigating circumstances exist under

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came before the Code Enforcement Board(the"Board")for public hearing on November 20,
2020,upon the Petitioner's Motion for Imposition of Fines/Liens,and the Board,having heard testimony under oath,
received evidence and heard argument respective to all appropriate matters, hereupon issues its Findings of Fact,
Conclusions of Law,and Order of the Board as follows:
FINDINGS OF FACT
1. On March 23,2017,the Code Enforcement Board issued a Findings of Fact,Conclusion of Law and Order,
recorded at OR 5377 PAGE 511. The Respondent,Esmerido Castro,was found guilty of violating Section
I0.02.06(B)(1)(a) of the Collier County Land Development Code on the subject property located at 5260
21 ST PL SW, NAPLES,FL 34116,Folio No. 36378000007 (Legal Description: GOLDEN GATE UNIT 6
PART 1 BLK 211 LOT 12),hereinafter referred to as the"Property,"in the following particulars:
New exterior door, a wall-mounted air conditioning unit, partitioned walls and plumbing fixtures
installed/added to the existing attached garage on improved occupied residential property without
obtaining a permit.
2. Respondent, having been notified of the date of hearing by certified mail, posting and/or personal service,
appeared at the public hearing and testified as to the Respondent's diligent efforts to pursue abatement of the
violations and requested fines be waived.
3. The violation has been abated as of October 23,2020.
4. All operational costs previously incurred by Petitioner in the prosecution of this case have been paid.
5. Operational costs in the amount of S59.91 have been incurred by Petitioner for this hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
I. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
2. Respondent has demonstrated by the preponderance of the evidence that mitigating circumstances exist under
Section 162.09(2),Florida Statutes,to abate all fines and costs accrued against Respondent.

Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida, it

A. Petitioner's Motion for Imposition of Fines/Liens is DENIED.
B. No accrued fines and or costs shall be imposed against Respondent.

FINDINGS OF FACT
I. Respondents, Melva Padilla and Nazaria Angelica Nunez, are the owners of the subject property (the
"Property").
2. Respondents, having been notified of the date of hearing by certified mail and posting, had Melva Padilla
appear at the public hearing.
3. Prior to the hearing, Respondents entered into a Stipulation, which is attached hereto as Exhibit "A." The
Stipulation is adopted and incorporated into this Order,and Respondents are ordered to comply.
4. The Property at 8322 Valiant Dr.,Naples,FL 34104,Folio No.56324013549(Legal Description:MADISON
PARK PHASE TWO LOT 135)is in violation of Collier County Land Development Code,Ord. No.04-41,
as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e), and 10.02.06(B)(1)(e)(i), in the following
particulars:
Alterations to garage area without a required Collier County building permit.
5. The violations have not been abated as of the date of this hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
1. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
2. The preponderance of the evidence shows that violations of Collier County Land Development Code, Ord.
No. 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(l)(e), and 10.02.06(B)(1)(e)(i), do exist,
and that Respondents committed,and were responsible for maintaining or allowing the violations to continue
as of the date of this hearing.

Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Respondents are found guilty of violating Collier County Land Development Code, Ord. No. 04-41, as
amended,Sections 10.02.06(B)(I)(a), I0.02.06(B)(1)(e),and I0.02.06(B)(I)(e)(i).
B. Respondents must abate all violations by:
1. ceasing and desist the use of the unpermitted garage conversion into additional living space and
powering off any unpermitted electricity from the circuit breaker until alterations are legally permitted
and inspected on or before March 27,2022,or a fine of S200.00 per day will be imposed for each
day the violations remain thereafter;and
2. obtaining all required Collier County Building Permit(s), Demolition Permit, Inspections, and
Certificate of Completion/Occupancy to keep the garage alteration or return it to a permitted state on
or before May 23, 2022,or a fine of$150.00 per day will be imposed for each day the violations
remain thereafter.
C. If Respondents fail to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriff's Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.28 on
or before April 23,2022.

STIPULATION/AGREEMENT
Before me, the undersigned, Melva Padilla, on behalf of Melva Padilla and Nazaria Angelica Nunez, enters
into this Stipulation and Agreement with Collier County as to the resolution of Notices of Violation in reference
(case) number CESD20210002415 dated the 15" day of July. 2021.
This agreement is subject to the approval of the Code Enforcement Board. If it is not approved, the case may
be heard on the scheduled Hearing date, therefore it is strongly recommended that the respondent or
representative attend the Hearing
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for March 24, 2022: to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows.
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence,
