EXECUTIVE SUMMARY

OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in all or a portion of
the 30-foot and 60-foot Roadway, Right -of -Way, and/or Ingress and Egress Easements as Recorded in
Official Records Book 968, Page 975; Official Records Book 1795, Page 1917; Official Records Book
284, Page 633; Official Records Book 279, Page 284; Official Records Book 238, Page 398; Official
Records Book 404, Page 997; and Official Records Book 416, Page 609, of the Public Records of Collier
County, Florida, located in Sections 11 and 14, Township 50 South, Range 26 East, Collier County,
Florida, being more specifically shown in Exhibit "A", and to accept Petitioner's grant of an access
easement to replace the vacated Roadway Easements.
CONSIDERATIONS: Petition VAC-PL2021002687 has been received by the Development Review
Division, Growth Management Department from Francesca Passidomo, Esq., of Coleman Yovanovich &
Koester, P.A., as agent for the property owner, to vacate all or a portion of the 30-foot and 60-foot
Roadway, Right -of Way, and/or Ingress and Egress Easements as Recorded in Official Records Book
968, Page 975; Official Records Book 1795, Page 1917; Official Records Book 284, Page 633; Official
Records Book 279, Page 284; Official Records Book 238, Page 398; Official Records Book 404, Page
997; and Official Records Book 416, Page 609 of the Public Records of Collier County, Florida, being
more specifically shown in Exhibit "A", located in Sections 11 and 14, Township 50 South, Range 26
East, Collier County, Florida.
This is a request to vacate the east -west easements generally bisecting the Hacienda Lakes and Willow
Run property boundaries as recorded in (collectively, the "Easements"):
• Official Records Book 968, Page 975.
• Official Records Book 1795, Page 1917.
• Official Records Book 284, Page 633.
• Official Records Book 279, Page 284.
• Official Records Book 238, Page 398.
• Official Records Book 404, Page 997; and
• Official Records Book 416, Page 609, all of the Public Records of Collier County, Florida.
The Easements commence at the Henderson Creek Canal and run easterly to the southeast corner of the
Southwest Quarter of the Southeast Quarter of Section 11. There is no practical access to Collier Blvd (CR
951) due to the intervening canal. The Easements were reserved in various deeds for access purposes over
the section lines before this area was assembled into larger tracts (i.e., Hacienda Lakes and Willow Run)
for development. The Easements were also reserved prior to the County's broader initiative to provide a
planned transportation network utilizing good planning principles.

At this point, the Easements do not serve any meaningful purpose but do interfere with intended residential
development for this area. It is the desire of the Petitioners to have the option for a joint site plan that
would eliminate buffering between the two projects to create a more unified and interconnected feel. A
PUD Amendment has been submitted for Hacienda Lakes described this option through a joint site
planning process, and a corollary PUD Amendment for Willow Run will be submitted in the future. As a
footnote, both projects are anticipated to include a variety of residential product types, supplying housing
for different tiers of need and at the same time broadening the County's property tax revenues.
Granting the vacation not only facilitates residential development, but, critical to the criteria for this
request, benefits the public in the following ways:
1. The vacation will not disrupt legal access. As part of the vacation, the Petitioner will
convey a public access easement along the eastern and northern boundary of Hacienda
Lakes, from Rattlesnake Hammock Road to the southeast corner of the Northeast Quarter
of the Northeast Quarter of Section 14, a conveyance of 297,778 square feet of area to the
County for access purposes. The replacement easement will tie into pre-existing public
access easements located within Willow Run, recorded in Official Records Book 231,
Page 791 and Official Records Book 279, Page 284, and pre-existing public access
easements continuing same located within Hacienda Lakes, recorded Official Records
Book 1196, Page 288, all of the Public Records of Collier County, Florida.
2. The vacation will stipulate that the County's payment of the fair market value of the land
and improvements conveyed to the County, pursuant to the County's obligation to
reimburse the respective property owners for such future transportation commitments as
memorialized in the Willow Run PUD and Hacienda Lakes PUD, respectively, may be off set on
an equal acreage basis relative to the land being vacated. The result is a reduction in the County's
contingent payments to the landowners by: (a) as to Willow Run, the fair market value of 2.31
acres of land area, and (b) as to Hacienda Lakes, the fair market value of 2.23 acres of land area.
The Development Review Division has reviewed this petition and found no reason for objection.
FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected
a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and
processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.
LEGAL CONSIDERATIONS: Petitioner is requesting the vacation of various east -west
easements generally bisecting the Hacienda Lakes and Willow Run property boundaries, used for
Roadway, Right -of Way, and/or Ingress and Egress.
Pursuant to Resolution 2021-243 and Florida Statutes Sections 336.09 and 336.10, the Board,
with respect to property under their control, upon petition of any person or persons, may adopt a
resolution to: (1) vacate, abandon, discontinue and close any existing public or private street,
alleyway, road, highway, or other place used for travel, or any portion thereof, other than a state
or federal highway, and to renounce and disclaim any right of the County and the public in and
to any land in connection therewith; and/or (2) Renounce and disclaim any right of the County
and the public in and to any land, or interest therein, acquired by purchase, gift, devise,

dedication or prescription for street, alleyway, road or highway purposes, other than lands
acquired for state and federal highways, when the following criteria are met:
1. The request is in the interest of the general public welfare, or no public detriment is
established.
2. The request does not invade or violate individual property rights
3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be
vacated, OR a statement from the Petitioner demonstrating the reason for the request
including any property or financial interest or projects affected by a granting of such
request.
This item has been approved as to form and legality, and requires a majority vote for Board approval. --

Records Book 279, Page 284; Official Records Book 238, Page 398; Official Records
Book 404, Page 997; and Official Records Book 416, Page 609 of the Public Records of
Collier County, Florida, located in Sections 11 and 14, Township 50 South, Range 26
East, Collier County, Florida, being more specifically shown in Exhibit "A", is hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to be in the
public interest and for the public benefit.
BE IT FURTHER RESOLVED that transportation impact fee credits or road
impact fee credits payable by the County to Petitioners pursuant to the Hacienda Lakes
PUD (Ordinance No. 2011-41) and DRI (Resolution No. 2011-20 1 /Development Order
2011-05) and the Willow Run PUD (Ordinance No. 14-35) be off -set on an acreage basis
relative to the vacated areas, such that the equivalent of 2.31 acres allocated to Willow
Run and 2.23 acres allocated to Hacienda Lakes shall be reduced from such credits
otherwise payable by the County.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board
is hereby directed to record a certified copy of the Resolution in the Public Records of the
public records of Collier County, Florida.

Please allow this correspondence to serve as a request for a Letter of No Objection from you regarding the vacation
of an easement granted in the following Deeds: Official Records Book 968, Page 975; Official Records Book 1795,
Page 1917; Official Records Book 284, Page 633; Official Records Book 279, Page 284; Official Records Book
238, Page 398; Official Records Book 404, Page 997; and Official Records Book 1028, Page 1128; all of the Public
Records of Collier County, Florida ("Easements"). The Easements are separated from the public right of way
(Collier Boulevard CR 951) by the Henderson Creek Canal and are not in use. However, the Easements are a
technical cloud on title and interfere with development in the easement area. Public access (and related easements
for utilities and roadway) will be replaced by easements that connect to Rattlesnake Hammock Road. For your
reference, please find enclosed a copy of a map and survey indicating the area to be vacated.
The proposed vacation is being submitted to the Collier County shortly and is time sensitive. Accordingly, we are
requesting that you return your Letter of No Objection as soon as possible. Pursuant to the requirements of the

Tamiami Trail, Naples, Florida 34112 ("County"). Mortgagee is used as singular or plural, as the context
requires.
WITNESSETH:
WHEREAS, Mortgagee is the owner and holder of that certain Mortgage and Security Agreement
dated December 27, 2012 and recorded December 28, 2012, in Official Records Book 4870, Page 268,
together with Collateral Assignment of Permits, Contracts, and Rights recorded December 28, 2012 in
Official records Book 4870, Page 295, together with UCC-1 Financing Statement recorded December 28,
2012 in Official records Book 4870, Page 306, executed by and between Hacienda Lakes of Naples, LLC
("Hacienda") and Mortgagee, all of the Public Records of Collier County, Florida (collectively, the
"MoMzaee"), encumbering the premises legally described therein ('Encumbered Property");
WHEREAS, the County has requested and received from Hacienda Lakes of Naples, LLC, a Florida
limited liability company, the fee simple owner of the Encumbered Property, a perpetual, non-exclusive
Access Easement over, under, on and across a portion of the Encumbered Property legally described in
Exhibit "A" attached hereto and incorporated herein by virtue of this reference (the 'Easement Property");
and
WHEREAS, the County has requested that Mortgagee consent to, join in and subordinate its
Mortgage to the interest that the County has in the Easement Property to which request Mortgagee has
agreed.
NOW, THEREFORE, in consideration of TEN DOLLARS ($10.00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the Mortgagee does hereby
consent to, join in and subordinate the lien of its Mortgage to the grant of that certain easement described
herein over, under, on and across the Easement Property and any interest of the County in any roadway or
sidewalk facilities located therein or affixed thereto. Except as subordinated to the easement described
herein over, under, on and across the Easement Property, said Mortgage shall remain in full force and
effect.

WHEREAS, the Board of County Commissioners of Collier County, Florida ("Board"),
pursuant to sections 125.01, 125.37, 177.101, 336.09 and 336.10, Florida Statutes, Collier
County Ordinance No. 2004-31, as amended, and the Collier County Land Development Code, is
authorized to grant or deny vacations and annulments of plats of subdivided land, road rights -of -
way, alleyways, and public dedicated easements conveyed by separate instrument recorded in the
public records, and exchange of real property; and
WHEREAS, the Board, on July 25, 2006, adopted Resolution 2006-160, which
superseded and replaced Resolution 1998-465, establishing the policies and procedures
previously established for the above; and
WHEREAS, the Board, on September 10, 2013, adopted Resolution 2013-166, which
amended Resolution 2006-160, to further amend the policies and procedures previously
established for the above; and
WHEREAS, the Board desires to further amend the policies and procedures for: 1)
closing and vacation of road rights -of -way; 2) vacation and annulment of plats or portions of
plats of subdivided land; and 3) extinguishment of public easements conveyed by separate
instrument records in the public records (conveyances other than on a subdivision plat) on platted
or unplatted land, except for public roads, and exchange of real property.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. This Resolution amends Resolution No. 2006-160, as amended, as set forth in the
following Attachments.
2. The policies and procedures for the closing and vacation of road rights -of -way are
amended and set forth in Attachment "A", incorporated herein and made part of this
Resolution.

POLICY AND PROCEDURE ON THE CLOSING
AND VACATION OF ROAD RIGHT-OF-WAY
A. AUTHORITY: --Sections 336.09 and 336.10, Florida Statutes.
B. POLICY: _When a request is in the interest of the general public welfare or where no public
detriment is established and when said request does not invade or violate individual property
rights and otherwise qualifies under Ssection 336.09, Florida Statutes, the Board of County
Commissioners (BCC) may:
1. Vacate, abandon, discontinue and close any existing public or private street, alleyway,
road, highway, or other place used for travel, or any portion thereof, other than a state or
federal highway, and to renounce and disclaim any right of the County and the public in
and to any land in connection therewith.
2. Renounce and disclaim any right of the County and the public in and to any land, or
interest therein, acquired by purchase, gift, devise, dedication or prescription for street,
alleyway, road or highway purposes, other than lands acquired for state and federal
highways.
3. Renounce and disclaim any right of the County and the public in and to land, other than
land constituting, or acquired for, a state or federal highway, delineated on any recorded
map or plat as a street, alleyway, road, highway or other place used for vehicular travel.
C. PROCEDURE:
An application for the vacation of road right-of-way is to be completed along with the
listed items needed for review and to be submitted to Growth Management, Development
Review Division . It must be
accompanied by a non-refundable application fee (refer to Growth Management.,
Development Services' current fee schedule for the applicable
fee).
2. The petitioner must also provide:
a) Evidence to show that the petitioner owns the fee simple title to the whole or that part
of the parcel sought to be vacated (FELE-ee S1N4P4:,EjMple DELE-Deed). If petitioner is

County or the public.
d) Certificate(s) showing all State and County taxes have been paid for the subject
parcel if petitioner is the owner or the agent of owner of the fee simple title to the
whole or part of the parcel sought to be vacated. (Available from the Collier County

e) Assessment Map depicting area of proposed vacation. (Available from the Collier
County Property Appraiser's Office, Radio Road).
f) List of abutting and other property owners within 250 feet of the proposed vacation to

and noted on the sketch, signed and sealed by a Florida Professional Surveyor

3. Development Review Division will review the petition application
for completeness and compliance with this Resolution. Engineering
ServieesDevelopment Review Division will prepare an appropriate executive summary
and resolution and transmit both documents to the County Attorney's Office for approval.
If approved as to form and legality by the County Attorney, the petition will be filed with
the Clerk to the Board with a request for a time and date for a public hearing. The
petition may be placed on the BCC agenda to establish a time and date for a public
hearing by Resolution pursuant to Ssection 336.09, Florida Statutes.
4. Once the time and date of the public hearing isare established, the Clerk to the Board
shall publish legal notice of the hearing one time in a newspaper of general circulation at
least two weeks prior to the date stated therein for such hearing.
The petitioner and all property owners within 250 feet (and others as may be required by
the Development Review Division) of the requested vacation parcel
shall be given notice by the Clerk to the Board; stating time, place and date of public
hearing, by regular mail. If the number of property owners within two hundred fifty feet
(250') exceeds twenty (20), petitioner shall incur an additional postage and handling
charge of fifty cents ($.50) per additional property owner.
6. In the event that the petitioner for the property in question does not represent lthemself
at the public hearing(s), they must provide a signed letter or other appropriate
documentation which authorizes another specific person to represent himthem.
7. The Board of County Commissioners shall then hold a public hearing and any approved
resolution by such governing body shall have the effect of vacating all requested streets
and alleys which have not become highways necessary for use by the traveling public.
Notice of the adoption of such a resolution by the Commissioners shall be published by
the Clerk to the Board one time, within 30 days following its adoption, in one issue of a
newspaper of general circulation published in the County. The proof of publication of

9. The processing of this petition shall coincide, where applicable, with the processing of
such other platting or land use change applications proposed for the same property with
regard to submissions of applications, staff reviews, reviews by advisory bodies, or the

PORTIONS OF PLATS OF SUBDIVIDED LAND
A. AUTHORITY: _Section 177.101 Florida Statutes, and Collier County Ordinance No. 01 57
2004-31 and the Collier County Land Development Code.
B. POLICY:_ When a request is in the interest of the general public welfare or no public
detriment is established the persons making application for said vacation own the fee simple
title to the whole or that part of the tract covered by the plat sought to be vacated, the request
will not affect the ownership or right of convenient access of persons owningother parts of
the subdivision, and the request does not invade or violate individual property rights, the
Board of County Commissioners may adopt resolutions vacating plats in whole or in part of
subdivisions in said countyies, returning the property covered by such plats either in whole or
in part into acreage.
C. PROCEDURE:
1. To petition for the vacation and annulment of plats or portions of plats of subdivided
land, an application is to be completed along with the listed items needed for review. The
application must be submitted to Growth Management,
Development Review Division, accompanied by a non-refundable application fee (refer
to Growth Management, Development Services' urrent fee
schedule for the applicable fee).
2. The petitioner must also provide:
a) Evidence to show that the petitioner owns the fee simple title to the whole or that part

b) A statement explaining the general public benefit received from the proposed

Development Review Division will review the petition for completeness and compliance
with this Resolution. Development Review Division will prepare an
appropriate executive summary and resolution and transmit both documents to the
County Attorney's Office for approval.
If approved as to form and legality by the County Attorney, the petition will be filed with
the Clerk to the Board with a request for a time and date for a public hearing.
4. Once the time and date of the agenda item isare established, the Clerk to the Board shall
publish legal notice of the hearing in not less than two weekly issues of a newspaper of
general circulation in the County, pursuant to Ssection 177.101, Florida- Statutes.

A. AUTHORITY: —Sections 125.01 and 125.37, Florida Statutes.
B. POLICY: Requests will be granted as long as the public benefit is established or no public
detriment is established. The Board of County Commissioners may:
1. Extinguish, vacate, abandon, discontinue, and close any easements, or any portion
thereof, granted to the County or public by any instrument recorded in the public records
of Collier County and to renounce and disclaim any right of the County and the public in
and to any land in connection therewith; when such interest is granted to the County or

2. Quitclaim, renounce, and disclaim any right of the County and the public in and to any
