11.E 07/12/2022 EXECUTIVE SUMMARY Recommendation to approve deductive Change Order No. 10 to Collier County Sport Complex Phases 2.1 and 2.2A Agreement No. 17-7198, with Manhattan Construction (Florida), Inc., for a time extension of 145 days; acknowledge staff report for update on phase 1, and modified phases 2.1 and 2.2 scopes; provide direction to staff for phase 3 and phase 4, and authorize the County Manager or designee to issue a notice of intent to terminate to Manhattan Construction, if necessary, and subject to Board ratification at a future Board meeting. (Project 50156). OBJECTIVE: To provide the Board with an update on the current and future phases of the Sports Complex, obtain direction for phases 3 and 4 and approve Change Order #10 for extension of time necessary to accommodate unforeseen delays as discussed below. CONSIDERATION: On February 13, 2018 (Item 16.D.21) the County entered into Agreement No. 17- 7198 (the "Agreement") with Manhattan Construction (Florida), Inc. ("Manhattan") for Construction Manager at Risk ("CMAR") services for all preconstruction phases for the Collier County Sports Complex. The process contemplated using individual contract amendments for each subsequent GMP construction phase. Phase 1: On September 25, 2018 (Agenda Item 11.13), the County entered into the First Amendment to the Agreement with Manhattan for work for Phase 0 that included the preparatory work required in anticipation of Phase 1, where the infrastructure and fields will be installed. Phase 0 included most of the land clearing, full lake excavation, a construction access road, and preliminary drainage work. On March 26, 2019 (Agenda Item 11.C), the County entered into the Second Amendment to the Agreement with Manhattan for work for Phase IA. This completed phase is open to the public and includes the primary underground utility work on the parcel, provides five fields, maintenance building, welcome center, market, ticket booth and restrooms. Phase IA also completes City Gate Boulevard South, main entrance improvements on City Gate Boulevard North, and parking for this phase. On October 22, 2019 (Agenda Item 16.D.9), the County entered into the Third Amendment to the Agreement with Manhattan to revise and correct the Construction Manager's Standard Rates in Exhibit "G" to the Agreement. On December 10, 2019 (Agenda Item I I.D), the County entered into the Fourth Amendment to the Agreement with Manhattan for work for Phase 113. That phase consists of the Stadium, Great Lawn and Championship Field. The Great Lawn was completed ahead of schedule and is open to the public. Amenities include the Cove with a food truck pavilion and bar, the Factory that consists of a MoveStrong workout area, National Fitness Court, open air classroom, open air weight room, lake trail, yoga area, climbing wall, volleyball, and bocce courts. On March 26, 2019 (Agenda Item 1 LC), the County entered into the Second Amendment to the Agreement with Manhattan for work for Phase IA. This completed phase is open to the public and includes the primary underground utility work on the City Gate parcel, provides five fields, maintenance building, welcome center, market, ticket booth, and restrooms. Phase IA also completes City Gate Boulevard South, main entrance improvements on City Gate Boulevard North, and parking for this phase. Phase 1 update: Phase 1 construction is completed with buildings and improvements open to the public under temporary Certificates of Occupancy originally issued in July 2020 for the Welcome Center and December 2020 for the Stadium. Manhattan has been pursuing final certificates of occupancy that require completion of required inspections and other work. There are pending Phase 1 issues including: final Certificate of Occupancy, punch list items, outstanding change orders, other potential contractor claims, and liquidated damages. Notwithstanding the foregoing, the improvements in this phase have been in use by the County under a Temporary Certificate of Occupancy. Packet Pg. 150 07/12/2022 Phase 2: On November 10, 2020 (Agenda Item 11.1)), the County entered into the Fifth Amendment to the Agreement with Manhattan for work for Phase 2.0. That phase consists of clearing, grubbing, and construction fencing of approximately 110 acres of the entire remaining complex including the extension of City Gate Boulevard North. This work was completed in May 2021. On December 8, 2020 (Agenda Item 1 LB), the County entered into the Sixth Amendment to the Agreement with Manhattan for work for Phase 2.1 and 2.2A. That phase consists of excavation of additional water management areas (lakes) the extension of City Gate Boulevard North, the addition of five sports fields, internal roadways and parking lots, infrastructure, overnight campground, and the additional parking spaces for the Cove area. Phase 2 update: The excavation of water management areas and other related site construction elements are largely complete. The extension of City Gate Boulevard North, the addition of four sports fields, internal roadways, and parking lots are approximately 70% complete. With a priority placed on delivering four fields in advance of the December FBU National Football Championship and in consultation with the operator of the Sports Complex, Sports Facilities Management, LLC, it was determined that field completion target date needs to be November 2022. To achieve this completion date, the fifth field (field No. 9) and its associated prefabricated metal building allowance are scoped out of Phase 2.1 and moved into a future Phase 3. Change Order No. 10 (CO #10) to Collier County Sport Complex Phase 2.1 and 2.2A, the Sixth Amendment of Agreement No. 17-7198, provides for a time extension of 145 days to complete Phase 2.1 and 2.2A. Change Order No. 10 includes additional time and related General Conditions and Requirements expense with a budgeted Time and Materials cost of $590,726.28. Other deductive and additive changes that are part of CO #10 result in this Change Order having a small net deductive impact of ($3,088.63) on the Agreement. The time extension provided by CO #10 is required due to the impact on the supply chain caused by both material shortages and shipping delays in the aftermath of the COVID-19 pandemic. Impacts to the production and shipping schedule of PVC conduit drastically influenced the construction schedule. Much of the delay in material delivery was related to the agreement between the County and Florida Power and Light to provide roadway and parking lighting along with required materials including conduit. Additionally, internal Purchase Order and Notice to Proceed processing timelines for Phase 2.1 and 2.2A may have contributed to the need for additional time. Outstanding Phase 2.1/2.2A matters include material cost escalation claims that have not yet been reviewed by staff or the County Attorney's Office and are referenced herein for informational purposes. Phase 3 update: Phase 3 will include field No. 9 and its associated prefabricated metal building structure, the south parking lot and potentially a bathroom structure (Bldg. 18) originally value engineered out of Phase 2. Staff will construct this phase through a new contract mechanism separate from the current Manhattan contract. Potential start of construction is early 2023 with an approximate construction timeline of six to eight months. Next step: present a contract award to the Board at a future meeting. Phase 4 update: This phase consists of eleven multipurpose fields (five fields will be softball, mini soccer, and little league, six fields will be baseball and soccer) as well as ancillary buildings. Building selection and design will be determined through the design process and may include: • Mini -welcome center • Several concessions and restrooms • Trophy presentation plaza • Mini marketplace Packet Pg. 151 07/12/2022 • Storage and maintenance building Phase 4 design and construction management services are estimated to be $1.4M with estimated construction costs between $25M and $30M. Financing will be required. Next step will be to present a design contract and a plan of finance to the Board at a future meeting. Phase 5: Phase 5 contemplates a two-story field house, a gymnasium, and RV Parking. Estimated construction cost is approximately $42M. Estimated design cost is approximately $2.5M. On September 16, 2021, a Community Development Block Grant (through the Department of Economic Opportunity ("DEO")) grant application for the Paradise Coast Sports Complex Field House/Shelter was approved by the Board. The intent of the grant is to harden the field house structure to accommodate special needs & general population during storm events. This grant application is in the amount of $14.3M. Staff anticipates notification of award status once the application review from the DEO is complete. Next step: report back to the Board on grant award status. Potential Termination: Section XV of Agreement No. 17-7198 allows the County to terminate the Agreement, at any time upon 30 calendar days written notice to the Construction Manager. The recommendation includes Board direction to the County Manager or designee to issue the requisite notice of intent to terminate to Manhattan Construction, if necessary, subject to Board ratification at a future Board meeting. At the moment, staff has not determined the actual cost of terminating the Agreement, including compensating the Construction Manager for work completed through the various phases or ancillary expenses/costs that are subject to reimbursement upon terminating the Agreement. FISCAL IMPACT: Change Order No. 10 is offset by additive and deductive scope adjustments and does not impact the current Sports Complex budget (Sports Complex Fund (370) Project No. 50156). The primary deductive element of Change Order No. 10, (prefabricated metal building structure), will be bid as part of Phase 3 following completion of Phase 2 work. Phase 3 funding: Sufficient estimated budget of approximately $3M is available from contract deductions and budgeted funds in the FY 22 and FY 23 Sports Complex Fund (370) Project No. 50156 to complete Field 9 and related shade structure being moved from Phase 2 to Phase 3. Phase 4: Design and construction cost is expected to be between $26M and $31M. Moving forward with this phase will require a combination of pay -go funding from the TDC 5th Penny allocation for the Sports Complex, General Fund capital program funding, and a Commercial Paper/Bonding plan of finance. A more specific plan of finance will be presented when the Phase 4 design contract is brought to the Board for approval. Phase 5 design and construction costs are estimated to be $45M. Proceeding with Phase 5 will depend on several factors including the availability of grant funding. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action.
