Agenda 07/12/2022 Item #11D ($10 Million Budget Amendment to recognize American Rescue Plan Act revenues)07/12/2022 EXECUTIVE SUMMARY Recommendation to authorize a $10 million budget amendment to recognize American Rescue Plan Act revenues to be used on nublic safetv. OBJECTIVE: To authorize a budget amendment to recognize the Revenue Loss Standard Allowance of $10 million for public safety. CONSIDERATIONS: Collier County received funding from the American Rescue Plan Act of 2021 (ARP) which was signed into law on March 11, 2021. On March 22, 2022, the Board approved agenda item 16.D.7. which reallocated the funds in accordance with Board's direction and in accordance with the final federal program and regulatory guidelines which went into effect on April 1, 2022. One of the categories of eligible uses is public sector revenue loss. The US Dept of Treasury rules allowed the Counties to use Recovery Funds to provide general government services, up to the amount of revenue loss experienced using one of two approaches. The approaches include selecting the standard allowance of up to $10 million or the county may calculate actual revenue loss using the US Treasury formula. On March 22, 2022, the Board approved the standard allowance of $10 million to be used on public safety. The regulations further stated that the County needs to "show" how the $10 million Revenue Loss was managed and spent. Depositing the $10 million in the General Fund is good, only if we can show (with a budget amendment) how we spent the money. By offsetting the Sheriff's transfer with the $10 million Revenue Loss funding would document that we used the $10 million on public safety services. FISCAL IMPACT: A budget amendment is needed in the General Fund (001) to recognize the $10 million Revenue Loss funding (revenue) received from the American Rescue Plan Act (ARP) and remit (expense) the funding to the Sheriff's Office. The Revenue Loss funding will be used to offset the Sheriff's final monthly transfer in August. The Sheriff's Office will still receive the final payment of $17,962,737, however, $10 million will be funded through the ARP and the balance of $7,962,734 will be a General Fund transfer. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues and requires majority vote for Board approval. -JAK RECOMMENDATION: To authorize the necessary budget amendment to document how the County spent the American Rescue Plan's Revenue Loss standard allowance of $10 million on public safety.
