EXECUTIVE SUMMARY
Recommendation to approve the selection committee's ranking and authorize staff to enter into
contract negotiations with Cardno, Inc., related to Request for Professional Services (RPS) No. 22-
7973, "Independent Design Peer Review Services for Transportation Engineering Projects," and to
bring a proposed agreement back for the Board's consideration at a future meeting. (Estimated
Fiscal Impact: $200,000, Gas Tax and Surtax)
OBJECTIVE: To approve the selection committee's ranking of RPS No. 22-7973 and to negotiate an
agreement to engage Professional Engineering Design Peer Review Services for three Transportation
Engineering projects.
CONSIDERATIONS: The three Transportation Engineering projects are as follows:
1. 16th Street NE Bridge: The project encompasses approximately a 3.3-mile section of 16th Street
NE from the intersection with Golden Gate Boulevard East extending north to the intersection
with Randall Boulevard. 16th Street NE intersects with a series of narrow dead-end streets. The
proposed roadway improvements for this project consist of adding a new bridge, providing
additional lane width and shoulders by widening to the west of the existing roadway. The project
will add a new signal system at the intersection of 16th Street NE and Randall Boulevard.
2. Vanderbilt Beach Road Extension, Phase 2: This project will consist of the construction of a two-
lane road extending Vanderbilt Beach Road, from 16th Street NE to Everglades Boulevard,
including a bridge over the Golden Gate Main Canal and a new intersection at Everglades
Boulevard. This project is a continuation of the Vanderbilt Beach Road Phase 1 Project from
Collier Boulevard to 16th Street NE and will provide similar project elements.
3. Wilson Boulevard Widening: This project will consist of the widening of Wilson Boulevard
North for a stretch of approximately 3.7 miles from Golden Gate Boulevard to Immokalee Road
from a two-lane undivided facility to a four -lane divided roadway with curb and gutter. The
project will add sidewalks, a shared -use path, bike lanes as well as enhancing the existing bus
stops. Additional project elements include upgrades to the drainage system, replacement of the
existing bridge over the Cypress Canal, and acquisition of right of way.
The consultant will provide independent peer review services for the design phase of each project. The
design phases for these projects will vary. We anticipate the design phases commencing in October of
2022 and completing in 2027.
On February 15, 2022, the Procurement Services Division issued Request for Professional Services (RPS)
Solicitation No. 22-7930, Independent Design Peer Review Services for Transportation Engineering
Projects. The County received one proposal by the April 8, 2022, submission deadline. The firm was
found to be responsive and responsible.
Due to limited initial response, the RPS was extended twice for a total of 17 days. The first extension
was until March 22, 2022, and the second and final extension was to April 8, 2022. Vendor outreach was
conducted during both extension periods to increase competition.
A selection committee convened on May 3, 2022, to evaluate and score the only proposal received which
was from Cardno, Inc. Since Cardno, Inc., was the only responsive and responsible firm to respond to the
RPS, they ranked first.
The evaluation criteria included: ability of professional personnel; certified minority business enterprise;

past performance/references; project approach, willingness to meet time and budget requirements;
location; and recent, current, and projected workloads of the firm. The County requested a minimum of
three references from clients on projects with a similar size for which the submitting firm previously
provided services similar in scope and complexity.
Subject to the Board's approval of staff s recommendation, staff will begin contract negotiations with the
top ranked firm, Cardno, Inc., in accordance with Florida Statutes, Section 287.055, the Consultants'
Competitive Act. Cardno, Inc., has provided services on various Collier County projects over the past 10
years and operated in Florida since 1984.
FISCAL IMPACT: Approval of this item does not result in a direct fiscal impact; however, the source
of funding for the future contract (subject to board approval at a subsequent meeting) will be Gas and
Surtax.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this
item.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for approval-RTT
RECOMMENDATION: To approve the selection committee's ranking and authorize staff to enter into
contract negotiations with Cardno, Inc., related to Request for Professional Services (RPS) No. 22-7973,

Solicitation 22-7973 for Independent Design Peer Review Services for Transportation Engineering Projects.
Thirty-four thousand nine hundred twenty four (34,924) vendors were notified, and eighty-six (86) vendors

INTRODUCTION
As requested by the Transportation Engineering Division (hereinafter, the "Division or Department"), the Collier County Board of
County Commissioners Procurement Services Division (hereinafter, "County") has issued this Request for Professional Services
(hereinafter, "RPS") with the intent of obtaining proposals from interested and qualified Consultants in accordance with the terms,
conditions and specifications stated or attached. The Consultant, at a minimum, must achieve the requirements of the
Specifications or Scope of Work stated.
BACKGROUND
The County is interested in receiving qualifications and proposals from experienced design teams to provide independent design
peer review services for the following three projects:
1. 16th Street NE Bridge: (Estimated Design Schedule: February 2022 thru March 2024; Estimated Construction Cost:
$8.1M, Source of Funds — Surtax and LAP)
The project encompasses approximately a 3.3-mile section of 16th Street NE from the intersection with Golden Gate
Boulevard East extending north to the intersection with Randall Boulevard. 16th Street NE intersects with a series of
narrow dead-end streets. The improvements proposed will provide connectivity and roadway enhancements to those dead-
end streets and improve emergency response times and safety along the corridor.
A PD&E Study entitled "Golden Gate Estates Bridge Crossings" was completed for this site in September 2016. The
proposed roadway improvements for this project consist of adding a new bridge, providing additional lane width and
shoulders by widening to the west of the existing roadway. The widening will provide 11-foot travel lanes with 6-foot
shoulders (4-foot paved plus 2-foot unpaved) along the entire length of the project. A 6-foot sidewalk will be constructed
to the west of the roadway.
The typical section of the proposed bridge consists of two, 12-foot travel lanes, 6-foot shoulders on each side, and a 6-foot
sidewalk on the west side of the bridge. The proposed bridge width and length is 44 feet 7.5 inches and 142 feet,
respectively. The final design shall confirm or modify these parameters for the bridge.
The project will add a new signal system at the intersection of 16th Street NE and Randall Boulevard.

2. Vanderbilt Beach Road Extension, Phase 2: (Estimated Design Schedule: July 2022 thru December 2022; Estimated
Construction Cost: $12.98M)
This project will consist of the extension of two -lanes along Vanderbilt Beach Road., from 16th Street NE to Everglades
Boulevard including a bridge over the Golden Gate Main Canal and a completely new intersection at Everglades Blvd.
This project is a continuation of the Vanderbilt Beach Road Phase 1 Project from Collier Boulevard to 16th Street NE and
will provide similar project elements.

from Immokalee Road (County Road (CR) 846) to Golden Gate Boulevard (CR 876) from a two-lane undivided facility to
a four -lane divided roadway with curb and gutter. The project will add sidewalks, a shared -use path, bike lanes as well as
enhancing the existing bus stops. Additional project elements include changes to access along the corridor, upgrades to the
drainage system, replacement of the existing bridge over the Cypress Canal, coordination of potential utility relocations,
and acquisition of right of way.

TERM OF CONTRACT
County reserves the right to modify this scope during negotiations for budgetary reasons.
The contract term, if an award is made, will commence on the date of the Notice to Proceed and end upon acceptance and approval
of the final payment.
Prices shall remain firm for the term of the awarded contract.
Surcharges will not be accepted in conjunction with this award, and such charges should be incorporated into the pricing structure.
DETAILED SCOPE OF WORK
The purpose of this exhibit is to describe the scope of work and the responsibilities of the CONSULTANT and the COUNTY
in connection with the independent peer review services required for this project.
The independent peer review services for this project include a coordinated review of the designs as they are developed for
the three projects listed below
• The 161 Street Bridge
• Vanderbilt Beach Road Extension Phase 2
• Wilson Boulevard Widening
Each project will have its own design and design team with the County coordinating the independent peer review process.
The Consultant will provide independent design peer review services for the activities as defined in each of the three projects
Scope of Services, which references the Florida Department of Transportation (FDOT) manuals, and procedures. For this
project the CONSULTANT and/or Sub-Consultant(s) must be FDOT qualified (Rule Chapter 14-75) to perform the assigned
work and/or services required of the project. At a minimum, the CONSULTANT and/or Sub- Consultant(s) must be qualified
to perform/review the design for the following types of work:

The CONSULTANT shall review the plans and documentation as provided by the COUNTY. The independent peer review
will be based on standards promulgated in the latest editions of minimum requirements as noted by the following manuals
and guidelines:

• Manual of Uniform Minimum Standards for Design, Construction and Maintenance (Florida
Greenbook)
• Florida Department of Transportation Standard Plans for Road Construction
• Florida Department of Transportation Standard Specifications for Road and Bridge Construction
• Manual on Uniform Traffic Control Devices (MUTCD)
• American Association of State Highway Transportation Officials (Greenbook)
• Collier County Traffic Operations Signalization Technical Special Provisions
• Collier County Traffic Operations Roadway Lighting Technical Special Provisions. Including, but not
limited to any other applicable manuals, provisions and standards to complete the review of the plans.
The CONSULTANT shall attend a minimum of one design review coordination meeting per phase per project as specified
below. The meeting(s) may be conducted in person, virtually by Skype, MS Teams, or Zoom. The COUNTY shall provide
electronic plans and documentation for mark up at the 60% and 90% submittals through Bluebeam Revu or a County FTP box
account. The CONSULTANT shall deliver tabulated written comments to the COUNTY including the responses from the
originator of the design comments for each submittal received (in electronic format). Submittals for review may include but not
necessarily limited to roadway plans set and the component plans (Signing and Marking, Signal, Lighting, and Structures);
Reports (Drainage, Geotechnical, BDR, NSR, Cost Estimates, Technical Specifications); Typical Section Package; Pavement
Design Package. The CONSULTANT will have a period of 21 days to provide initial review comments (for each phase
submittal) and 10 days to reply to responses from the design consultant.
The CONSULTANT shall become familiar with the project(s) design scope of services and provide a critical technical review of
the engineering plans and documents. The independent peer review is intended to be a comprehensive, thorough check of the
Engineer of Record plans and calculations. All outstanding/ unresolved comments and issues presented at each phase review are
required to be resolved and implemented prior to the next plan submittal phase. Each review phase for each project shall include
but not limited to the independent confirmation of the following when applicable:
1. Compatibility of the typical roadway and bridge sections, with the horizontal and vertical geometries.
2. Compatibility of the construction phasing with the Traffic Control Plans
3. Horizontal and vertical clearances for bridges, overhead structures, and roadside features
4. Potential conflicts with underground and overhead utilities

Pine Ridge Road and Logan Boulevard / Pine Ridge Road and Airport -Pulling Road
Intersection Improvements, Collier County, FL. Project Manager for design to enhance the
operational characteristics of the intersection by adding and/or extending the left -turn lane.
Study efforts included peak -hour traffic counts, intersection level of service, and queueing
analysis using Synchro software. Design services included survey, roadway, drainage,
structures, traffic signal, lighting, signing and pavement marking design. This was a LAP project
where Cardno worked closely with both Collier County and FDOT to design and permit the
projects. Additional efforts included supporting the County with bid -phase and post design work.
Sidewalk Improvements (LAP Projects), Collier County, FL. Project Engineer for
engineering design, survey and utility coordination for various sidewalk projects throughout
Collier County. These sidewalk projects are LAP -funded and include:
> Golden Gate Parkway from Sunshine Boulevard to Collier Boulevard (CB 951)
> Golden Gate City Sidewalks
> New Market Road West from SR 29 (North 15th Street) to SR 29 (East Main)
> East Naples Sidewalk
1-75 (SR 93) South of SR 82 to South of Luckett Road, FOOT District One, Lee County, FL.
Deputy Project Manager for interstate widening of a 1.5-mile section of 1-75 in Lee County. The
project limits were from south of SR 82 (ML King Boulevard) to South of Luckett Road. This
project constructed the Stage I roadway improvements which widened the Interstate from four
lanes to six lanes by widening one lane in each direction toward the median. The widening did
not encroach into the 44-foot-wide multi -modal corridor. The pond designs and permitting were
accomplished for the Stage II roadway improvements, which consisted of 8-lane and 10-lane
widening. The project included bridge widening of the twin bridges crossing over SR 82.
Metro Parkway (SR 739) from Winkler Avenue to North of SR 82, FOOT District One,
Lee County, FL. Project Engineer for the design and preparation of construction plans for the
construction of Metro Parkway, Sections 1 and 2. Modified existing contract for the preparation
of construction plans for the six -lane Metro Parkway, re -construction of Evans Avenue and
milling and resurfacing of Fowler Street to facilitate the one-way pair concept developed in the
PD&E phase.
45th Street East Roadway Improvements, Manatee County, FL. Engineer of Record for
reconstructing 45th Street from a two-lane facility to a four -lane divided roadway from SR 70
(53rd Avenue) to 44th Avenue E. This capacity improvement project is critical to the area and is
the main connection between two high traffic arterial roadways. Safety improvements included
sidewalks, bicycle lanes and lighting and new signals with pedestrian features at the 45th
Street intersections with SR 70 and 44th Avenue East. This project also included widening an
existing bridge to accommodate the additional travel lanes, and two new pedestrian bridges.
44th Avenue East from 19th Street Court East to US 301, Manatee County, FL. Engineer of
Record for final plans and specifications for improvements to approximately one mile of

roadway. Design consists of a four -lane divided urban roadway with a 22-foot raised median
with curb and gutter, two 12-foot travel lanes in each direction, bicycle lanes in each direction,
5-foot sidewalks along both sides of the roadway, and a 120-foot-wide right-of-way. The project
includes improvements to adjacent connecting roadways for overall traffic circulation. These
improvements include two roundabouts along 38th Avenue East. Other improvements include
roadway lighting, signing and pavement marking, and new water distribution main.
2°d Avenue East from 12' Street East to 24' Street East (Complete Streets
Improvement), Bradenton, FL. Project Manager for preliminary design and study for
implementing complete streets elements along a one -mile section of 2°d Avenue East. The
project includes two phases involving alternatives for roundabouts, multi -use trail, pedestrian -
activated refuge islands, and LID to improve mobility and safety for all users while provided a
green infrastructure. The project includes multiple geometric alternatives, traffic analysis,
drainage, environmental, utility impacts, right-of-way impacts, safety and construction cost.
Moccasin Wallow Road from US 41 to West of 1-75, Manatee County, FL. Roadway
Engineer of Record. The roadway typical section will consist of an ultimate six -lane divided
urban roadway with a raised grass median, three travel lanes in each direction, bike lane in each
direction, sidewalk on the south side and multi -use path on the north side. Plans will be
developed to construct the outside lanes in each direction. The project length is approximately
1.9-miles.
Honore Avenue at Old Farm Road Intersection Improvements, Manatee County, FL.
Project Manager for this intersection improvements project. Cardno provided roundabout
analysis and design for this stop -sign -controlled intersection. Our single -lane roundabout design
provides significant efficiency and LOS improvements along with added safety features such as
pedestrian crossings, ramps for bike -lane transitions, and lighting to increase visibility of all
users. Several challenges were encountered during design, but Cardno's design team found
cost-effective solutions.
Bee Ridge Road from Mauna Loa Boulevard to Iona Road, Sarasota County, FL. Senior
Roadway Engineer for reconstructing and widening Bee Ridge Road from two to four lanes. The
project involved adding street lighting, sidewalks, bike lanes, resurfacing, traffic analysis, trails,
and utilities upgrades. Four roundabouts were added along the project for access management
and replacing aging signalized intersections.
SR 50 from US 19 to West of CR 587 (Mariner Boulevard), FOOT District Seven,

includes redesigning the bridge to resist the wave forces in a more efficient manner than the
originally designed structure. The CSI is anticipated to save a total of $1 million from the original
bridge design.
Gordon River Connector Bridge and Boardwalk, City of Naples, FL. Project Manager and
Engineer of Record for this pedestrian bridge and boardwalk design. Cardno designed the bridge
and boardwalks that provide a connection for the area's beaches, parks, rowing community,
environmentalist, and trail users. This overpass provides a continuation of the Greenway Trail to
Freedom Park and beyond to the north. The design requested by the City was for both the east
and west boardwalks to be composed of 10-foot spans. The west boardwalk was modified to
reflect the lighter vehicle load. The east side of the boardwalk was constructed utilizing the top -
down construction technique to minimize construction impacts to surrounding conservation area.
Ipe wood was used to create decorative rails and decking for the boardwalks.
Moccasin Wallow Road from US 41 to West of 1-75, Manatee County, FL. Principal -in -
Charge for comparison and recommendations for the most feasible and cost-effective alignment.
The roadway typical section will consist of an ultimate six -lane divided urban roadway with a 22-
foot raised grass median, three 12-foot travel lanes in each direction, 7-foot bicycle lane in each
direction, 6-foot sidewalk on the south side and 12-foot wide multi -use path on the north side of
the roadway. Plans will be developed for the interim phase to construct the outside lanes in each
direction. Proposed right-of-way would be approximately 150 feet wide. The project length is
approximately 1.9 miles.
44th Avenue East from 19th Street Court East to US 301, Manatee County, FL. Principal -in -
Charge for final plans and specifications for improvements to approximately one mile of
roadway. Design consists of a four -lane divided urban roadway with a 22-foot raised median
with curb and gutter, two 12-foot travel lanes in each direction, bicycle lanes in each direction,
5-foot sidewalks along both sides of the roadway, and a 120-foot-wide right-of-way. The project
includes improvements to adjacent connecting roadways for overall traffic circulation. These
improvements include two roundabouts along 38th Avenue East. Other improvements include
roadway lighting, signing and pavement marking, and new water distribution main.
45th Street East Roadway Improvements, Manatee County, FL. Principal -in -Charge for
reconstructing 45th Street from an existing two-lane facility to a four -lane divided roadway from
SR 70 (53rd Avenue) to 44th Avenue East. This capacity improvement project is critical to the
area and will serve as the main connection between two high traffic arterial roadways. Safety
improvements along the corridor included the addition of sidewalks, bicycle lanes and lighting
along the entire corridor and new signals with pedestrian features. This project also included

Lee County Roundabout Projects, Lee County, FL. Gateway Boulevard is a 4-lane divided
minor arterial street. Commerce Lake Drive and Griffin Drive are 2-lane minor collector streets.
The intersection is controlled by stop signs on Commerce and Griffin. Lee DOT received
complaints that motorists were experiencing excessive delay and crashes. This study was done
to determine the appropriate traffic control for the intersection. Cardno provided Traffic
Engineering Services for the evaluation, design, plans preparation, permitting and post design
services of intersection improvements for the intersection. The improvements consist of
changing the existing control of a 4-way intersection to an alternative design at the intersections
of Gateway Boulevard at Commerce Lake Drive and Gateway Boulevard at Griffin Drive. The
alternative analysis considered two different options: signalized intersection and roundabout.

roadway corridor alternatives for 60th Avenue East so roadway corridor reservations could be
included in any site development plans approved by the County. The study considered multiple
alternative alignments through the corridor and documented the alternative alignments that
were considered most feasible. The study also established evaluation criteria that normally
influence selection of roadway alignments, and made reasonable projections for probable
construction and right-of-way costs and other evaluation factors such as wetland impacts. For
the study purposes, the typical section included a 22-foot curbed and landscaped median, 12-
foot travel lanes, 4-foot bicycle lanes and 5-foot sidewalks.
US 301/Fort Hamer Road Intersection and Bridge, Manatee County, FL. Senior Drainage
Engineer for drainage issues that will be accommodated by a curb and gutter system for
collection of stormwater and underground storm sewer for stormwater conveyance. The project
includes a stormwater management system meeting regulatory requirements and inlet and storm
system design, pond siting analyses and design, and environmental permitting. Roadway design

Project Experience
As -Needed Civil Engineering Plan Review and Inspection Services, Treasure
Island, FL. Cardno is providing civil engineering review and inspection services, as required
by the City for subdivision plats, site plans, site modifications, seawall applications and
permit submissions in conformance with the City of Treasure Island Land Development
Regulations. Ms. Bergeron is currently serving as Project Manager for the City's Seawall
Conditional Assessment and Recommendation Report Project. As part of this project, Cardno
is investigating 22 seawall locations with a total approximate length of 5,120 linear feet.
Services performed will include public meetings, site observations, GIS data in support of the
final report.
Stan Gober Memorial Bridge Assessment and Rehabilitation, Collier County, FL.
Project Manager and FOR for this bridge formerly known as the Goodland Bridge. The primary
objective of this project is to address/repair all deficiencies identified in FDOT Bridge
Inspection Reports per applicable codes, guidelines, regulations, and permitting agency
requirements. Cardno was tasked to identify, evaluate and recommend potential
upgrades/improvements that will extend the useful service life of the structure and mitigate
future deterioration.
Stan Gober Memorial Bridge Emergency Embankment Repair, Collier County, FL.
Project Manager. This project's purpose is to repair damage suffered during Hurricane Irma.
Damage included erosion of riprap protection and loss of embankment under the end bent.
The riprap shore protection under the bridge washed out during Hurricane Irma and the
Cardno Team provided the County with repair plans.
Chokoloskee Bridge (CR 29 over Chokoloskee Bay), Collier County, FL. Project
Manager and EOR. Led by Ananda, Cardno's structures staff worked with Kelly Brothers Inc.
Contractors on a Cost Savings Initiative (CSI) for the CR 29 over Chokoloskee Bay bridge
replacement in Collier County. The CSI includes redesigning the bridge to resist the wave
forces in a more efficient manner than the originally designed structure. The CSI saved
approximately $1 million from the original bridge design.
Rye Road Bridge Widening, Manatee County, FL. Project Manager / Engineer of Record
for this north -south corridor in Manatee County connecting SR 64 to SR 70. Manatee County
tasked Cardno with widening the two bridge structures, Bridge No. 134025 and Bridge No.
134026 over Branches of Mill Creek. The bridges are precast flat slab unit structures
supported on 12-inch pile foundations of unknown depth. The bridge widenings will be
supported on steel H-piles to minimize vibrations on the adjacent existing bridge foundations
during construction.
44th Avenue East from 19th Street Court East to US 301, Manatee County, FL.
Structures Engineer for stormwater management systems for treatment of the stormwater
runoff. The treatment was accommodated in offsite stormwater treatment ponds and linear

treatment ditches. The project also included creation of a new mitigation site to offset
wetlands that are to be impacted.
General Engineering Consultant Services, FDOT District Three, Chipley, FL. For this
GEC project, Ananda provided QC services by assisting with structures plans reviews.
Structures plans reviews have consisted of steel girder bridges, pre- stressed Florida I -Beam
(FIB) bridges, pre -stressed slab unit bridges, Geosynthetic Reinforced Soil (GRS) bridges, and
box culvert.
45th Street East Roadway Improvements, Manatee County, FL. Structures Engineer for
reconstructing 45th Street from an existing two-lane facility to a four -lane divided roadway
from SR 70 (53rd Avenue) to 44th Avenue East. This capacity improvement project is critical
to the area and will serve as the main connection between two high traffic arterial roadways.
Safety improvements along the corridor included the addition of sidewalks, bicycle lanes and
lighting along the entire corridor and new signals with pedestrian features.
Wauchula Road over Youngs Creek Bridge Replacement, Manatee County, FL.
Project Manager. This project involves evaluating a replacement for the aging two -span flat
slab bridge carrying Wauchula Road over Youngs Creek in Manatee County. The scope of
work included a site inspection, topographical survey, and SPT borings to support the
development of a Geotechnical Recommendations Report, Preliminary Bridge Hydraulics
Memorandum, and Bridge Recommendation Memo. The Bridge Recommendation Memo
includes an evaluation of bridge replacement alternatives and construction cost estimates.
Cardno prepared the Bridge Development Report Memo, preliminary and final plans for the
replacement of the Wauchula Rd. Bridge over Young's Creek in Manatee County. The original
structure, constructed in 1951, is at the end of its design life.
Citywide Bridge Rehabilitation Engineering Services, City of Sarasota, FL. Project
Manager for this contract to evaluate, inspect, and make recommendations to rehabilitate
and maintain bridges and box culverts throughout the city. Cardno is responsible for all
phases of the project, from pre -design (data collection, coordination with stakeholders, and

Palm Creek Culvert Replacement, Hernando County, Weeki Wachee, FL. Structural
Quality Control Reviewer for replacement of a culvert carrying Palm Creek Drive over Palm
Creek in Weeki Wachee. The structure consists of a single -barrel concrete box culvert with a
span of 8 feet and a length of 40 feet. The project is currently near the end of the design
phase and has a preliminary construction cost estimate of $440,000.

Description: Collier County tasked Cardno with providing an independent peer review of five County projects. These projects
were a mix of traditional design -bid -build and design -build and all capacity improvements. The schedule is always a critical
component of any design project, but schedules are paramount with design -build projects. For that reason, Cardno selected the
most experienced team members from each design discipline to conduct the independent peer reviews. With over 200 years of
combined years of experience, the review team was able to beat the review schedule ensuring that the project stayed on track.
Our team conducted the reviews through Bluebeam, a cloud -based technology that streamlined the communication process. The
design teams provided electronic versions of the plans in Bluebeam and all of Cardno's comments were electronically marked on
the plans for clarity. The comments were also exported into an Excel file to which the designers could provide their responses.
The last critical step in this process was the opportunity for the Peer Review Team to provide concurrence for the responses.
This step adds review time but is important to close the communication circle and ensure comments are properly interpreted.
Cardno's reviews were all -encompassing and cross -discipline. Roadway reviewers were focused on horizontal and vertical
geometry, but also reviewed onsite and offsite grading issues that would present drainage challenges. Our traffic reviewers
often team with the structures reviewers for mast arm design and the roadway reviewers for geometric concerns. At Cardno, we
understand that communication between all the review disciplines is crucial in covering all design aspects of the project.

Description: PD&E evaluation and design of Moccasin Wallow Road from US 41 to West of 1-75 in Manatee County, Florida.
Evaluation included comparison and recommendations for the most feasible and cost-effective alignment.
The roadway typical section will consist of an ultimate six -lane divided urban roadway with a 22-foot raised grass median, three
12-foot travel lanes in each direction, 7-foot bicycle lane in each direction, 6-foot sidewalk on the south side and 12-foot wide
multi -use path on the north side of the roadway. Plans will be developed for the interim phase to construct the two inside lanes
in each direction. Proposed right-of-way would be approximately 150 feet wide. Stormwater collection, conveyance treatment
ponds, floodplain compensation, and wetland mitigation will be designed and permitted for ultimate six -lane urban section. The
project length is approximately 1.9-miles.
Stormwater conveyance system will be accommodated within an underground storm drainage system. Two stormwater
management facilities will be required for stormwater treatment and attenuation for all roadway improvements. It is anticipated
that the existing stormwater treatment ponds located in the adjacent developments cannot be utilized for a portion of the
stormwater management system for this roadway project. The stormwater management facilities will be designed to meet
current Environmental Resource Permitting requirements, and also meet County discharge criteria.
The existing right-of-way between US 41 and west of 1-75 consists of multiple widths and configurations. The alternative
alignment study evaluated environmental, social, and utility impacts, and right-of-way cost. Environmental evaluation includes
ecological resources, endangered species, contamination screening and cultural resources assessment survey.
PD&E study is complete and the project is now under design.
Innovative Solutions:
Moccasin Wallow Road expansion project involved relocating water, sewer, and reclaimed water utilities which demand
constant coordination with the roadway, signaling, lighting, and drainage designers along with the client. Cardno understands
the demands and incorporates innovative working solutions in-house to bring these disciplines together to streamline the
coordination process with one point of contact to the client. The end result is a quality project that incorporates team effort,
seamless communication, and lowers coordination costs between disciplines. This method also fosters value engineering to the
client due to the synergy it creates.

Description: SR 50 is the principal east/west arterial in Hernando County and is a part of the Florida Intrastate Highway System
(FINS) and the Strategic Intermodal System (SIS). It is a hurricane evacuation route, major commuter route and truck route. The
project limits are from US 19 (SR 55) on the west to west of CR 587 (Mariner Boulevard) on the east, for a total length of 3.8
miles.
This project consists of widening SR 50 by adding an additional lane in the west bound direction on the outside and adding
an additional lane in the east bound direction on the inside to accommodate a six -lane divided rural section and milling and
resurfacing of the existing four lanes. Proposed pedestrian and bicyclist features include constructing a 5-foot sidewalk on the
north side and a 10-foot-wide shared use path on the south side. This project also includes the milling and resurfacing of a
portion of US 19 (SR 55).
Drainage design utilizes roadside ditches to collect the runoff and convey it to ponds via an enclosed drainage pipe system.
Off -site ponds are required for treatment and attenuation of the runoff. Current signals will be replaced with mast arms at four
locations. Lighting Plans, Signing & Pavement Marking Plans and Interconnect Plans are required as part of this project.

This project involved the reconstruction of an existing two-lane rural roadway to a four -lane urban and suburban facility
along the Pasco -Hernando County line. The project length extends from US 19 to east of East Road (2.5 miles). Environmental
permitting, pond design and right-of-way acquisition was completed for the ultimate six -lane urban section.
The project included:

> Design of multiple driveways and side streets.
> Design of a multi -use path, sidewalk and bicycle lanes.

Description: Cardno provided design for Metro Parkway in two phases.
Metro Parkway is a major north -south arterial located in Lee County within the City of Fort Myers. The project included roadway
reconstruction/ widening and new roadway construction. The overall project length was 2.7 miles and consisted of:
Widening Metro Parkway, from Winkler Avenue to Hanson Street, to a six -lane urban section
Construction of the bridge over the North Colonial Waterway, Seminole Gulf Railway, Ten Mile Canal and Palm Avenue
Conversion of Fowler Street and Evans Avenue (two-way traffic facilities) to twin one-way pair
Realignment and reconstruction of Seminole Gulf Railroad tracks along the Evans Avenue
> Reconstruction of a three -lane (northbound) of Evans Avenue from Hanson Street to SR 82
> Reconstruction of Hanson Street from Royal Palm Avenue to east of Cranford Avenue
Considerable coordination with the adjacent community, emergency services personnel, and the general public was required
throughout design and construction process in order for the conversion of twin one-way pair to function as intended. Cardno
conducted a detailed review of the PBE study previously performed for this project which included new public workshops to
analyze the new alignment. Cardno provided unique techniques for construction of the bridge that detailed alternative methods
and cost analysis for each option.
Through extensive coordination efforts with the Florida Department of Transportation, Lee County, City of Fort Myers, Seminole
Gulf Railroad, South Florida Water Management District, US Army Corps of Engineers, and numerous utility companies, many
construction related concerns were addressed early in the design process.
Cardno was selected to provide design, permitting and limited construction administration services for the relocation of the
City's utilities for this project. Design included the relocation of approximately 5,600 LF of potable water main ranging in size
from 6 inches through 24 inches in diameter, 1,400 LF of 12-inch force main and 2,000 LF of sanitary sewer up to 18 inches in
duplex diameter. The pipeline design also included valves, fittings, pressure taps, line stops and associated appurtenances. The
design include the relocation of a submersible type sewage pump station (2,250gpm at 55TDH), and several roadway crossings
which were constructed by horizontal auger boring and pipe jacking method.

design review. As part of our document control policy, we use Bluebeam software as our review and markup tool. Our QC review
process includes a review of the plans to ensure they meet the requirements for standard plans format. One element of our
design review worth noting, includes an integrated review of the various design disciplines and their interrelation relative to
safety. This process has elevated the design of each review we perform making the design as safe as possible.

Description: The project called to reconstruct 2.5 miles of an existing two-lane rural section of roadway to a four -lane urban
and suburban facility. Cardno was responsible for the design plans, calculations, estimates, and specifications for the project.
This challenging corridor includes significant coordination with CSX, who has an adjacent railroad along the southern right-of-
way line.
Our team worked very closely with MOT to minimize impacts to CSX and was very responsive in remedying any issues during
their negotiations with the railroad. Several businesses are located along the north right-of-way limit, which required right-of-
way acquisition. The primary concern for these owners was losing left -turn access to their businesses due to the new raised
median. To accommodate their needs, Cardno provided a design that incorporated a center two-way left -turn lane to restore
left -turn access to the businesses. The center two-way left -turn lanes included islands at strategic locations, which not only
increases safety, but also reduces speeds along this mostly straight corridor.

Cardno's Approach
From a technical perspective, Cardno's proposed approach to this
Independent Peer Review contract is to provide an expert team
with Collier County Peer Review experience, versed in capacity
improvement projects and immediately available with short
notice. Cardno has worked for Collier County for over 20 years
and we know how to quickly and effectively execute project
assignments.
Logistically, Cardno uses a combination of methods and tools to
monitor, schedule and budget labor and equipment resources,
including spreadsheets/reports, work breakdown structures, and
monthly meetings with group managers. Each manager receives
a weekly resource management report that tracks workload and
equipment use. Based on workload as a percentage of capacity,
the weekly reports indicate which disciplines are under goal, on
target or above goal for utilization.
Cardno currently holds a Professional Services Library contract
with Collier County and, over the past year, has been providing
Independent Peer Reviews for multiple projects through that
contract. Out of five projects assigned as part of the task, we
have completed phase reviews for three. With this specific Collier
County experience and our processes and procedures already in
place, our team will have little to no learning curve or setup time.
As part of our document control, we use Bluebeam software as
our review and markup tool. Our QC review process includes a
review of the plans to ensure they meet the requirements for
standard plans format.
One important element of our design review includes an
integrated review of the various design disciplines and their
interrelation to safety. This process has elevated the design of

This Project
Collier County has requested services for independent peer
review of the construction plans for conformity to design
standards and criteria for three transportation projects. This
review will be conducted at the 60% and 90% phases. The
projects include:

During the scoping process, our team will review the project to
determine which disciplines will be required. The discipline leads
will review the concept plans to determine the level of effort

peer review projects for Collier County, we fully understand what
the County expects and the level of effort in terms of fees.

We will schedule and attend at least one coordination meeting
for this project, and more if the County believes it is warranted.
The 60% and 90% plans package will be submitted in Bluebeam
for review. This Bluebeam session is typically set up by the
design team and the peer review team is invited to the session,
but Cardno can certainly lead this effort if it helps streamline
the process for the County. We will provide comments in the
Bluebeam session along with a written tabulated version in Excel.
At this point, our team will also download the submittal package
and comments onto Cardno servers for record keeping, since
reviewers will no longer have access once the session is closed.
Our technical review will confirm the accuracy and constructability
of elements such as these, as they apply to each project:
> Cardno's roadway experts have decades of roadway design
experience and will review each project's horizontal and
vertical geometry. Since criteria for the geometry is tied
directly to the elements of the typical section, we must review
all three elements together as a system and correspond as
one.
Temporary traffic control plans (TTCP) are critical components
and shape public opinion of the project. Our TTCP review will
ensure standards are met, and focus on minimizing impacts to
the traveling public and adjacent business and home owners.
> Clear zone and clearance requirements are key to safety along
any roadway project. In addition to reviewing survey and cross

sections in the plans for these requirements, our reviewers
find using Google Street View identifies elements that may not
stand out on the plan sheets, such as a large utility installation

> Utility conflicts can be easily overlooked during design, but is a
major component that can delay a project during construction.
A detailed review of the existing and proposed utilities will
be an important task to minimize impacts to utilities and the
construction schedule. Our in-house utility design staff can
provide specialty insight to utility conflicts and requirements for
these peer review projects.
> With decades of experience working on County and FOOT
projects, our staff is well versed in the requirements of the
Florida Green Book and FOOT Design Manual. In addition,
our permitting experts can review the plans to make sure
permitting requirements are being met.
> With a fresh -set -of -eyes, our team can review each project
objectively and ensure the County's goals are being met.
> Our detailed checklist is extensive and was derived from
Cardno's own internal QC review procedures. It includes a
detailed list of required information for the submittal package
including plans, specifications, and documentation.

comprehensive design review. Below is a brief overview of a few
of the discipline plan review process.
Signing and Pavement Marking (S&PM)
Our S&PM peer review process includes a review of the plans
to ensure they meet the requirements for standard plans format,
quantity take -offs to ensure the Tabulation of Quantities are
consistent with the plan sheets, General and Pay Item notes are
specific to the project, Maintenance of Traffic notes are applicable
to the construction of the plans, plan sheets include all required
signing and marking elements, the coordination of both the
signing and marking design elements to provide clear direction to
motorists, bicyclists and pedestrians, all signing to include station
and offsets, stationing for each marking element.
Signa/ization
Our traffic signal peer review process includes a review of the
plans to ensure they meet the requirements for standard plans
format, quantity take -offs to ensure the Tabulation of Quantities
are consistent with the plan sheets, General and Pay Item notes
are specific to the project and include any County preferences,
TTCP notes are applicable to the construction of the signal, plan
sheets include all required design elements include signal head
designation and phase association, correctness of the yellow,
all -red and pedestrian clearance timings, street name sign
legends and block numbers, controller operation notes, vehicle
detection design and table, signal structure placement meeting
clear zone requirements with station and offset included, review
to ensure no utility conflicts, proper layout and conduit routing
and placement of pedestrian features and consistency with the
signing and marking plans.
Lighting
Our lighting QC review process includes a review of the plans to
ensure they meet the requirements for standard plans format,
quantity take -offs to ensure the Tabulation of Quantities are
consistent with the plan sheets, General and Pay Item notes
are specific to the project, TTCP notes are applicable to the
construction of the plans, plan sheets include all required lighting
elements including light poles, conduit and conductors, power
service requirements, Pole Legend sheet matching the plans
including station and offset.
Structures
The Cardno team has specific peer review experience relating to
bridge and structures design with both Collier County and FDOT.
Our team, led by Ananda Bergeron, is currently serving the County
on several structural peer review tasks including the Vanderbilt
Beach Road Extension Phase 1 which includes two bridges. Prior
to this project, Ananda served FOOT Districts One, Three, as well
as the Turnpike as the lead structural reviewer in several bridge
projects.
Our approach as peer reviewers for bridge structures is to
examine the plans and design calculations to ensure conformance
with FDOT Manuals including the Structures Design Guidelines
(SDG) and AASHTO LRFD
Bridge Design Specifications.

Meeting Time and Budget Requirements
Schedule Controls
Making and keeping schedule commitments is crucial. Once
the contract is executed, our Project Manager, Jason Yam, PE,
will coordinate with the County PM with regard to schedules
of each project, progress reporting, invoicing procedures, and
communication preferences. Our team developed a specific
schedule for the peer review process that considers a number
of factors such as the size of project and number of design
disciplines required. We also include time for a concurrence
review of responses to our comments, which is critical to ensure
comments are correctly interpreted and fully addressed.
Schedule Management — Meeting schedules successfully
involves effective project management, proactively assessing
each project's progress and anticipating problems before they
arise. Maintaining the schedule requires frequent communication
with the project staff through coordination meetings and email
progress outlines to ensure disciplines are on track with meeting
the review schedule.
We routinely provide roll -up reporting on a project's status so
the County can easily track the project's completion. This takes
the "worry" out of what's going on and what's coming next.
Cardno's processes, procedures, practices, standards, guidelines,
and policies are constantly being monitored and updated. This
will give Collier County the relief and satisfaction that our staff
is providing the best services possible. We continually train and
coach our project managers and project teams. The County can be
assured our staff is equipped with the latest and best techniques
available.
Budget Controls
Strict Cost Control — Cardno understands the need to be
financially responsible and mindful of budget constraints.
Once a scope of services has been agreed upon, Cardno will
propose a reasonable fee that reflects the effort required to
satisfy the scope, while meeting the County's expectations. The
responsibility for cost control on projects lies with Jason Yam, PE,
Cardno's Project Manager.
Our BST accounting system enables the Cardno team to strictly
monitor project financial health, and ensures compliance with
Federal Cost Accounting Standards. The system provides all
necessary information at the contract, project and task levels for
Mr. Yam to effectively manage the project budget. He receives
monthly statements of all project charges, and a monthly

Notice to Proceed (NTP)— Work will commence upon receipt of NTP, with the technical approach conforming to the approved scope
of services.
Communication — A successful project begins and ends with the timely and accurate transfer of information between County
Project Manager and Cardno's Project Manager, Jason Yam, PE. This central point of contact will unburden the County and
streamline interdisciplinary coordination. It will be his responsibility to disseminate information to appropriate parties within
Cardno and our subconsultants.
Ongoing Coordination — An important means of coordination will be monthly project briefings. Discussion will include work

Recent, Current, and Projected Workload of the Firm
Cardno uses a combination of methods and tools to monitor, schedule and budget resources for projects, including resource
management spreadsheets/reports, work breakdown structures, and monthly meetings with group managers. Each manager
receives a weekly resource management report that tracks the workload of our personnel and equipment use. Based on workload
as a percentage of capacity, the weekly reports indicate to managers which disciplines are under goal, on target or above goal for
utilization. This tracking method allows managers to best allocate resources and adjust priorities accordingly to ensure that project
schedules are met. Our current forecast, workload projections and staff/equipment resources allocation report shows we have
ample staff capacity, equipment and project team availability to successfully complete any project on time and within budget.
Workload — Current and Anticipated
Cardno commits to assigning an adequate number of experienced personnel to this project so it is completed on or ahead of
schedule. All of the proposed staff identified in our organizational chart are immediately available and will be assigned to this
project for its entire duration. Many of our current projects are nearing completion, which will allow our team to transition to this
project seamlessly. Our projected staff commitment and availability is such that the project team's current and projected workload
levels allow more than enough capacity to work on this project. Should additional staffing be required for any assignment, more
staff resources can easily be made available to commit to the project.
As one of the County's trusted engineering services consultants, Cardno understands the County's practices and protocols. More
importantly, we understand the County's expectations and what it takes to deliver on those expectations.

MEMORANDUM OF UNDERSTANDING
FOR EMPLOYERS
ARTICLE I
PURPOSE AND AUTHORITY
The parties to this agreement are the Department of Homeland Security (DHS) and the
Cardno (Employer). The purpose of this agreement is to set forth terms and conditions which the
Employer will follow while participating in E-Verify.
E-Verify is a program that electronically confirms an employee's eligibility to work in the United States
after completion of Form 1-9, Employment Eligibility Verification (Form 1-9). This Memorandum of
Understanding (MOU) explains certain features of the E-Verify program and describes specific
responsibilities of the Employer, the Social Security Administration (SSA), and DHS.
Authority for the E-Verify program is found in Title IV, Subtitle A, of the Illegal Immigration Reform and
Immigrant Responsibility Act of 1996 (IIRIRA), Pub. L. 104-208, 110 Stat. 3009, as amended (8 U.S.C.
§ 1324a note). The Federal Acquisition Regulation (FAR) Subpart 22.18, "Employment Eligibility
Verification" and Executive Order 12989, as amended, provide authority for Federal contractors and
subcontractors (Federal contractor) to use E-Verify to verify the employment eligibility of certain
employees working on Federal contracts.
ARTICLE II
RESPONSIBILITIES
A. RESPONSIBILITIES OF THE EMPLOYER
1. The Employer agrees to display the following notices supplied by DHS in a prominent place that is
clearly visible to prospective employees and all employees who are to be verified through the system:
a. Notice of E-Verify Participation
b. Notice of Right to Work
2. The Employer agrees to provide to the SSA and DHS the names, titles, addresses, and telephone
numbers of the Employer representatives to be contacted about E-Verify. The Employer also agrees to
keep such information current by providing updated information to SSA and DHS whenever the
representatives' contact information changes.
3. The Employer agrees to grant E-Verify access only to current employees who need E-Verify access.
Employers must promptly terminate an employee's E-Verify access if the employer is separated from
the company or no longer needs access to E-Verify.

4. The Employer agrees to become familiar with and comply with the most recent version of the
E-Verify User Manual.
5. The Employer agrees that any Employer Representative who will create E-Verify cases will
complete the E-Verify Tutorial before that individual creates any cases.
a. The Employer agrees that all Employer representatives will take the refresher tutorials when
prompted by E-Verify in order to continue using E-Verify. Failure to complete a refresher tutorial
will prevent the Employer Representative from continued use of E-Verify.
6. The Employer agrees to comply with current Form 1-9 procedures, with two exceptions:
a. If an employee presents a "List B" identity document, the Employer agrees to only accept "List
B" documents that contain a photo. (List B documents identified in 8 C.F.R. § 274a.2(b)(1)(B)) can
be presented during the Form I-9 process to establish identity.) If an employee objects to the photo
requirement for religious reasons, the Employer should contact E-Verify at
888-464-4218.
b. If an employee presents a DHS Form 1-551 (Permanent Resident Card), Form 1-766
(Employment Authorization Document), or U.S. Passport or Passport Card to complete Form 1-9,
the Employer agrees to make a photocopy of the document and to retain the photocopy with the
employee's Form 1-9. The Employer will use the photocopy to verify the photo and to assist DHS
with its review of photo mismatches that employees contest. DHS may in the future designate
other documents that activate the photo screening tool.
Note: Subject only to the exceptions noted previously in this paragraph, employees still retain the right
to present any List A, or List B and List C, document(s) to complete the Form 1-9.
7. The Employer agrees to record the case verification number on the employee's Form 1-9 or to print
the screen containing the case verification number and attach it to the employee's Form 1-9.
8. The Employer agrees that, although it participates in E-Verify, the Employer has a responsibility to
complete, retain, and make available for inspection Forms 1-9 that relate to its employees, or from other
requirements of applicable regulations or laws, including the obligation to comply with the
antidiscrimination requirements of section 274B of the INA with respect to Form 1-9 procedures.
a. The following modified requirements are the only exceptions to an Employer's obligation to not
employ unauthorized workers and comply with the anti -discrimination provision of the INA: (1) List B
identity documents must have photos, as described in paragraph 6 above; (2) When an Employer
confirms the identity and employment eligibility of newly hired employee using E-Verify procedures,
the Employer establishes a rebuttable presumption that it has not violated section 274A(a)(1)(A) of
the Immigration and Nationality Act (INA) with respect to the hiring of that employee; (3) If the
Employer receives a final nonconfirmation for an employee, but continues to employ that person,
the Employer must notify DHS and the Employer is subject to a civil money penalty between $550
and $1,100 for each failure to notify DHS of continued employment following a final
nonconfirmation; (4) If the Employer continues to employ an employee after receiving a final
nonconfirmation, then the Employer is subject to a rebuttable presumption that it has knowingly

employed an unauthorized alien in violation of section 274A(a)(1)(A); and (5) no E-Verify participant
is civilly or criminally liable under any law for any action taken in good faith based on information
provided through the E-Verify.
b. DHS reserves the right to conduct Form 1-9 compliance inspections, as well as any other
enforcement or compliance activity authorized by law, including site visits, to ensure proper use of
E-Verify.
9. The Employer is strictly prohibited from creating an E-Verify case before the employee has been
hired, meaning that a firm offer of employment was extended and accepted and Form 1-9 was
completed. The Employer agrees to create an E-Verify case for new employees within three Employer
business days after each employee has been hired (after both Sections 1 and 2 of Form 1-9 have been
completed), and to complete as many steps of the E-Verify process as are necessary according to the
E-Verify User Manual. If E-Verify is temporarily unavailable, the three-day time period will be extended
until it is again operational in order to accommodate the Employer's attempting, in good faith, to make
inquiries during the period of unavailability.
10. The Employer agrees not to use E-Verify for pre -employment screening of job applicants, in
support of any unlawful employment practice, or for any other use that this MOU or the E-Verify User
Manual does not authorize.
11. The Employer must use E-Verify for all new employees. The Employer will not verify selectively
and will not verify employees hired before the effective date of this MOU. Employers who are Federal
contractors may qualify for exceptions to this requirement as described in Article II.B of this MOU.
12. The Employer agrees to follow appropriate procedures (see Article III below) regarding tentative
nonconfirmations. The Employer must promptly notify employees in private of the finding and provide
them with the notice and letter containing information specific to the employee's E-Verify case. The
Employer agrees to provide both the English and the translated notice and letter for employees with
limited English proficiency to employees. The Employer agrees to provide written referral instructions
to employees and instruct affected employees to bring the English copy of the letter to the SSA. The
Employer must allow employees to contest the finding, and not take adverse action against employees
if they choose to contest the finding, while their case is still pending. Further, when employees contest
a tentative nonconfirmation based upon a photo mismatch, the Employer must take additional steps
(see Article III.B. below) to contact DHS with information necessary to resolve the challenge.
13. The Employer agrees not to take any adverse action against an employee based upon the
employee's perceived employment eligibility status while SSA or DHS is processing the verification
request unless the Employer obtains knowledge (as defined in 8 C.F.R. § 274a.1(1)) that the employee
is not work authorized. The Employer understands that an initial inability of the SSA or DHS automated
verification system to verify work authorization, a tentative nonconfirmation, a case in continuance
(indicating the need for additional time for the government to resolve a case), or the finding of a photo
mismatch, does not establish, and should not be interpreted as, evidence that the employee is not work
authorized. In any of such cases, the employee must be provided a full and fair opportunity to contest
the finding, and if he or she does so, the employee may not be terminated or suffer any adverse
employment consequences based upon the employee's perceived employment eligibility status

(including denying, reducing, or extending work hours, delaying or preventing training, requiring an
employee to work in poorer conditions, withholding pay, refusing to assign the employee to a Federal
contract or other assignment, or otherwise assuming that he or she is unauthorized to work) until and
unless secondary verification by SSA or DHS has been completed and a final nonconfirmation has
been issued. If the employee does not choose to contest a tentative nonconfirmation or a photo
mismatch or if a secondary verification is completed and a final nonconfirmation is issued, then the
Employer can find the employee is not work authorized and terminate the employee's employment.
Employers or employees with questions about a final nonconfirmation may call E-Verify at 1-888-464-
4218 (customer service) or 1-888-897-7781 (worker hotline).
14. The Employer agrees to comply with Title VI of the Civil Rights Act of 1964 and section 274B of
the INA as applicable by not discriminating unlawfully against any individual in hiring, firing,
employment eligibility verification, or recruitment or referral practices because of his or her national
origin or citizenship status, or by committing discriminatory documentary practices. The Employer
understands that such illegal practices can include selective verification or use of E-Verify except as
provided in part D below, or discharging or refusing to hire employees because they appear or sound
"foreign" or have received tentative nonconfirmations. The Employer further understands that any
violation of the immigration -related unfair employment practices provisions in section 274B of the INA
could subject the Employer to civil penalties, back pay awards, and other sanctions, and violations of
Title VI could subject the Employer to back pay awards, compensatory and punitive damages.
Violations of either section 274B of the INA or Title VII may also lead to the termination of its
participation in E-Verify. If the Employer has any questions relating to the anti -discrimination provision,
it should contact OSC at 1-800-255-8155 or 1-800-237-2515 (TDD).
15. The Employer agrees that it will use the information it receives from E-Verify only to confirm the
employment eligibility of employees as authorized by this MOU. The Employer agrees that it will
safeguard this information, and means of access to it (such as PINS and passwords), to ensure that it
is not used for any other purpose and as necessary to protect its confidentiality, including ensuring that
it is not disseminated to any person other than employees of the Employer who are authorized to
perform the Employer's responsibilities under this MOU, except for such dissemination as may be
authorized in advance by SSA or DHS for legitimate purposes.
16. The Employer agrees to notify DHS immediately in the event of a breach of personal information.
Breaches are defined as loss of control or unauthorized access to E-Verify personal data. All
suspected or confirmed breaches should be reported by calling 1-888-464-4218 or via email at
EE-Verify(@dhsgov. Please use "Privacy Incident — Password" in the subject line of your email when
sending a breach report to E-Verify.
17. The Employer acknowledges that the information it receives from SSA is governed by the Privacy
Act (5 U.S.C. § 552a(i)(1) and (3)) and the Social Security Act (42 U.S.C. 1306(a)). Any person who
obtains this information under false pretenses or uses it for any purpose other than as provided for in
this MOU may be subject to criminal penalties.
18. The Employer agrees to cooperate with DHS and SSA in their compliance monitoring and
evaluation of E-Verify, which includes permitting DHS, SSA, their contractors and other agents, upon

reasonable notice, to review Forms 1-9 and other employment records and to interview it and its
employees regarding the Employer's use of E-Verify, and to respond in a prompt and accurate manner
to DHS requests for information relating to their participation in E-Verify.
19. The Employer shall not make any false or unauthorized claims or references about its participation
in E-Verify on its website, in advertising materials, or other media. The Employer shall not describe its
services as federally -approved, federally -certified, or federally -recognized, or use language with a
similar intent on its website or other materials provided to the public. Entering into this MOU does not
mean that E-Verify endorses or authorizes your E-Verify services and any claim to that effect is false.
20. The Employer shall not state in its website or other public documents that any language used
therein has been provided or approved by DHS, USCIS or the Verification Division, without first
obtaining the prior written consent of DHS.
21. The Employer agrees that E-Verify trademarks and logos may be used only under license by
DHS/USCIS (see M-795 (Web)) and, other than pursuant to the specific terms of such license, may not
be used in any manner that might imply that the Employer's services, products, websites, or
publications are sponsored by, endorsed by, licensed by, or affiliated with DHS, USCIS, or E-Verify.
22. The Employer understands that if it uses E-Verify procedures for any purpose other than as
authorized by this MOU, the Employer may be subject to appropriate legal action and termination of its
participation in E-Verify according to this MOU.
B. RESPONSIBILITIES OF FEDERAL CONTRACTORS
1. If the Employer is a Federal contractor with the FAR E-Verify clause subject to the employment
verification terms in Subpart 22.18 of the FAR, it will become familiar with and comply with the most
current version of the E-Verify User Manual for Federal Contractors as well as the E-Verify
Supplemental Guide for Federal Contractors.
2. In addition to the responsibilities of every employer outlined in this MOU, the Employer understands
that if it is a Federal contractor subject to the employment verification terms in Subpart 22.18 of the
FAR it must verify the employment eligibility of any "employee assigned to the contract" (as defined in
FAR 22.1801). Once an employee has been verified through E-Verify by the Employer, the Employer
may not create a second case for the employee through E-Verify.
a. An Employer that is not enrolled in E-Verify as a Federal contractor at the time of a contract
award must enroll as a Federal contractor in the E-Verify program within 30 calendar days of
contract award and, within 90 days of enrollment, begin to verify employment eligibility of new hires
using E-Verify. The Employer must verify those employees who are working in the United States,
whether or not they are assigned to the contract. Once the Employer begins verifying new hires,
such verification of new hires must be initiated within three business days after the hire date. Once
enrolled in E-Verify as a Federal contractor, the Employer must begin verification of employees
assigned to the contract within 90 calendar days after the date of enrollment or within 30 days of an
employee's assignment to the contract, whichever date is later.

b. Employers enrolled in E-Verify as a Federal contractor for 90 days or more at the time of a
contract award must use E-Verify to begin verification of employment eligibility for new hires of the
Employer who are working in the United States, whether or not assigned to the contract, within
three business days after the date of hire. If the Employer is enrolled in E-Verify as a Federal
contractor for 90 calendar days or less at the time of contract award, the Employer must, within 90
days of enrollment, begin to use E-Verify to initiate verification of new hires of the contractor who
are working in the United States, whether or not assigned to the contract. Such verification of new
hires must be initiated within three business days after the date of hire. An Employer enrolled as a
Federal contractor in E-Verify must begin verification of each employee assigned to the contract
within 90 calendar days after date of contract award or within 30 days after assignment to the
contract, whichever is later.
c. Federal contractors that are institutions of higher education (as defined at 20 U.S.C. 1001(a)),
state or local governments, governments of Federally recognized Indian tribes, or sureties
performing under a takeover agreement entered into with a Federal agency under a performance
bond may choose to only verify new and existing employees assigned to the Federal contract. Such
Federal contractors may, however, elect to verify all new hires, and/or all existing employees hired
after November 6, 1986. Employers in this category must begin verification of employees assigned
to the contract within 90 calendar days after the date of enrollment or within 30 days of an
employee's assignment to the contract, whichever date is later.
d. Upon enrollment, Employers who are Federal contractors may elect to verify employment
eligibility of all existing employees working in the United States who were hired after November 6,
1986, instead of verifying only those employees assigned to a covered Federal contract. After
enrollment, Employers must elect to verify existing staff following DHS procedures and begin
E-Verify verification of all existing employees within 180 days after the election.
e. The Employer may use a previously completed Form 1-9 as the basis for creating an E-Verify
case for an employee assigned to a contract as long as:
i. That Form 1-9 is complete (including the SSN) and complies with Article II.A.6,
ii. The employee's work authorization has not expired, and
iii. The Employer has reviewed the Form 1-9 information either in person or in
communications with the employee to ensure that the employee's Section 1, Form 1-9
attestation has not changed (including, but not limited to, a lawful permanent resident alien
having become a naturalized U.S. citizen).
f. The Employer shall complete a new Form 1-9 consistent with Article II.A.6 or update the
previous Form 1-9 to provide the necessary information if:
i. The Employer cannot determine that Form 1-9 complies with Article II.A.6,
ii. The employee's basis for work authorization as attested in Section 1 has expired or
changed, or
iii. The Form 1-9 contains no SSN or is otherwise incomplete.
Note: If Section 1 of Form 1-9 is otherwise valid and up-to-date and the form otherwise complies with

Article II.C.5, but reflects documentation (such as a U.S. passport or Form 1-551) that expired after
completing Form 1-9, the Employer shall not require the production of additional documentation, or use
the photo screening tool described in Article II.A.5, subject to any additional or superseding instructions
that may be provided on this subject in the E-Verify User Manual.
g. The Employer agrees not to require a second verification using E-Verify of any assigned
employee who has previously been verified as a newly hired employee under this MOU or to
authorize verification of any existing employee by any Employer that is not a Federal contractor
based on this Article.
3. The Employer understands that if it is a Federal contractor, its compliance with this MOU is a
performance requirement under the terms of the Federal contract or subcontract, and the Employer
consents to the release of information relating to compliance with its verification responsibilities under
this MOU to contracting officers or other officials authorized to review the Employer's compliance with
Federal contracting requirements.
C. RESPONSIBILITIES OF SSA
1. SSA agrees to allow DHS to compare data provided by the Employer against SSA's database. SSA
sends DHS confirmation that the data sent either matches or does not match the information in SSA's
database.
2. SSA agrees to safeguard the information the Employer provides through E-Verify procedures. SSA
also agrees to limit access to such information, as is appropriate by law, to individuals responsible for
the verification of Social Security numbers or responsible for evaluation of E-Verify or such other
persons or entities who may be authorized by SSA as governed by the Privacy Act (5 U.S.C. § 552a),
the Social Security Act (42 U.S.C. 1306(a)), and SSA regulations (20 CFR Part 401).
3. SSA agrees to provide case results from its database within three Federal Government work days of
the initial inquiry. E-Verify provides the information to the Employer.
4. SSA agrees to update SSA records as necessary if the employee who contests the SSA tentative
nonconfirmation visits an SSA field office and provides the required evidence. If the employee visits an
SSA field office within the eight Federal Government work days from the date of referral to SSA, SSA
agrees to update SSA records, if appropriate, within the eight -day period unless SSA determines that
more than eight days may be necessary. In such cases, SSA will provide additional instructions to the
employee. If the employee does not visit SSA in the time allowed, E-Verify may provide a final
nonconfirmation to the employer.
Note: If an Employer experiences technical problems, or has a policy question, the employer should
contact E-Verify at 1-888-464-4218.
D. RESPONSIBILITIES OF DHS
1. DHS agrees to provide the Employer with selected data from DHS databases to enable the
Employer to conduct, to the extent authorized by this MOU:
a. Automated verification checks on alien employees by electronic means, and

b. Photo verification checks (when available) on employees.
2. DHS agrees to assist the Employer with operational problems associated with the Employer's
participation in E-Verify. DHS agrees to provide the Employer names, titles, addresses, and telephone
numbers of DHS representatives to be contacted during the E-Verify process.
3. DHS agrees to provide to the Employer with access to E-Verify training materials as well as an
E-Verify User Manual that contain instructions on E-Verify policies, procedures, and requirements for
both SSA and DHS, including restrictions on the use of E-Verify.
4. DHS agrees to train Employers on all important changes made to E-Verify through the use of
mandatory refresher tutorials and updates to the E-Verify User Manual. Even without changes to
E-Verify, DHS reserves the right to require employers to take mandatory refresher tutorials.
5. DHS agrees to provide to the Employer a notice, which indicates the Employer's participation in
E-Verify. DHS also agrees to provide to the Employer anti -discrimination notices issued by the Office of
Special Counsel for Immigration -Related Unfair Employment Practices (OSC), Civil Rights Division,
U.S. Department of Justice.
6. DHS agrees to issue each of the Employer's E-Verify users a unique user identification number and
password that permits them to log in to E-Verify.
7. DHS agrees to safeguard the information the Employer provides, and to limit access to such
information to individuals responsible for the verification process, for evaluation of E-Verify, or to such
other persons or entities as may be authorized by applicable law. Information will be used only to verify
the accuracy of Social Security numbers and employment eligibility, to enforce the INA and Federal
criminal laws, and to administer Federal contracting requirements.
8. DHS agrees to provide a means of automated verification that provides (in conjunction with SSA
verification procedures) confirmation or tentative nonconfirmation of employees' employment eligibility
within three Federal Government work days of the initial inquiry.
9. DHS agrees to provide a means of secondary verification (including updating DHS records) for
employees who contest DHS tentative nonconfirmations and photo mismatch tentative
nonconfirmations. This provides final confirmation or nonconfirmation of the employees' employment
eligibility within 10 Federal Government work days of the date of referral to DHS, unless DHS
determines that more than 10 days may be necessary. In such cases, DHS will provide additional
verification instructions.
ARTICLE III
REFERRAL OF INDIVIDUALS TO SSA AND DHS
A. REFERRAL TO SSA
1. If the Employer receives a tentative nonconfirmation issued by SSA, the Employer must print the
notice as directed by E-Verify. The Employer must promptly notify employees in private of the finding
and provide them with the notice and letter containing information specific to the employee's E-Verify

case. The Employer also agrees to provide both the English and the translated notice and letter for
employees with limited English proficiency to employees. The Employer agrees to provide written
referral instructions to employees and instruct affected employees to bring the English copy of the letter
to the SSA. The Employer must allow employees to contest the finding, and not take adverse action
against employees if they choose to contest the finding, while their case is still pending.
2. The Employer agrees to obtain the employee's response about whether he or she will contest the
tentative nonconfirmation as soon as possible after the Employer receives the tentative
nonconfirmation. Only the employee may determine whether he or she will contest the tentative
nonconfirmation.
3. After a tentative nonconfirmation, the Employer will refer employees to SSA field offices only as
directed by E-Verify. The Employer must record the case verification number, review the employee
information submitted to E-Verify to identify any errors, and find out whether the employee contests the
tentative nonconfirmation. The Employer will transmit the Social Security number, or any other
corrected employee information that SSA requests, to SSA for verification again if this review indicates
a need to do so.
4. The Employer will instruct the employee to visit an SSA office within eight Federal Government work
days. SSA will electronically transmit the result of the referral to the Employer within 10 Federal
Government work days of the referral unless it determines that more than 10 days is necessary.
5. While waiting for case results, the Employer agrees to check the E-Verify system regularly for case
updates.
6. The Employer agrees not to ask the employee to obtain a printout from the Social Security
Administration number database (the Numident) or other written verification of the SSN from the SSA.
B. REFERRAL TO DHS
1. If the Employer receives a tentative nonconfirmation issued by DHS, the Employer must promptly
notify employees in private of the finding and provide them with the notice and letter containing
information specific to the employee's E-Verify case. The Employer also agrees to provide both the
English and the translated notice and letter for employees with limited English proficiency to
employees. The Employer must allow employees to contest the finding, and not take adverse action
against employees if they choose to contest the finding, while their case is still pending.
2. The Employer agrees to obtain the employee's response about whether he or she will contest the
tentative nonconfirmation as soon as possible after the Employer receives the tentative
nonconfirmation. Only the employee may determine whether he or she will contest the tentative
nonconfirmation.
3. The Employer agrees to refer individuals to DHS only when the employee chooses to contest a
tentative nonconfirmation.
4. If the employee contests a tentative nonconfirmation issued by DHS, the Employer will instruct the

employee to contact DHS through its toll -free hotline (as found on the referral letter) within eight
Federal Government work days.
5. If the Employer finds a photo mismatch, the Employer must provide the photo mismatch tentative
nonconfirmation notice and follow the instructions outlined in paragraph 1 of this section for tentative
nonconfirmations, generally.
6. The Employer agrees that if an employee contests a tentative nonconfirmation based upon a photo
mismatch, the Employer will send a copy of the employee's Form 1-551, Form 1-766, U.S. Passport, or
passport card to DHS for review by:
a. Scanning and uploading the document, or
b. Sending a photocopy of the document by express mail (furnished and paid for by the employer).
7. The Employer understands that if it cannot determine whether there is a photo match/mismatch, the
Employer must forward the employee's documentation to DHS as described in the preceding
paragraph. The Employer agrees to resolve the case as specified by the DHS representative who will
determine the photo match or mismatch.
8. DHS will electronically transmit the result of the referral to the Employer within 10 Federal
Government work days of the referral unless it determines that more than 10 days is necessary.
9. While waiting for case results, the Employer agrees to check the E-Verify system regularly for case
updates.
ARTICLE IV
SERVICE PROVISIONS
A. NO SERVICE FEES
1. SSA and DHS will not charge the Employer for verification services performed under this MOU. The
Employer is responsible for providing equipment needed to make inquiries. To access E-Verify, an
Employer will need a personal computer with Internet access.
ARTICLE V
MODIFICATION AND TERMINATION
A. MODIFICATION
1. This MOU is effective upon the signature of all parties and shall continue in effect for as long as the
SSA and DHS operates the E-Verify program unless modified in writing by the mutual consent of all
parties.
2. Any and all E-Verify system enhancements by DHS or SSA, including but not limited to E-Verify
checking against additional data sources and instituting new verification policies or procedures, will be
covered under this MOU and will not cause the need for a supplemental MOU that outlines these
changes.

B. TERMINATION
1. The Employer may terminate this MOU and its participation in E-Verify at any time upon 30 days
prior written notice to the other parties.
2. Notwithstanding Article V, part A of this MOU, DHS may terminate this MOU, and thereby the
Employer's participation in E-Verify, with or without notice at any time if deemed necessary because of
the requirements of law or policy, or upon a determination by SSA or DHS that there has been a breach
of system integrity or security by the Employer, or a failure on the part of the Employer to comply with
established E-Verify procedures and/or legal requirements. The Employer understands that if it is a
Federal contractor, termination of this MOU by any party for any reason may negatively affect the
performance of its contractual responsibilities. Similarly, the Employer understands that if it is in a state
where E-Verify is mandatory, termination of this by any party MOU may negatively affect the
Employer's business.
3. An Employer that is a Federal contractor may terminate this MOU when the Federal contract that
requires its participation in E-Verify is terminated or completed. In such cases, the Federal contractor
must provide written notice to DHS. If an Employer that is a Federal contractor fails to provide such
notice, then that Employer will remain an E-Verify participant, will remain bound by the terms of this
MOU that apply to non -Federal contractor participants, and will be required to use the E-Verify
procedures to verify the employment eligibility of all newly hired employees.
4. The Employer agrees that E-Verify is not liable for any losses, financial or otherwise, if the Employer
is terminated from E-Verify.
ARTICLE VI
PARTIES
A. Some or all SSA and DHS responsibilities under this MOU may be performed by contractor(s), and
SSA and DHS may adjust verification responsibilities between each other as necessary. By separate
agreement with DHS, SSA has agreed to perform its responsibilities as described in this MOU.
B. Nothing in this MOU is intended, or should be construed, to create any right or benefit, substantive
or procedural, enforceable at law by any third party against the United States, its agencies, officers, or
employees, or against the Employer, its agents, officers, or employees.
C. The Employer may not assign, directly or indirectly, whether by operation of law, change of control or
merger, all or any part of its rights or obligations under this MOU without the prior written consent of
DHS, which consent shall not be unreasonably withheld or delayed. Any attempt to sublicense, assign,
or transfer any of the rights, duties, or obligations herein is void.
D. Each party shall be solely responsible for defending any claim or action against it arising out of or
related to E-Verify or this MOU, whether civil or criminal, and for any liability wherefrom, including (but
not limited to) any dispute between the Employer and any other person or entity regarding the
applicability of Section 403(d) of IIRIRA to any action taken or allegedly taken by the Employer.
E. The Employer understands that its participation in E-Verify is not confidential information and may be
disclosed as authorized or required by law and DHS or SSA policy, including but not limited to,

Congressional oversight, E-Verify publicity and media inquiries, determinations of compliance with
Federal contractual requirements, and responses to inquiries under the Freedom of Information Act
(FOIA).
F. The individuals whose signatures appear below represent that they are authorized to enter into this
MOU on behalf of the Employer and DHS respectively. The Employer understands that any inaccurate
statement, representation, data or other information provided to DHS may subject the Employer, its
subcontractors, its employees, or its representatives to: (1) prosecution for false statements pursuant to
18 U.S.C. 1001 and/or; (2) immediate termination of its MOU and/or; (3) possible debarment or
suspension.
G. The foregoing constitutes the full agreement on this subject between DHS and the Employer.
