Agenda 06/14/2022 Item #16F1 (Award RFP #22-7956 to Smith, Bryan & Myers, Inc.)06/14/2022 EXECUTIVE SUMMARY Recommendation to award Request for Proposal (“RFP”) No. 22-7956, “Professional State Lobbyist Services,” to Smith, Bryan & Myers, Inc., to represent Collier County at the State Capitol in Tallahassee, and authorize the Chairman to sign the attached agreement. ______________________________________________________________________________ OBJECTIVE: To retain a State lobbying firm (“lobbyist”) to provide lobbying services on behalf Collier County. CONSIDERATION: The lobbyist selected by the Board will work in conjunction with our Director of Communications, Government & Public Affairs, and County Manager’s Office to monitor the actions of the legislative and executive branches of the State of Florida, work proactively to protect local interests, and advance the legislative and project funding agenda of the Board. On December 16, 2021, the Procurement Services Division posted RFP No. 22-7956, “Professional State Lobbyist Services,” with a due date of February 1, 2022, which staff extended two extra weeks to promote the competitive process. The evaluation criteria included review of a cover letter/management summary; certified minority business enterprise; business plan; costs of services to the County; experience and capacity of the firm; specialized expertise of team members and local vendor preference. The solicitation also requested the firms to submit references from clients on projects of a similar size for which the firms provided services similar in scope and complexity. A selection committee met on March 11, 2022, and scored and ranked the proposals in the following order: Firm Name Final Ranking Smith, Bryan & Myers, Inc. 1 Gunster, Yoakley & Stewart, P.A. 2 Smith, Bryan & Myers, Inc., is a Tallahassee, Florida-based government relations firm with over forty years of experience. Smith, Bryan & Myers’ experienced professionals provide a range of expertise in appropriations and the process by which substantive legislation is considered by the Florida Legislature. Smith, Bryan & Meyers is currently providing lobbying services to the County under Agreement No. 17-7186; and the proposed attached agreement will supplant Agreement No. 17-7186, which expires September 30, 2022. The term of the attached Agreement commences on October 1, 2022, and runs for three years, with two, one-year renewal options. The annual compensation for the initial three-year term of the agreement is fixed. FISCAL IMPACT: This executive summary has a contractual fiscal impact not to exceed $75,000. Funding is available in County Manager's General Administration (cc 100190). GROWTH MANAGEMENT IMPACT: This executive summary has no immediate growth management impact. The firm, at a minimum, must achieve the requirements of the Specifications or Scope of Work stated. The results of this solicitation may be used by other County departments once award ed according to the Board of County Commissioners Procurement Ordinance. The County is seeking proposals from interested firms to represent the County’s interests before the Florida Legislature and Executive Branch of the State government. Historically, County departments have spent approximately $75,000 annually; however, this may not be indicative of future buying patterns. BACKGROUND State government lobbying services are needed, based in Tallahassee, on behalf of the County where they will advocate policy positions, as adopted by the Board, and monitor and report on emerging issues and actions of the legislative and executive branches. TERM OF CONTRACT The contract term, if an award(s) is/are made is intended to be for three (3) years with two (2) one (1) year renewal options. Prices shall remain firm for the initial term of this contract. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. The County Manager, or designee, may, at his discretion, extend the Agreement under all of the terms and conditions contained in this Agreement for up to one hundred eighty (180) days. The County Manager, or designee, shall give the Contractor written notice of the County's intention to extend the Agreement term not less than ten (10) days prior to the end of the Agreement term the n in effect. DETAILED SCOPE OF WORK The selected firm shall provide and perform the following professional services which shall constitute the GENERAL SCOPE of the SERVICES under the covenants, terms, and provisions of the resultant agreement. Consult with designated County staff to recommend, review, and draft proposed legislative priorities ahead of each regular or special legislative session. 2. If requested, participate in presenting the proposed legislative priorities and/or any after -action report to the Board. 3. Devise and diligently execute strategies that accomplish the legislative and administrative goals of the Board. 4. Monitor legislative and executive activity that could materially impact Collier County and suggest the most effective approach in achieving the best outcome for the County. 5. Provide regular oral and written updates to the County Manager, or their designee, on issues potentially impa cting Collier County during any regular or special session and during legislative interim committee weeks. 6. Secure sponsors for bills and amendments that further the legislative goals of the County. 7. Lobby, consistent with Board adopted positions, for or against legislation to achieve the legislative goals of the County. 8. Coordinate meetings with appropriate legislative members, key staff, and executive level officials and personnel. 9. Promptly notify the County Manager, or their designee, of any potential or ac tual conflicts of interest arising from the lobbyist’s and/or lobbying firm’s legislative efforts. 10. Monitor and report on the rulemaking process when it could potentially materially impact the County. 11. When approved by the County Manager, or their designee, represent the County at applicable coalition and association meetings. 12. Aggressively pursue and report on funding opportunities that may benefit projects, programs, and services applicable to Collier County. The County may, at times, need additional specialized lobbying services, which may be solicited on an independent basis. The selected firm must be able to register and be approved as an executive and legislative branch lobbyist in the State of Florida. The selected firm will meet with the County Manager, or his/her designee, to have a work plan assigned. The County Manager, or his/her designee, will have the sole discretion in directing the firm on the County’s behalf. REQUEST FOR PROPOSAL (RFP) PROCESS 1.1 The Proposers will submit a qualifications proposal which will be scored based on the criteria in Evaluation Criteria for Development of Shortlist, which will be the basis for short-listing firms. The Proposers will need to meet the minimum requirements outlined herein in order for their proposal to be evaluated and scored by the COUNTY. The COUNTY will then score and rank the firms and enter into negotiations with the top ranked firm to establish cost for the services needed. The COUNTY reserves the right to issue an invitation for oral presentations to obtain additional information after scoring and before the final ranking. With successful negotiations, a contract will be 16.F.1.a Packet Pg. 1914 Attachment: 22-7956 Solicitation (22231 : RFP for Professional State Lobbyist Services) 4 developed with the selected firm, based on the negotiated price and scope of services and submitted for approval by the Board of County Commissioners. 1.2 The COUNTY will use a Selection Committee in the Request for Proposal selection process. 1.3 The intent of the scoring of the proposal is for respondents to indicate their interest, relevant experience, financial capability, staffing and organizational structure. 1.4 The intent of the oral presentations, if deemed necessary, is to provide the vendors with a venue where they can conduct discussions with the Selection Committee to clarify questions and concerns before providing a final rank. 1.5 Based upon a review of these proposals, the COUNTY will rank the Proposers based on the discussion and clarifying questions on their approach and related criteria, and then negotiate in goo d faith an Agreement with the top ranked Proposer. 1.6 If, in the sole judgment of the COUNTY, a contract cannot be successfully negotiated with the top -ranked firm, negotiations with that firm will be formally terminated and negotiations shall begin with th e firm ranked second. If a contract cannot be successfully negotiated with the firm ranked second, negotiations with that firm will be formally terminated and negotiations shall begin with the third ranked firm, and so on. The COUNTY reserves the right to negotiate any element of the proposals in the best interest of the COUNTY. RESPONSE FORMAT AND EVALUATION CRITERIA FOR DEVELOPMENT OF SHORTLIST: 1.7 For the development of a shortlist, this evaluation criterion will be utilized by the COUNTY’S Selection Committee to score each proposal. Proposers are encouraged to keep their submittals concise and to include a minimum of marketing materials. Proposals must address the following criteria: Evaluation Criteria Maximum Points 1. Local Vendor Preference 10 Points TOTAL POSSIBLE POINTS 100 Points Tie Breaker: In the event of a tie at final ranking, award shall be made to the proposer with the lower volume of work previously awarded. Volume of work shall be calculated based upon total dollars paid to the proposer in the twenty -four (24) months prior to the RFP submittal deadline. Payment information will be retrieved from the County’s financial system of record. The tie breaking procedure is only applied in the final ranking step of the selection process and is invoked by the Procurement Services Division Director or designee . EVALUATION CRITERIA NO. 4: COST OF SERVICES TO THE COUNTY (20 Total Points Available) In this criteria, include but not limited to: • Annual not-to-exceed compensation inclusive of all costs, to be paid on a monthly basis. Payments shall be full compensation for all services, labor, tools, equipment, travel, and any other items required for project completion and/or completion of services. EVALUATION CRITERIA NO. 5: EXPERIENCE AND CAPACITY OF THE FIRM (20 Total Points Available) In this criteria, include but not limited to: • Provide a list of government and private clients your firm has on contract for the past five (5) years, with a description of any potential conflicts of interest between the County and your firm’s other clients. • Provide a brief description of your firm’s accomplishments. • Provide a description of all business-related claims, arbitrations, administrative hearings, and lawsuits that are pending or were filed during the last three (3) years b y or against the firm or its members, predecessor organization(s), or wholly owned subsidiary (including, error, or omission, default, termination, suspension, failure to perform, or improper performance contract or legal duty. The County requests that the vendor submits no fewer than three (3) and no more than ten (10) completed reference forms from clients during a period of the last 5 years whose projects are of a similar nature to this solicitation as a part of their proposal. Provide information on the projects completed by the Proposer that best represent projects of similar size, scope and complexity of this project using form provided in Form 5. Proposers may include two (2) additional pages for each project to illustrate aspects of the completed project that provides the informatio n to assess the experience of the Proposer on relevant project work. We believe this high client satisfaction is due to both our effective representation and our proactive communication with them. A critical component of our success is our team -driven business model. We find many firms in this industry are siloed in their representation of clients, meaning the firm lead is typically the only person in the firm who works on a particular issue. This is not the case at SBM. We pride ourselves in the amount of time and res ources we devote to ensuring all seven team members are intimately familiar with our clients’ issues so that each one of us can engage at any time and place on a client’s behalf. SBM employs seven lobbyists, two of whom are lawyers, two administrative staff and three runners. The level of firm resources we dedicate to each of our clients dictates that we monitor our capacity to take on new issues and clients very closely. We are confident that we currently have the ability to continue representing the County at the highest-level. We have attached our current client list and, as you can see, we are involved in issue areas across the board on behalf of our diverse client portfolio. This has allowed us to gain expertise in virtually every area that might concern the County with respect to state government. Some examples of our recent accomplishments include, last year we helped secure state funding for both of the County’s priority projects at the total amount requested, $250,000 for the Golden Gate Senior Center Expansion and $250,000 for the Lake Park Blvd. Capital Improvements and Water Quality Flowway. We worked to significantly amend legislation pertaining to the Big Cypress Basin that would have negatively impacted the County, and we also partnered with the Department of Emergency Management to pass legislation to create a Public Records Exemption for Emergency Shelter Registration information which was a priority for the County. On behalf of Hillsborough County, we helped secure $20M from the Department of Environmental Protection Wastewater Grant Fund for a $40M septic to sewer project; $5M for a Preliminary Development and Environmental design and construction project for new entrance and exit ramps on I-75; and $885,000 for a Special Needs Emergency Shelter. On behalf of Alachua County, we were successful in obtaining $2.3M from the legislature for the North Central Regional Sports Complex center which is a public/private partnershi p estimated to cost a total of $68.5M when completed; $1M for Newnans Lake Restoration project to reduce nutrient loads; and $1M for a septic to sewer project. 16.F.1.b Packet Pg. 1925 Attachment: Smith Bryan Myers Proposal (22231 : RFP for Professional State Lobbyist Services) On behalf of the City of Naples, we helped secure $1.2M funding for the Naples Bay/Red Tide Septic to Sewer Phase I project, and received another appropriation for $1.1M for Phase II the following year but funding was unfortunately vetoed by the Governor’s historic $1B budget cut as a result of the onset of the COVID-19 pandemic. Notably, last year the City of Naples did not request any appropriation from the state, rather our focus for them was ensuring that legislation did not pass that would impact their ability to enforce their ordinance regulating Vacation Rentals and none did. Lastly, SBM was instrumental in helping the University of Florida secure a record $557M in state appropriations to its main campus last year which represented a doubling of the amount appropriated since 2013. All the clients referenced in these examples have completed the required Form 5 questionnaires which have been included with our proposal. As is evident by these examples, we understand the budget process and spend a large portion of our time with the members who make budget decisions. We have secured millions of dollars in appropriations over the years for a variety of clients. The General Appropriations Act is one of our firm’s key focus areas. Our submission of this proposal demonstrates our determination that no conflicts of interest currently prohibit us from continuing our representation of the County.
