Agenda 06/14/2022 Item #16D8 (CCAP Programs Temporary Personnel Services Expenditures)06/14/2022 EXECUTIVE SUMMARY Recommendation to authorize expenditures exceeding the $50,000 competitive threshold, under an Exemption from the Competitive Process, through fiscal year 2023, for Robert Half International, Inc., to provide temporary personnel services for Collier County Assistance Programs (CCAP) programs, American Rescue Plan, Local Fiscal Recovery Plan, and Department of Treasury, Emergency Rental Assistance Programs. (Housing Grant Fund 705, Community & Human Grant Support Fund 123) OBJECTIVE: To support the Collier County CCAP relief funding program in the processing of electronic submission of electronic application requests. CONSIDERATIONS: On March 11, 2021, President Biden signed the American Rescue Plan (the “ARP”) into law. The ARP includes $350 billion in payments to state, local, and tribal governments intended to provide for navigating the recovery from the impact of the COVID-19 outbreak. Collier County has received a direct appropriation of $74,762,701. On May 11, 2021 (Agenda Item #11J ), the Board approved an “After-the-Fact” agreement submitted to the United States Treasury Department (the U.S. Treasury). On March 22, 2022 (Agenda Item #16D), the Board approved reallocations to the Local Fiscal Recovery Plan based on changes to the Treasury’s release of the State and Local Fiscal Recovery Funds final rule. Those funds have an obligation deadline of December 31, 2024, and an expenditure deadline of December 31, 2026. On January 5, 2021, the U.S. Treasury announced funding available to state and local governments to provide funding to residents that are unable to pay rent and utilities due to the impacts of the COVID-19 pandemic. On January 26, 2021 (Agenda Item #16D7), the Board accepted Emergency Rental Assistance Program 1 (“ERA 1”) funding in the amount of $11,622,381. Collier County is eligible for such funding because its resident population exceeds 200,000, and it is provided under the authorization of the Consolidated Congressional Act of 2021. The County is required to expend those funds on renters who are eighty percent (80%) and below the Area Median Income. To date, the County has expended $4,720,639.49 in funds and has assisted 460 households. The ERA program offers $25 billion in funding nationwide to assist such needs. The ARP established funding for the Emergency Rental Assistance Program 2 (“ERA 2”). The County received those funds on May 10, 2021. On June 8, 2021 (Agenda Item #16D1), the Board accepted the ERA 2 funding in the amount of $9,088,102. The ERA 2 program has e xpanded the eligibility criteria of applicants and has a spending deadline of September 2025. To meet the immediate demand for the direct assistance application process and subrecipient payments, hiring temporary administrative staff is necessary. Community and Human Services (“CHS”) staff is currently processing 300-400 rental and 15 subrecipient payments per month. Each payment is time- consuming in processing and is unique and requires a separate transaction. In FY20, the CHS Division was working with temporary personnel agencies to process and review online applications: Robert Half International, Inc., and Premier Staffing. Approval of this request will allow the Division to use temporary personnel to process direct assistance programs under the ARP-Local Fiscal Recovery Program and ERA. Current temporary staffing agreements are being utilized but are not meeting the demand and quality necessary in temporary staff to properly audit and validate financial transactions necessary to properly 16.D.8 Packet Pg. 1448 06/14/2022 expend federal funds. Increasing the pool of temporary staff will allow the division to build capacity to administer the remaining assistance programs that are approved in the Local Fiscal Recovery Plan, which include assistance to Not-for-Profits and two (2) small business assistance programs, totaling eight million dollars ($8M) in direct assistance. Section 8, subsection 11 of Collier County Procurement Ordinance No. 2013-69, as amended, provides that personnel and recruitment services may be eligible for exemption from the competitive process based upon the determination of the County Manager or designee Procurement Services Director, that approval of such an exemption is in the best interest of the County. Section 3 of the Ordinance further requires that purchases in this category exceeding $50,000 in annual expenditures be approved by the Board. The required exemption form, approved by Procurement Services, is attached. FISCAL IMPACT: Funding has been made available within the Community & Human Service Housing Grant Fund (705) Project 33765, Project 33734, and Project 33761, and Community & Human Service Grant Support Fund (123) Project 33699. Staff will distribute funds for eligible expenditures in accordance with Board-approved policy. The estimated cost for temporary staff is based on market quote and number of staff needed till all approved time-limited FTE positions are filled. Any expenses incurred by the County and associated with the administration of this agreement, including requested full-time employees, will be accounted for, and are expected to be fully reimbursable under applicable grant funding.
