Agenda 06/14/2022 Item #16A23 (Resolution - SFGA Supplemental Agreement No. 1)06/14/2022 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign Supplemental Agreement No. 01 for the State-Funded Grant Agreement (SFGA) with Florida Department of Transportation (FDOT) to receive reimbursement for Design and Construction for the widening of Airport Road from Vanderbilt Beach Road to Immokalee Road; to execute a Resolution memorializing the Board’s action; and to authorize the necessary budget amendments. (Project 60190) _____________________________________________________________________________________ OBJECTIVE: That the Board of County Commissioners (Board) approves Supplemental Agreement (SA) No. 01 for the SFGA with FDOT to receive reimbursement for Design, Construction and CEI services in the amount of $6,428,100 for Project 60190 ‘Airport Road from Vanderbilt Beach Road to Immokalee Road’ (the Project); and, to execute a Resolution memorializing the Board’s action. CONSIDERATION: On June 12, 2018, (BCC agenda 16A24), the Board approved to submit a County Incentive Grant Program (CIGP) application to FDOT for the widening of Airport Road from Vanderbilt Beach Road to Immokalee Road. CIGP funds are awarded to projects which relieve congestion on the State Highway System and are consistent with established plans in the area. On September 8th, 2020, (BCC agenda 16A26), the Board approved the State-Funded Grant with FDOT in the amount of $6,428,100 for Design and Construction for the widening of Airport Road from Vanderbilt Beach Road to Immokalee Road and executed a Resolution memorializing the Board’s action for the County Incentive Grant Program with FDOT. On December 7th, 2020, FDOT executed the State-Funded Agreement and issued the Notice to Proceed (NTP) for the Project. On February 10th, 2021, FDOT rescinded the Design NTP for the Project. On July 21st, 2021, FDOT issued the revised NTP to proceed with the Design phase portion of the Project. On March 08th, 2022, FDOT issued a State-Funded Grant Supplemental Agreement (SA) No. 01 for the County Incentive Grant Program amending Exhibit B, the Schedule of Financial Assistance moving the design funds from FY 2020/2021 to FY 2021/2022. There is no revision to the construction funds. FISCAL IMPACT: The county has been awarded a total amount of $12,856,200 including a required 50% local match in the amount of $6,428,100. Funding in the amount of $3,000,000 has been previously appropriated within Growth Management Grant Fund (711) and Growth Management Match Fund (712), project 60190 for design. Budget amendments are required to appropriate remaining grant funding in the amount of $4,928,100 within Growth Management Grant Fund (711), project 60190 for the construction phase of the project. There is a fifty percent (50%) required local match in the amount of $4,928,100. Budget amendments are necessary to transfer funds from Growth Management Capital Fund (310), Infrastructure Sales Tax Fund (318), Road Impact Fee District 1 Fund (331), and Road Impact Fee District 2 Fund (333) to Growth Management Grant Match Fund (712), project 60190. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues and requires majority vote for approval. - JAK RECOMMENDATION: That the Board of County Commissioners (BCC) approves and authorizes the Chairman to sign the attached Supplemental Agreement No. 01 for the State-Funded Grant Agreement with Florida Department of Transportation (FDOT) to furnish Design, Construction and CEI services necessary to complete the widening of Airport Road from Vanderbilt Beach Road to Immokalee Road; execute a Resolution memorializing the Board’s action; and authorizes the necessary budget amendments.
