Agenda 06/14/2022 Item #16A12 (Release Code Enforcement Lien - Crispin Trujillo)06/14/2022 EXECUTIVE SUMMARY Recommendation to approve the release of a code enforcement lien with a value of $47,068.63 for payment of $618.63 in the code enforcement action entitled Board of County Commissioners v. Crispin Trujillo in Case No. CEOCC20190008179 relating to property located at 4825 Green Blvd, Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an accrued value of $47,068.63 for payment of $618.63 in relation to Case No. CEOCC20190008179. CONSIDERATIONS: As a result of a code violation, the Code Enforcement Board ordered the imposition of a lien against Crispin Trujillo in Case No. CEOCC20190008179 for a code violation at 4825 Green Blvd. The violations consisted of prohibited business activity on the property without a business tax receipt. The lien was recorded in the Official Records on November 18, 2020, at O.R. Book 5846, Page 2417. The lien amount of $47,068.63 is based on 313 days of accrued fines ($150 per day from August 23, 2020, through July 1, 2021) totaling $46,950, and $118.63 in operational costs. The property was brought into compliance on July 1, 2021. Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by an existing owner would be considered for a waiver as long as the existing owner has diligently pursued abatement and compliance has been achieved. In 2020, Mr. Trujillo was involved in a serious accident that drastically changed his life, leaving him bedridden, emotionally and financially devastated. When his roommate, the owner of the business, became aware of the violation, he quickly began the process to obtain the business tax receipt despite many setbacks, including the Covid -19 Pandemic. Mr. Trujillo faces many financial obligations due to health issues that prevent him from working. It took a substantial amount of time, commitment, and follow-up, to abate the violation. Moreover, with the passage of HB 403 (F.S. 559.95), home-based businesses with up to two employees are permitted under state law. The property is being actively maintained and $618.63 has been paid in settlement of fines. The owner is requesting a waiver of $46,450 in accrued fines, see attached hardship letter as required. There are no known violations at this time. FISCAL IMPACT: Payment of $618.63 in settlement of fines and costs has been made. If approved by the Board, accrued fines in the amount of $46,450 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2012-46. -CAK RECOMMENDATION: To waive the fines in the amount of $46,450, accept payment amount of $618.63, release the liens, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records. There are several factors that prevented me to comply and as a result of this I have accumulated several fines since 2020 and am humbly asking for these fines to be waived please. First, I suffered an accident that left me completely disabled in bed for a few months, the result of this accident was that the doctors had to amputate my leg, the loss of my leg and the feeling of failure left me very bad emotionally as well as financially. This is the main reason why I was not able to comply in the time that was given to clean up because I could not to do it myself nor hire help because it was not possible financially. On the other hand, my brother landscaping company is his main job and was helping me financially during these terrible times and could not asked him to stop working because my livelihood depended on him and continue to do so. The other problem was with Mr. Mares, he lives in my house and has his own company. Mr. Mares was asked to meet the requirements of getting the proper licenses for his business which he did. The two people who came to my house during this time one came to help my brother and the other came to help Mr. Mares. After the accident my life changed drastically as you know now, and now I need help to do most things and cannot work. Then, pandemic came and because of the business closing and people afraid of Setting the infected left Mr. Mares without work. With this letter I am imploring the collier county commissioners to remove these fines since ldo not work and support myself with whatever help I receive from my brother to pay my monthly expenses.
