Agenda 06/14/2022 Item #16A 2 (PL20220000084 - Cay Lagoon Offsite Sewer Facilities)06/14/2022 EXECUTIVE SUMMARY Recommendation to approve final acceptance of the sewer facilities, and accept the conveyance of the sewer facilities for Cay Lagoon - Offsite Sewer Facilities PL20220000084. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water-Sewer District, approve final acceptance of these sewer facilities, in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The developer constructed the offsite sewer facilities for Cay Lagoon, within the Orange Blossom Drive right-of-way and were originally privately owned and maintained. The Cay Lagoon Condominium Association has been requested to turn over those utilities located within the Orange Blossom Drive right-of-way to the County (see attached location map). The value of these sewer utility facilities (assets) was $9,475.34 2) Staff recorded all final acceptance documents associated with the sewer facilities conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney’s office as to form and legality. The County acquired its interest in the sewer facilities by Utility Facilities Warranty Deed and Bill of Sale recorded in Official Records Book 6101, Page 3656, and are located within: (1) County Right-of-Way, Drainage, and Utility easement recorded in O.R. Book 6096, PG 2311; (2) the “Future Road Right-of Way” parcel, according to the plat of Emerald Lakes at Bridget Lake Unit Two - B, as recorded in Plat Book 16, Page 47; and (3) the Right of Way and County Utility Easement, Orange Blossom Drive, According to the plat of The Crossings, Mill Run, as recorded in Plat Book 15, Page 39, all contained within the Public Records of Collier County, Florida. 3) Staff recommends final acceptance of the subject sewer utilities facilities in the amount of $9,475.34. 4) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended. 5) Staff is unaware of any issues that would serve to negate the recommendation to approve this final acceptance. FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water-Sewer District receiving title to the sewer utility facilities, which have a gross value of $9,475.34 (no depreciation applied) and an asset will be recorded in the financial records of the county. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. -DDP RECOMMENDATION: To approve final acceptance and accept the conveyance of the sewer utility facilities for Cay Lagoon - Offsite Sewer Facilities PL20220000084, and accept the conveyance of the Utilities Facilities Deed, and the facilities described therein.
