RELATING TO PETITION NUMBER
V-86-17 FOR A VARIANCE OF PROPERTY
HEREINAI•TER DESCRIBED IN COLLIER
COUNTY, FLORIDA.

• WHEREAS, the Legislature of the State of Florida in Chapter 125,
o Florida Statutes, has conferred on all counties in Florida the power to
• establish, coordinate and enforce zoning and such business regulations as
are necessary for the protection of the public, and
WHEREAS, the County pursuant thereto has adopted a Comprehensive
Zoning Ordinance establishing regulations for the zoning of particular
geographic divisions of the County, among which is the granting of
variances, and
ill
WHEREAS, the Board of Zoning Appeals being the duly elected
constituted board of the area hereby affected, has held a public hearing

after notice as in said regulations made and provided, and has considered
the advisability of a variance from the required canopy setback of 20
feet to 13 feet and from the required pump island setback of 30 feet to
,` 25 feet, both for an automobile service station in a C-3 zone for the
property hereinafter described, and has found as a matter of fact that
satisfactory provision and arrangement has been made concerning all

applicable matters required by said regulations and in accordance with
Section 11.1.b of the Zoning Regulations for the unincorporated area of
Collier County, and
.', r • ( WHEREAS, all interested parties have been given opportunity to be
heard by this Board in public meeting assembled and the Board having
considered all matters presented, _
{ NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
of Collier County, Florida, that the petition V-86-17 filed by Nick S.
Centenaro, represented by Dr. Neno J. Spagna with respect to the
``1 property hereinafter described as: •
, Lots 1 thru 5, Block 72, Naples Park, Unit 5, as recorded in
Plat Book 3, Page 14 of the Public Records of Collier County,
Florida.

he and the same hereby is approved for a variance from the required
canopy setback of 20 feet to 13 feet and from the required pump island
setback of 30 feet to 25 feet, both for an automobile service station of
the C-3 zoning district wherein said property is located, subject to the
following conditions:
1. If extensive paving replacement/new paving is contemplated;
grading, paving and drainage plans which provide for storm
water retention and water quality protection nhnll be approved
by the Engineering Department.
2. Any work within the County Right-of-Way shall be approved by
the Engineering Department at time of Right-of-Way permit
application.

• . BE IT RESOLVED that this resolution relating to Petition Number
V-86-17 be recorded in the minutes of this Board.
Commissioner nines offered the foregoing resolution and
moved its adoption, seconded by Commissioner Saunders and upon
roll call the vote was:
