Agenda 05/24/2022 Item #16K 4 (Resolution - Reappointment of a member to the Water & Wastewater Authority)05/24/2022 EXECUTIVE SUMMARY Recommendation to reappoint a member to the Water and Wastewater Authority. OBJECTIVE: To reappoint one member to the Water and Wastewater Authority, to a four-year term expiring on May 21, 2026. CONSIDERATIONS: This five-member authority was established on February 27, 1996, by Ordinance No. 96-6 to regulate utility rates and related matters regarding non-exempt water and wastewater utilities in unincorporated Collier County. Three members shall be technical in nature, with expertise in engineering, finance and/or business administration. The remaining two members shall be appointed on the basis of individual civic pride, integrity, and experience in any area of regulation. Members are required to file a Form 1 Statement of Financial Interests each year with the Supervisor of Elections. Terms are four years. A list of the current membership is included in the backup. One seat on this authority expired on May 21, 2022. The vacancy was advertised and an application was received from the following: APPLICANT CATEGORY DIST. VOTER ADVISORY COMM. Sherwin H. Ritter* Technical member 5 Yes Water & Wastewater Authority (Oct. 2008-present) *re-applying Term limits apply to this committee, per Code of Laws Sec. 134-353(e)(3), powers and duties, which states in relevant part: “…A member of the authority may not serve more than eight consecutive years except if an individual is appointed initially to less than a four-year term that individual may serve two full four-year terms in addition to the initial term, for a maximum continuous term of up to 11 years…” Dr. Ritter has served on this Authority since October 2008, a total of 13½ years thus far. ATTENDANCE: Dr. Ritter has had only one absence (excused) in the past two years. STAFF RECOMMENDATION: That Dr. Sherwin Ritter be reappointed to his seat on this Authority, and that the term limit restrictions as stated above be waived so that he may continue his valuable volunteer service to the County. A recommendation memo is included in the backup. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the Board of County Commissioners adopts the Staff Recommendation, and authorizes the Chair to execute the attached resolution confirming the reappointment. RESOLUTION NO. 2022 - ____ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, REAPPOINTING SHERWIN RITTER TO THE COLLIER COUNTY WATER AND WASTEWATER AUTHORITY. WHEREAS, Collier County Ordinance No. 96-6 established the Collier County Water and Wastewater Authority to regulate utility rates and related matters regarding non-exempt water and wastewater utilities in unincorporated Collier County; and WHEREAS, Ordinance No. 96-6, as amended, provides that the Authority shall be composed of five members; three members with technical expertise and two members with experience in any area of regulation; and WHEREAS, a seat on this Authority expired on May 21, 2022; and WHEREAS, the Board of County Commissioners previously provided public notice soliciting applications from interested parties. WHEREAS, staff has provided the Board of County Commissioners with its recommendation for reappointment. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that SHERWIN RITTER, in the category of technical member, is hereby reappointed to his seat on the Collier County Water and Wastewater Authority, to a term which shall expire on May 21, 2026, and further, that the term limit restrictions described in Section 134-353(e)(3) of the Code of Laws are hereby specifically waived for the duration of this reappointment.
